The Landing at Hyannis – Phase 2
Addendum to Special Permit Application
Since its execution of the ground lease with the Town of Barnstable for the
approximately 26.72 acre subject property, formerly known as “Capetown Plaza”, the
Applicant has embarked on a multi-phase redevelopment and modernization of the previously
dated shopping center. Construction of the initial phase of the center, now known as The
Landing at Hyannis, which is currently underway, consists of new facades on the largest building
on the property, new parking, new and improved pedestrian connections, new and coordinated
signage, and significantly enhanced landscaping.
The Applicant now proposes “Phase 2” of the redevelopment which necessitates this
zoning application. As shown on the project plans, the Applicant proposes to redevelop an
approximately 128,360 square foot paved area presently striped with parking spaces in the
south-east corner of the property. In this area, the shopping center use will be expanded to
include an approximately 3,366 square foot stand -alone bank building with a drive-up window,
a stand-alone approximately 3,605 square foot restaurant with a drive -up window, and a “pad”
area for future construction of additional buildings. This phase also entails reconfigured
parking, additional landscaping, additional drainage and stormwater tre atment, minor grading
to improve ADA accessibility, and additional site features such as lighting, sidewalks connecting
the Phase 2 area to Route 132 and internally within the site, and outdoor seating areas.
Although the subject property is split between the HB and B zoning districts, the Phase 2
site work is located solely within the HB-zoned portion of the property. The proposed work has
been reviewed and approved by the Site Plan Review Committee which conditioned its
approval on receipt of a special permit for the proposed drive-up windows. In all other respects,
the Phase 2 work either complies with the applicable zoning requirements or is pre-existing,
non-conforming to the zoning requirements and is either maintaining or reducing the non-
conformity.
With respect to parking, the Zoning Board of Appeals approved special permit no. 2023 -
021 in October of 2023, setting forth a minimum parking ratio of 3.5 spaces per 1,000 square
feet for the shopping center. Upon completion of the Phase 2 redevelopment, the proposed
parking ratio will be approximately 4.66 spaces per 1,000 square feet, thereby complying (and
exceeding) the requirements of the Zoning Board’s 2023 parking special permit decision.
Section 240-25.C(10) of the Zoning Ordinance permits the two proposed drive-up
windows by special permit upon finding that the drive-up windows do not “substantially
adversely affect the public health, safety, welfare, comfort or convenience of the communi ty.”
Here, the proposed bank and restaurant drive-up windows demonstrably satisfy this required
finding.
The restaurant drive-up window is proposed on the north side of the structure,
internally facing the shopping center. The drive-up window comfortably allows 8 cars to be
stacked in a queue without interfering with any parking spaces. The plan also includes a
“waiting space” for a customer to pass the drive-up window and wait for their order if it isn’t
completed. The proposed plan also incorporates a pass-by lane around the drive-up queuing
lane.
The bank’s proposed drive-up window is located on the east side of the proposed
structure, separated from the proposed parking area for the future “pad” locations. The bank’s
drive-up window can accommodate several cars in the drive-up lane, and if necessary,
additional cars can queue alongside the building without blocking parking spaces.
The proposed drive-up windows provide a comfort and convenience to the community
by allowing access to services without needing to exit their vehicle. The internal site circulation,
which was reviewed by the Site Plan Review Committee, is such that the cars utilizing the drive -
up windows can be comfortably and safely accommodated on-site without interfering with
vehicular or pedestrian circulation. And, both drive-up windows are designed to safely
accommodate queues on-site without any substantial adverse effects. Accordingly, the
Applicant respectfully requests issuance of the conditional use special permit to allow both
drive-up windows.
