Approval Not Required
Park City Wind LLC has submitted an Approval Not Required plan entitled “Approval Not Required Plan of
Land prepared for Park City Wind LLC Barnstable Massachusetts, dated November 26, 2024”
Chair Stephen Robichaud – we have received correspondence from Stacey Gunther today.
Jim Kupfer explains what an Approval Not Required (ANR) is for the record. Limited review under Mass
General Law - control law, specifically that if adequate frontage than endorsement may be entitled. There is
a Staff Report and has been reviewed and these standards have been met. Board meeting for those reasons,
to be done within 21 days if not it is constructively approved and granted by default.
Ray Sexton clarifies that technical matter. This is not appropriate forum for any larger issue. If meets
standards.

Chair Stephen Robichaud entertains a motion to approve, moved by Tim O’Neill to endorse the plan
entitled “Approval Not Required Plan of Plan Prepared for Park City Wind LLC” prepared for Park city
Wind LLC, prepared by Dawood, last revised November 26, 2024, as an Approval Not Required Plan,
With the following Findings;
▪ It does not constitute a subdivision because each of the lots have the minimum required
frontage on an existing way having suitable grades, and adequate construction to provide for
the needs of vehicular traffic in relation to the proposed use and for the installation of
municipal services to serve such use or has been labeled as “not buildable”; and
▪ All materials and conditions of Chapter 801, Article IV Approval Not Required Plans, have been
submitted and are in full compliance, seconded by Matt Teague,

Staff Updates
Jim Kupfer, LCP will meet again to finalize. Have gotten a lot of good feedback online and emails all posted
on Barnstable LCP.com website, Dec. 19th at 5:30. Hope to put together the final draft or the draft of the plan
for public review closer to February. Early feedback and next steps. Open Space Plan.
Housing report snapshot – 30 minute long presentation. Since 2017. Project by project, all projects since
2017.
HPP update – recommendation to Town Council, will now go to them for their consideration. Will report
back to the Board.
Discussion
Cape Cod Vision Zero Action Plan Presentation
Steven Tupper, Deputy Director presenting on Cape Cod Vision Zero Action Plan. Civil Engineer. Digital equity
plan at Town.
Gives a presentation – The Safe System Approach. Safe streets. Hyannis Main Street. Roadway safety. Traffic
deaths. Have to design system for safety.
Vision Zero Advisory Committee. List shown Federal grant program.
Goal – create transportation system. Systematic crash analysis. Solutions to tackle the root cause. Elements
of the plan. Policy and process changes. Progress and transparency. Project schedule. In the outreach phase
now. Community Engagement. Crashes reported on Cape Cod. Nearly 30,000 over 6 years. Crash density.
Crashes reported. Environmental Justice. Means diversity in the area, minority and housing. Higher
percentage taking biking or public transportation.
365 pedestrians and 474 bicyclist crashes. Every 3 days someone is hit by a car. 74 pedestrians are serious
and 52 bicyclists. Staggering number – 81 fatalities and 644 serious injuries.

Roadway network. High risk network. High injury network. Draft map of roads that have many crashes.
Statistical locations.

Countermeasures. Speed management. Crosscutting treatments. Roadway Departures.
Public engagement. Met with focus group. Public meetings. High tech strategies. Online website as well.
Comment tool. We have been hearing. Feedback and Discussion. Education, Town policies, safety ideas,
enforcement, and any other ideas.
Chair Stephen Robichaud, good to hear that there are some low cost strategies for this. Route 132 is bad. All
about sidewalks. Route 6A is a challenge.
Michael Mecenas, this is a huge problem, especially during the summer.
Matt Teague, was run over as a child on Route 6A. E bikes and e scooters. No helmet in the travel lane.
Where does this come into play. These are extremely dangerous and fast.
Steven Tupper, more research for this. Seeing some safety issues with this. E bikes do go much faster and
has created some significant safety issues. Regulation for this.
Matt Teague, 40 or 50 miles an hour with an E bike and no helmet is a challenge, this has to be addressed.
Reflective vest, this can save a life.
Ray Sexton, has to be some enforcement. Overhead sensors possibly. Safe streets.
Jim Kupfer, Safe and complete working hand in hand with most of them. Complete streets in place. Bike
accommodations and lane widths. Safe Streets, received a grant to study intersections for road safety.
Looking at ways to improve. Implement quickly.
Bob Twiss, a lot of issues, hard to prioritize. Not a lot of places in Barnstable can utilize safely. Not enough
sidewalks. Need more signs. Roads and paths can’t accommodate.
Tim O’Neill, E bikes will probably become more prevalent and a larger issue. Scooters are more prevalent in
other parts of the country and in tourist areas. How will be regulated. How does Cape Cod Commission
(CCC) interact with the state, Route 28 and 132 - long term planning for that.
Jim Kupfer, doing locally from where state road ends, from state to town road.
Tim O’Neill, Route 28 is dangerous, what ability does CCC have to push the state or having input for these
state roadways. Bearse’s Way, good example of what should be done. Anything to lean into the state?

Steven Tupper, a lot of things in process. State is behind this, they provided the local match grant. All the
areas mentioned have come up. Newtown Road and Route 28 is in the plan. Next 5 years for state funding
are Route 28 and several locations. We are all on the same direction. E bikes and scooters, state is trying to
keep up and are starting to classify E bikes in regards to the speed. E mobility devices. Municipality would
have a role in this. Safety requirements and mobility benefits.
Chair Stephen Robichaud, education won’t help, waste of money. Walkable downtown needed. Pedestrians
should come first. Seasonal rule and regulations should apply.
