Introduction CAPE & ISLANDS ENGINEERING, INC. is submitting this Notice of Intent (NOI) application, on behalf of the applicant and owner 88 Hayes Road LLC c/o Matthew Golding, for the proposed plan to remove the existing sunroom and deck and construct an addition to the single-family dwelling at 88 Hayes Road (Property ID: 210 098) in Barnstable, MA. All proposed work will occur within the limits of the existing developed footprint. Construction will occur within 100 feet of freshwater wetland resource areas. 1.2 Applicable Regulations This application has been filed jointly with the Department of Environmental Protection, pursuant to the Commonwealth of Massachusetts Wetlands Protection Act (MWPA, M.G.L. Chapter 131, Section 40) in accordance with its implementing regulations (310 CMR 10.00); and the Town of Barnstable, pursuant to Town of Barnstable Wetlands Protection Bylaw (Chapter 237 of the Town Code) and implementing regulations. 2.0 BACKGROUND 2.1 Existing Conditions The project site is located at 88 Hayes Road is a private residentially developed property with views of Wequaquet Lake, a great pond. The property is a naturally flat landform currently occupied by an existing dwelling and associated deck, sunroom, and stairs, shed, gravel parking court, stone patio, flagstone walk, maintained lawn, landscaped plantings, and natural shrubbery. The lot slopes gradually towards the east, along the shore of Wequaquet Lake. The home is service by a septic system and connected to public utilities. Developed residential properties border the property to the east, west, and south. 2.2 Property History The property at 88 Hayes Road is a 0.35 acre developed lot shown on the Town of Barnstable Assessors as Map 210 Parcel 098. The lot has been recorded in the Barnstable Registry of Deeds under Deed reference Book 36004 and Page 237. The property was originally developed in 1951 and was effectively built as a legal single family residence as of 1986 per the Town Assessors records. 2.3 Site Characteristics The project site is located adjacent to and within Wequaquet Lake, a great pond located in Centerville, Barnstable. Wetland resources on or within 100 feet of the property include the Bank associated with Wequaquet Lake. The limits of the resource areas were flagged in the field and are shown on the plans. According to the Federal Emergency Management Agency (FEMA) Flood Insurance Rate Map (FIRM) Community Panel No. 25001C0742J, Effective July 16, 2014, the property is not located within the 100-year Flood Zone. NOTICE OF INTENT APPLICATION 88 HAYES RD, BARNSTABLE, MA Project Narrative Page 2 The Massachusetts Natural Heritage and Endangered Species Program (NHESP) Atlas (15th edition, August 1, 2021) and MassGIS online were consulted, and the project site does not fall within Estimated Habitats of Rare Wildlife or Priority Habitats of Rare Species. There are no vernal pools within 300 feet of the site. The project limits are not located within the limits of the Waquoit Bay Area of Critical Environmental Concern, Outstanding Resource Waters, or Zone II Wellhead Protection Areas. 3.0 PROPOSED PROJECT 3.1 Scope of Work The applicant requests permission to demolish the existing sunroom and patio to construct an addition to the existing single-family dwelling as well as a new proposed patio. The work will occur within the 0- 50 and 50-100 foot Buffer Zones to Inland Bank associated with Wequaquet Lake. 3.2 Construction Methodology Prior to the start of work, the Order of Conditions and DEP File Number will be posted at the site an the Conservation Commission will be notified in advance that work will be starting on site. The limit of work, consisting of compost roll with a silt fence backing, will be installed as shown on the drawings to enclose and confine the project for the construction. The limit of work will be maintained throughout the construction phase and until ground surfaces are stabilized. Efforts will be coordinated to minimize construction time and disturbance within and around the subject resource areas. The existing sunroom, stairs, and a portion of the stone patio will be removed and graded. Construction of the enclosed addition will be completed using standard construction practices. All refuse and debris material transported off-site to a suitable off-site upland disposal site. Areas temporarily disturbed by construction activities will be stabilized and any plantings will be implemented according to local guideline. After all the work has been completed a site inspection will be performed by the engineer and a request for a Certificate of Compliance submitted to the Commission once all applicable conditions have been satisfied. 3.3 Anticipated Impacts The project has been designed to incorporate construction methodologies which will minimize impacts to the maximum extent feasible. Ground disturbance will be kept to a minimum and adjacent resource areas will be avoided to the maximum extent possible. Much of the work proposed falls within previously disturbed and maintained lawn areas. The project involves Buffer Zone activities only. The proposed addition will result in a 45 square foot (sf) reduction in total coverage of hardscape to the developed lot. Of which a 51 sf reduction falls within 0-50 feet and a 6 sf increase within 50-100 feet to Wequaquet Lake. The proposed future vista corridor will be in consultation with staff in accordance with the vista pruning guidelines when the vegetation has grown up to block the vista. 4.0 AVOIDANCE, MINIMIZATION AND MITIGATING MEASURES 4.1 Avoidance and Minimization Measures Prior to the commencement of any construction activities, erosion and sedimentation controls, (e.g. siltation fence) will be installed as shown on the attached plan. The erosion and sedimentation NOTICE OF INTENT APPLICATION 88 HAYES RD, BARNSTABLE, MA Project Narrative Page 3 controls will function to keep sediment within the limits of work and will also serve to define the limit of construction to site workers. Erosion and sedimentation controls will be maintained in good condition at the site until disturbed areas have been restored. Any staging areas will be located on the existing lawn and paved spaces, and away from resource areas. No debris, equipment or materials will be stored directly in resource areas. Any temporary disturbances to resource areas will be restored to pre-construction conditions after work is complete. All ground disturbances will be kept to the minimum necessary to complete the construction, and the site will be restored upon completion. 4.2 Mitigation Measures Mitigation guidelines are set forth in Chapter 704 of the Barnstable Town Code under regulations governing activities in the 100 foot Buffer Zone. The 0-50 foot Buffer Zone is not considered undisturbed. The work will fall within the 0-50 and 50-100-foot Buffer Zones, however there will be on overall reduction in hardscapes, particularly within the 0-50 foot Buffer Zone. Therefore, no vegetation mitigation is required or proposed for this project and no waiver is anticipated. The implementation of a drywell will serve to benefit the area. 5.0 APPLICABLE PERFORMANCE STANDARDS The following is a discussion of how the proposed project meets the performance standards under the state and local regulations for each jurisdictional resource area impacted as a result of the project activities. 5.1 Buffer Zone Definitions and performance standards for activities in the Buffer Zone are set forth locally in Chapter 704 of the Barnstable Town Code. The 0-50-foot and 50-100-foot Buffer Zones are defined landward from the top of Inland Bank to Wequaquet Lake, a great pond. The 0-50-foot Buffer Zone is not undisturbed and consists of some hardscape, including a portion of the sunroom, stairs, and stone patio, as well as maintained grass lawn, landscaped plantings, and small areas of natural shrubbery along the shore. The entire home is built within the 100-foot Buffer Zone, including a shed, porch, and flagstone walk. There will be a 51 sf DECREASE within the 0-50 foot Buffer Zone due to the removal of the existing patio and a 6 sf INCREASE within the 50-100 foot Buffer Zone as a result of the addition. The proposed work includes hardscape alteration within a disturbed 0-50-foot Buffer Zone, however the work will result in an overall decrease in hardscapes and a waiver is not anticipated. 5.3 Land Under Waterbodies and Waterways (LUW) Definitions and performance standards for LUW are set for in 310 CMR 10.56 and are not defined locally. The limits of LUW are located waterward of the Inland Bank to Wequaquet Lake. The proposed work falls within 0-50 and 50-100 feet to LUW of Wequaquet Lake. The proposed work will not result in direct impacts to resource areas. The work will not impair the water carrying capacity of Wequaquet Lake, water quality, or capacity of the land under Wequaquet Lake to provide breeding or wildlife habitat functions. Rather, the drainage improvements (drywell installation) will decrease the runoff, therefore increasing the overall quality of the Buffer Zone. The waters and bottom topography of Wequaquet Lake will not be impacted. The work does not involve a stream crossing nor is the project located within rare species habitat. No permanent impacts to LUW are proposed. NOTICE OF INTENT APPLICATION 88 HAYES RD, BARNSTABLE, MA Project Narrative Page 4 Project activities will not induce cumulative impairment of the resource area’s functional characteristics. 6.0 SUMMARY 6.1 Performance Standard Metrics The existing wetland resources, anticipated project impacts and the proposed impact reduction measures associated with this project have been fully documented within this Notice of Intent application. Based on the information provided in this application it is asserted that the following project features would result in no a benefit to the associated resource area will have no adverse effect on the subject resource area(s) values and functional characteristics. The project should be approved for the following reasons: • The proposed project results in a decrease of impervious surfaces in the 0-50’ buffer zone. • The project will not cause unacceptable significant or cumulative effect upon resource area values, functions, or characteristics. With the proposed drainage structure there will be a net benefit to the resource area. • The project conforms to the Massachusetts Wetlands Protection Act, (MWPA, M.G.L. Chapter 131, Section 40) and its implementing regulations (310 CMR 10.00) and the Barnstable Wetlands Protection Bylaw, (Chapter 237 of the Town Code) and implementing Regulations (Part VII of the Town Code) and will not cause unacceptable significant or cumulative effect upon the resource area values. 6.2 Request for Order of Conditions The Applicant has demonstrated and documented evidence that this project meets or exceeds all the relevant performance standards set forth in the governing regulations and respectfully request this project be approved and that an Order of Conditions be issued to the Applicant through its representative. 6.3 Contact Information In an effort to reduce the amount of paper required for filings, the entire application can be emailed upon request to regulatory staff and commission members.
