December 2024 1 December 2, 2024 Commissioners Barnstable Conservation Commission 230 South Street Hyannis, Massachusetts 02601 RE: Randal Green (applicant/ owner), NOI application, @ 101 Center Lane, Centerville, MA (Map:251, Parcel: 220) Dear Commissioners: On behalf of Randal Green (Applicant/owner), I respectfully request the Barnstable Conservation Commission (BCC) review the attached Notice of Intent (NOI) application and Plan of Record (POR). The applicant petitions the BCC to approve the boundaries of the wetland resource areas (WRAs) and to approve permission for the INSTALLATION of a SEASONAL dock and CONSTRUCTION of a 4’ wide footpath with associated timber retaining wall and timber landscaped steps. The Plan of Record (POR) was prepared by Bracken Engineering, Inc., titled “Proposed Dock Plan in Centerville, Massachusetts”, dated October 31st, 2024 with a scale of 1”=20’ (or as noted) and signed and stamped by Zachary L. Basinski, PE 47797 and David A. French Jr., PLS 57164. In December 2023, 99 Center Lane and 101 Center Lane were subdivided. A copy of the Notice of Approval Not Required (ANR) Plan Endorsement and the accepted ANR Plan (Plan Book:703, Page:1) are attached. The newly established property boundaries have not been updated on the Town of Barnstable online GIS mapping. The property boundaries of the former 99 Center Lane and 101 Center Lane were both used to notify abutters. This was to guarantee abutters within 100’ of the proposed work were notified. Wetland Resource Areas: The property is abutting the Great Pond Wequaquet Lake and is the location of the proposed seasonal dock. The project is subject to the performance standards outlined in Land Under Water Bodies and Waterways (310CMR10.56). The seasonal dock and a portion of the proposed footpath is within “Estimated Habitats of Rare Wildlife” and “Priority Habitats of Rare Species” (Priority Habitat 282) according to the MA Natural Heritage and Endangered Species Program (MNHESP) on-line mapping. MNHESP has been sent a copy of this Notice of Intent for review and comment. 2 A site assessment was conducted on January 18, 2024, to identify and confirm the Wetland Resource Areas. Photographic documentation of the existing conditions is included within the NOI application. The site assessment determined there are no bordering vegetated wetlands (BVW – 310 CMR 10.55) within 100’ of the property line. Proposed Construction Activities: • CLEAR and GRADE a 4’ wide footpath as shown on the POR. • CONSTRUCT a timber retaining wall for the footpath. • INSTALL a 30 gallon drywell to control runoff. • CLEAR a 6’ wide footpath and INSTALL 4’ wide timber landscaped steps. • INSTALL SEASONAL dock (200SF) with 4-step self-leveling stairs for lateral access along the waterline. MA Natural Heritage & Endangered Species Program (MNHESP): The NOI & project plans have been forwarded to MNHESP for review & comment as a portion of the parcel is within mapped Priority Habitat (PH 282 – see attached map) and Estimated Habitats of Rare Wildlife. Of the 1019SF total proposed work, 216SF is proposed within these resource areas. The work proposed within these resource areas is 0.8% of total lot coverage. The work proposed outside this resource area is 2.99% of the total lot coverage. The total property consists of 26,803SF per the POR. Summary: The applicant petitions the BCC to approve the wetland resource areas & boundaries and to permit the INSTALLATION of a SEASONAL dock, and to CLEAR, GRADE, and MAINTAIN a footpath access. Provide a copy of the Assessor's Map indicating the parcel of the project s ite and showing the 100 ft radius of the project parcel. Provide a copy of the abutter notification letter. Use the form letter prov ided in our A butter Notification Regulatio n (Chapter 706), available on the Conservation Di v isi on website. Bring the green return receipts, from the certifi ed mailings to the abutters, as proof of notification to the public hearing. If any mailings are returned, bring the entire envelope, indicating by postal service stamp the reason for return. You will retain the receipts afterwards, not the Conservation Division . f. I further certify under the penalties of perjury that a ll abutters were notified of the Notice of Intent Application, pursuant to the requirements of Chapter 23 7 of the General Ordinances of the Code of the Town of Barnstable. Notice must be made in writing by certified mail to all abutters with in l 00 ft of the property line of the project location. Field Staking: a. On or before T uesday ,@ 8:30 a.m., o ne week prior to the scheduled public hearing, have your project staked by a profess ional e ngineer or registered land s urvey or showing all outside corners of aJI proposed structures and the continuous proposed "limit of work" line. b. Have a wetland scientist or other qualifi ed professional flag all wetland resource areas o n or within l 00 ft of the work area. Make sure that the flags are sequentially numbered. C. Provide a project identification stake with bright painted top and applicant name and address, easily visible from the street approaching the s ite. Legal Advertisement Fees: a. Conservation will submit the legal ad for pub li cation in a local newspaper. The applicant or his/her agent is responsible for payment, by check (payable to the Town of Barnstable), at the hearing or by mail. The cost of the legal ad will be pre-calculated and posted on the hearing agenda prior to the hearing. Mi nimum Documentation for a Com plete Application: a. Provide a completely filled-out (in a ll parts) NOi application as locally adopted for the Town of Barnstable, including MassDEP Vegetated Wetland Field Data Form . Indicate Assessor's map a nd parcel of the project, as well as the street or road address, and perti nent village (i.e., Hyannis, Centervi ll e, Barnstable, etc). b. Provide two (2) original project p lan s, stamped in blue or red ink (wet stamp). Plans must be signed and dated by a Massachu setts licensed, professional engineer, land s urveyor, architect or landscape architec t (as applicable), and shall be drawn at a readable s cale (l" = 20' preferred). Provide a signed Permission to Access Property, Form PA. The form must be signed by the property Owner, or legal representative and submitted prio r to NOl being docketed and appli cation advertised. For projects requiring mitigation plantings under Chapter 704-3, 704-4, and 704-5, mitigation pl anting location(s) s hall clearly be shown on landscaping planting plan. The planting plan shall in c lu de species list (chosen from the Town of Barnstable Conservation Commission approved planting li sts), s izes, den sit ies and/or quantities. The plan shall also provide area calculations between O to 50 and 50 to I 00 separatel y fo r the amount of mitigation planting requ ired, and the amount of mitigatio n pl anting proposed. Provide detailed, written street directions to the locus (site). Provide a copy of a U.S.G .S. locus map indicating the general area of t he proj ect site. Prov ide a check for the Town of Barnstable portion of the required fi ling fee. (The porti on payable to the Com monwealth, see 7. e. below) Provide any other documentation, photographs, architectural renderings or other supporting data prepared by professionals competent in the field wh ich may be relevant to the application. The site plan s hall also show: a . All existi ng and proposed contours at 2-ft. minimum intervals (]-ft. preferred). b . Clear delineation of all exjsting an d proposed structures and features. Build ing structures must be accurately dimensioned (fixed location) fro m property lines a nd wetland resource areas. Plans shall prov ide s ufficient detail to show a ll potential wetland impacts, miti gation, compensatory areas, engineered structures, utilities, landscaping, etc. w ithin the area of jurisdiction . On com plicated s ites, existing and proposed cond itions must be shown o n se parate s heets. c. Locus inset m ap o f t he site clearly showing its location relati ve t o s urrounding publ ic streets. d. All wetlan d resource area flags by ind ividual flag number (matched to the field) to clearly identify all resource areas on or within 100 feet of the work area.
