Town of Barnstable Conservation Commission Office: 508-862-4093 230 South Street Hyannis Massachusetts 02601 E-mail: conservation@town.barnstable.ma. us CHAPTER 707 Regulation Governing Minimum Submission Requirements for a Notice of Intent Application The Barnstable Conservation Commission has adopted the following requirements in order to obtain more consistently complete submission documents necessary for a thorough and efficient review of all Notice of Intent (NOi) applications. Failure to complete any of the items in this checklist may result in your application being denied. Applicant or applicant's agent should check each box denoting that the task has been completed or in certain instances, like field staking, denoting that the task will be completed. The following submission checklist covers the requirements of Chapter 237, Wetlands Protection, of the Pait I General Ordinances of the Code of the Town of Barnstable. This checklist shall be submitted to the Barnstable Conservation Division with the NOi application. 1. Requirements a. The applicant understands, unless they've instructed otherwise, they are applying both under the Massachusetts Wetlands Protection Act M.G.L. c.131,§40 and Chapter 237 of the Town of Barnstable General Ordinances. b. Attach a written narrative to the NOi application (WPA Form 3), available at: www.mass.gov/ eea/ agencies/massdep/service/approvals/wpa-form-3 .html C. d. describing any project impacts and proposed mitigation as they relate to the following: 1) 2) 3) 4) 5) of Any of the interests of Chapter 23 7 of the General Ordinances and the MassDEP Wetlands Protection Act M.G.L. 131, §40. Contact the Conservation Division office at (508) 862-4093 regarding the docketing process, or see current schedule of Conservation Hearings and submission deadlines at: www.townofbarnstable.us/Conservation/ b. C. d. e. f. Provide a copy of the list of abutters within a 100 ft radius of the project parcel. Provide a copy of the Assessor's Map indicating the parcel of the project site and showing the 100 ft radius of the project parcel. Provide a copy of the abutter notification letter. Use the form Jetter provided in our Abutter Notification Regulation (Chapter 706), available on the Conservation Division website. Bring the green return receipts, from the ce11ified mailings to the abutters, as proof of notification to the public hearing. If any mailings are returned, bring the entire envelope, indicating by postal service stamp the reason for return. You will retain the receipts afterwards, not the Conservation Division. I further certify under the penalties of perjury that all abutters were notified of the Notice of Intent Application, pursuant to the requirements of Chapter 23 7 of the General Ordinances of the Code of the Town of Barnstable. C. On or before Tuesday,@ 8:30 a.m., one week prior to the scheduled public hearing, have your project staked by a professional engineer or registered land surveyor showing all outside corners of all proposed structures and the continuous proposed "limit of work" line. Have a wetland scientist or other qualified professional flag all wetland resource areas on or within I 00 ft of the work area. Make sure that the flags are sequentially numbered. Provide a project identification stake with bright painted top and applicant name and address, easily visible from the street approaching the site. 4. Legal Advertisement Fees: 5. a. Conservation will submit the legal ad for publication in a local newspaper. The applicant or his/her agent is responsible for payment, by check (payable to the Town of Barnstable), at the hearing or by mail. The cost of the legal ad will be pre-calculated and posted on the hearing agenda prior to the hearing. Minimum Documentation for a Complete Application: a. b. Provide a completely filled-out (in all parts) NOI application as locally adopted for the Town of Barnstable, including MassDEP Vegetated Wetland Field Data Form. Indicate Assessor's map and parcel of the project, as well as the street or road address, and pertinent village (i.e., Hyannis, Centerville, Barnstable, etc). Provide two (2) original project plans, stamped in blue or red ink (wet stamp). Plans must be signed and dated by a Massachusetts licensed, professional engineer, land surveyor, architect or landscape architect (as applicable), and shall be drawn at a readable scale (l" = 20' preferred). For multi-acre sites, a second site plan, drawn at larger scale showing the entire site, should also be provided. Chap 707 /rev. March 2022 Page 2

The fonn must be signed by the property Owner, or legal representative and submitted prior to NOI being docketed and application advertised. Form PA is available at www.townofbarnstable.us/Conservation/. Do not send the abutter letter out until the fonn is submitted to the Conservation Division office. For projects requiring mitigation plantings under Chapter 704-3, 704-4, and 704-5, mitigation planting location(s) shall clearly be shown on landscaping planting plan. The planting plan shall include species list (chosen from the Town of Barnstable Conservation Commission approved planting lists), sizes, densities and/or quantities. The plan shall also provide area calculations between O to 50 and 50 to 100 separately for the amount of mitigation planting required, and the amount of mitigation planting proposed. Provide detailed, written street directions to the locus (site). Provide a copy ofa U.S.G.S. locus map indicating the general area of the project site. Provide a check for the Town of Barnstable portion of the required filing fee. (The portion payable to the Commonwealth, see 7. e. below) Provide any other documentation, photographs, architectural renderings or other supporting data prepared by professionals competent in the field which may be relevant to the application. 6. The site plan shall also show: a. b. c. d. e. All existing and proposed contours at 2-ft. minimum intervals ( 1-ft. preferred). Clear delineation of all existing and proposed structures and features. Building structures must be accurately dimensioned (fixed location) from property lines and wetland resource areas. Plans shall provide sufficient detail to show all potential wetland impacts, mitigation, compensatory areas, engineered structures, utilities, landscaping, etc. within the area of jurisdiction. On complicated sites, existing and proposed conditions must be shown on separate sheets. Locus inset map of the site clearly showing its location relative to surrounding public streets. All wetland resource area flags by individual flag number (matched to the field) to clearly identify all resource areas on or within 100 feet of the work area. The individual who performed the flagging and date of flagging shall be identified on the plan next to the resource line. Section views showing changes in grade, cuts and fills. 7. SUBMISSION OF THE COMPLETED APPLICATION WITH PLANS: a. b. c. Provide a signed Permission to Access Property, Form PA. PROJECT NARRATIVE #6 Stoney Cliff Road, Centerville The applicant is pleased to submit a Notice of Intent application to construct additions to an existing single-family dwelling. The site consists of a developed 35,254 s.f. lot improved with a 3-bedroom single family dwelling that was constructed in 1977 per assessors' records. There is a Bordering Vegetated Wetland located to the south along Bumps River. The edge of the Bordering Vegetated Wetland was flagged by Paul Shea of Independent Environmental Consultants. The site does not lie within Priority or Estimated Habitat in accordance with the latest Natural Heritage map (2017). Two attached garage additions with living space above are proposed. All construction will take place within existing gravel drive or landscaped areas. A work limit line of staked silt fence is proposed downgradient of all work. 310 CMR 10.55 Bordering Vegetated Wetland The proposed dwelling will be constructed within existing developed areas. No adverse effects from the work are expected, as the work limit line shall remain staked in place until all work is complete, and the site is stabilized. All work will take place on the landward side of a 20' dirt right of way the leads to a cranberry bog. Roof drywells are proposed to infiltrate the roof runoff. No fill is proposed. The proposed mitigation will enhance the buffer to the BVW and it will continue to act fully in its capacity to provide habitat and food sources for wildlife. Riverfront Area {310 CMR 10.58} Bumps River runs through the southerly portion of the property. The 100' Inner and 200' Outer Riparian Zones are shown on the site plan. The lot and existing dwelling pre-date the Rivers Act (1988). Section 10.58(5) of the Wetland Protection Bylaw allows redevelopment of a previously developed area, provided the proposed work improves existing conditions. Native plant species are proposed to re-vegetate the areas between the new additions and the River. The proposed work will take place within existing developed areas and will have no adverse impacts on the riverfront area. (a) The lot is previously developed, and the proposed work will result in an improvement over the existing conditions. (b) No additional runoff into the riverfront area will be created with this work. Roof drywells are proposed to infiltrate all new roof runoff. (c) All work will take place within existing developed or landscaped areas. (d) No expansion of existing developed areas is proposed. (e) See (d) (f) A net increase of 246 s.f. of hardscape is proposed within the riverfront area. 506 s.f. of mitigation is proposed to help offset this increase.
(g) See (f) (h) See (f) Barnstable Wetlands Protection Bylaw (Chapter 237 compliance) 1. Effects on Erosion Control: the work limit line will consist of staked silt fence. This will be installed prior to any work occurring on the site and shall remain in place until all the construction is completed. No fill or regrading is proposed. The proposed roof drywells will mitigate roof run-off. 2. Effects on wildlife: The proposed additions will not have a deleterious effect on wildlife. This lot is not within Priority or Estimated Habitat of Rare or Endangered Species. All of the work will occur within an existing gravel driveway or landscape areas. Mitigation is proposed to offset the increase in hardscape within the 100' buffer to the BVW. 3. Effects on Recreational Interests: None expected; this is privately owned property. 4. Effects on Aesthetic Interests. No negative effects. 5. (& 6.) Effects of Agriculture/Aquaculture: N/A 7. Effects on Historic Interests: No archaeological sites are known to occur on the property. Standard excavating equipment will be used for the construction. Any staging areas will be located outside the 50' buffer to the BVW and within the existing driveway area. Mitigation Calculations under Barnstable Chapter 704 This site presents a unique set of circumstances in regard to mitigation requirements. Within the 50' Buffer, a 20' dirt right of way to a cranberry bog lies between the construction and the BVW and cannot be used for mitigation plantings. 506 sf of mitigation plantings are proposed to offset the increase in hardscape within the 50-100' buffer zone. These plantings will fill the entire 50' buffer that is not within the existing right of way or already vegetated. The stated goal of chapter 704-3 is to restore the full 50' buffer zone in its entirety. We are requesting a waiver in this case to only re-vegetate to the extent practicable, noting that a majority of the buffer zone is not under our control. The proposed mitigation plantings do meet the 2:1 requirement of redevelopment within the riverfront. The proposed work, and mitigation calculations are plotted on the enclosed site plan By Down Cape Engineering, Inc. Alternatives Analysis The site could remain as it is, but the client would like to create some more habitable space and vehicle storage space. The garage additions line up with or are located within existing driveway areas. An addition to the north of the dwelling further away from the wetland resource areas is not practical given the presence of existing utilities and grade conditions in that area. Two 1-car additions are proposed in lieu of one 2-car addition to take advantage of the existing driveway areas and reduce the proposed hardscape increase on the site.

This property is located at the intersection of Stoney Cliff Road and Ames Way. Independent Environmental Consultants, Inc. (IEC) conducted a site inspection and evaluation on 9-1-24 to delineate the boundary of wetland resource areas located adjacent to the subject property. This site inspection occurred during the summer season, during the growing season, with full leaf out conditions. The property contains an existing residential house, fence, and driveway off of Ames Way. There is a bordering vegetated wetland (BVW) located downgradient from the property, located downgradient of the driveway. The BVW wetland is a wooded swamp which contains greater than 50% wetland vegetative species, hydric soils, high groundwater conditions, and ponding areas within the swamp. IEC has delineated the boundary of the BVW wetland with the flags A 1 -AS. The edge of wetlands is located just downgradient of the driveway at 6 Stoney Cliff Road. There is a 50' buffer zone and a 100' buffer zone associated with the edge of wetlands, and this 100' buffer zone extends onto the property at 6 Stoney Cliff Road. This bordering vegetated wetland is contiguous with a large freshwater pond, and there is a perennial river (Bumps River), which flows out of the pond, and flows downgradient through the BVW wetland system. There is a culvert within Ames Way for the perennial river. There is a 200' Riverfront Area associated with the Mean Annual High Water Line (MAHWL) of the Bumps River, perennial river. The 200' Riverfront Area has a 100' Inner Riparian Zone, and a 100' Outer Riparian Zone, which is measured from the MAHWL of the Bumps River. The 200' Riverfront Area extends towards the subject property, 6 Stoney Cliff Road. There is Bordering Land Subject to Flooding associated with the Bumps River. A 100 year flood zone is associated with this perennial river.
