The proposed addition and pool represents 163 square feet (sf) of new “hardsacpe” area within the buffer 100 ft. zone of a Bordering Vegetated Wetland (BVW). The project also includes the relocation of an existing domestic sewer line, and the constructuon of 2 subsurface drywell structures to infiltrate ruoof runoff from part of the existing house footprint, and all of the new house roof. The larger of the 2 drywells is intended to also infiltrate water from the periodic draining of the pool, when needed. This proposed work location is within the 50-100 ft. buffer zone of the BVW, and lies within the 100-200 ft. riverfront area of the nearby perrenial stream; Joshua’s Brook. This property is partially located within the 100- yr. flood plain, but is not located within a mapped MA Natural Heritage Program (NHESP) Priority Habitat for Threatened or Endagered Species. Project Impacts & Mitigation This project does not represent a significant impact to the wetland resource areas, and is not a significant change to the current use of the site, or neighboring area. Buffer zone mitigation plantings are proposed on the north side of the property (between the addition and the BVW) for a total of 494 sf, which represents mitigation of the new hardscape area at slightly more than the 3:1 required ratio (per Ch. 704-3D). Riverfront Area/Alternatives Analysis The applicant’s lot creation in 1959 & 1970, and original dwelling construction pre-date the implementation of the Rivers Protection Act of 1996, having been constructed in 1960 & 1991 (per the Barnstable Assessor’s Card). The total area of riverfront on the property = 32,555 sf. The proposed area of disturbance/alteration in the riverfront area = 1,196 sf, which represents only 3.67% of the total riverfront area, and is completely located in the 100-200 ft. outer riparian area of the riverfront. The alternatives reviewed for the proposed house addition and pool involved siting the work on the east, and or south, sides of the existing dwelling, which would result in a larger amount of disturbance (which would also include some changes to the driveway). Instead, the addition was changed to include a second story to limit the Page 2 of 3 Notice of Intent Project Narrative 64 Greenwood Ave., Hyannis, MA ________________________________________________________________________________________________ overall footprint, and allow for the pool to be constructed right next to the addition, but on the north side of the existing dwelling, thereby reducing the area of alteration. Similarly, the location of mitigation plantings was selected along the north side of the property to improve the riverfront & BVW buffer in this location. Additionally, the project scope includes the construction of new gutters, downspouts, and subsurface infiltration drywells to improve the overall stormwater management at this property. According to 310 CMR 10.58(4)(d), the permit issuing authority may allow the proposed alteration if the work proposed would result in a finding of “No Significant Adverse Impact.” We believe that this project will result in this finding due to the following: a. This project is not altering any natural vegetative cover within the 0-100 ft. inner riparian zone, but will be actually adding back some natural vegetation via the proposed mitigation plantings. b. Stormwater is being managed by the project, via the use of new roof drain drywells. c. Nothing about the project will alter features providing important wildlife habitat function currently within the riverfront area, and the proposed mitigation plantings will improve cover and foraging habitat for birds and other wildlife. d. The project is not impairing groundwater or surface water quality since it is incorporating erosion and sedimentation control measures during construction to attenuate pollution. Review of impacts regarding other interests including the interests of the Wetlands Protection Act: 1. Effects regarding the Protection of Public & Private Water Supply: None. This project will not result in any impacts or changes to public or private water supplies. 2. Effects regarding the Protection of Groundwater Supply: Positive. This project will result in a net improvement to stormwater infiltration on the site, which supports the area groundwater supply and connected stream flows. 3. Effects on Flood Control: Improvement. This project will provide the collection (new gutters and downspouts) and infiltration of roof drain stormwater from the new house addition, and a part of the existing home into new subsurface drywells, resulting in a net improvement of stormwater management & flood control. 4. Effects on Storm Damage Prevention and Erosion Control: Positive. Together with the roof drains described above, the existing site is mature and well stabilized. Additionally, the construction period erosion controls, together with subsequent loam & seeding restoration, will not result in erosion to Joshua’s Brook. 5. Effects on Prevention of Pollution: None. This project does not represent any new source of pollution, and again, proper erosion controls will be employed during construction. 6. Effects on Land Containing Shellfish: N/A 7. Effects on the Protection of Fisheries: None. This project will not create negative impacts to local fisheries (in Joshua’s Brook). Effects on Protection of Wildlife: Positive. The proposed activities do not result in a modification of the BVW, nor wildlife habitat of the wetland system/area. However, the proposed mitigation plantings will provide additional cover and forage habitat for birds and other wildlife. 9. Effects on Recreational Interests: Positive. This project will provide an improvement to the recreational interests of the property owner, but no overall major change to the surrounding site or neighborhood area. 10. Effects on aesthetic interests: Positive. The project will not create negative impacts to these interests. The proposed work will be architecturally complimentary with the architecture of the neighborhood and will mostly be screened from views from the wetland side of the property, due to existing vegetation. _____________________________________________________________ Compliance with Town of Barnstable Performance Standards Chapter 704-3 of the Barnstable Code –Performance Standards for Projects Requiring a Notic of Intent This project involves new hardscape within the 50-100 ft. buffer (where a 50 ft. undisturbed buffer does not exist), and therefore requires mitigation plantings at a 3:1 ratio, per Section 704-3D as follows: 1. Mitigation Planting Calculations: Area of new house addition & pool/deck area within the 100 ft. buffer = 163 sf Required Mitigation Planting area from Section 704-3D. = 163 sf X 3 = 489 sf Required 494 sf Provided (as described below, and shown on the site plan) 2. Building structures must be accurately dimensioned (fixed location) from property lines and wetland resource areas. Plans shall provide sufficient detail to show all potential wetland impacts, mitigation, compensatory areas, engineered structures, utilities, landscaping, etc. within the area of jurisdiction. On complicated sites, existing and proposed conditions must be shown on separate sheets. c.Locus inset map of the site clearly showing its location relative to surrounding public streets. d.All wetland resource area flags by individual flag number (matched to the field) to clearly identify all resource areas on or within 100 feet of the work area.
