Licensing Authority Minutes
The regularly scheduled Barnstable Licensing Authority Public Meeting was called to order at approximately 10:00
a.m. on Wednesday, December 18, 2024 and was held at Barnstable Town Hall, 2nd Floor Hearing Room, 367 Main
Street, Hyannis.
Members Present: David Nunheimer, John Flores, Larry Decker, Nancy Karlson-Lidman, Jessica Sylver,
John Murphy.
Staff Present: Erin Logan, Officer Chris Kelsey
PUBLIC COMMENT – Chair Nunheimer called for public comment. Seeing none, he closed public
comment.
NEW BUSINESS
1. Amend Common Victualler All Alcohol – Change of Hours
An application has been filed by Sam Diego’s Inc. dba Sam Diego’s, looking for a reduction in their
hours of operation from: Sundays 11:30am to 12am, Monday through Saturday 8am to 1am . to:
Sunday through Thursday 11:30am to 10:00pm, Friday and Saturday 11:30am to 11pm, with the
ability to stay open until 11pm, any day of the week, on the eve of a holiday.
Teri Pratt, General Manager, was present to represent the application for Sam Diego’s. Flores
confirmed with Pratt that COVID caused disruption in their hours of operation. Pratt added that the
public does not seem to be interested in late dining. Flores confirmed with Pratt that this will be a
permanent change. Nunheimer opened public comment, and seeing none, he closed public
comment.
Motion: Larry Decker moved, seconded by John Flores, to approve this application as submitted. So
voted, aye, unanimously.
2. Amend Club All Alcohol – Change of Manager
An application has been filed by Wequaquet Lake Yacht Club Inc. dba Wequaquet Lake Yacht Club,
150 Annable Point Road, Centerville, for a change of manager from Scott Mullen to John York.
John York was present to represent the application for Wequaquet Lake Yacht Club.Nunheimer
confirmed that York is taking over as manager. Flores confirmed with York that Wequaquet Lake
Yacht Club has an annual license. Karlson-Lidman confirmed with York that he currently has 5
bartenders, all of whom are TIPS certified.
Motion: Larry Decker moved, seconded by John Flores, to approve the application as submitted.
So voted aye, unanimously.
PUBLIC HEARINGS
1. New Class II Auto Dealer
An application was filed by Hyannis Wheels Inc. dba Hyannis Wheels, 455 Yarmouth Road, Hyannis
for a new Class II Auto Dealer License. The applicant proposes to take over the existing business.
The location is restricted to a maximum of 25 vehicles; 18 display, 3 customer, 2 employee, 2
handicap accessible. Proposed daily hours of operation are Monday through Friday, 8:30am to
6:00pm, and Saturday 8:30am to 3:30pm, closed Sunday. Hyannis Wheels has an agreement with
Clerio Auto Repair, 362 Yarmouth Road, Hyannis, for repair work.
Clesio Silva was present to represent the application submitted by Hyannis Wheels. Silva noted that
his uncle purchased the business, and he is the manager. Silva confirmed he will be operating the
license as outlined in the agenda (see above).
Motion: Larry Decker moved, seconded by John Flores, to approve this application as submitted. So
voted, aye, unanimously.
2. Amend Entertainment License
An application was filed by Scottish Rock LLC dba The Quarterdeck Lounge, 247 Iyannough Road,
Hyannis, to add live entertainment to the existing entertainment license. Live entertainment to
include 2, live, amplified performers (4 pieces), including karaoke and trivia. Proposed hours of live
entertainment are 8am to 12:45am, daily.
Haullie Thompson was present to represent the application submitted by The Quarterdeck Lounge.
Thompson is hoping to host trivia nights to entertain patrons. Kelsey confirmed with Thompson
that she will be moving a pin ball machine to allow for space for live entertainment. Kelsey also
confirmed and Thopson acknowledged the understanding that the entertainment is restricted to
inside only.
Motion: Larry Decker moved, seconded by John Flores, to approve the application as submitted. So
voted, aye, unanimously.

Decker noted that the renewal application for House of Hatchets indicates Malt and Wine only wherein
they were recently approved for all alcohol. Logan explained that we are still awaiting approval of the
Alcoholic Beverages Control Commission for that amendment. Until that approval is received, they must
continue to operate with malt and wine only.
Motion: Larry Decker moved, seconded by John Flores, to approve the consent agenda as printed. So
voted, aye, unanimously.
LICENSING UPDATES
1. Licensing Authority & Division Updates:
a. Gimmy’s Tavern
Logan advised that Gimmy’s Tavern no longer has a legal right to occupy the premises.
b. Summary of permanent closures
Logan advised that The Karibbean Lounge, Little Miss Cupcape, Barbyann’s, and Dragon
Lite have permanently closed their doors. The Karibbean Lounge and Little Miss Cupcape
hope to return in the future. Barbyann’s and Dragon Lite owners retired.
2. Police Department Updates:
a. Unlicensed activities at 64 Enterprise Road, Hyannis
Kelsey advised the members that below the 1st floor commercial operations at 64
Enterprise Road, there are three large storage units at basement level. The landlord of
said property discovered a party in the storage units and called the Barnstable Police
Department. The unit lessee was holding the party in the unit and confirmed he was
storing alcohol for a restaurant that he owns in the Town of Dennis. Kelsey notified the
Town of Dennis accordingly and they will take over the investigation. The owner of the
building cancelled the lease with the lessee and has evicted him. Murphy confirmed with
Kelsey that there was no evidence of a fee being charged.
b. Compliance Check update – Hyannis Sip & Shop
Kelsey advised that on December 6, 2024, he conducted a compliance check of the Sip &
Shop event in addition to the required police detail. On this night they observed two people
walking out of an establishment with alcoholic beverages. Kelsey witnessed 5 customers
walking out of another establishment with alcohol. Kelsey notified the Hyannis BID that this
occurred at Mrs. Mitchells. Nunheimer suggested that the BID should be ensuring
compliance. Kelsey noted there have not been many issues associated with this event and
that we can deal with each establishment individually with any compliance matters.
Nunheimer advised that these matters can continue to be reviewed and approved on a
consent agenda, but that staff should communicate with the Hyannis BID that they must
ensure compliance at each establishment. Decker confirmed with Kelsey that the infractions
were resolved on the spot.
c. Operating without a license – Spinnaker Records, 596 Main St, Hyannis
On December 6, 2024, Barnstable Police detectives responded to Spinnaker Records on
Main Street, Hyannis, as part of investigation regarding stolen property. They spoke with
the owner who was cooperative and unaware that he has purchased stolen property.
Detectives were satisfied with the interactions with Spinnaker Records. Kelsey advised the
business owner that his junk dealer license was expired and that he would need to reapply
for a Junk Dealer license adding that he may not buy or sell used goods until they obtained
a Junk Dealer license.
D. 237 Barnstable Road, Hyannis
In December 2023 Hyannis Fire conducted an inspection and alerted the Barnstable Police
Department of alcohol storage on site. Kelsey noted that he was recently notified that a
wedding took place at the party store. We believe there have been other parties at this
location. Kelsey advised they cannot have parties there as they do not have approval to use
the store as event space. Kelsey noted that the Building and Health Departments have been
alerted to this matter.
