He explains what the business is and the proposed signage. Also would like an open/closed sign, will do steady full neon. A-frame sign, wooden proposed with two sides , so can switch back and forth. Chair Cheryl Powell looks for four different colorings, would like 4 pictures? 2 Sanjay Sah, yes, 4 different would like to put on the frame. It will have the picture and color of. He passes around a picture on his phone of what the eyes will look like and colors on the proposed A frame sign. Peri Wentworth directs to Staff/Corey and the conformity of the application? Corey Pacheco, will need more documentation on the A frame sign and clarify window lettering or painting. Sanjay Sah, vinyl lettering seems easier to put in, but can do a paint. Corey Pacheco, vinyl may be considered by the Commission, at their discretion. Kevin Matthews, vinyl lettering fine. Clarifies window banner with decal ? Sanjay Sah, that is a second option, but don’t need to use. Kevin Matthews, A frame, plastic is not allowed, should be wood, some businesses do use plastic, but it is not allowed. Sanjay Sah, looking into a two sided A frame, wooden – metal is ok, good. Laura Cronin, the word eyebrows or eyebrow, which would be correct wording? Vinyl lettering ok. Neon sign, ok as long as steady and turned off at night. Guideline for A frame? HHDC guidelines. Would there be some other language on the sign? Jim Kupfer, there is hardship language that the application may still reference, that used to be within the zoning, but changed now. Has to be along the frontage and if on public way has to get a license, town manager/liability review, but HHDC doesn’t have concern with that part of it. Chair Cheryl Powell opens public comment. None. Voting guidelines – all 7 members in attendance can vote. Kevin Matthews, fine with all as long as materials needed and correct for A Frame sign. No window banner. Chair Cheryl Powell suggests clarification for lettering and ok with vinyl. Decal banner removed. A frame make sure compliant with guidelines. Eyebrow or eyebrows wording. Amend wording, not actually a hardship for A frame signage. Corey Pacheco, will have to also clari fy the open/close sign. Red and steady neon. Just open not closed. Chair Cheryl Powell closes public comment. Chair Cheryl Powell entertains a motion for the Findings, moved by Kevin Matthews to find this application to be compatible with the pr eservation and pr otection of the district, vinyl sign approved, removal of banner sign, the open sign be red solid neon and the A frame cannot be plastic material, has to be an approved material of wood or metal, the hardship sign request removed, approval of graphics, seconded by Peri Wentworth, Roll Call Vote: Laura Cronin - aye Kevin Matthews - aye Matt Clark - aye Jeniffer Hinckley Needham - aye Jack Kay - aye Peri Wentworth - aye Cheryl Powell - aye Chair Cheryl Powell entertains a motion for a Certificate of Approval, and to add as amended in the Findings, moved by Kevin Matthews to issue for application at 497 Main Street with the amendments as stated in the Findings, seconded by Peri Wentworth, Roll Call Vote: Kevin Matthews - aye Laura Cronin - aye Peri Wentworth - aye 3 Jack Kay - aye Jeniffer Hinckley Needham - aye Matt Clark - aye Cheryl Powell - aye Continued Business The Cordial Eye and Hyannis Public Library – Community Wall Art Project at 401 Main Street, Hyannis Mary George and Anastaci Pacella of The Cordial Eye in attendance. Mary George, presentation shown. Overview. Proposing an agreement to continue the Community Art Wall. Would like to request understanding of the wall, installation is not permanent because a renovation will be happening. Would like to keep until th e renovation commences. See presentation. First panel reserved for commission work. Aerosol artistry as well. Goals of the project. Antonia Stevens, director of the library is in support of the wall and continuing. Is removal and reversible, 4 pieces of plywood, haven’t ha d to have any emergency removal. Signage in multiple languages also surveillance cameras and staff , monitoring. Community Programming. B arnstable High School (B HS ) Dept. involved over 100 students. Grants received again for later this spring and the students come again to the wall. JFK supporter of the initiative and others. Outcomes, decrease in graffiti per Business Improvement District (BID) annual meeting info. Contributions to the wall have been appropriate. Large formats are not easy to find or afford. This has been an initiative that has brought a lot of joy and a safe space for the community to enjoy. Would like it to exis t until meets the end with the change of the building/renovations that are in the near future for the library . Point of order from Peri Wentworth – can she vote on this? Jim Kupfer, this is not a hearing, so Peri can vote, it is fine to vote. Char Cheryl Powell has been notified of five complaints, with regard to the same piece/part.. Correspondence is read into record: Chair Cheryl Powell r eads letter from Bruce Stepanek dated December 28, 2024. Kevin Matthews reads letter from Alysa Chase dated January 8, 2025 Jack Kay reads letter from Ali Guest dated January 13, 2025 Anastaci Pacella r ead letter from Abby Faye Smith dated January 14, 2025 Chair Cheryl Powell has contacted Mass Code of Ethics Commission and confirmed that she is ok to speak/hear this matter. Chair Cheryl Powell reads into record the Commission ’s Purpose - Chapter 112-24, Article III ordinance. Chair Cheryl Powell, we have had several complaints. Per agreement of the conditions , there are twelve conditions – Conditions read in: Community Art Wall shall be constructed with wood panels, excess material stored, shall monitor and maintain, BID has agreed to --- Reads in the numbered section of the Decision. Cordial Eye shall monitor, no explicit content, no advertising of any kind. Kevin Matthews refers to the correspondence from Bruce Stepanek - wish there was maybe two more lights in the area. Landscaping – brush in the area. White wash walls and start clean? Mary George, yes, had an artist do this. Sometimes someone will come with a roller and make clean. Kevin, QR code, good thing to put up for all. As a lear ning mechanism, as to why here. All twelve of the conditions read, none have been broken, no problem extending until the library renovations made. Chair Cheryl Powell – complaints. Concerns about the location. This is on a public building. Directly outside and near the children’s section. Appropriate location and monitored. Want to make sure family friendly. Things may get overlooked. There was an item/wording and with four other complaints. People worried about taking their children there. Chair Cheryl Powell passes around her phone, which has a picture that was sent and thought it was explicit. 4 Mary George it looks like an abstract four letter word. We work on a daily basis with the library. Chair Cheryl Powell it started in October. Mary George, she isn’t aware of this. Chair Cheryl Powell likes the 6 month reviews and then can keep a monitor on the wall. Mary George, we are there daily to review. Would request that anyone let us know immediately. If notified we could have cov ered up immediately. Chair Cheryl Powell asks, what is the procedure for monitoring? Mary George, we do a walkway/walk by at least 3 times a week and we have multiple eyes on the walls/panels. Chair Cheryl Powell would not want to wait until the end of the library building renovations are done. Peri Wentworth agrees with keeping a review in place and not leaving until the renovations. Maybe another set of eyes to look at. And appropriate. Laura Cronin, this is too large for the space. Would like to see not extended and propose that removed and moved to a different location. Very large and should be placed somewhere else. This has been there for over a year. Mary George this wall has been up for two years, this is the only complaint. Chair Cheryl Powell opens up public comment. None. Chair Cheryl Powell is ok to continue on condition that this is rectified. Would not feel comfortable to make until the natural end of the library/renovations. We don’t know when that will happen. Good with every six months for review. Kevin Matthews, fine with keeping and with the twelve conditions. Peri Wentworth, the six month review makes all feel comfortable and keep going. Jack Kay, suggests the art barn/Guyer Barn, this may be a good location. Anastaci Pacella, this is a historic asset/feature and more difficult to use and fix on the barn. Chair Cheryl Powell, restructuring of library could address placement/another spot. Laura Cronin, this is too large for this area and for the district. Matt Clark, will abstain from this vote. Tired of rehashing this matter. Chair Cheryl Powell closes public comment. Jim Kupfer, condition – continued complaints may require the Cordial Eye to come in. If motion made to extend, know that this is a condition and can change this, i..e., no specific number or intermediate remedies or notify staff or reach out to C ordial Eye. Possibly, i.e., two complaints requires further review. Corey Pacheco, thinks regulating has been content neutral and appropriate, no changes there. Chair Cheryl Powell makes a motion to not withdraw the Certificate of Appropriateness that was issued previously and continue, that will be addressed and monitored on a daily basis and the inappropriate item removed and modify condition one to reflect the extension dates to six months from now to come back for review, seconded by Kevin Matthews, Roll Call Vote: Peri Wentworth - aye Jack Kay - aye Jennifer Hinckley Needham - abstain 5 Matt Clark - abstain Kevin Matthews - aye Laura - nay Cheryl Powell - aye Discussion Item Jim Kupfer, regulations and guidelines now – for windows, vinyl may be considered, wood is recommended. Wood in regulations and vinyl in guidelines. Guidelines act two fold, HHDC has strict standards for regulations. They can be waived by this Commission, can move to guidelines as opposed to regulations – this is at the discretion of the Commission. Not prohibited and can use at discretion. Cape Cod character, maybe should be stated different. Revisit annually and having a meeting with anything that was highlighted and can be addressed. Jack Kay, wood is almost impossible to get, a lot of synthetic now because wood is expensive and less available. Can’t get e xotic wood at all. May be forced to be more understanding for other materials. The industry can’t find it. Cannot buy wood shutt ers any longer, at all. Jim Kupfer, need to have option to consider other materials. Jim Kupfer, did speak with Town Attorney, regarding moratorium, working with Sarah Korjeff. Public art and architecture. Will come at next meeting or meeting following to start having discussion.
