Dear Ms. Karle:
This letter, completed Form R, and attached supporting documentation requests Commission approval of a
minor plan revision to the above-referenced Order of Conditions to include installation of a free-standing
sculptural “Corten Steel” wall in the outer 50 feet of the 100-foot buffer zone at the subject property. The wall
is comprised of three (3) curved sections proposed within landscaped portions of the front yard, two of which
are located on the upland side of the existing site driveway including a small portion outside of jurisdiction.
The proposed location of the wall in relation to the Cabana Patio (SE3-6134) work is shown on the attached
Project Locus - Figure 1 and a copy of the Order of Conditions is attached. Landscape architect renderings of
the wall are attached, and the wall has been staked in the field in case the Commission or its staff conduct a
site visit.
We are requesting the plan revision to reduce the number of outstanding Orders of Conditions at the subject
property and since the work is relatively limited in scale. Additionally, the wall is located within areas of
improved landscape, completely outside the 0-50’ buffer zone, and separated from the resource area by a
large swath of woods resulting in virtually no risk of impact to the resource area. The following more
specifically describes the work which is shown on the attached Corten Wall Site Plan – Figure 2.
Resource Area Boundary: Resource area boundaries are taken from the prior Notice of Intent submittal for
the Driveway Gates (SE3-5396) which encompassed the same general work area. A copy of our 2022
request for certificate of compliance for that project is attached for reference.
Work: The work includes (1) excavating a 4’(W) x 4’(D) trench to construct the wall’s concrete footing, (2)
erection of prefabricated wall sections, and (3) surface repairs and finish landscape improvements. The
footing will be constructed using a backhoe or small excavator and excavated material will be removed
immediately from the site. Wall panels will be delivered to the site by truck and erected with a mobile crane
staged from the driveway. All surfaces will be returned to their original condition or otherwise landscaped as
indicated on Figure 2 following installation of the sculpture wall and any areas disturbed during construction
will be repaired immediately.
Schedule: We anticipate installation of the foundation and wall sculpture will take approximately 15-20 days
after which all materials and equipment will be removed and any areas disturbed during installation will be
repaired immediately.
Erosion Controls: A row of 12” compost filter tube will be installed as shown on the attached plan to ensure
any erosion or sediment is contained and to otherwise define the limit of work (excluding groundcover

planting). Potential for erosion or sedimentation is extremely limited given excavated material will be removed
immediately and runoff in the vicinity of the work will be captured within the footing trench. Erosion controls
will remain in place until the sculpture wall is installed, and all related repair work is complete. Materials
required for the construction will be staged within the paved parking area immediately east of the work area.
The parking area is bounded by a stone wall ensuring no materials or unintended activity will extend beyond
the staging area. Any equipment or material not fitting within the parking area will be stored at the adjoining
Rushy Marsh Farm property outside of jurisdiction and moved to the project site when needed or when
adequate space is available in the staging area. The parking/staging area is shown on Figure 1. Proposed
sedimentation and erosion controls are shown on the attached Corten Wall Erosion Control Plan – Figure 3.
Mitigation: The work will result in less than 20 square feet of new impervious surface (1” wall) within the 50-
100’ wetland buffer requiring 60 sf of mitigation planting (3:1 ratio) per requirements of the Town of Barnstable
Wetlands Protection Bylaw (Ch. 237). The proposed work includes conversion of more than 2,000 sf of lawn
or otherwise sparsely vegetated ground to a dense ivy ground cover which more than offsets the 20 square-
foot impact. The approximate limits of the proposed ivy groundcover are shown on Figure 2.
Enclosed is a completed Form R, supporting documentation (including two (2) stamped original Figures 1-3),
a check in the amount of $50 and eight (8) collated copies of the request. We would appreciate being added
