Centerville that is on the agenda for the 2/11/25 Conservation Commission meeting.

My name is Stuart Woodring and, along with my wife, I have owned 39 Hornbeam
Lane, Centerville since 2001. We are abutters to 531 South Main Street and have a
legally-deeded Right of Way from our property to South Main Street along the
southwest property line of 531 South Main Street. The Right of Way is at least 25’
wide throughout and totals +/-18,850 square feet as shown on the Site Plans
prepared by John O’Dea of Sullivan Engineering. We have never surrendered our
interest in the Right of Way.
The extensive project at 531 South Main Street was approved by the Conservation
Commission in 2021 and the original Site Plan that was referenced in the Order of
Conditions (prepared by John O’Dea of Sullivan Engineering) showed absolutely no
changes to the grade of the land at the south/southwest end of the property, including
the land of my Right of Way. However, this Site Plan did show grade changes on
other parts of the property.
In the course of the project, the grade of the land at the south/southwest end of 531
South Main Street was significantly altered in ways not approved in the Order of
Conditions. Most or all of these unapproved alterations in the grade of the land are
within the 50’ Buffer and much of the land that was raised and extended toward the
Centerville River invade my Right of Way. The Revised Site Plan that is being
considered at the 2/11/25 Conservation Commission meeting shows that the grade
was raised by more that 3’ in some areas and extends roughly 10’ into some portions
of my Right of Way. The net effect of these unapproved alterations make my Right of
Way impassable to vehicular traffic. I was never asked and I did not give permission
to the owner of 531 South Main Street to make these changes that negatively impact
my Right of Way to South Main Street.
I will also forward an email that I sent to Darcy Karle and Ed Hoopes at the
Conservation Commission on 11/21/24. This email includes “before” and “after”
pictures taken from a number of perspectives that illustrate the significant unapproved
changes to the grade of the land on the south/southwest portion of 531 South Main
Street and how these changes drastically impact my Right of Way. After Darcy and Ed
received my email, the Request for a Certificate of Compliance by the owner of 531
South Main Street was put on “Hold”. This is why John O’Dea of Sullivan Engineering
was asked by Ed Hoopes to create the Revised Site Plan that shows the actual
current conditions of the south/southwest portion of 531 South Main Street.
I respectfully ask that the request to approve the Revised Site Plan be denied and
that the owner of 531 South Main Street be required to return the grade of the
south/southwest portion of the property - especially my Right of Way - to its original
condition. Additionally, I request that the Conservation Commission require the owner
of 531 South Main Street to relocate the “Proposed Replacement Tree 6’ Cedar or
Other” to a location at least 10' outside of my Right of Way, instead of in my Right of
Way as indicated on the Site Plans.
