Box 243 West Barnstable, MA 02668 www.westbarnstable.org westbarnstablecivic@gmail.com Friday, February 7, 2025 Chairman Jacob Dewey Town of Barnstable Zoning Board of Appeals Re: Appeal 2024-044 Dear Chairman Dewey, We are in agreement with the Building Commissioner’s assertion in his Notice of Zoning Violation(s) and Order to Cease, Desist and Abate, dated August 25, 2022, that the auto body shop at 970 Main Street has expanded in scope, size and volume. Richard Sundelin has made an application for a Special Permit to codify this expansion. We are opposed to the expansion of this pre- existing, non-conforming use. On behalf of the West Barnstable Civic Association Board of Directors, we urge you to limit the expansion of operations by setting a firm number of vehicles permitted and by reducing the days and hours of operations. We have concerns regarding the impact an expansion would have on: • the Historic character of the neighborhood • traffic safety along Route 6A • drainage of surface water coming from the auto body shop • the impact to private wells and watershed • fire safety • the overburden of property • the spill-over onto the abutting property • air emissions from the increased use of paint spray West Barnstable is a community served by private wells. We are opposed to the expansion of a business that has the potential to negatively affect our groundwater. Our village business district is largely in residential or mixed use. We do not believe that a business that produces the emission of odor, fumes, dust, or noise should be allowed to expand. The Town's regulations for an expansion of a pre-existing, nonconforming use (240-94 paragraph B) state that the proposed expansion/intensification should not be more detrimental to the neighborhood. It's important that we get it right for our village center. Sincerely Ed Jay WBCA President
