PROJECT NARRATIVE
EXISTING CONDITIONS
The project site consists of a single parcel located at 353 Ocean Street, identified on the
Town of Barnstable’s Assessors Tax Maps as Map 325 Parcel 15. The project site is
comprised of a .20± acre parcel and is currently developed with a single-family home
and detached garage. The current home requires major restoration due to neglect from
the previous owner. In lieu of demolition the applicant is pursuing restoration of the entire
home with exterior and interior improvements. A portion of the work proposed is located
at 337 Ocean Street, identified on the Town of Barnstable’s Assessors Tax Maps as Map
325 Parcel 17.
PROPOSED PROJECT
This Notice of Intent (NOI) is required because there are proposed additions including a
front porch, a three-season porch, and patio within the buffer zone to the top of a coastal
bank.
The project proposes a total of 445 Square Feet (S.F.) of disturbance within the buffer zone
to the top of the coastal bank. 21 square feet of disturbance is located within the 0–50-
foot buffer zone and we are requesting a waiver for these activities (see page 12 of this
application for details). The first phase of the project will be to construct a 204 (S.F.) three-
season porch attached to the rear façade of the house, as well as a 114 S.F. patio
containing steps and an outdoor shower. The outdoor shower will include a dry well for
subsurface drainage. The proposed patio will either be a natural bluestone, or concrete
paver and will be dry laid as opposed to mortar to allow for water absorption. Following
the construction of the porch, a set of stairs leading to a bluestone stepper walkway is
proposed to connect the new addition to the existing driveway. Lastly, a 115 square-foot
front porch will be added to the front of the home, 62 Square Feet of which is located at
the furthest point of the 100-foot buffer zone.
In addition to the proposed work, an existing stone walkway, steps, and patio will be
removed prior to the work being completed. The removal of the hardscape is shown on
the mitigation planting plan.
Additionally, the project proposes 2,324 Square Feet of invasive species removal within
and beyond the top of the coastal bank (no removals are proposed within the B.V.W.).
Included in the invasive species removal is one large Norway Maple (Acer platanoides)
that will be cut, and the stump will remain. A supplemental native Red Maple will be
installed for mitigation. The invasive species management area is predominantly
Japanese Knotweed (Reynoutria japonica) but additional invasive species include
Oriental Bittersweet (Celastrus orbiclatus), Multiflora rose (Rosa multiflora), and Bush
Honeysuckle (Lonicrea tatarica).

Following removals 2,922 Square Feet of Mitigation plantings will be installed in the form
of woodland shrub planting within the coastal bank, and a Native Flowering Meadow
area within the 50-foot buffer zone. These plantings will vastly increase the biodiversity of
the site and increase the ecological function of the Naturally Vegetated Buffer Strip.
Approximately 841 Square Feet of removals and plantings will be completed on the
property located at 337 Ocean Street in Hyannis. A signed agreement was submitted as
part of this application, as well as the state permit including this site as the project
location.
Mitigation plantings were calculated using the “Town of Barnstable Chapter 704
regulation governing activity in the 100-foot buffer zone under Notice of Intent
Applications”. (See Conservation Mitigation Plan for Details). Section 7-4-3 outlines the
performance standards for working in the buffer zone. The proposed project meets all
these performance standards. The mitigation plantings will be planted by using ELS’s
recommended spacing requirements for mitigation plantings including 4 ft O.C for larger
shrubs, and 2 ft. O.C. for perennials. During the invasive species removal phase, a native
grass seed mix will be established over the entire proposed mitigation area, and erosion
control measures may be installed where necessary.
The plant list on the next page demonstrates the native plantings that will be completed
to mitigate the disturbance within the BVW. The plant list is labeled by the planting areas
that correspond to the attached “Conservation Mitigation Plan” located in section 5.0 of
this Notice of Intent.
The plant list outlines the restoration of native shrubland and pollinator habitat. This plant
list will greatly contribute to the biodiversity of the site and is designed to mimic planting
patterns in nature. This plant list and planting will contain many hard-to-find native species
and will vastly improve the site’s ecological value over existing conditions.

INVASIVE SPECIES REMOVAL METHODOLOGY
ELS proposes a foliar treatment, combined with mechanical removal and stump
treatment as the most appropriate means of achieving full eradication. The first phase of
removals is an herbicide application of a wetland-approved formula of aminopyralid
(Milestone®) mixed with a natural-organic (OMRI-approved) pine oil surfactant
(spreader-sticker) also approved for use in wetlands (Cide-Kick II). These formulas are
then carefully applied to the weeds or invasives when in bloom, using backpack sprayers
and a directed application to foliage only. Before treatment, the Knotweed stalks will be
tied using a bio-gradable jute rope to limit the risk of drift and will be applied directly to
the bunches of vegetation. All foliar applications will be completed by a licensed
herbicide applicator.
No foliar applications will be done when winds exceed five to six miles per hour. There is
no impact to the adjacent vegetation or impact on the surrounding native vegetation
by use of this method of treatment.
The second phase of removal is the mechanical removal of the treated material. ELS
proposes the removal of all treated vegetation by flush-cutting the material and leaving
the existing root structure to minimize erosion throughout the project timeline. The first
phase of vegetation removal will be completed with hand sheers, and hedge trimmers,
as will be disposed of off-site at an appropriate recycling facility. Once the treated
vegetation is removed ELS staff will complete either stem injection or painting of the
treatment material (Pathfinder II®) directly to the exposed shoots. This phase will allow for
a secondary application to target the root system of the plants while allowing for a 100%
concentration of herbicide uptake in the removal process.
Only one foliar application is proposed as part of this application. Should an additional
foliar application be needed, we will contact the conservation department to schedule
a site meeting to explain why this is necessary and receive approval. Following the foliar
application, stump treatment alone will be used to control emerging invasive plant
material.
The next page outlines the Invasive Species Management schedule over the next 3 years.

INVASIVE SPECIES MANAGEMENT PLAN
ELS proposes the following schedule for the next 2 to 3 years as part of the restoration of
the site. Should additional treatment for the invasives be required beyond three years the
applicant will request an extension as part of their Order of Conditions.
Spring 2025 – Site assessment and meeting with the client and Conservation Agent before
invasive species removal
Late Summer 2025 – Foliar treatment of invasive plant material within the work limit
Late Summer 2025 – Removal of treated vegetation and stump treatment of invasive
plant material within work limit (roots to remain for bank stability)
Fall 2025 – Follow up stump treatment and installation of seed mix for erosion control
Spring 2026 – Site assessment and stump treatment of vegetation within the work limit
Summer 2026 – Site assessment and stump treatment of vegetation within the work limit
Fall 2026 – Site assessment and possible mitigation plantings based on removal efficacy
Spring 2027 – Site assessment and stump treatment of vegetation within the work limit
Summer 2027 – Site assessment and stump treatment of vegetation within the work limit
Fall 2027 – Final removal of any remaining invasive vegetation and installation of all
mitigation plantings outlined on the approved plan
In summary, the herbicide applications will be completed in spring and late summer
and notice will be given to the conservation department prior to any application
being completed. All applications will be completed by a licensed applicator and will
have no adverse effect on surrounding native vegetation.

ENVIRONMENTAL DUE DILIGENCE & PERFORMANCE STANDARDS
10.30 COASTAL BANK
The top of the coastal bank was delineated on Thursday, February 13, 2025, by
Environmental Landscape Solutions LLC. The bank was calculated by referring to the
Town of Barnstable Regulation – Chapter 706 “Coastal Bank Definition & Delineation
Policy. When calculating the slope, it was determined that throughout the area defined
as the bank, the slope was greater than 18%. The areas in which the slope was not greater
than 18% determined the location of the top of coastal bank. The bank was delineated
and staked in the field with white flags labeled “Bank”. Once the top of bank was
delineated it was surveyed in the field and labeled on both the “Plot Plan, and
Conservation Mitigation Plan” respectively.
Below are the performance standards as laid out in the most current version of the
Massachusetts Wetlands Protection Act. This project meets all performance standards
and a clear explanation of each is included as part of this application.
(3) No new bulkhead, revetment, seawall, groin or other coastal engineering
structure shall be permitted on such a coastal bank except that such a coastal
engineering structure shall be permitted when required to prevent storm
damage to buildings constructed prior to the effective date of 310 CMR 10.21
through 10.37 or constructed pursuant to a Notice of Intent filed prior to the
effective date of 310 CMR 10.21 through 10.37 (August 10, 1978), including
reconstructions of such buildings subsequent to the effective date of 310 CMR
10.21 through 10.37, provided that the following requirements are met: …
Not applicable to this project, no such structures are proposed.
(4) Any project on a coastal bank or within 100 feet landward of the top of a
coastal bank, other than a structure permitted by 310 CMR 10.30(3), shall not
have an adverse effect due to wave action on the movement of sediment
from the coastal bank to coastal beaches or land subject to tidal action.
Not applicable to this project, the coastal bank is surrounded by a bordering
vegetated wetland that is not subject to wave action.
(5) The Order of Conditions and the Certificate of Compliance for any new
building within 100 feet landward of the top of a coastal bank permitted by
the issuing authority under M.G.L. c. 131, § 40 shall contain the specific
condition: 310 CMR 10.30(3), promulgated under M.G.L. c. 131, § 40, requires
that no coastal engineering structure, such as a bulkhead, revetment, or

seawall shall be permitted on an eroding bank at any time in the future to
protect the project allowed by this Order of Conditions.
Not applicable to this project, no coastal engineering structures are proposed as part
of this application.
(6) Any project on such a coastal bank or within 100 feet landward of the top
of such coastal bank shall have no adverse effects on the stability of the
coastal bank.
Not applicable to this project, the proposed area of removal of invasive species within
the bank will be mitigated following removals. The native plant material will have
maximum coverage and enhance the stability of the bank with deep rooted native plant
material typical of this environment.
(7) Bulkheads, revetments, seawalls, groins or other coastal engineering
structures may be permitted….
Not applicable to this project; no such structures are proposed.
(8) Notwithstanding the provisions of 310 CMR 10.30(3) through (7), no project
may be permitted which will have any adverse effect on specified habitat sites
of rare vertebrate or invertebrate species….
Not applicable to this project; No Endangered Species Identified on Site, see Exhibit #5
for details.
10.55 BORDERING VEGETATED WETLANDS
The Bordering Vegetated Wetland was delineated on February 13, 2025, by
Environmental Landscape Solutions LLC. The BVW was calculated by referring to
“Massachusetts Delineating Bordering Vegetated Wetlands Manual” revised September
2022, by soil sampling and identifying wetland indicator plants on site. The B.V.W. is
comprised of both native and non-native wetland vegetation, an on-site soil sample
indicated soil characteristics of wetland soil hydrology within the wetland flags located
on site. Both wetland indicator plants and soil hydrology were used to determine the
B.V.W. The B.V.W is outlined on the “Conservation Mitigation Plan” as well as the 50- and
100-foot buffers respectively.
We contend that this project meets all the applicable Performance Standards, as we
discuss below:

See the Commonwealth of Massachusetts, WPA: 310 CMR 10.55; and the Town of
Barnstable Wetlands Protection Regulations, Section 704-3 “PERFORMANCE
STANDARDS FOR PROJECTS REQUIRING A NOTICE OF INTENT”
For the WPA, the following Performance Standards apply:
“(a) Where the presumption set forth in 310 CMR 10.55(3) is not overcome, any
proposed work in a Bordering Vegetated Wetland shall not destroy or
otherwise impair any portion of said area.”
Not applicable no work is proposed within the BVW
“(b) Notwithstanding the provisions of 310 CMR 10.55(4)(a), the issuing authority
may issue an Order of Conditions permitting work which results in the loss of up
to 5000 square feet of Bordering Vegetated Wetland when said area is
replaced in accordance with the following general conditions and any
additional, specific conditions the issuing authority deems necessary to ensure
that the replacement area will function in a manner similar to the area that will
be lost:….“
Not applicable to this project—no loss of wetlands is proposed, see
attached “Conservation Mitigation Plan”.
“(c) Notwithstanding the provisions of 310 CMR 10.55(4)(a), the issuing authority
may issue an Order of Conditions permitting work which results in the loss of a
portion of Bordering Vegetated Wetland when:….”
Not applicable to this project, no loss of wetlands is proposed.
“(d) Notwithstanding the provisions of 310 CMR 10.55(4)(a),(b) and (c), no
project may be permitted which will have any adverse effect on specified
habitat sites of rare vertebrate or invertebrate species, as identified by
procedures established under 310 CMR 10.59.”
Not applicable to this project: the site is not located within an area that
has been mapped by the Massachusetts NHESP as “Estimated Habitat of
Rare Wetlands Wildlife”, nor is it located within “Priority Habitat”. SEE Exhibit
# 5.

“(e) Any proposed work shall not destroy or otherwise impair any portion of a
Bordering Vegetated Wetland that is within an Area of Critical Environmental
Concern designated by the Secretary of Environmental Affairs under M.G.L. c.
21A, § 2(7) and 301 CMR 12.00….”
Not applicable to this project; this site is not within a designated ACEC. SEE

704-3 PERFORMANCE STANDARDS FOR PROJECTS REQUIRING A NOTICE OF INTENT
For the Barnstable Wetland Protection Regulations see section 704-3 “PERFORMANCE
STANDARDS FOR PROJECTS REQUIRING A NOTICE OF INTENT”:
“(A) A 50 ft undisturbed buffer zone shall be retained between the landward-most
wetland resource areas and the limit of proposed site disturbance.”
The area of proposed disturbance is comprised of entirely lawn area
meeting to the edge of proposed clearing of invasive species. The
proposed project intends to remove 55 Square Feet of previously installed
hardscape. 21 Square Feet of disturbance is proposed within the 50-foot
buffer zone. The closest point of disturbance is 47.8 feet from the top of the
coastal bank. The proposed mitigation improves runoff absorption to the
wetland and increases wildlife habitat within the 50-foot buffer zone. We
are requesting a waiver under Barnstable Chapter 704, 704-4 “Required
Waiver of Performance standards for projects proposed in the fifty-foot
buffer.” for this portion of work.
“(B) WHERE A 50 FT UNDISTURBED BUFFER ZONE, as measured in accordance with
704-2A, EXISTS prior to the proposed work and is proposed to remain intact,
proposed work within the 50 to 100 ft. buffer zone shall not require further buffer
zone enhancement.”
The areas of proposed work are completely within an existing lawn area
and no removal of native vegetation is proposed in these areas. All areas
of proposed invasive species removal within the 50-foot buffer zone are
proposed for mitigation, and there is an increase in square footage of the
naturally vegetated buffer strip.

“(C) WHERE A 50 FT UNDISTURBED BUFFER ZONE, as measured in accordance with
704-2A, DOES NOT EXIST prior to the proposed work, any work proposed within the
100 ft. buffer zone shall be subject to mitigation planting requirements intended to
restore, in so far as possible, both the dimensions of a 50 ft undisturbed buffer and
its vegetation. For such work proposed within the 50-100 ft zone, the calculation of
mitigation is set forth in 704-3D.”
The existing 50-ft buffer zone is comprised of both invasive species and lawn
areas. The areas of proposed invasive species removal will have
appropriate mitigation following removals and there will be a reduction in
lawn area within the 50-foot buffer zone. The project will be mitigated to be
in accordance with 704-2A. The mitigation plan provided shows the
adherence to the mitigation requirements, see attached Conservation
Mitigation Plan”.
“(D) CALCULATION OF MITIGATION FOR WORK PROPOSED WITHIN THE 50 TO 100 FT
BUFFER – The amount of mitigation planting required for work proposed within the
50 to100 ft. buffer zone shall be determined by the following method: a. Calculate
area of proposed hardscape within the 50 to100 ft. buffer zone; b. Multiply the
area found in 704-3D(a) by 3 to obtain the area of required mitigation at a 3:1
planting to disturbance ratio. c. In no case shall the total area of mitigation
plantings required be greater than that which is necessary to restore a 50 ft.
undisturbed buffer in its entirety.”

“(E) LOCATION OF MITIGATION PLANTING - Mitigation planting location(s) shall
clearly be shown on the site plan. The plan shall also provide area calculations for
the amount of mitigation planting herein required, and the amount of mitigation
planting proposed.”
Not applicable the mitigation plan provided shows the adherence to the
mitigation requirements, and labels all required and proposed mitigation
plantings, see attached Conservation Mitigation Plan”.
“(F) BEST PRACTICES (1) The Conservation Commission shall exercise a preference
for pervious surface types of hardscape. (2) Where possible and practical,
proposed hardscape within the 50 to 100 ft. buffer zone shall be located no closer
than 10 ft from the landward limit of the 50 ft buffer zone, so that attendant
construction, landscaping and maintenance activities may proceed without
impact to the 50 ft buffer zone.”
Not applicable, no hardscaping is proposed within 10 ft landward from the
resource area and proper mitigation has been proposed. The proposed
materials are located in the “Project Narrative”.

NHESP PRIORITY HABITAT
A review of the latest Massachusetts Natural Heritage Atlas; 14th Edition, reveals that
there are no Priority Habitats on-site or directly adjacent to the site. A copy of the Natural
Heritage and Endangered Species Program (NHESP) mapping is included in Section 2.0
of this application.
FEMA FLOODPLAIN
The latest Federal Emergency Management Agency (FEMA) Flood Insurance Rate Map
(FIRM) panel number 25001C0569J, effective 07/16/2014, was reviewed and it was
determined that the site is located within the 100-year floodplain “Zone AE”.
CONCLUSION
This Notice of Intent to the Town of Barnstable displays how the proposed project will
vastly increase the biodiversity within the property as well as remove an extensive area
of invasive species while limiting all disturbance during construction. We believe this
project is an improvement over the existing conditions.
