February 2025 Page 1 CHAPTER 707 Regulation Governing Minimum Submission Requirements for a Notice of Intent Application The Barnstable Conservation Commission has adopted the following requirements in order to obtain more consistently complete submission documents necessary for a thorough and efficient review of all Notice of Intent (NOI) applications. Failure to complete any of the items in this checklist may result in your application being denied. Applicant or applicant’s agent should check each box denoting that the task has been completed or in certain instances, like field staking, denoting that the task will be completed. The following submission checklist covers the requirements of Chapter 237, Wetlands Protection, of the Part I General Ordinances of the Code of the Town of Barnstable. This checklist shall be submitted to the Barnstable Conservation Division with the NOI application. 1. Requirements a. The applicant understands, unless they’ve instructed otherwise, they are applying both under the Massachusetts Wetlands Protection Act M.G.L. c.131,§40 and Chapter 237 of the Town of Barnstable General Ordinances. b. Attach a written narrative to the NOI application (WPA Form 3), available at: www.mass.gov/eea/agencies/massdep/service/approvals/wpa-form-3.html describing any project impacts and proposed mitigation as they relate to the following: 1) Any of the interests of Chapter 237 of the General Ordinances and the MassDEP Wetlands Protection Act M.G.L. 131, §40. 2) The performance standards contained in the MassDEP Wetlands Protection Regulations (310 CMR 10.00) 3) Chapter 704: Regulation Governing Activity in the 100-ft. Buffer Zone. 4) Chapter 703: Private Docks and Piers. 5) Any other applicable regulations (310 CMR 10.00 or as promulgated under Chapter 237 of the General Ordinances). c. Enclose proper payment to cover the fee for Chapter 237 filings. Consult current Fee Schedule at www.townofbarnstable.us/Conservation d. Contact the Conservation Division office at (508) 862-4093 regarding the docketing process, or see current schedule of Conservation Hearings and submission deadlines at: www.townofbarnstable.us/Conservation/ b. Provide a copy of the list of abutters within a 100 ft radius of the project parcel. c. Provide a copy of the Assessor’s Map indicating the parcel of the project site and showing the 100 ft radius of the project parcel. d. Provide a copy of the abutter notification letter. Use the form letter provided in our Abutter Notification Regulation (Chapter 706), available on the Conservation Division website. e. Email copies of the green return receipts, from the certified mailings to the abutters, as proof of notification . If any mailings are returned, email a copy of the entire envelope, indicating by postal service stamp the reason for return. You will retain the receipts afterwards, not the Conservation Division. f. I further certify under the penalties of perjury that all abutters were notified of the Notice of Intent Application, pursuant to the requirements of Chapter 237 of the General Ordinances of the Code of the Town of Barnstable. Notice must be made in writing by certified mail to all abutters within 100 ft of the property line of the project location. _______________________________________ Signature of Applicant or Representative Date 3. Field Staking: a. On or before Tuesday, @ 8:30 a.m., one week prior to the scheduled public hearing, have your project staked by a professional engineer or registered land surveyor showing all outside corners of all proposed structures and the continuous proposed “limit of work” line. b. Have a wetland scientist or other qualified professional flag all wetland resource areas on or within 100 ft of the work area. Make sure that the flags are sequentially numbered. c. Provide a project identification stake with bright painted top and applicant name and address, easily visible from the street approaching the site. 4. Legal Advertisement Fees: a. Conservation will submit the legal ad for publication in a local newspaper. The applicant or his/her agent is responsible for payment, by check (payable to the Town of Barnstable), at the hearing or by mail. The cost of the legal ad will be pre-calculated and posted on the hearing agenda prior to the hearing. 5. Minimum Documentation for a Complete Application: a. Provide a completely filled-out (in all parts) NOI application as locally adopted for the Town of Barnstable, including MassDEP Vegetated Wetland Field Data Form. Indicate Assessor’s map and parcel of the project, as well as the street or road address, and pertinent village (i.e., Hyannis, Centerville, Barnstable, etc). b. Provide two (2) original project plans, stamped in blue or red ink (wet stamp). Plans must be signed and dated by a Massachusetts licensed, professional engineer, land surveyor, architect or landscape architect (as applicable), and shall be drawn at a readable scale (1" = 20' preferred). For multi-acre sites, a second site plan, drawn at larger scale showing the entire site, should also be provided. 2/25/25 Chap 707/rev. February 2025 Page 3 c. Provide a signed Permission to Access Property, Form PA. The form must be signed by the property Owner, or legal representative and submitted with the NOI. . Form PA is available at www.townofbarnstable.us/Conservation/. d. For projects requiring mitigation plantings under Chapter 704 -3, 704-4, and 704-5, mitigation planting location(s) shall clearly be shown on landscaping planting plan. The planting plan shall include: 1. species (chosen from the Town of Barnstable Conservation Commission approved planting lists), sizes, densities and/or quantities. 2. area calculations in 0’ - 50’ and 50’ – 100’ separately for the amount of mitigation planting required. 3. the amount of mitigation planting proposed. 4. a note or indication stating the area between the proposed plants will either be planted with an appropriate native seed mix or left to naturalize. 5. a note stating mulch may only be used under the dripline of proposed plants. 6. demarcation markers along the landward side of the mitigation planting area. The type of demarcation marker shall be selected from the list approved by the Conservation Commission. e. Provide detailed, written street directions to the locus (site). f. Provide a copy of a U.S.G.S. locus map indicating the general area of the project site. g. Provide a check for the Town of Barnstable portion of the required filing fee. (The portion payable to the Commonwealth, see 7. e. below) h. Provide any other documentation, photographs, architectural renderings or other supporting data prepared by professionals competent in the field which may be relevant to the application. 6. The site plan shall also show: a. All existing and proposed contours at 2-ft. minimum intervals (1-ft. preferred). b. Clear delineation of all existing and proposed structures and features. Building structures must be accurately dimensioned (fixed location) from property lines and wetland resource areas. Plans shall provide sufficient detail to show all potential wetland impacts, mitigation, compensatory areas, engineered structures, utilities, landscaping, etc. within the area of jurisdiction. On complicated sites, existing and proposed conditions must be shown on separate sheets. c. Locus inset map of the site clearly showing its location relative to surrounding public streets. d. All wetland resource area flags by individual flag number (matched to the field) to clearly identify all resource areas on or within 100 feet of the work area. The individual who performed the flagging and date of flagging shall be identified on the plan next to the resource line. e. Section views showing changes in grade, cuts and fills. 7. SUBMISSION OF THE COMPLETED APPLICATION WITH PLANS: a. Email NOI application and all associated materials in PDF format to Kimberly.Cavanaugh@town.barnstable.ma.us AND Edwin.Hoopes@town.barnstable.ma.us Do not include copies of checks. All attachments must be named with the hearing date (year first), type, name, address. Examples 20220301 NOI Smith 21 Main Street or 2022031 NOI Plan Smith 21 Main Street. c. Provide two (2) full NOI applications with folded plans (colored ink stamp) with signature/date to the Town of Barnstable Conservation Division Office for administrative use; Chap 707/rev. Provide seven (7) additional collated copies of the NOI (with folded plans and all pertinent data attached) to the Barnstable Conservation Division Office for distribution to, and review by, Conservation Commission members. Any supplementary documentation for administrative and commission review should be submitted as soon as possible prior to the scheduled public hearing.* e. Mail one (1) copy of the complete NOI with plan(s) to the Massachusetts Department of Environmental Protection (MassDEP) Southeast Regional Office, 20 Riverside Dr., Lakeville, MA 02347. Send MassDEP portion of filing fee to: MA Department of Environmental Protection, Box 4062, Boston, MA 02211. MassDEP also recommends applicants send their Notices of Intent by email to SERO_NOI@mass.gov. f. For roadway construction or repair projects, provid e one electronic copy of the NOI and plans to the Senior Project Manager Special Projects, c/o the Town of Barnstable Department of Public Works, 382 Falmouth Road, Hyannis, MA 02601. g. For coastal piers, dredging, coastal engineering structures or other coastal erosion control projects, provide two hard copies of the NOI and plans to the Shellfish Biologist, c/o Town of Barnstable Natural Resources, 1189 Phinney’s Ln., Centerville, MA 02632. In addition, email a (PDF) version to: 1) shellfishNOI@town.barnstable.ma.us. (Email must be sent the same day as submission to the Conservation Division); and 2) conservationprojects@town.barnstable.ma.us h. Also, for coastal piers, dredging, coastal engineering structures, provide two hard copies of the NOI and plans to the Harbormaster, c/o Town of Barnstable Marine and Environmental Affairs (MEA), 1189 Phinney’s Ln., Centerville, MA 02632. The wetland resources at the site are Land Under Ocean, Coastal Beach, Coastal Bank, and Land Subject To Coastal Storm Flowage. A dwelling was moved to the property in the 1950’s and remained within the larger family estate until 2019 when this parcel was sold. Existing Stairs were approved by the Commission under SE3-5017. In 2021 Order of Conditions were issued for a Landscape Management and Restoration Plan, and to demolish the existing dwelling and redevelop the site. The dwelling was demolished, but redevelopment never commenced. The Orders have been extended and will expire in 2027. The property was purchased by the applicant in November 2024. The Existing Conditions narrative of the site in the 2021 files described the Coastal Bank as “showing signs of erosion, and slumping, but looks to be stable and this time”. The description further noted that the “in the future that (the Coastal Bank) may need to be addressed in order to protect both the stairway and the Coastal Bank”. The condition of the Coastal Bank has deteriorated significantly since. The toe of the bank has eroded, the face has multiple break lines, and trees are falling further threatening what little stability remains. The Bank along the adjacent properties is similarly deteriorating. The current owner is prioritizing addressing the stability of the Coastal Bank. The project as proposed will include grading and vegetation restoration and construction of a vinyl bulkhead to stabilize the failing Coastal Bank, and replacement of the bank access stairs. The existing Bank slopes at 1:1 and steeper in the scarped and slumped areas. The soil consists of very lose sand. Given the soil conditions we believe that it would be very difficult to restore and maintain the Bank at this steep pitch. It is proposed to soften the slope of the bank to 2:1. A vinyl bulkhead, approximately 4.5’ high, is proposed along the toe of the Bank. A plateau is proposed above the bulkhead creating separation between the un-armored bank face and bulkhead overwash, with fiber rolls proposed to further protect this secondary toe. It is proposed to restore the vegetation on the bank. The proposed restoration of a native plant community on and along the Coastal Bank will enhance the functional capacity of the resource area by increasing native plant species biodiversity, improving wildlife habitat, filtering stormwater runoff pollution, and preventing erosion through Coastal Bank stabilization. The proposed native herbaceous species will provide nectar and pollen throughout the growing season, while offering a variety of bloom colors and plant heights to attract the greatest number and diversity of pollinators. The applicant would also propose to proactively restore an additional approximately 20’ wide band of buffer zone along the top of the Coastal Bank and would request the Commission allow this area to be used as provided Mitigation if required based on buffer zone calculations for revised or new re- development plans when they are established. We believe that establishing this buffer sooner than later – will serve to better protect the bank restoration efforts. The work will be performed from the land. The existing stairs and vegetation in the proposed regrading area will be removed. An excavator will be used from the top of the Bank to rough grade the softened slope, plateau, and create an access ramp for the proposed bulkhead construction. A smaller machine will be used for installation of the vinyl sheeting. A limit of work will be staked 20’ seaward of the proposed bulkhead to contain the access above the inter tidal zone. Upon completion of the bulkhead, the fiber rolls will be installed, and grading completed. Protection of the slope and revegetation will immediately follow and be performed per the Restoration Plan prepared by Wilkinson Ecological. New stairs will be installed by hand. 310 CMR 10.30 COASTAL BANK (3): Coastal Engineering Structures shall be permitted when required to prevent storm damage to buildings constructed prior to August 10, 1978, including reconstruction of such buildings. The proposed project has been designed and will be constructed to minimize adverse effects on adjacent or nearby Coastal Beaches due to changes in wave action. The proposed bulkhead will be located approximately 20’ above the intertidal zone, and will have no effect on typical tidal wave action. During moderate storm events which reach the toe of the bank, stones are proposed at the ends of the bulkhead to disperse any wave energy. The proposed top of bulkhead is set to elevation 8, approximately 4.5’ above the beach contour. This height generally corresponds to 10 year storm elevation. We believe this height will adequately protect the toe of the bank during these moderate events. During a major storm event we believe the plateau, fiber rolls, and significant vegetation restoration will protect the remainer of the bank from substantial damage, while being a softer solution from both energy and visual perspectives than further extending the wall height. Given the steepness of the bank, the current failures, the sediment composition, the location and orientation of the bank, we believe there is no practical alternative to protecting the bank and building site. 28 Lots Hollow Road | Orleans, MA 02653 WILKINSON ECOLOGICAL DESIGN Tel:(508)255-1113 | Fax:(508)255-9477 1 Existing Conditions The project site is a residential lot located along Cotuit Bay at 135 Putnam Ave in Cotuit. The proposal for the project includes a coastal adaptation strategy to stabilize and revegetate the Coastal Bank, native plant restoration, and invasive plant management. At present, the integrity of the Coastal Bank is threatened as existing mature trees fall and pull at the eroding bank, hastening its deterioration. The majority of the trees on and along the Coastal Bank are compromised as erosion exposes their root systems to tidal air and waters. Several trees are leaning or have already fallen and lay at the toe of the bank. The face of the Coastal Bank contains a minor infestation of State-listed invasive black locust (Robinia pseudoacacia) and non-native scotch broom (Cytisus scoparius). Black locust is a nitrogen-fixing, clonal tree that threatens native species because of its ability to form dense stands, which may displace native vegetation. Additionally, the soil enriching properties of this tree have the ability to facilitate the invasion of other non-native and aggressive species. Figure 1: Fallen oak along toe of Coastal Bank, exposed root systems of compromised upland trees Work Protocols for Fiber Roll Array Installation, Native Species Restoration & Invasive Plant Management 135 Putnam Ave, Cotuit February 19, 2025 2 Access and Installation of Fiber Rolls The installation of the fiber roll array will occur after the re-contouring of the bank and installation of the proposed bulkhead. Access for machines and materials will follow the same access route as the proposed bulkhead. Machines will be utilized to transport material to the access route and lowered to the work area along the toe of the bank. Staging for all equipment and materials will be located within the upland areas of 135 Putnam Ave, and ground protection mats will be utilized as needed to protect existing vegetation and soils from compaction. All equipment will be returned to the staging area prior to high tide or any astronomic tidal or storm event. The proposed approximately 202 linear foot fiber roll array will be composed of 3 rows of high-density fiber rolls with the seams between the rolls planted with American beach grass. Installation begins with the lowest fiber roll, and construction continues up the gradient to the specified height to comply with the Restoration and Coastal Stabilization Plan. The fiber roll array is proposed to be encapsulated in two layers of 900-gram weight coir blankets to provide additional protection from ultra-violet degradation. An anchoring system using galvanized steel cables and earth anchors will be installed as the array is being constructed. All fiber rolls will be identified with stainless steel tags noting the company name, project address, and company telephone number. The finished installation will be nourished with a 6” layer of compatible sediment over the fiber rolls. Immediately following installation, bare soils above the proposed fiber rolls will be seeded with the specified native grasses and stabilized with 100% biodegradable erosion control blankets. Restoration Planting Upon the completion of the fiber roll installation, the project area will be planted with native trees, shrubs, grasses, and forbes through the erosion control blankets as specified on the Restoration and Coastal Stabilization Plan. Native plant restoration recommendations are based on several environmental factors, including soils, topography, solar exposure, salt tolerance, and existing plant communities. Recommendations Figure 2: Slipping of upland sediment, fallen pine, exposed root systems of compromised upland trees 3 primarily consider the long-term health of the resource area by proposing to increase biological plant diversity, improve wildlife habitat, filter stormwater runoff pollutions, and prevent erosion through Coastal Bank stabilization. Refer to the Restoration and Coastal Stabilization Plan for a complete list of proposed species, quantities, and locations. Native plant community restoration is also proposed to extend upland into the buffer zone, replacing existing lawn. The biodiverse herbaceous layer within this buffer will provide pollen, nectar, habitat and forage for insects and wildlife that does not currently existing within the resource area. The proposed planting provides a wide variety of native plant species that will provide nectar and pollen throughout the growing season, while offering a variety of bloom colors and plant heights to attract the greatest number and diversity of pollinators. This expanded vegetated buffer will also aid in the increased absorption of stormwater runoff to prevent erosion and protect the resource area. A temporary irrigation system will also be installed at this time to water the bank and encourage rapid colonization of the project area within the first three years after planting. Following establishment of the plantings, the irrigation system will be disconnected and removed. Ongoing Maintenance The project also includes maintenance to limit the reintroduction of targeted State-listed invasive and non-native plant species into the project area. Management methods will include hand removal and/or selective herbicide application using the “cut and wipe” method to selectively treat individual stems. Follow-up management will include either hand weeding, selectively treating using a low-volume foliar spot application, or a cut and wipe application of an approved herbicide at the approved rates. The follow-up management will occur three to five times per season for the life of the Order of Conditions. Maintenance and monitoring of the bioengineering materials and establishment of native plant species is critical to ensure a longer lifespan of the erosion management strategy. The project includes annual maintenance, as well as regular monitoring throughout the storm season to ensure maintenance, repairs, or replacement of nourishment or planted native species is undertaken when needed. The project will be monitored after significant winter storms to assess the need for minor maintenance activities.
