Dear Board of Health,
I am wriƟng this leƩer to you for many reasons as to why I think that the request to not repair or replace a a failed sepƟc
system, (a situaƟon that was known by both the seller and the buyers at the Ɵme of the purchase, and was somehow put
under the rug because “it was a cash deal.” ) because sewers are soon to be installed (now a date that keeps moving
farther and farther into the future) is baseless and has already caused unknown damage to the waters of Lake
Wequaquet.
First in my complaint:
I was not given enough noƟficaƟon to be there in person. I received a cerƟfied leƩer from Sullivan Engineering and
ConsulƟng on Wednesday of last week (3/19). I was at work and was not at home at the Ɵme to sign.I put the signed
cerƟficaƟon in the mailbox the next day and on Friday, 3/21, when I got home from work at 8:30pm, I picked up the mail.
I did not look at it Ɵl Sunday aŌernoon. AŌer I read the contents, I was shocked. To receive a noƟficaƟon such as this
about such a serious problem that impacts all who live around Lake Wequaquet, only a few days before a variance
hearing, is wrong. There was no contact informaƟon, except for that of Sullivan Engineering (the agents of the
applicants, Edward and Lana Lakatsky.) Had I known sooner, I would have tried to schedule a flight up to the Cape from
North Carolina to aƩend the meeƟng. I was not given enough noƟficaƟon. (Again, even if I had been able to be at home
to sign for the leƩer on Wednesday, 3/19, it would have been difficult to make this work, and quite frankly, I feel that the
agents of the applicants knew exactly what they were doing and were very tacƟcal in trying to get to their desired
outcome). This meeƟng should not be allowed to take place on Tuesday, 3/25 because I cannot be there in person to
advocate for the Lake and for all the property owners on Lake Wequaquet who are good stewards.
Second:
129 Hayes Road was sold as a 2 bedroom home. At the Ɵme of the sale, it was a Cape in the front, salt box second story
in the back, with 2 bedrooms on the first floor and an unfinished 2nd floor. The prior owner was working on a bathroom

on the second floor, but had not completed it. It looked like it was framed to either have 2 or 3 more bedrooms on the
2nd floor. Even if the sepƟc system were working, it is a zoned for only 2 bedrooms. Given the size of the family and
extended family who purchased the home, I assume that the second floor has been completed and the

I have spoken to the owners many Ɵmes about all that they are doing to hurt the water/land and flora and fauna in and
around the lake. They ferƟlize and apply pesƟcides although pesƟcides and ferƟlizer are not allowed that close to a body
of water. They have cut down more trees than I can count so that they can have more grass to ferƟlize on one side of
their house, without the permission of conservaƟon. They made changes and increased the size of their dock also
without going through the proper channels. They are a very nice family, but they don’t seem to care about the lake and
what their acƟons are doing to it.
Fourth:
As you all must know, Lake Wequaquet was closed for most of August into September due to Cyano bacteria outbreak.
We could not swim or really do anything in or on the water. In fact, I have read that people who live next to bodies of
water likewise impacted, have a higher risk of geƫng ALS (Lou Gherig’s Disease). I cannot imagine the amount of waste
water that has gone into our lake from 129 Hayes Road in the past 3, or is it 4 summers because of a known failed sepƟc
system.
FiŌh:
To simply add an extra holding tank is not an opƟon. With that many people in the house even for 3 months, it will need
to be empƟed at least once every 1.5 weeks. How is that fair to the neighbors? To the lake? To have a loud and sƟnky
truck come that oŌen?
Sixth:
Tax basis: If the quality of Lake Wequaquet’s waters are degraded any more, the tax values of all the homes along the
lake will plummet. Most of these homes are second homes and provide 25% more to the town. But this is nothing
compared to the death of the second largest lake on the Cape. I have seen so much tearing down of old 2-3 bedroom
coƩages in the past few years, replaced by huge homes. I am sure that most applied for a variance because of the
impending sewer, whose date seems to move farther and farther into the future. I have not seen new sepƟc systems
going in. How much damage are those causing as well? Perhaps that is why the lake is at an almost breaking point right
now.
I have spent every summer of my life on Wequaquet. My family has had camps on the lake for over 100 years, and have
been Cape residents since the 1600’s. My grandmother gave the majority of land to Audubon for The Great Marsh
Sanctuary on 6A. I am a board member of Orenda Land Trust and work through the year to help fund the preservaƟon
of the few remaining pieces of land on the Cape. I care. You all need to care as well. There is very liƩle Ɵme. In this
instance, you can do something. You can deny the request and insist that a new sepƟc systems be installed. This system
will probably have to infringe on my property. I care about this so much that I will work with them to do just this.
While I realize that the owners would like to make a band aid soluƟon at best before the summer so that they can enjoy
their home, I need all of you in the board of health to be good stewards on my behalf and on behalf of the Cape, the lake
and all those animals, fish, and birds who do not have a voice, and not allow this. It should never have come to this.
I hope that this meeƟng will be postponed, because that is the right thing to do. But if it is not, I ask you to please not
read this at the meeƟng, but to please consider and heed my plea.
