HomeMy WebLinkAboutSR - Lot Release Parker Lane (Barnstable)1 Town of Barnstable Planning & Development Department Staff Report Subdivision #827 Release of Covenant 640 PARKER LANE, BARNSTABLE Date: April 10, 2025 To: Stephen Robichaud, Chair, Planning Board From: Planning & Development Department Staff Subdivision: No. 827 Owner: William Eagen Applicant: Willaim Eagen Property Address: 640 Parker Lane, Barnstable Assessor’s Map/Parcel: Map 152 and Parcel 005/002 Zoning: Residential District (RF), Resource Protection Overlay District (RPOD), Aquifer Protection Overlay District (AP) Request & Background: The owner and applicant, William Eagen of 70 Newport Lane in Osterville, MA, has requested a release of covenant for a lot within subdivision number 827. The specific request is to release the covenant of lot 3A from a subdivision that was approved in 2023. The lot in question is currently vacant and served by the subdivision road Parker Lane. Procedure: Parker Lane Definitive Subdivision Lot 2A and Lot 3A are currently held under covenant. As per §801- 24J(2)(a), a covenant is a form of security for the Town to provide guarantees that a subdivision shall be constructed per the Approved Plan. The request was filed with the Planning Board’s Office on April 10, 2025. In order to release a lot from covenant, the applicant shall file with the Planning Board for review at a regularly scheduled public meeting. The release of covenant shall be by majority vote of the Planning Board. The Developer has now installed a portion of the infrastructure necessary in accordance with the Approved Plan and has requested to be released from covenant for Lot 3A, which would allow for the Developer to seek building permits to construct a single-family house. Correspondence: A request for comments has been sent to the Town Engineer. The Town Engineer identified outstanding issues as it pertains to this lot (see attached). Draft Motion: If the Board agrees to the request, a motion should be formulated to Release the Covenant for Lot 3A at 640 Parker Lane, Subdivision 827 as identified in the submission to the Planning Board.
