Dear Administrator Hoopes and Members of the Commission:
On behalf of the Town of Barnstable (the Town), Tighe & Bond, Inc. respectfully submits this
Notice of Intent (NOI) for the Hawes Avenue Culvert Repair Project located at 11 Hawes
Avenue north of Kalmus Beach in Barnstable, Massachusetts. The scope of work involves the
replacement of a damaged portion of an existing reinforced concrete pipe (RCP) culvert
beneath Hawes Avenue to address structural deficiencies of the crossing, along with the mill
and overlay of the entirety of Hawes Avenue.
A NOI is required for the project as work will occur within areas subject to jurisdiction under
the Massachusetts Wetlands Protection Act (MAWPA; M.G.L. c. 131 §40), and the Town of
Barnstable Wetlands Protection Bylaw (Chapter 237). These areas include Coastal Dune, Salt
Marsh, Land Subject to Coastal Storm Flowage, and Riverfront Area, as well as the 100-foot
Buffer Zone.
This culvert repair project meets the criteria to be reviewed as a Limited Project pursuant to
310 CMR 10.24(7)(c)1 and 2 as it involves “The maintenance and improvement of public
roadways…” and “The maintenance, repair and improvement… of structures, including…
culverts…” This NOI application is being filed following applications for a Section 401 Individual
Water Quality Certification and a Section 404/Section 10 Army Corps General Permit.

6. General Project Description:
The Town of Barnstable proposes to repair an existing culvert beneath Hawes Avenue to correct
structural deficiencies and prevent further deterioration or potential failure of the crossing or roadway.
A damaged portion of the reinforced concrete pipe (RCP) will be replaced in-kind, along with the mill
and overlay of Hawes Avenue. Refer to the Project Narrative for further details.

Regulation Governing Minimum Submission
Requirements for a Notice of Intent Application
The Barnstable Conservation Commission has adopted the following requirements in order to obtain more
consistently complete submission documents necessary for a thorough and efficient review of all Notice of Intent
(NOI) applications. Failure to complete any of the items in this checklist may result in your application being
denied.
Applicant or applicant’s agent should check each box denoting that the task has been completed or in certain
instances, like field staking, denoting that the task will be completed. The following submission checklist covers the
requirements of Chapter 237, Wetlands Protection, of the Part I General Ordinances of the Code of the Town of
Barnstable. This checklist shall be submitted to the Barnstable Conservation Division with the NOI application.
1. Requirements
a. The applicant understands, unless they’ve instructed otherwise, they are applying both
under the Massachusetts Wetlands Protection Act M.G.L. c.131,§40 and
Chapter 237 of the Town of Barnstable General Ordinances.
b. Attach a written narrative to the NOI application (WPA Form 3), available at:
www.mass.gov/eea/agencies/massdep/service/approvals/wpa-form-3.html
describing any project impacts and proposed mitigation as they relate to the following:
1) Any of the interests of Chapter 237 of the General Ordinances and the MassDEP
Wetlands Protection Act M.G.L. 131, §40.
2) The performance standards contained in the MassDEP Wetlands Protection Regulations
(310 CMR 10.00)
3) Chapter 704: Regulation Governing Activity in the 100-ft. Buffer Zone.
4) Chapter 703: Private Docks and Piers.
5) Any other applicable regulations (310 CMR 10.00 or as promulgated under Chapter 237
of the General Ordinances).

c. Provide a copy of the Assessor’s Map indicating the parcel of the project site and

d. Provide a copy of the abutter notification letter. Use the form letter provided in our Abutter
Notification Regulation (Chapter 706), available on the Conservation Division
website.
e. Email copies of the green return receipts, from the certified mailings to the abutters, as proof of
notification . If any mailings are returned, email a copy of the entire envelope,
indicating by postal service stamp the reason for return. You will retain the receipts
afterwards, not the Conservation Division.
f. I further certify under the penalties of perjury that all abutters were notified of the Notice of
Intent Application, pursuant to the requirements of Chapter 237 of the General Ordinances of the
Code of the Town of Barnstable. Notice must be made in writing by certified mail to all abutters
within 100 ft of the property line of the project location.

3. Field Staking:
a. On or before Tuesday, @ 8:30 a.m., one week prior to the scheduled public hearing, have
your project staked by a professional engineer or registered land surveyor showing all
outside corners of all proposed structures and the continuous proposed “limit of work” line.
b. Have a wetland scientist or other qualified professional flag all wetland resource areas on or
within 100 ft of the work area. Make sure that the flags are sequentially numbered.
c. Provide a project identification stake with bright painted top and applicant name and address,
easily visible from the street approaching the site.
4. Legal Advertisement Fees:
a. Conservation will submit the legal ad for publication in a local newspaper. The applicant or
his/her agent is responsible for payment, by check (payable to the Town of Barnstable), at the
hearing or by mail. The cost of the legal ad will be pre-calculated and posted on the hearing
agenda prior to the hearing.
5. Minimum Documentation for a Complete Application:
a. Provide a completely filled-out (in all parts) NOI application as locally
adopted for the Town of Barnstable, including MassDEP Vegetated Wetland Field Data Form.
Indicate Assessor’s map and parcel of the project, as well as the street or road address, and
pertinent village (i.e., Hyannis, Centerville, Barnstable, etc).
b. Provide two (2) original project plans, stamped in blue or red ink (wet stamp). Plans must be
signed and dated by a Massachusetts licensed, professional engineer, land surveyor, architect or
landscape architect (as applicable), and shall be drawn at a readable scale (1" = 20' preferred).
For multi-acre sites, a second site plan, drawn at larger scale showing the entire site, should also
be provided.

c. Provide a signed Permission to Access Property, Form PA. The form must be signed by the property
Owner, or legal representative and submitted with the NOI. .

d. For projects requiring mitigation plantings under Chapter 704 -3, 704-4, and 704-5,
mitigation planting location(s) shall clearly be shown on landscaping planting plan. The
planting plan shall include:
1. species (chosen from the Town of Barnstable Conservation Commission approved planting
lists), sizes, densities and/or quantities.
2. area calculations in 0’ - 50’ and 50’ – 100’ separately for the amount of mitigation planting
required.
3. the amount of mitigation planting proposed.
4. a note or indication stating the area between the proposed plants will either be planted with
an appropriate native seed mix or left to naturalize.
5. a note stating mulch may only be used under the dripline of proposed plants.
6. demarcation markers along the landward side of the mitigation planting area. The type of
demarcation marker shall be selected from the list approved by the Conservation
Commission.
e. Provide detailed, written street directions to the locus (site).
f. Provide a copy of a U.S.G.S. locus map indicating the general area of the project site.
g. Provide a check for the Town of Barnstable portion of the required filing fee. (The portion
payable to the Commonwealth, see 7. e. below)
h. Provide any other documentation, photographs, architectural renderings or other supporting data
prepared by professionals competent in the field which may be relevant to the application.
6. The site plan shall also show:
a. All existing and proposed contours at 2-ft. minimum intervals (1-ft. preferred).
b. Clear delineation of all existing and proposed structures and features. Building structures must
be accurately dimensioned (fixed location) from property lines and wetland resource areas. Plans
shall provide sufficient detail to show all potential wetland impacts, mitigation, compensatory
areas, engineered structures, utilities, landscaping, etc. within the area of jurisdiction. On
complicated sites, existing and proposed conditions must be shown on separate sheets.
c. Locus inset map of the site clearly showing its location relative to surrounding public streets.
d. All wetland resource area flags by individual flag number (matched to the field) to clearly
identify all resource areas on or within 100 feet of the work area. The individual who performed
the flagging and date of flagging shall be identified on the plan next to the resource line.
e. Section views showing changes in grade, cuts and fills.

Section 1
Introduction
This Notice of Intent (NOI) is being submitted on behalf of the Town of Barnstable (the
Town) for the repair of a section of an existing culvert located in the Town of Barnstable
beneath Hawes Avenue approximately 180 feet west of Ocean Street. The culvert
connects a Salt Marsh to the north with Hyannis Harbor, via Kalmus Beach, to the south.
Structural deficiencies of the culvert are resulting in sinkholes and frequent ponding in
the roadway. Replacement of a portion of the existing reinforced concrete pipe (RCP) will
prevent further deterioration and potential failure of the infrastructure. The Town also
proposes to mill and overlay the entirety of Hawes Avenue.
The project will result in the alteration of areas subject to protection under the
Massachusetts Wetlands Protection Act (MAWPA; M.G.L. c. 131 § 40), the Town of
Barnstable Wetlands Protection Bylaw (Chapter 237), and their implementing
regulations. These areas include Coastal Dune, Salt Marsh, Riverfront Area, Land Subject
to Coastal Storm Flowage, and the 100-foot Buffer Zone. The proposed project appears
to qualify as a Limited Project pursuant to 10.24(7)(c)1 and 2, as it consists of “The
maintenance and improvement of public roadways…” and “The maintenance, repair and
improvement (but not substantial enlargement except when necessary to reduce or
eliminate a tidal restriction) of structures, including… culverts…”
The location of the culvert is shown in the USGS Site Locus Map (Figure 1), the Priority
Resources Map (Figure 2), the Orthophotograph (Figure 3), and the Project Drawings
provided in Appendix A. Representative photographs of the Project Site are included in
Appendix B.

Section 2
Existing Conditions
2.1 Project Location
The project area is located within the Town of Barnstable on Hawes Avenue north of
Kalmus Beach and Hyannis Harbor. Land use in the general vicinity of the project area
near Hyannis Avenue primarily consists of open water (Hyannis Harbor), coastal
wetlands including Salt Marsh, Coastal Dune, Coastal Beach (Kalmus Beach), and
Coastal Bank, as well as single-family residences.
2.1.1 Project Site
The Project Site (Site) or Limit-of-Work (LOW), is an approximately 33,875 square foot
(sf) area located at and around the Hawes Avenue culvert, and within the entirety of the
Hawes Avenue roadway right-of-way (ROW) for the mill and overlay. The existing
culvert consists of a 30-inch diameter reinforced concrete pipe (RCP) approximately 380
feet long and conveys a tidal stream northwest to southwest into Hyannis Harbor. The
repair work will be limited to a 200-foot portion of the culvert and the adjacent area
including Hawes Avenue and surrounding Coastal Dune and Salt Marsh for access and
staging.
2.2 Jurisdictional Wetland Resource Areas
On July 16, 2024, a Tighe & Bond wetland scientist visited the Site to identify and
delineate wetland resource areas and evaluate the jurisdictional status of each resource
area relative to local, state, and federal criteria. Wetland resource areas identified within
the Project Site that are jurisdictional under the MAWPA include:
• Land Under the Ocean
• Coastal Beach
• Coastal Dune
• Coastal Bank
• Salt Marsh
• Bordering Vegetated Wetland (BVW)
• Land Subject to Coastal Storm Flowage (LSCSF)
• Riverfront Area
A summary of wetland resource areas delineated by flag series is presented in Table 2 -
1. Detailed descriptions of jurisdictional resource areas within the Project Site and a
figure showing their locations are provided in the Wetland Delineation Memorandum
provided in Appendix C.

2.3 Rare Species
The Massachusetts Natural Heritage and Endangered Species Program (NHESP) Atlas
(15th edition, effective August 1, 2021) and MassGIS online mapping data (August 1,
2021) were reviewed relative to the Project Site. According to these sources, a portion
of the proposed work is within the limits of mapped Estimated Habitats of Rare Wildlife
(EH 693) and Priority Habitats of Rare Species (PH 2156).
On February 5, 2025, an Information Request was submitted to NHESP to determine the
extent and type of state-listed protected species within proximity to the proposed work.
A summary of these species is provided in Table 2-2, below.

As shown in Table 2-2, two (2) state-listed species are located within proximity to the
proposed work. This NOI has been submitted concurrently to NHESP for review under
the Massachusetts Endangered Species Act (MESA). Under the guidance of NHESP, the
work will implement strategies to avoid and minimize impacts to rare species, such as
time-of-year restrictions. Work is planned to occur during the fall and early winter
months, outside of the active season of these species. Additionally, the proposed LOW
has been concentrated around the culvert to provide the minimum amount of work area
required to facilitate construction while reducing the amount of temporary impacts to
wetland resource areas to the maximum extent feasible. NHESP correspondence is
provided in Appendix D.

Section 3
Project Description
3.1 Proposed Activities
The proposed project will result in the in-kind replacement of a portion of the existing
Hawes Avenue culvert to repair existing structural deficiencies. The LOW will be an
approximately 33,875 sf area consisting of the roadway, roadway shoulders, Salt Marsh,
Coastal Dune, and tidal stream. A 200-foot long by 10-foot wide work area will be
excavated with the culvert on center and the existing 30-inch diameter RCP will be
completely removed from the site. Sheet piles will be driven into the ground where the
culvert was removed, and a concrete pile cap will be installed for the base support of the
new culvert. A new 30-inch diameter RCP will be installed with a new inlet headwall at
the north end and a new manhole at the south end. In addition to the culvert
replacement, the entirety of the Hawes Avenue roadway will be milled and repaved.
Access for the culvert replacement will be from Hawes Avenue as well as the adjacent
Salt Marsh and Coastal Dune via timber matting.
Proposed activities are shown in detail on the Project Drawings provided in Appendix A
and summarized in sequence below.
3.2 Anticipated Construction Sequence
While the exact means and methods of construction are left to the discretion of the
contractor, it can generally be assumed, based on Tighe & Bond’s experience with
projects of a similar scope, that proposed activities will be sequenced as follows:
1. Install timber matting in wetland areas to be protected and erosion and sediment
control barriers along the perimeter of the LOW prior to ground disturbance.
Implement any pre-construction rare species BMPs as required by NHESP.
2. Clear trees and other vegetation as necessary to prepare for excavation. Salvage
and stockpile and cover Coastal Dune and Salt Marsh vegetation to be reused for
site restoration.
3. Install temporary cofferdams at the north end of the culvert.
4. Place excavation supports on either side of the area to be excavated around the
culvert.
5. Excavate around the existing culvert pipe between excavation supports. Install a
temporary plug at the south end of the culvert.
6. Segregate wind borne dune sediment and marsh peat into separate stockpiles
during excavation for reuse during site restoration.
7. Remove the existing RCP and demolish existing headwall (north) and manhole
(south).
8. Install sheet piles and concrete pile cap. Install the new RCP, headwall with
riprap apron, and manhole.
9. Backfill area of excavation and fill small existing voi d that exposes the pipe within
Salt Marsh with organic, wetland soils.

10. Restore disturbed Salt Marsh and Coastal Dune. Stabilize any upland areas with
loam and seed as necessary.
11. Mill and repave Hawes Avenue.
12. Remove cofferdams and remove timber matting.
13. Remove erosion and sediment controls once all areas are stable.
3.3 Construction-Period BMPs
The following Best Management Practices (BMPs) will be implemented during
construction to minimize the potential for impacts to jurisdictional resource areas.
3.3.1 Erosion and Sedimentation Controls
Proposed erosion, sedimentation, and pollution controls are shown on the Project
Drawings in Appendix A. The erosion control barriers will be placed in order to restrict
the contractor(s) to the areas necessary to conduct the work and will define the limits of
work. Controls will include:
• Erosion control barriers such as silt fence and/or compost filter tubes that define
the LOW.
In addition:
• The contractor(s) will be required to maintain a reserve supply of erosion control
barriers on-site to make repairs, as necessary.
• Erosion, sedimentation , and pollution controls will be installed prior to
construction and will remain in place until permanent restoration features are
implemented and the site is stabilized.
3.3.2 Timber Matting
Temporary timber mats will be used for access in Salt Marsh and Coastal Dune to
protect existing vegetation and avoid the compaction of soils. Mats will be installed
where vehicle and equipment access is necessary and will be positioned so they are
offset from the boundary of the coastal resource area to avoid the creation of ruts when
vehicles enter the work area. Timber mats will be removed immediately upon completion
of construction and disturbed soils will be regraded to pre-existing contours.
3.3.3 Cofferdams
Cofferdams will be installed at the upstream proposed limits of work to create an
isolated (i.e., dry) work area. The cofferdams may be constructed of sandbags and
woven geotextile fabric. The selected cofferdam materials are subject to the discretion
and design of the contractor; however, the use of unconsolidated fill material will be
strictly prohibited, and cofferdams will be located within the limits shown on the Project
Drawings.
The cofferdam will separate the work area from water flow which will protect the tidal
stream from construction debris and sedimentation and reduce the pumping and
discharge treatment required for construction. All work will be performed in the dry to
protect wetland resource areas. The location of cofferdams is shown on the Project
Drawings.

3.3.4 Construction, Demolition, and Hazardous Waste
The project will generate solid waste including concrete, stone, and scrap metal
materials. The contractor(s) will be responsible for proper disposal/recycling of the
materials in accordance with Massachusetts solid waste regulations.
The contractor(s) will be required to conduct the work in an environmentally safe
manner and in accordance with applicable regulations for the management of fuels,
waste spoils, and hazardous substances. Any hazardous materials will be transported,
stored, and handled in compliance with applicable federal or state regulations, the
contractor(s) will also be required to maintain a spill kit at the Project Site.
3.3.5 Construction Period Access and Staging
Access for construction will be from the Hawes Avenue roadw ay ROW and adjacent areas
including Coastal Dune and Salt Marsh. A staging area for construction materials will be
located along the ROW outside of jurisdictional resource areas to the extent possible and
will be surrounded by erosion control barriers. The exact location of the staging area will
be determined by the contractor.
3.3.6 Dewatering
Work areas within the cofferdams or area of excavation may require additional
dewatering during construction. Dewatering activities will be conducted using a
discharge hose, filter bag, and sediment trap as specified on Sheet 10 of the Project
Drawings.
Dewatering of excavated material is subject to the means and methods of the selected
contractor. Dewatering of excavated material will be conducted in a manner that does
not introduce potential contaminants (e.g., fines) of excavated material into new areas
(where excavated material was not generated). At a minimum, excavated material will
be placed within a geotextile-lined straw bale basin or approved equivalent. Excavated
material will be tested and properly disposed at an approved facility in accordance with
state and federal guidelines.
3.3.7 Other Protective Measures
The following general measures will be employed to minimize impacts to the resource
areas:
• Protective measures will be inspected weekly during construction and after
significant precipitation events and repaired, as necessary.
• Water control systems will be designed to handle typical flows and flows from
small precipitation events. The Contractor will be required to prepare a flood
contingency plan with procedures for monitoring weather forecasts and preparing
the site for flooding.
• The use of products containing hay and plastic or nylon netting is strictly
prohibited.
• Use of air quality and dust control measures, including wetting agents, truck bed
covers, use of ultra-low sulfur diesel fuel, limitations on idling, vehicle anti -
tracking pads, and street cleaning. Construction equipment will be refueled as far
away from resource areas as possible.

3.4 Post-Construction Restoration
Following construction, all disturbed upland areas along the side of the roadway will be
restored in-kind with loam and seed. The Coastal Dune and Salt Marsh areas temporarily
impacted by the culvert replacement activities will be restored in -kind. Prior to
excavation within Salt Marsh, spot elevations will be collected within the marsh that will
be temporarily excavated to establish an elevation benchmark at which this wetland
area will be restored, given the successful reestablishment of Salt Marsh is largely
elevation driven. During site preparation, any peat and marsh vegetation as well as
wind-borne dune material and plants will be carefully excavated, segregated, stockpiled,
and maintained over the course of construction to be reused during site restoration to
the extent feasible. Should the salvaged plant and soil material need to be augmented to
complete restoration, appropriate materials will be selected that are compatible with the
existing site characteristics. It is anticipated that the Coastal Dune area may require
additional overplanting with American beachgrass. A local ecotype of beach grass will be
obtained and planted according to the recommended guidelines for this species within
disturbed dune areas where salvaged vegetation is not otherwise able to be reused. If
the salvaged peat is not adequate to fully restore the area of impacted Salt Marsh, a
high-organic loam will be used to augment the salvaged peat to reestablish the area in -
situ. Plugs of Spartina alterniflora and/or Spartina patens may be obtained from a local
nursery and planted to provide added vegetation cover as needed if any bare patches of
peat are observed. No net loss of these wetland areas is anticipated as disturbed areas
will be restored in-kind. The wetland areas will be monitored for two (2) growing
seasons to document adequate restoration, and an annual report detailing the findings
of each monitoring visit will be submitted to the Conservation Commission. Refer to
Page 11 of the Project Drawings for further restoration details.

Section 4 Alternatives Analysis
4.1 Alternative 1 - No Action
The “No Action” alternative would consist of making no improvements to the existing
culvert beneath Hawes Avenue. This option would not allow the Town to improve
existing structural deficiencies identified at the culvert and thus risks further degradation
and potential failure of the stream crossing and roadway, which has significant public
safety and environmental impact concerns. As such, the alternative of “No Action” is not
desirable.
4.2 Alternative 2 - Ongoing Maintenance
This alternative consists of no replacement or repair of the existing culvert but includes
ongoing maintenance to repair sinkholes caused by culvert deterioration. Under existing
conditions, the culvert is exposed to open air due to a sink/scour hole in the Salt Marsh
at the north end of the site. Additionally, the portion of pipe in this area has visible holes
due to exposure. Allowing the culvert to remain in its current condition presents public
safety concerns, increased maintenance, and reduced tidal flow to the adjacent Salt
Marsh. Overall, the initial cost for this alternative is the least (with the exception of the
No Action alterative), but future cost and safety concerns are the highest. Therefore,
this alternative is not desirable.
4.3 Alternative 3 - Box Culvert
This alternative consists of the replacement of the entire length of the existing culvert
with a new box culvert. This design would involve the installation of a pipe larger than
existing conditions to provide larger hydraulic capacity for drainage or tidal nutrient
exchange. However, only a portion of the pipe requires replacement due to structural
concerns, and this alternative would only be viable if the culver t were replaced in its
entirety which would result in unnecessary resource area impacts. This alternative would
require hydraulic modeling to determine feasibility and its effects to Salt Marsh, aquatic
animal migration, stream flow, and other variables. This alternative would have the
highest impact to surrounding wetland resource areas and would also result in greater
impacts to Coastal Dune, Coastal Beach, and Land Under the Ocean. It would also incur
the highest cost. Ultimately, this alternative was not considered further due to resource
area impacts, design needs, and available town budget for the culvert improvements.
4.4 In-Kind 200-linear foot Repair (Preferred)
The preferred alternative as proposed involves the replacement of a section of the
existing 30-inch-diameter reinforced concrete pipe (RCP) with a new 30-inch-diameter
pipe spanning an approximately 200-foot portion of the pipe from the Salt Marsh
beneath Hawes Avenue to the north to a manhole within Costal Dune to the south. The
proposed design replaces the existing pipe with a new pipe of the same size and at the
same depth to reduce disturbance of the surrounding wetland resource areas. Sheet
piling is proposed for support of excavation to limit the overall impact area compared to
an open excavation with 2-foot:1-foot embankment slopes. Sheet piles add additional
cost to the project but reduce impact areas to Salt Marsh and Coastal Dune by
approximately 50% compared to open excavation.

Section 5
Regulatory Compliance
The proposed activities will occur within areas subject to protection and jurisdiction
under the MAWPA and Chapter 237. These areas consist of Coastal Dune, Salt Marsh,
LSCSF, Riverfront Area, as well as the 100-foot Buffer Zone. This section summarizes
the project’s relationship to and compliance with pertinent local, state, and federal
regulations.
5.1 Massachusetts Wetlands Protection Act
5.1.1 Limited Project Status
The proposed activities qualify for consideration as a Limited Project per 310 CMR
10.24(7)(c):
“The following projects may be permitted as a limited project pursuant to 310
CMR 10.24(7) provided the project complies with all applicable provisions of 310
CMR 10.24(1) through (6) and (9) and (10):
(1) Maintenance and improvement of existing public roadways, but limited to
widening less than a single lane, adding shoulders, correcting substandard
intersections, and improving drainage systems.
(2) The maintenance, repair and improvement (but not substantial
enlargement except when necessary to reduce or eliminate a tidal
restriction) of structures, including buildings, piers, towers, headwalls,
bridges and culverts which existed on November 1, 1987.”
The project’s compliance with 310 CMR 10.24(1) through (6) and (9) and (10) is
summarized below:
1. The project will comply with all applicable requirements of federal, state, and
local statutes and regulations.
2. An operation and maintenance (O&M) plan will be implemented by the Town
to enable the culvert to function as designed following repair.
3. The proposed project consists of the in-kind replacement of a damaged
portion of the culvert for purposes of repairing the existing infrastructure. The
work has been designed to avoid and minimize, as well as mitigate, adverse
impacts to wetland resource areas as described in the Alternatives Analysis of
this NOI. The existing crossing does not substantially restrict tidal flow, and
the damaged portion of the crossing will be replaced in -kind and thus will not
create tidal flow restriction. Refer to Section 4 for a discussion regarding the
evaluation of alternatives relative to environmental, cost, and feasibility
factors.

The Town requests that the Barnstable Conservation Commission grant authorization for
the work to proceed as a Limited Project. Limited Project status is requested for the
following performance standards:
• 310 CMR 10.28(3) – Coastal Dune impacts. Refer to Section
5.1.2.1
• 310 CMR 10.32(3) – Salt Marsh impacts. Refer to Section 5.1.2.2
5.1.2 Summary of MAWPA Jurisdictional Alterations
The proposed project will result in temporary alterations to the following wetland
resource areas:
• Coastal Dune
• Salt Marsh
• LSCSF
• Riverfront Area
Table 5-1 below outlines the total proposed alterations by wetland resource.

Approximately 17,155 sf of the project is proposed within the 100-foot Buffer Zone. The
following sections summarize the project’s compliance with the General Performance
Standards (provided in italics) established in the MAWPA regulations for each resource
area.
5.1.2.1 Coastal Dune
As noted in Table 5-1, approximately 4,675 sf of Coastal Dune will be temporarily
impacted during the implementation of the proposed project associated with culvert
repair activities (e.g., excavation and installation of the new pipe and manhole) and
placement of timber matting for access. The Performance Standards for Coastal Dune
are set forth at 310 CMR 10.28(3) through (6) and are addressed below.
(3) Any alteration of, or structure on, a coastal dune or within 100 feet of a
coastal dune shall not have an adverse effect on the coastal dune by:
(a) affecting the ability of waves to remove sand from the dune;
(b) disturbing the vegetative cover so as to destabilize the dune;

(c) causing any modification of the dune form that would increase the
potential for storm or flood damage;
(d) interfering with the landward or lateral movement of the dune;
(e) causing removal of sand from the dune artificially; or
(f) interfering with mapped or otherwise identified bird nesting
habitat.
The proposed project will result in temporary impacts to Coastal Dune associated with
excavation for repair of the culvert pipe, as well as access and staging with timber mat
placement. However, no adverse impacts are anticipated to Coastal Dune, and no
impairment of dune function is anticipated as the area will be restored in-kind following
construction. Excavated dune material, including vegetation, will be carefully stockpiled
and maintained in order to be reused for site restoration. As needed, additional dune
plantings will be used to augment the restoration areas to ensure no net loss of Coastal
Dune. Furthermore, the work will follow necessary time-of-year restrictions in order to
avoid and minimize impacts to birds and bird nesting habitat associated with Coastal
Dune. Temporary impacts to dune vegetation are unavoidable due to the location of the
culvert. However, all impacts to Coastal Dune will be restored in -situ, as detailed above.
As such, the Town respectfully requests that the Barnstable Conservation Commission
grant Limited Project status for this performance standard.
(4) Notwithstanding the provisions of 310 CMR 10.28(3), when a building
already exists upon a coastal dune, a project accessory to the existing building
may be permitted, provided that such work, using the best commercially
available measures, minimizes the adverse effect on the coastal dune caused by
the impacts listed in 310 CMR 10.28(3)(b) through (e). Such an accessory
project may include, but is not limited to, a small shed or a small parking area for
residences. It shall not include coastal engineering structures.
Not applicable. No accessory buildings or similar structures are proposed.
(5) The following projects may be permitted, provided that they adhere to the
provisions of 310 CMR 10.28(3):
(a) pedestrian walkways, designed to minimize the disturbance to the
vegetative cover and traditional bird nesting habitat;
(b) fencing and other devices designed to increase dune development;
and
(c) plantings compatible with the natural vegetative cover.
Not applicable. The proposed project does not involve these activities, aside from
plantings for site restoration.
(6) Notwithstanding the provisions of 310 CMR 10.28(3) through (5), no project
may be permitted which will have any adverse effect on specified habitat sites of
Rare Species, as identified by procedures established under 310 CMR 10.37.
As noted in Section 2.3, a portion of the proposed work falls within the limits of mapped
Estimated Habitats of Rare Wildlife (EH 693) and Priority Habitats of Rare Species (PH
2156). Thus, the work is subject to review under MESA, and this NOI is being submitted
concurrently to NHESP for a joint review. The work will incorporate recommended BMPs
and protective measures by NHESP to avoid adverse impacts to rare species habitat.

5.1.2.2 Salt Marsh
As noted in Table 5-1, approximately 680 sf of Salt Marsh will be temporarily impacted
during the implementation of the proposed project associated with culvert repair
activities (e.g., excavation and installation of the new pipe, headwall, and riprap apron),
cofferdams and dewatering, and placement of timer matting for access. The
performance standards for Salt Marsh are set forth at 310 CMR 10.32(3) through (6)
and are addressed below.
(3) A proposed project in a salt marsh, on lands within 100 feet of a salt marsh,
or in a body of water adjacent to a salt marsh shall not destroy any portion of the
salt marsh and shall not have an adverse effect on the productivity of the salt
marsh. Alterations in growth, distribution and composition of salt marsh
vegetation shall be considered in evaluating adverse effects on productivity. 310
CMR 10.32(3) shall not be construed to prohibit the harvesting of salt hay.
The proposed work will result in temporary alterations to Salt Marsh resulting from the
culvert repair activities. However, no adverse impacts to Salt Marsh, including
permanent areal or functional loss of the resource, are anticipated as the area will be
restored in-kind following construction. While a small amount of fill is proposed in order
to close an existing sink/scour hole in the marsh exposing the pipe, only organic wetland
material will be used and the elevation of the area will not be brought above the Mean
High Water mark, thus allowing the area to still function as Salt Marsh. Excavated Salt
Marsh material will be carefully stockpiled and maintained in order to be reused for site
restoration. If necessary, the restoration area will be augmented with additional wetland
soil and/or plantings. Temporary impacts to Salt Marsh are unavoidable due to the
location of the culvert. However, all impacts to Salt Marsh will be restored in -situ, as
detailed above. As such, the Town respectfully requests that the Barnstable
Conservation Commission grant Limited Project status for this performance standard.
(4) Notwithstanding the provisions of 310 CMR 10.32(3), a small project
within a salt marsh, such as an elevated walkway or other structure which has no
adverse effects other than blocking sunlight from the underlying vegetation for a
portion of each day, may be permitted if such a project complies with all other
applicable requirements of 310 CMR 10.21 through 10.37.
Not applicable. The project does not involve walkways or similar structures.
(5) Notwithstanding the provisions of 310 CMR 10.32(3), a project which will
restore or rehabilitate a salt marsh, or create a salt marsh, may be permitted in
accordance with 310 CMR 10.11 through 10.14, 10.24(8), and/or 10.53(4).
Not applicable. The purpose of the proposed work is not to restore or rehabilitate Salt
Marsh.
(6) Notwithstanding the provisions of 310 CMR 10.32(3) through (5), no
project may be permitted which will have any adverse effect on specified habitat
sites of Rare Species, as identified by procedures established under 310 CMR
10.37.
As noted in Section 2.3, a portion of the proposed work falls within the limits of mapped
Estimated Habitats of Rare Wildlife (EH 693) and Priority Habitats of Rare Species (PH
2156). Thus, the work is subject to review under the MESA, and this NOI is being
submitted concurrently to NHESP for a streamlined review. The work will incorporate all

recommended BMPs and protective measures by NHESP to avoid adverse impact to rare
species habitat.
5.1.2.3 Land Subject to Coastal Storm Flowage
As noted in Table 5-1, approximately 29,375 sf of alterations to LSCSF are anticipated.
These impacts are due to work associated with the mill and overlay of Hawes Avenue.
Although there are no performance standards for LSCSF, no flood storage loss is
anticipated to occur as the work will not result in net fill to LSCSF.
5.1.2.4 Riverfront Area
There is approximately 345,650 sf of Riverfront Area within the limits of the Project
Locus. Of this, approximately 20,770 sf (6%) is degraded, as defined in the MAWPA. A
portion of the work is proposed within Riverfront Area, resulting in a total of
approximately 14,915 sf of temporary alterations. All of these impacts are within the
first 100 feet of Riverfront Area. This section describes how the proposed project
satisfies the Riverfront redevelopment provisions at 310 CMR 10.58(5). The performance
standards are provided below in italics, while the details of project design follow .
(a) At a minimum, proposed work shall result in an improvement over existing
conditions of the capacity of the riverfront area to protect the interests identified
in M.G.L. c. 131 § 40. When a lot is previously developed but no portion of the
riverfront area is degraded, the requirements of 310 CMR 10.58(4) shall be met.
The proposed work will result in approximately 14,915 sf of temporary impacts to
Riverfront Area. Approximately 3,475 sf of these impacts overlap with impacts to Coastal
Dune, and the remaining 11,440 sf of impacts are limited to existing degraded
Riverfront Area (e.g., Hawes Avenue and roadway shoulders). The work will not result in
the increase of degraded Riverfront Area, and all impacts to non-degraded areas will be
restored in-kind for no net loss of wetland resource areas. Additionally, the roadway will
be restored following the completion of work and its footprint will not be increased or
encroach further toward the tidal stream. As such, the general characteristics of the area
will not be changed.
(b) Stormwater management is provided according to standards established by the
Department.
The project is not subject to the Massachusetts Stormwater Management Standards as
the work will not result in new impervious areas or point source discharges. Refer to
Section 5.1.3.
(c) Within 200 foot riverfront area, proposed work shall not be located closer to the
river than existing conditions or 100 feet, whichever is less, or not closer than
existing conditions within 25 foot riverfront areas, except in accordance with 310
CMR 10.58(5)(f) or (g).
Due to the nature of the proposed work (e.g., culvert repair) it is not feasible to conduct
the work outside of the first 100 feet of Riverfront Area. The work will not encroach
further toward the river than under existing conditions as the culvert will be replaced in-
kind. Additionally, a portion of the work associated with roadway repaving will take place
within the first 100 feet of Riverfront Area. However, as noted above, this will not result
in an increase in degraded Riverfront Area and all areas will be restored in -kind.

(d) Proposed work, including expansion of existing structures, shall be located
outside the riverfront area or toward the riverfront area boundary and away from
the river, except in accordance with 310 CMR 10.58(5)(f) or (g).
As noted above, the proposed work involves the in-kind repair/partial replacement of a
culvert. The work will not result in further encroachment/new development within
Riverfront Area, or an increase in degraded Riverfront Area.
(e) The area of proposed work shall not exceed the amount of degraded area,
provided that the proposed work may alter up to 10% if the degraded area is less
than 10% of the riverfront area, except in accordance with 310 CMR 10.58(5)(f)
or (g).
The Project Locus contains approximately 345,650 sf of Riverfront Area, 20,770 sf (6%)
of which is degraded. The proposed activities will result in approximately 14,915 sf of
temporary impacts to Riverfront Area. This represents an alteration of approximately 4%
of the total Riverfront Area within the Project Locus. As such, this standard has been
met.
(f) When an applicant proposed restoration on-site of degraded riverfront area,
alteration may be allowed notwithstanding the criteria of 310 CMR 10.58(c), (d)
and (e) at a ratio in square feet of at least 1:1 of restored area to area of
alteration not conforming to the criteria. Areas immediately along the river shall
be selected for restoration. Alteration not conforming to the criteria shall begin at
the riverfront area boundary. Restoration shall include
1. removal of all debris, but retaining any trees or other mature vegetation;
2. grading to a topography which reduces runoff and increases infiltration;
3. coverage by topsoil at a depth consistent with natural conditions at the
site; and
4. seeding and planting with an erosion control seed mixture, followed by
plantings of herbaceous and woody species appropriate to the site.
The majority of the proposed work is limited to the footprint of previously developed and
degraded Riverfront Area and will not increase the amount of degraded Riverfront Area
within the Project Locus as the culvert will be replaced in-kind. All impacts to non-
degraded Riverfront Area will be restored in-kind and work will comply with the
applicable performance standards for Coastal Dune and Salt Marsh, as described in
Sections 5.1.2.1 and 5.1.2.2. As such, this standard has been met.
(g) When an applicant proposes mitigation either on -site or in the riverfront area
within the same general area of the river basin, alteration may be allowed
notwithstanding the criteria of 310 CMR 10.58(c), (d), or (e) at a ratio in square
feet of at least 2:1 mitigation area to area of alteration not conforming to the
criteria or an equivalent level of environmental protection where square footage
is not a relevant measure. Alteration not conforming to the criteria shall begin at
the riverfront area boundary. Mitigation may include off -site restoration of
riverfront areas, conservation restrictions under M.G.L. c. 184 §§ 31 to 33 to
preserve undisturbed riverfront area that could otherwise be altered under 310
CMR 10.00, the purchase of development rights within the riverfront area, the
restoration of bordering vegetated wetland, projects to remedy an existing

adverse impact on the interests identified in M.G.L. c. 131 § 40 for which the
applicant is not legally responsible, or similar activities undertaken voluntarily by
the applicant which will support a determination by the issuing authority of no
significant adverse impact. Preference shall be given to potential mitigation
projects, if any, identified in a River Basin Plan approved by the Secretary of the
Executive Office of Environmental Affairs.
The work will not result in an increase of degraded Riverfront Area and all impacts will
be restored in-kind. Thus, mitigation is not proposed.
(h) The issuing authority shall include a continuing condition in the Certificate of
Compliance for projects under 310 CMR 10.58(5)(f) or (g) prohibiting further
alteration within the restoration or mitigation area, except as may be required to
maintain the area in its restored or mitigated condition. Prior to requesting the
issuance of the Certificate of Compliance, the applicant shall demonstrate the
restoration or mitigation has been successfully completed for at least two growing
seasons.
Not applicable. Mitigation is not proposed.
5.1.3 Stormwater Management Standards
The proposed project will not generate additional stormwater runoff, increase impervious
area, or create a new point source discharge. Per the Recommended Final Decision
issued on July 29, 2016, in the Matter of Berkshire Community College Docket No. WET -
2015-023 from the MassDEP Office of Appeals and Dispute Resolution, it was ruled that
310 CMR 10.05(6) (k) through (q) do not apply to a project that does not propose a
“point source” or “stormwater discharge” within Resource Areas or their Buffer Zones. As
such, the project is not subject to the Massachusetts Stormwater Management
Standards.
5.2 Barnstable Wetlands Protection Bylaw
The proposed activities are also subject to the Town of Barnstable Wetlands Protection
Bylaw (Chapter 237) as it recognizes the protections under the MAWPA. Aspects of
Chapter 237 and its implementing regulations that are more stringent than the MAWPA
are discussed in the following sections.
5.2.1 Chapter 704: Regulation Governing Activity in the 100-ft Buffer
Zone
The Barnstable Conservation Commission outlines performance standards for work
within the 100-foot Buffer Zone in Chapter 704 of the Barnstable Wetlands Protection
Regulations. These standards require the maintenance or improvement (including
mitigation planting) of a 50-foot undisturbed buffer zone between the proposed
disturbance and the landward-most wetland resource area.
Under existing conditions, there is no 50-foot undisturbed buffer zone as the closest
wetland resource area directly abuts Hawes Avenue and existing residential
development. Impacts to the 50-foot and 100-foot Buffer Zone will be restored in-kind
following construction.
The proposed project appears to be exempt from the requirement for mitigation planting
per Section 704-6(5), as it consists of “the construction of water dependent facilities as
defined in 704-2(F) herein.” As the work consists of a culvert repair, it must be located

“at or near the shoreline and within the 100 -foot Buffer Zone”, and “is dependent on the
water as part of the intrinsic nature or function of the operation”.
5.2.2 LSCSF Guidelines
The Barnstable Conservation Commission outlines guidelines for proposed activities in
LSCSF, specifically within Zone V and Coastal Zone A. The following addresses these
provisions:
1. The proposed work will not adversely impact the ability of LSCSF to
absorb or dampen wave impacts by reducing native vegetation or pervious
areas. The work will result in negligible fill to LSCSF and all impacts to
native vegetation will be restored in-kind. Work within LSCSF will comply
with the performance standards set forth under the MAWPA for land
subject to flooding and other coastal resource areas. Additionally, the
majority of work within LSCSF is within existing paved areas (e.g., Hawes
Avenue).
2. The proposed project will not reduce the ability of LSCSF to buffer more
inland areas from flooding and wave damage as it will not result in net fill
or changes in flood stage and/or velocity.
3. The proposed work will not displace or divert flood waters to other areas.
4. The proposed work will not cause or create the likelihood of damage to
other structures on land within LSCSF.
5. The project will not cause ground or surface pollution triggered by coastal
storm flowage.
6. The work within LSCSF will not negate the BMPs implemented for the work
within other resource areas, including as required under Chapter 704 for
work within the 100-foot Buffer Zone.
7. The work will not impact areas suitable for inland migration of Salt Marsh.
All impacts to LSCSF will be restored in-kind.
5.2.3 Abutter Notification
Abutters have been notified in accordance with Chapter 237-5A of the Barnstable
Wetlands Protection Bylaw, Chapter 706 of the Barnstable Wetlands Protection
Regulations, as well as 310 CMR 10.05(4). Copies of the abutter notification form and
list of abutters are provided in Appendix E.
5.3 Other Pertinent Regulatory Programs
5.3.1 State
5.3.1.1 Project Notification Form
New construction projects that require funding, licenses, or permits from any state or
federal governmental agencies must be reviewed by the Massachusetts Historical
Commission (MHC) for impacts to historic and archaeological properties. On February
14, 2025, a PNF was submitted to the MHC as well as the Massachusetts Board of
Underwater Archaeological Resources (MA BUAR) and all geographically pertinent Tribal
Historic Preservation Officers (THPOs) to determine potential impacts on historical,
cultural, and/or archaeological resources. In their response dated March 12, 2025, MHC

Hawes Avenue Culvert Repair Project - Notice of Intent 5-9
indicated that the proposed project is unlikely to affect significant historic or
archaeological resources. As of the date of this NOI application , no response has been
received from MA BUAR or the THPOs. Should artifacts or human remains be
encountered during construction, work will be halted, and appropriate agencies will be
notified. Information regarding historical resources is included in Appendix D.
5.3.1.2 Massachusetts Endangered Species Act (MESA)
The proposed work is within the limits of mapped Estimated and Priority Habitats
according to the NHESP Natural Heritage Atlas Map (15 th edition, August 2021). An
Information Request was submitted to NHESP on February 5, 2025. On March 6, 2025,
NHESP indicated that the proposed activities occur within mapped habitat of Piping
Plover and Least Tern. As discussed in Section 2.3, this NOI has been submitted for a
streamlined review under MESA. The work will incorporate appropriate construction-
period BMPs as recommended by NHESP to avoid and minimize impacts to state-listed
species and their habitats. NHESP correspondence is provided in Appendix D.
5.3.1.3 Section 401 of the Federal Clean Water Act
The proposed work will require an Individual 401 Water Quality Certification (WQC)
because the project requires a federal permit and will result in a discharge of dredged or
fill material to Waters of the United States (e.g., Salt Marsh) within the Commonwealth
of Massachusetts. An application for a 401 WQC will be submitted to MassDEP following
this NOI application.
5.3.2 Federal
5.3.2.1 Section 404 of the Federal Clean Water Act and Section 10 of the Rivers
and Harbors Act
The proposed work will result in impacts to Waters of the United States and thus
requires review by the Army Corps of Engineers (the Corps) under Section 404 of the
Federal Clean Water Act and Section 10 of the Rivers and Harbors Act. A Pre-
Construction Notification (PCN) application for coverage under the 2023 Massachusetts
General Permits was submitted to the Corps on April 2, 2025, and assigned file number
NAE-2025-00941.
5.3.2.2 Coastal Zone Management Act
The proposed work is within a Coastal Zone and thus requires a Coastal Zone
Management (CZM) Federal Consistency Review. This review will be undertaken by the
Massachusetts Office of CZM concurrently with the Corps review of the PCN application.

NOTIFY THE ENGINEER IN WRITING FOR RESOLUTION OF THE CONFLICTING INFORMATION.
11. PROTECT AND MAINTAIN ALL UTILITIES IN THE AREAS UNDER CONSTRUCTION DURING THE
WORK. LEAVE ALL PIPES AND STRUCTURES WITHIN THE LIMITS OF THE CONTRACT IN A CLEAN
AND OPERABLE CONDITION AT THE COMPLETION OF THE WORK. TAKE ALL NECESSARY
PRECAUTIONS TO PREVENT SAND AND SILT FROM DISTURBED AREAS FROM ENTERING THE
DRAINAGE SYSTEM.
12. NOTIFY THE ENGINEER IN WRITING OF ANY CONFLICT, ERROR, AMBIGUITY, OR DISCREPANCY
WITH THE PLANS OR BETWEEN THE PLANS AND ANY APPLICABLE LAW, REGULATION, CODE,
STANDARD SPECIFICATION, OR MANUFACTURER'S INSTRUCTIONS.
13. THE CONTRACTOR IS RESPONSIBLE FOR SUPPORT OF EXISTING UTILITIES AND REPAIR OR
REPLACEMENT COSTS OF UTILITIES DAMAGED DURING CONSTRUCTION, WHETHER ABOVE OR
BELOW GRADE. REPLACE DAMAGED UTILITIES IMMEDIATELY AT NO ADDITIONAL COST TO THE
OWNER AND AT NO COST TO THE PROPERTY OWNER.
14. TAKE NECESSARY MEASURES AND PROVIDE CONTINUOUS BARRIERS OF SUFFICIENT TYPE,
SIZE, AND STRENGTH TO PREVENT ACCESS TO ALL WORK AND STAGING AREAS AT THE
COMPLETION OF EACH DAYS WORK.
15. NO OPEN TRENCHES WILL BE ALLOWED OVER NIGHT. THE USE OF ROAD PLATES TO PROTECT
THE EXCAVATION WILL BE CONSIDERED UPON REQUEST, BUT BACKFILLING IS PREFERRED.
16. THE CONTRACTOR IS RESPONSIBLE FOR ALL NECESSARY TRAFFIC CONTROL/SAFETY DEVICES
TO ENSURE SAFE VEHICULAR AND PEDESTRIAN ACCESS THROUGH THE WORK AREA, OR FOR
SAFELY IMPLEMENTING DETOURS AROUND THE WORK AREA. PERFORM TRAFFIC CONTROL IN
ACCORDANCE WITH THE APPROVED TRAFFIC CONTROL PLAN.
17. MAINTAIN EMERGENCY ACCESS TO ALL PROPERTIES WITHIN THE PROJECT AREA AT ALL TIMES
DURING CONSTRUCTION.
18. WHEN WORKING IN THE ROAD, PROVIDE THE OWNER AND LOCAL FIRE/POLICE/SCHOOL
AUTHORITIES A DETAILED PLAN OF APPROACH INDICATING METHODS OF PROPOSED TRAFFIC
ROUTING ON A DAILY BASIS. PROVIDE COORDINATION TO ENSURE COMMUNICATION AND
COORDINATION BETWEEN THE OWNER, CONTRACTOR AND LOCAL FIRE/POLICE/SCHOOL
AUTHORITIES THROUGHOUT THE CONSTRUCTION PERIOD.
19. REMOVE AND DISPOSE OF ALL CONSTRUCTION-RELATED WASTE MATERIALS AND DEBRIS IN
ACCORDANCE WITH ALL APPLICABLE LOCAL, STATE, AND FEDERAL LAWS.
20. THE TERM "DEMOLISH" AND "R&D" USED ON THE DRAWINGS MEANS TO REMOVE AND DISPOSE
OF IN ACCORDANCE WITH LOCAL, STATE, AND FEDERAL REQUIREMENTS.
21. THE TERM "ABANDON" USED ON THE DRAWINGS MEANS TO LEAVE IN PLACE AND TAKE
APPROPRIATE MEASURES TO DECOMMISSION AS SPECIFIED OR NOTED ON THE DRAWINGS.
22. ALL PROPOSED WORK MAY BE ADJUSTED IN THE FIELD BY THE OWNER'S PROJECT

1. ALL PAVEMENT DAMAGED BY THE CONTRACTOR'S OPERATIONS SHALL BE REPLACED IN
ACCORDANCE WITH THE CONTRACT DOCUMENTS AT NO ADDITIONAL COST TO THE OWNER.
2. PROTECT PROJECT FEATURES (E.G., WALLS, FENCES, MAIL BOXES, SIGNS, SIDEWALKS,
CURBING, STAIRS, UTILITY POLES, GUY WIRES, WALKWAYS, TREES, ETC.) FROM DAMAGE
DURING CONSTRUCTION, INCLUDING PROVIDING TEMPORARY SUPPORTS, WHEN
APPROPRIATE.
3. IF REMOVAL OF PROJECT FEATURES IS REQUIRED IN ORDER TO PERFORM THE PROPOSED
WORK, REMOVE THOSE SITE FEATURES ONLY UPON APPROVAL OF ENGINEER. REPLACE ALL
REMOVED PROJECT FEATURES; NEW ITEMS SHALL BE EQUAL OR BETTER IN QUALITY AND
CONDITION TO THE ITEMS REMOVED.
4. EXISTING SURVEY MONUMENTS DISTURBED BY THE CONTRACTOR SHALL BE REPLACED BY A
LAND SURVEYOR LICENSED IN THE STATE IN WHICH THE WORK IS PERFORMED AT NO
ADDITIONAL COST TO THE OWNER.
5. COORDINATE THE ADJUSTMENT OF EXISTING UTILITY STRUCTURES WITH EACH RESPONSIBLE
UTILITY OWNER PRIOR TO RECONSTRUCTION AND/OR PAVING OPERATIONS. RAISE ALL
STRUCTURES TO FINISHED GRADES PRIOR TO THE END OF THE CONSTRUCTION SEASON AND
PRIOR TO FINISHED PAVING.
6. REPAIR DISTURBED PAVED SURFACES AT THE END OF EACH WORK WEEK, UNLESS
OTHERWISE APPROVED/REQUIRED BY THE OWNER.
7. TRANSFER ALL TEMPORARY BENCHMARKS, AS NECESSARY.
8. RESTORE ALL AREAS DISTURBED BY THE CONTRACTOR BEYOND THE PROJECT LIMITS TO
ORIGINAL CONDITIONS AT NO ADDITIONAL COST TO THE OWNER.
9. REGRADE ALL UNPAVED AREAS DISTURBED BY THE WORK AS REQUIRED. REPAIR/REPLACE
PAVED SURFACES DISTURBED BY THE WORK IN-KIND, UNLESS OTHERWISE NOTED. RESTORE
SURFACES TO EXISTING OR PROPOSED CONDITIONS AS INDICATED ON THE DRAWINGS.
1. ADJUSTMENTS TO THE PROPOSED STORM DRAIN LAYOUTS AND ELEVATIONS SHALL NOT BE
CONSIDERED CAUSE FOR ADDITIONAL PAYMENTS. THE CONTRACTOR SHALL NOT MAKE
PROPOSED STORM DRAIN LAYOUT AND ELEVATION ADJUSTMENTS WITHOUT APPROVAL FROM
THE ENGINEER.
2. MAINTAIN OPERATION OF DRAINAGE SYSTEM DURING CONSTRUCTION. PROVIDE BYPASS
PUMPING OF DRAINAGE FLOWS AND/OR TEMPORARY CONNECTIONS, AS NECESSARY.
1. ANY WORK CONDUCTED IN SALT MARSH REQUIRING THE USE OF HEAVY EQUIPMENT MUST
UTILIZE LOW-GROUND-PRESSURE EQUIPMENT OR TIMBER MATS (WITH A MAXIMUM OF 2.8 PSI)
THAT ARE SPECIFICALLY DESIGNED TO SPREAD THE WEIGHT OF THE EQUIPMENT OVER A
LARGER AREA TO PREVENT COMPACTION OF THE UNDERLYING SOIL.
2. PLACE MATS ALONG THE TRAVEL AREA WITHOUT ANY GAPS AND SO THAT EACH BOARD IS
POSITIONED PERPENDICULAR TO THE DIRECTION OF TRAFFIC.
3. REMOVE MATS BY "BACKING" OUT OF THE SITE AND REMOVING MATS ONE AT A TIME.
REGRADE SOILS TO PRE-EXISTING CONTOURS WHILE TAKING CARE NOT TO COMPACT SOILS.
4. MONITORING OF WORK IN SALT MARSH SHALL DEMONSTRATE THAT COMPACTION OF THE
UNDERLYING SOIL AS A RESULT OF THE WORK HAS REBOUNDED FOLLOWING COMPLETION OF
THE WORK WITHIN THE SALT MARSH; THIS MAY INCLUDE ESTABLISHING BENCHMARK
ELEVATIONS PRIOR TO WORK COMMENCING. FAILURE OF THE SALT MARSH REBOUNDING
FOLLOWING THE COMPLETION OF WORK SHALL BE CONSIDERED A PERMANENT IMPACT TO
THE SALT MARSH.
5. EXCAVATION WITHIN THE SALT MARSH SHALL BE COMPLETED IN A MANNER THAT KEEPS
PEAT, ROOTS, AND VEGETATION INTACT TO BE STOCKPILED AND MAINTAINED AND THEN
REPLANTED FOLLOWING CONSTRUCTION.
6. DUNE MATERIAL SHALL BE STOCKPILED AND SEGREGATED BY TYPE AND REPLACED IN KIND.
THE TOP LAYERS OF DUNE ARE ROUNDED, UNIFORM, WIND-BORNE MATERIAL. THE SECOND
LAYER OF MATERIAL MAY BECOME MORE ANGULAR AND VARIED IN SIZE DISTRIBUTION.
THESE MATERIAL TYPES SHALL BE REPLACED AT SIMILAR ELEVATIONS DURING SITE
RESTORATION WITH THE ROUNDED, WIND-BORNE MATERIAL FROM THE TOP LAYERS USED AS
THE TOP DRESSING FOR SITE RESTORATION TO MIMIC PRE-EXISTING DUNE CONDITIONS.

The Town of Barnstable is proposing the repair of an existing culvert located beneath Hawes
Avenue approximately 180 feet west of Ocean Street that conveys a tidal stream northwest
to southwest from a salt marsh into Hyannis Harbor via Kalmus Beach. Structural deficiencies
of the culvert are resulting in sinkholes and frequent ponding in the roadway. Replacement of
a portion of the existing reinforced concrete pipe (RCP) will prevent further deterioration and
potential failure of the infrastructure. This memorandum provides an overview of existing
jurisdictional wetland resource areas identified within and adjacent to the Project Site.
1 Wetland Resource Area Investigation
1.1 Methodology of Resource Area Investigation
On July 16, 2024, a Tighe & Bond wetland scientist conducted a site visit to identify and
delineate wetland resource areas and evaluate the jurisdictional status of each resource area
relative to local, state, and federal regulations. This wetland delineation was conducted in
accordance with the Massachusetts Handbook for Delineation of Bordering Vegetated
Wetlands (2022), the 1987 Corps of Engineers Wetlands Delineation Manual, the Regional
Supplement to the Corps of Engineers Wetlands Delineation Manual - Northcentral and
Northeast Region (2012), and Field Indicators for Identifying Hydric Soils in New England
(Version 4, 2017).
1.2 Summary of Wetland Resource Areas
Wetland resource areas subject to jurisdiction under the Massachusetts Wetlands Protection
Act (MAWPA; M.G.L. c. 131 § 40) and Sections 401 and 404 of the Clean Water Act have been
identified within the Site, as summarized below:

1.2.1 Salt Marsh / Vegetated Wetland / Land Below HTL and MHT
Salt Marsh is defined at 310 CMR 10.32(2) as “a coastal wetland that extends landward up to
the highest high tide line, that is, the highest spring tide of the year, and is characterized by
plants that are well adapted to or prefer living in, saline soils. Dominant plants within salt
marshes typically include salt meadow cord grass (Spartina patens) and/or salt marsh cord
grass (Spartina alterniflora), but may also include, without limitation, spike grass (Distichlis
spicata), high-tide bush (Iva frutescens), black grass (Juncus gerardii), and common
reedgrass (Phragmites). A salt marsh may contain tidal creeks, ditches and pools.”
Vegetated Wetlands are defined at defined at 33 CFR § 328.3(c)(1) as “those areas that are
inundated or saturated by surface or ground water at a frequency and duration sufficient to
support, and that under normal circumstances do support, a prevalence of vegetation typically
adapted for life in saturated soil conditions. Wetlands generally include swamps, marshes,
bogs, and similar areas.”
The HTL is defined at 33 CFR § 328.3(c)(3) as “the line of intersection of the land with the
water’s surface at the maximum height reached by a rising tide. The high tide line may be
determined, in the absence of actual data, by a line of oil or scum along shore objects, a more
or less continuous deposit of fine shell or debris on the foreshore or berm, other physical
markings or characteristics, vegetation lines, tidal gages, or other suitable means that
delineate the general height reached by a rising tide. The line encompasses spring high tides
and other high tides that occur with periodic frequency but does not include storm surges in
which there is a departure from the normal or predicted reach of the tide due to the piling up
of water against a coast by strong winds such as those accompanying a hurricane or other
intense storm.”

The MHT line is defined at 314 CMR 9.02 as “the line where the arithmetic mean of the high
water heights observed over a specific 19-year Metonic cycle (the National Tidal Datum Epoch)
meets the shore and shall be determined using hydrographic survey data of the National
Ocean Survey of the U.S. Department of Commerce.”
The HTL/MHT line in this area is at 1.36 feet in elevation, as determined by the existing tidal
datum information from the National Oceanic and Atmospheric Administration (NOAA).
Salt Marsh was demarcated in the field with flag series 1A. The landward limit of Salt Marsh
extended above the HTL in some areas, and dominant vegetation observed included salt
meadow cord grass (Spartina patens) and salt marsh cord grass (Spartina alterniflora).
1.2.2 Bordering Vegetated Wetland / Vegetated Wetland
Bordering Vegetated Wetlands (BVW) are defined at 310 CMR 10.55(2)(a) as “… freshwater
wetlands which border on creeks, rivers, streams, ponds and lakes. The types of freshwater
wetlands are wet meadows, marshes, swamps and bogs. Bordering Vegetated Wetlands are
areas where the soils are saturated and/or inundated such that they s upport a predominance
of wetland indicator plants. The ground and surface water regime and the vegetation
community which occur in each type of freshwater wetland are specified in M.G.L. c 131 sec.
40.”
Vegetated Wetlands are defined at defined at 33 CFR § 328.3(c)(1) as “those areas that are
inundated or saturated by surface or ground water at a frequency and duration sufficient to
support, and that under normal circumstances do support, a prevalence of vegetation typically
adapted for life in saturated soil conditions. Wetlands generally include swamps, marshes,
bogs, and similar areas.”
A BVW fringe adjacent to Salt Marsh was demarcated in the field with flag series 1B. Common
vegetation observed in this wetland included common reed (Phragmites australis; FAC),
groundsel bush (Baccharis halimifolia; FACW), common greenbrier (Smilax rotundifolia; FAC),
fox grape (Vitus labrusca; FACU), and Virginia creeper (Parthenocissus quinquefolia; FACU).
Soils observed in the wetland consisted of fibric muck (10YR 2/1) 0 to 12 inches below the
soil surface and sand (10YR 3/1) at 12 to 20 inches (Indicators A2 (histic epipedon) and A3
(black histic)).
Indicators of wetland hydrology observed at the time of delineation in this wetland included
a high water table (A2; 8 inches) and soil saturation to the surface (A3).
1.2.3 Coastal Dune
Coastal Dune is defined at 310 CMR 10.28(2)as “any natural hill, mound, or ridge of sediment
landward of a coastal beach deposited by wind action or storm overwash. Coastal dune also
means sediment deposited by artificial means and serving the purpose of storm damage
prevention or flood control.”
Coastal Dune was demarcated in the field with flag series 1C and 1D. Common dune
vegetation observed included dune grass (Ammophila breviligulata; UPL), common juniper
(Juniperus communis; FACU), yarrow (Achillea millefolium; FACU), multiflora rose (Rosa
multiflora; FACU), groundsel bush, seaside goldenrod (Solidago sempervirens; FACW),
oriental bittersweet (Celastrus orbiculatus; FACU), beach rose (Rosa rugosa; FACU), Japanese
black pine (Pinus thunbergii), common St. Johnswort (Hypericum perforatum; UPL), Spotted

knapweed (Centaurea stoebe), small bayberry (Morella caroliniensis; FAC), and curly dock
(Rumex crispus, FAC).
1.2.4 Coastal Bank
Coastal Bank is defined at 310 CMR 10.30(2) as “the seaward face or side of any elevated
landform, other than a coastal dune, which lies at the landward edge of a coastal beach, land
subject to tidal action, or other wetland.”
Coastal Bank of Hyannis Harbor was demarcated in the field with flag series 1E. Bank in this
area is comprised of a riprap seawall approximately 4 feet high with concrete backing along
the perimeter of an elevated residential lot.
1.2.5 Land Under the Ocean
Land under the Ocean is defined at 310 CMR 10.25(2) as “land extending from the mean low
water line seaward to the boundary of the municipality’s jurisdiction and includes land under
estuaries.”
The Mean Low Water line in this area is at -2.0 feet in elevation, as determined by the existing
tidal datum information from NOAA. Land under the Ocean associated with Hyannis Harbor is
categorized as a subtidal marine system with an unconsolidated bottom (M1UBL).
1.2.6 Coastal Beach
Coastal Beach is defined at 310 CMR 10.27(2) as “unconsolidated sediment subject to wave,
tidal, and coastal storm action which forms the gently sloping shore of a body of salt water
and includes tidal flats. Coastal beaches extend from the mean low water line landward to the
dune line, coastal bankline or the seaward edge of existing human -made structures, when
these structures replace one of the above lines, whichever is closest to the ocean.”
Coastal Beach (i.e., Kalmus Beach), was demarcated in the field with flag series 1F. Kalmus
Beach can be classified as an intertidal marine system with an unconsolidated shore comprised
of sand material and is irregularly flooded (M2US2P).
1.2.7 Land Subject to Coastal Storm Flowage
Land Subject to Coastal Storm Flowage (LSCSF) is defined at 310 CMR 10.04 as “land subject
to any inundation caused by coastal storms up to and including that caused by the 100 -year
storm, surge of record or storm of record, whichever is greater.”
Tighe & Bond reviewed the most recent flood data available from the Federal Emergency
Management Agency (FEMA) for the Site and surrounding area. According to the FEMA Flood
Insurance Rate Map (FIRM; Community-Panel No. 25001C0568J, effective date: July 16,
2014) for the Town of Barnstable, the entirety of the Site is within the limits of areas subject
to a 100-year flood (Zone AE, Base Flood Elevation 13 feet and Zone VE, Base Flood Elevation
14 feet). The proposed work associated with the project is within Zone VE, which extends
from just north of the culvert inlet to Kalmus Beach. Zone AE is located north of the culvert
inlet and is comprised of Salt Marsh.

1.2.8 Riverfront Area
Riverfront Area is defined at 310 CMR 10.58(2)(a) as “the area of land between a river's mean
annual high water line and a parallel line measured horizontally. The riverfront area may
include or overlap other resource areas or their buffer zones. The riverfront area does not
have a buffer zone.”
The proposed work will take place within Riverfront Area associated with the tidal tributary
associated with Snow’s Creek conveyed through the existing culvert. Riverfront Area within
the Project Site consists of Salt Marsh, Coastal Dune, Coastal Beach, Hawes Avenue, and
residential development.

be submitted to the Division so that it is received at the same time as the local conservation commission. If the

state-protected wildlife, then the proposed project may not be permitted (310 CMR 10.37, 10.58(4)(b) & 10.59). In
such a case, the project proponent may request a consultation with the Division to discuss potential project design
modifications that would avoid adverse effects to state-listed wildlife habitat.
A streamlined joint MESA/WPA review process is available. When filing an NOI, the applicant may file concurrently
