1.0 OVERVIEW
1.1 Introduction
CAPE & ISLANDS ENGINEERING, INC. is submitting this Notice of Intent (NOI) application, on behalf
of the applicant and owner Harold C. Coxall Jr, Trustee of the Harold C. Coxall Jr Trust, for the
proposed project at 265 Sea View Avenue (Property ID: 138 020) in Barnstable. The project as
proposed is to lift the existing single-family dwelling onto a new foundation, additions, pool, pool house
with living space, and bank restoration with mitigation planting.
The additions are an expansion of living space to the west as well as a proposed garage on the east
side. The existing screened in porch in the 0-50 is being reduced in size with a net reduction of
hardscape in the 0-50-ftbuffer. The pool and cabana are proposed outside the 0-50-ftbuffer and
drainage structures are proposed to be used as a pool drawdown pit. The proposed work incorporates
all associated appurtenances including a driveway, additional septic tank, ac units, and generator.
The work includes an invasive management and bank restoration plan designed by Wilkinson
Ecological Design (WED). Work will occur within Land Subject to Coastal Storm Flowage (LSCSF) and
within 100 feet of coastal resources.
1.2 Applicable Regulations
This application has been filed jointly with the Department of Environmental Protection, pursuant to the
Commonwealth of Massachusetts Wetlands Protection Act (MWPA, M.G.L. Chapter 131, Section 40)
in accordance with its implementing regulations (310 CMR 10.00); and the Town of Barnstable,
pursuant to Town of Barnstable Wetlands Protection Bylaw (Chapter 237 of the Town Code) and
implementing regulations.
2.0 BACKGROUND
2.1 Existing Conditions
The project site is located at 265 Sea View Avenue is a private residentially developed property with
frontage of Nantucket Sound to the south. The developed portion of the property is relatively flat within
the stairs an a deck to access the steep slope along to access the waters of Nantucket Sound. The lot
is occupied by a single-family dwelling, a brick path, gravel parking along the street, fencing, an
observational deck and stairs, maintained lawn, landscaping, and areas of natural vegetation. The
existing foundation is aged and in need of replacement.
A rip rap revetment and a stone groin exist along the southern limits. The home is service by a septic
system and connected to public utilities. Developed residential properties border the property on all
sides and a vacant lot exists directly north of the subject parcel.
2.2 Property History
The property at 265 Sea View Avenue is a 0.91 acre developed lot shown on the Town of Barnstable
Assessors as Map 138 Parcel 020. The lot has been recorded in the Barnstable Registry of Deeds
under Certificate of Title 238241. The property was originally developed in 1890 and was effectively
built as a legal single family residence per the Town Assessors records.

2.3 Site Characteristics
Jurisdictional wetland resources identified on or within 100 feet of the property include LSCSF, Coastal
Bank, Coastal Beach, and Land Under the Ocean. The limits of the resource areas were ground
surveyed in the field, and are shown on the plans.
According to the Federal Emergency Management Agency (FEMA) Flood Insurance Rate Map (FIRM)
Community Panel No. 25001C0757J, Effective July 16, 2014, a portion of the property is located within
minimal flood hazard Zone X, and the 100-year floodplain Flood Zone VE (E.L. 16) (NADV 88).
The Massachusetts Natural Heritage and Endangered Species Program (NHESP) Atlas (15th edition,
August 1, 2021) and MassGIS online were consulted, and the project site does not fall within
Estimated Habitats of Rare Wildlife or Priority Habitats of Rare Species. There are no vernal pools
within 300 feet of the site.
The project is not located within the limits of an Area of Critical Environmental Concern, Outstanding
Resource Waters, or Zone II Wellhead Protection Areas. The project involves work on a single-family
dwelling and is exempt for Massachusetts Stormwater Standards.
3.0 PROPOSED PROJECT
3.1 Scope of Work
The applicant requests permission to lift the existing dwelling onto a new foundation with a new first
floor elevation at 21.16. Several existing features including decks and porches will be removed to
allow for the proposed additions. An attached garage is proposed along the eastern face of the
dwelling at the location of an existing deck. A stone driveway will extend from the garage to Sea View
Avenue. A residential addition is proposed extending from the western side of the dwelling with a
covered porch. Additionally, a pool patio area with a separate pool house and ADU is proposed west
of the proposed extension. A 1,500 gallon septic tank is proposed in the design to accommodate for
the living space in the cabana which meets the criteria as an ADU.
All appearances and associated features are included in the design. The brick walk leading to the front
of the house will be replaced with a new walkway and portions of the decks and porched will be
removed to allow for the necessary work. An extensive restoration plan is prepared by WED for the
increase in hardscapes. All of the work will occur within the 0-50 and 50-100 foot Buffer Zones from
the Top of Coastal Bank.
3.2 Construction Methodology
Prior to the start of work, the Order of Conditions and DEP File Number will be posted at the site an
the Conservation Commission will be notified in advance that work will be starting on site.
The limit of work, consisting of compost roll with a silt fence backing, will be installed as shown on the
drawings to enclose and confine the project for the construction. The limit of work will be maintained
throughout the construction phase and until ground surfaces are stabilized. Efforts will be coordinated
to minimize construction time and disturbance within and around the subject resource areas.
The area around the house will be dug out for the blocks used to lift the house will be set and steel
beams will be installed under the house. Once the house is lifted the material and cape cod basement
under the existing house will be excavated. The area will be prepared for the new foundation including
compacting the existing material. Forms will be installed for the new concrete foundation and concrete

will be poured. Once this is complete the area will be backfilled, and the house will be set on the new
foundation.
Construction of the additions will be in previously disturbed areas. The additions will be constructed
once the existing house is set on the new foundation.
Construction of the pool will be typical pool construction with excavating the site and shooting the pool
with shotcrete or another concrete type pool. The pool house will be constructed on a crawl space with
typical timber framing. The pool house will be connected to the existing septic system with the addition
of another septic tank due to the pool house meeting the definition of an ADU, a second tank is
required per the updated guidelines.
Areas temporarily disturbed by construction activities will be stabilized and returned to pre-existing
conditions. After all the work has been completed a site inspection will be carried out by the engineer
and a request for a Certificate of Compliance submitted to the Commission once all applicable
conditions have been satisfied.
3.3 Anticipated Impacts
All of the proposed hardscape work associated with the project will occur within the 0-100-foot Buffer
Zone from the Top of Coastal Bank. The proposed work will result in a 334 sf of decrease in
developed areas within the 0-50 ft Buffer Zone and a 2,649 sf increase in developed areas within the
50-100 ft Buffer Zone. A total of 6,620 sf of mitigation is proposed for the increase in structures and
hardscapes. All the proposed hardscape construction work falls within previously disturbed and
maintained lawn areas or in areas that are taken over by invasive species. See the Wilkenson

4.0 AVOIDANCE, MINIMIZATION AND MITIGATING MEASURES
4.1 Avoidance and Minimization Measures
Prior to the commencement of any construction activities, erosion and sedimentation controls, (e.g.
siltation fence) will be installed as shown on the attached plan. The erosion and sedimentation
controls will function to keep sediment within the limits of work and will also serve to define the limit of
construction to site workers. Erosion and sedimentation controls will be maintained in good condition
at the site until disturbed areas have been restored.
Any staging areas will be located on the existing lawn and away from resource areas. No debris,
equipment or materials will be stored directly in resource areas. Any temporary disturbances to
resource areas will be restored to pre-construction conditions after work is complete. All ground
disturbances will be kept to the minimum necessary to complete the construction, and adjacent
resource areas will be avoided to the maximum extent possible. Upon completion, temporarily
disturbed areas will be restored upon completion.
Mitigation demarcation is proposed along the proposed mitigation area to provide a visual
representation of where the no disturbance areas begin. The plan calls out 24” long 4”x4” stone posts
to be buried 12” with 12” exposed. This is shown as example #6 in the approved boundary markers for
mitigation area & buffer zone demarcation guideline.
4.2 Mitigation Measures
Mitigation guidelines are set forth in Chapter 704 of the Barnstable Town Code under regulations
governing activities in the 100 foot Buffer Zone. There will be a reduction in hardscapes within the 0-

50-ft Buffer Zone and a increase in hardscapes within the 50-100 ft Buffer Zone for a net increase of
2,649 sf. total in the buffer zone areas. At a 4:1 mitigation ratio in the 0-50 ft buffer zone and 3:1
mitigation ratio in the 50-100 ft Buffer Zone, a total of 6,611 sf of mitigation is required and 6,620 sf is
proposed. Refer to the Land Management Plan prepared by WED for more information.
5.0 WAIVER REQUEST
A waver is being requested for the lifting of a portion of the existing screened in porch is within the
existing 0-50-ft buffer. The 0-50-ft Buffer Zone is considered disturbed as a portion of the dwelling is
located within this area and the remaining area consists of maintained lawn.
The reduction of hardscape as part of the removal of part of the porch and decks constitutes a 334 sf
reduction in the 0-50-ft buffer and a substantial mitigation and bank restoration is part of this project as
shown on the WED land management plan. A total of 6,620 sf of native plants are proposed to revegetate
a large portion of the 0-50-ft Buffer Zone currently maintained as lawn. All of the proposed mitigation will
be provided on site and the planting location can be seen on both plans. Please refer to the plans and
Land Management Plan prepared by WED for more information. The result will serve as a net benefit to
resource areas and a waiver from the performance standards listed in Chapter 705 of the Barnstable
Town Code is requested.
6.0 APPLICABLE PERFORMANCE STANDARDS
The following is a discussion of how the proposed project meets the performance standards under the
state and local regulations for each jurisdictional resource area impacted as a result of the project
activities.
5.1 Buffer Zone
Definitions and performance standards for activities in the Buffer Zone are set forth locally in Chapter
704 of the Barnstable Town Code. The 0-50-ft and 50-100-foot Buffer Zones are defined from the most
landward resource from the Top of Coastal Bank to Nantucket Sound.
The 0-50-ft Buffer Zone is not undisturbed and consists of some hardscape, including the porch and a
portion of the dwelling, as well as maintained grass lawn and landscaped plantings. The entire home
falls within the 100-foot Buffer Zone and all of the proposed expansions are limited to the 50-100 ft
Buffer Zone.
There will be a 334 sf DECREASE within the 0-50-ft Buffer Zone due to the removal of the existing
porch and decks and a 2,649 sf INCREASE within the 50-100 foot Buffer Zone as a result of the
additions. The proposed work includes hardscape alteration within a disturbed 0-50-ft Buffer Zone,
however the work will result in an overall decrease in hardscapes within 50-feet and a waiver is not
anticipated.
5.2 Coastal Bank
Definitions and performance standards for activities within Coastal Bank are set forth in 310 CMR
10.30 and are referenced in Chapter 705 of the Barnstable Town Code. The top of Coastal Bank is
defined where the slope becomes less than 18%. The top of slope was ground surveyed and flagged
in the field as shown in the project plans.
The proposed mitigation is located along the edge of the Top of Coastal Bank and will serve to better
protect the stability of the bank and improve the wildlife habitat value of the area. There will be no
bank disturbance by this project. The Coastal Bank is not considered an eroding bank according to

the CZM Coastal Erosion Analysis Tool and the proposed restoration area serves to benefit the
resource area. Best management practices will be implemented to avoid adverse impacts.
5.3 Land Subject to Coastal Storm Flowage (LSCSF)
Performance standards for LSCSF are not defined on a state or local level. A portion of the restoration
work totalling 3,040 sf falls within LSCSF defined by Flood Zone VE (EL 16). The work for the
proposed restoration work and invasive species removal will not adversely impact LSCSF. Rather, the
restoration area will serve to improve the areas’ ability to protect against storm surges and flood
events.
7.0 SUMMARY
6.1 Performance Standard Metrics
The existing wetland resources, anticipated project impacts and the proposed impact reduction
measures associated with this project have been fully documented within this Notice of Intent
application. Based on the information provided in this application it is asserted that the following
project features would result in no a benefit to the associated resource area will have no adverse
effect on the subject resource area(s) values and functional characteristics. The project should be
approved for the following reasons:
•The proposed project results in a decrease of impervious surfaces in the 0-50-ftbuffer zone.
•All of the proposed expansions are located outside of the 0-50 ft Buffer Zone. No hardscape
construction work is proposed within LSCSF.
•The project will not cause unacceptable significant or cumulative effect upon resource area
values, functions, or characteristics. With the proposed drainage structure there will be a net
benefit to the resource area.
The project conforms to the Massachusetts Wetlands Protection Act, (MWPA, M.G.L. Chapter 131,
Section 40) and its implementing regulations (310 CMR 10.00) and the Barnstable Wetlands
Protection Bylaw, (Chapter 237 of the Town Code) and implementing Regulations (Part VII of the
Town Code) and will not cause unacceptable significant or cumulative effect upon the resource area
values.
6.2 Request for Order of Conditions
The Applicant has demonstrated and documented evidence that this project meets or exceeds all the
relevant performance standards set forth in the governing regulations and respectfully request this
project be approved and that an Order of Conditions be issued to the Applicant through its
representative.
