Our original site visit was to be on Thursday, 7/10/25 along with Corey, however the weather was not cooperating, so we moved it to Friday, 7/11/25 at 2:00PM, and Corey was not able
to attend.
During our 7/1/25 Historic Commission meeting, the applicant hadrequested topaint a sister building on the same property, with the same whitewashed brick and green trim. Commissioners
were concerned with the applicant’s interpretation of whitewash was not what the commissioners approved of during their original application; it appears to be painted, which was not
approved. During the discussion, Commissioners had further concerns that after seeing the work being done today, it was not the plan that was presented before us for approval. Particularly,
the original application was not to scale, so the materials, design, dimensions and layout, etc. could not fit in within the site which was approved. Specific concerns, lighting, bandstand
roof, tiki bar, design and placement, patio furniture, etc.,were not approved. The applicant Will Planinshek, admitted his original design plan and layout would not fit, and he has made
modificationsto get it to fit the site. He didn’t mention he was aware that any change to the approved design should have been back before the Commission. The applicant said he was willing
to work with us to make the project to be in compliant. He said he used the string lights that he saw other places were using on Main Street, we said they were not in complaint, which
is why we recommended Smiths Family - Neptune’s orPalioPizzeria patio globe lights (which are approved). The commission asked if he would come back to the next meeting (7/16/25) with
an updated plan, design and layout, lighting and materials, etc. So, the Commission can review to see if still approved, he agreed.
The Chair asked if we could form a sub-committee and go to the site to meet with them in person and go over what items were approved, vs. not approved. Commissioners Doherty and Cronin
volunteered to be part of the sub-committee and would work with Karen and Corey toarrange a sitevisit to walk through what is being done vs what was approved.
On Friday 7/11/25, Commissioner Doherty and Cronin met with Mr. Planinshek, at the site. After review and discussion, it was confirmed that the majority of what was built and being done
today was not approved by the HMSWHDC at the May 7, 2025 meeting.
White-Wash Brick – Close up inspection, you can see it is an attempted whitewash look. However, the brick is much too covered for the historic district example we provided. The applicant
has agreed to power wash it, to bring out more of the brick. Once he has done that, the commission can inspect to see if it is acceptable, and we would be able to approve the application
for the other building.
Landscaping and fencing – Due to the significant change in size and layout of the site, the landscape has been modified, and we have not received an updated landscape plan. Hanging plants
have been added, which work well.
Fencing (with matte surface) has been ordered and will be installed as soon as it arrives. The remaining landscape will be done after the fence is installed.
Stone pavers layout and design on patio works well for space. - No issues.
Tiki Bar – was to be a free-standing bar, underneath a wooden pagoda. All materials were, including the roof were to be wooden (as described in original application).
Currently, the bar design is not what was approved. It had to be downsized to fit the space and has fewer seats. It has thatched roof, not approved, and the design is completely different,
with painted art on the sides. Colors in the painting, (while they may be in the historic color palette), design and placement were not approved.
Thatch roofs are not allowed in the Historic District. Recommend it goes back to original stained wooden roof design.
There is no covering over the bar area – this should be noted in the updated scope and site layout being provided.
There is currently no plan for coverage in inclement weather.
Tiki bar posts are unpainted–and final design needs to be approved.
Lighting – Lamp posts were approved for 5, currently there are 4. The applicant is willing to look at additional if needed, once everything is in place.
Design was accepted by Corey; however, the model being used is color-changing (which is why we can see red lights), and which we would not have approved. The applicant said he can control
with a switch and will leave them white.
Other Lighting – Light strings hanging along fence, around the property, above tiki bar, and the building, etc. These were not approved.
During the first meeting, we recommended that if the applicant wanted to add other lighting, to use the globe lights currently used with Smith Family – Neptunes or Palio Pizzeria patio
areas.
All exterior string lights should be changed to a globe light style.
Band Stand – The band stand roof, is translucent ribbed green and white, and was approved by Corey. The applicant showed us a picture of the band stand design and dimensions he reviewed
with Corey and has noted it is a translucent material.
This should be noted, the roof was accepted as a variance by the HMSWHDC and would need approval if anyone else came before the commission is interested in using that material in the
future.
The band stand back has been updated to a more finished look, and acceptable.
The band stand has a painting hung in the background, not on plan.
Outside Patio – furniture, umbrellas, etc. – These were not on original plan or approved. The original approved application only had high top tables and chairs. Because scope and layout
have significantly changed, this should be re- reviewed by the commission.
Furniture design is okay; however, colors of cushions and umbrellas need to be brought before us.
We asked the applicant to include them, along with propane gas tables he has there now, on the updated scope and layout he gives us.
Additional outdoor alcove added to front entrance – this was to accommodate the ice maker, so it can be placed outside.
Commission may want to look to have it more finished on the outside, like what the band stand looks like.
At the conclusion of our site walk, the project scope, design and materials have been significantly changed from the original application presented to the Hyannis Main Street Waterfront
Historic District Commission on May 7, 2025. Therefore, in our opinion, the Certificate of Findings we voted on is not the same as what is there now on site and currently is not compatible
with the preservation and protection or the district; nor is the Certificate of Appropriateness as described in the submitted materials on the original application. (the outstanding
issues were permission from owner - provided, stage plans – provided and approved by Corey, landscape plan – not provided for existing site layout, lighting plan – not provided for existing
site plan, or for string lights, signage and placement on the pergola – not provided – pergola is no longer in the scope or site plan). There was no mention of the site design, scope
and plan they attached were not accurate.
Before we left, we explained this to Mr. Planinshek, we would be writing up a summary of the site visit, and reaffirmed, what he has built, is not the design, material, scope or project
the Hyannis Main Street Waterfront Historic District Commission approved. He said he is willing to work with us andhas agreed to provide an updated site plan to scale, which includes
all of items and placement on the site to the commission at our next meeting on July 16, 2025.
