Re: Request to Amend Order of Conditions SE3-5862
Dear Mr. Lee and Members of the Conservation Commission,
Applicant the Red Lily Pond Project Association, Inc. (“RLPPA”) requests that the
Barnstable Conservation Commission approve a fourth amendment to Order of Conditions SE3-
5862 (originally issued to permit removal of macrophytes) to permit installation of additional
benthic barriers in Lake Elizabeth and Red Lily Pond in the fall of 2025. These barriers would
supplement benthic barriers that were installed in Lake Elizabeth and Red Lily Pond under the
second and third amended OOCs in February 2024 and March 2025. The benthic barriers have
proven highly effective in preventing regrowth of macrophytes, have caused no detriment to
water quality, have provided clear passage for paddling recreational watercraft, and may have
enhanced wildlife habitat.
This Request for Amendment is submitted alongside a Notice of Intent, filed by TRC of
Waltham, to permit the use of herbicides on water-based plant species. Together, these
submissions are part of a three-prong approach to controlling water-based vegetation in Lake
Elizabeth and Red Lily Pond, consistent with the long-range plan for the bodies of water:
•We propose to continue limited annual manual cutting and removal of macrophytes as we
have done during four annual campaigns so far, under the existing OOC. However,
clearing alone cannot improve and maintain habitat for wildlife and recreational use:
there are limitations in the amount of vegetation that can be cut and cleared, and the
plants simply grow back (although there are immediate benefits in the reduction of plant
density, and lasting benefit in removing vegetation that would otherwise decompose and
add to the muck at the bottom of the bodies of water).
2
•The second prong is the installation of benthic barriers, which we performed in February
2024 and March 2025, and propose to do on an annual basis until we reach a total of 10%
of the plant growth area within Lake Elizabeth and Red Lily, in areas where manual
cutting and removal have been performed. The installation of benthic barriers provides a
more lasting solution, preventing and inhibiting plants from regrowing, but is
recommended on only up to 10% of the plant growth area in the bodies of water, as
discussed further below.
•The third prong is the application of herbicides to limited areas of the Pond and the Lake.
The application of herbicide is more comprehensive, less expensive, and less labor-
intensive, but requires repeated application of chemical herbicides, over many years, and
will result in additional decomposed material being added to the bottoms of the bodies of
water.
RLPPA suggests that a coordinated campaign using these three methods, combined with
the upcoming installation of a rehabilitated fish ladder system (an attractive and effective series
of pools and riffles which has been funded by federal and Barnstable funds), will greatly
enhance the ability of alewife herring to spawn in Lake Elizabeth, and restore attractive habitat
for wildlife and recreational uses (noncommercial fishing and use of nonmotorized watercraft,
such as kayaks, canoes, and paddleboards).
We have requested that the Conservation Commission consider at its meeting on August
19, 2025, both this requested Fourth Amendment to permit installation of additional benthic
barriers, and the NOI permitting application of herbicides.

Our mailing address is 39 Prospect Avenue, Centerville, MA 02632. We can also be
reached by email at dbf@hpm.com and deytonpatricia@gmail.com.
The project location is Red Lily Pond and Lake Elizabeth in Centerville, MA. The two
bodies of water constitute a Great Lake owned by the Commonwealth of Massachusetts and
therefore do not have a deed reference or plan and lot number. The Lake is located on
assessor’s map 226. A small portion of Lake Elizabeth is included within the property
boundaries for 29 Marie Avenue, Centerville, which is listed as Deed reference no. D1377838/0
(a deed was recorded affecting the property at Book 32905, Page 336), and
Map/Block/Lot: 226/135/001. The portion of Lake Elizabeth included within that parcel will
not be affected by this request for amendment. A property adjacent to the Lake (160 Lake
Elizabeth Road) is listed as Map/Block/Lot: 226/137. Red Lily Pond is located on assessor’s
map 227. A property adjacent to Red Lily Pond is listed as 0 Lake Elizabeth Drive,
Map/Block/Lot: 227/036.

We include below a detailed description of the proposed modification to OOC SE3-5862,
which includes an analysis of impacts to the interests of The Act and Ordinances. We include as
attachments Project Plans, an Overlay plan, an Assessor’s Map, Abutters List, and Draft
Abutters Notice.
Summary
RLPPA requests the Fourth Amendment to OOC SE3-5862 to permit installation of
additional benthic barriers in Lake Elizabeth and Red Lily Pond in the fall of 2025 (probably in
November 2025), and in subsequent years. These barriers would supplement benthic barriers
that were installed in Lake Elizabeth in February 2024 and in both Lake Elizabeth and Red Lily
Pond in March 2025. These benthic barriers have proven to be highly effective in preventing
regrowth of macrophytes, caused no detriment to water quality, provided clear passage for
paddling recreational watercraft, and potentially enhanced wildlife habitat. The total coverage
of benthic barriers if the Fourth Amendment is approved will be less than 10% of the plant
growth area within Lake Elizabeth and Red Lily Pond. A Massachusetts Department of
Environmental Protection (DEP) guidance encourages conservation commissions to issue a
Negative Determination of Applicability for benthic barrier use on up to 10% of the plant
growth area within a waterbody, as long as there are no state-listed (protected) species present:
there are none in Lake Elizabeth or Red Lily Pond. We envision that subsequent installations of
benthic barriers in Red Lily Pond will occur during the period between November 1 and March
14 in following years, to ensure that there will be no disturbance to alewife herring when they
are spawning. These proposed additional benthic barriers will be the subject of future requests
to amend OOC SE3-5852, or of new Notices of Intent.
Background
RLPPA manually removed vegetation from Lake Elizabeth and Red Lily Pond in four
annual campaigns under the First Amended Order of Conditions SE3-5862. In February 2024,
RLPPA installed the first benthic barrier over a portion of Lake Elizabeth where vegetation had
been removed. In March 2025, we installed additional benthic barriers in Red Lily Pond and
Lake Elizabeth. On September 20, 2024, we filed with the Conservation Commission a report
on the installation of the first benthic barrier. On July 26, 2025, we filed with the Conservation
Commission a report on the installation of the benthic barriers in March 2025.
Impact of First Benthic Barrier
The first benthic barrier was installed in Lake Elizabeth in February 2024. Volunteers
and one paid contractor installed a chain of benthic barriers that is 10’ wide and 240’ long over a
portion of Lake Elizabeth that was cleared of macrophytes in July 2023. The barrier covers an
area basically from the point where we installed a new dock (pursuant to Order of Conditions
4
SE3-6050), headed north toward (but not reaching)
the “Sandy Beach” on the causeway between Lake
Elizabeth and Red Lily Pond. A drone photo
(Figure 1, right) taken in June 2024 shows that the
benthic barrier is extremely effective: the water
surface is clear of vegetation above the benthic
barrier except for water lilies rooted on the edges of
the barrier that have spread slightly over the barrier,
and a very few water lilies that have grown up
through the openings between the 40’ long sheets
that were zip-tied together.
The area covered by the earlier installation of
a benthic barrier, about 2,400 square feet, was less
than 1 percent of the area of Lake Elizabeth (the
lake is about 5 acres large, or 245,000 square feet).
Impact of Benthic Barriers Installed in
March 2025
In March 2025, volunteers and one paid contractor installed four benthic barriers in Lake
Elizabeth and one benthic barrier in Red Lily Pond. The barriers were installed over areas of the
Lake and Pond that were cleared of macrophytes in July 2024. The benthic barrier installed in
March 2025 in Red Lily Pond, about 2,400 square feet, was only about 1 percent of the growth
area of Red Lily Pond (the Pond is about 202,000 square feet). The benthic barriers installed in
March 2025 in Lake Elizabeth, about 5,200 square feet, covered about 2 percent of the growth
area of Lake Elizabeth (the Lake is about 245,000 square feet). The total of benthic barriers
installed to date in Lake Elizabeth (7,600 square feet) covers a cumulative total of about 3
percent of the growth area of Lake Elizabeth.
Composite drone photos on the next page show the cumulative effectiveness of the
benthic barriers in Red Lily Pond (Figure 2) and in Lake Elizabeth (Figure 3). These
photographs were taken on June 3, 2025.
Figure 1. Zone of 2024 benthic barrier in Lake
Elizabeth.
5
The benthic barriers installed to date have fulfilled their purposes: paddling lanes have
been opened in Red Lily Pond and Lake Elizabeth. Habitat has been improved. And, most
importantly, the benthic barriers have prevented regrowth of cut and removed macrophytes.
Over the summers of 2024 and 2025, many kayaks and canoes have been observed paddling in
the Pond and the Lake, some for recreational fishing. Those fishing from the shores or the
docks have reported increased catches. Osprey have been seen with increasing frequency flying
over Lake Elizabeth and catching fish. And the benthic barrier relieved our volunteers from the
burden of manually recutting and removing macrophytes in some of the areas where we
removed the macrophytes in previous campaigns. We also believe that the creation of edge
habitat by the benthic barrier enhances habitat for fish and wildlife. Water quality monitoring
indicated no detectable impacts from benthic barrier placement (monitoring data were discussed
in detail in the report submitted to the Conservation Commission on August 15, 2024). We
anticipate being able to provide updated water quality results prior to the hearing on this request
for Amendment.

barrier installed in Red Lily Pond in March
2025 is outlined in red. (The area within
which we proposed to clear macrophytes in
July 2025 is outlined in yellow).

barriers installed in Lake Elizabeth in February
2024 and in March 2025 are outlined in red.

Request for Additional Benthic Barriers
We propose to place additional benthic barriers in Red Lily Pond and Lake Elizabeth this
fall in areas where macrophytes were cut and removed in July 2025. Please note that RLPPA is
not requesting permission to install benthic barriers that would impact additional areas of the
ponds beyond areas already impacted by macrophyte harvesting and removal. Rather, we
request authorization to supplement the macrophyte removal with a method known to provide
more lasting improvement in certain key areas where existing vegetation has been removed.
This will be the third annual campaign to place benthic barriers in Lake Elizabeth, and
the second for Red Lily Pond. We plan to install the benthic barriers in November 2025 (we
will notify the Conservation Commission Administrator and Herring Warden of the precise date
at least a week before the operation).
The benthic barriers require little maintenance: occasionally, gases generated by
decomposing vegetation below the benthic barrier cause the barrier to become buoyant, but
pressing the barrier back down toward the bottom of the lake easily causes the gas to be
released. The barriers will likely need to be removed, cleaned, and restored in the ponds once
every three or four years, but will last indefinitely. The material used in prior campaigns – and
that we propose to use again for this campaign – is the Lake Bottom Blanket. The Lake Bottom
Blanket is brown on one side and white on the other. The barrier will be placed with the brown
side up, since the ponds are not used for swimming, and placing the white side up is
recommended only where individuals will be swimming. The Lake Bottom Blanket is a solid
sheet material with vents which allow gases from decomposing vegetation to pass through the
material, and the barrier is weighted down by iron rebar placed at appropriate intervals in
sleeves that are sewn into the material. By way of reminder, under Massachusetts Department
of Environmental Protection (DEP) guidance, conservation commissions are encouraged to issue
a Negative Determination of Applicability for benthic barrier use on up to 10% of the plant
growth area within a waterbody, as long as there are no state-listed (protected) species present.
There are none in Lake Elizabeth or Red Lily Pond.
The areas outlining the spaces where we propose to install the benthic barriers under the
Fourth Amendment are included on the attached Project Plans. The areas where the barriers will
be placed are outlined in yellow; the approximate locations and sizes of the benthic barriers are
drawn in red. These areas are outlined on composites of drone photos taken in July 2025 after
this year’s macrophyte removal campaign was completed (a separate report on that operation
will be submitted to the Conservation Commission shortly).
The benthic barriers we propose to install, even when coupled with those installed in
January 2024 and March 2025, are well within the 10% limit of the plant growth area
recommended by DEP, since the entire areas of Lake Elizabeth and Red Lily Pond are capable
of supporting water-based vegetation. The additional benthic barriers will be installed in such a
7
manner as to allow corridors of regrowth of macrophytes between chains of barriers, to enhance
the edge habitat that is believed to be beneficial for fish and other aquatic creatures. Indeed, the
official Massachusetts document on pond management, the Generic Environmental Impact
Report (available at https://www.mass.gov/files/documents/2016/08/sd/eutrophication-and-
aquatic-plant-management-in-massachusetts-final-generic-environmental-impact-report-
mattson.pdf), recognizes that excessive plant growth, including dense populations of floating
attached macrophytes like water lilies, are detrimental to fish, stating as follows:
•Excessive aquatic plant growth can interfere with recreational lake uses such as
boating, swimming and fishing (at page 1-31).
•In addition to impeding recreational uses, excessive aquatic plant growth can also
result in the degradation of fish and wildlife habitat, strong fluctuations in
dissolved oxygen concentrations and pH, an increase of phosphorus release from
sediments and an acceleration of sediment deposition (at page 1-31).
•[Water lilies are] Attractive plants at low densities, [but] these species can cover
the entire water surface and create habitat and recreational impairment in shallow
lakes (at page 1-34).
In addition, the GEIR Report included a case study about the use of benthic barriers with
favorable results for fish populations, although anecdotal. It states (at page 2-47) that, at Great
Pond in Eastham, “No formal survey of impacts to aquatic animals was conducted, but
observations by divers involved in the study suggested that the wall of plants at the edge of the
[benthic barrier] cover provided edge habitat preferred by many fish, and substantial fish activity
was observed on and around the cover.” Likewise, the GEIR Report also states (at page 4-75)
that “some fish and invertebrates are attracted to the [benthic] barrier, as it creates open water
habitat and edge effect desired by some predators.” And, at page 4-76, the Report states, “While
the barriers are in place, some fish and invertebrates will find the created habitat more attractive
than the pre-treatment conditions, while others will not, but overall impacts on lake ecology
should be imperceptible.”
Finally, the GEIR Report mentions (at page 4-78) that, in terms of protecting fisheries,
benthic barriers have “Possible benefit (habitat enhancement) and possible detriment (food
source alteration, loss of cover), but over a relatively small area with no lakewide effects
expected.”
The online Bass Resource report (https://www.bassresource.com/fish_biology/fish-
edges.html) also emphasizes the important of edge diversity as being favorable to fish, including
the type of edge diversity that is achieved through creation of open water next to denser lines of
macrophytes: “Increasing edge diversity in water increases the diversity of aquatic organisms.”
8
As mentioned above, anglers on both Red Lily
Pond and Lake Elizabeth have reported much improved
success in catching bass in areas where benthic barriers
have been placed, or vegetation has been recently cut and
removed.
We include the calculations of coverage by benthic
barriers compared with lake growth areas below.
Red Lily Pond
As shown in the attached Project Plans, we propose
to install in one area of Red Lily Pond four strips of
benthic barrier, each 10 feet wide, and with lengths of 90
feet, 85 feet, 45 feet, and 40 feet. The strips, with a total
of 2,600 square feet, will be installed within the area
marked in yellow. Together with the 2,400 square foot
benthic barrier installed in March 2025, the total area
covered by benthic barriers will constitute about 5,000
square feet (the actual figure will be slightly less,
because of some overlap of the barrier strips as they are
installed), or about 2.5 percent of the 202,000 square feet
of the surface area in Red Lily Pond, all of which is capable of supporting water-based
vegetation.
Lake Elizabeth
As shown in the attached Project Plans, we propose to install seven strips of benthic
barrier in one area of Lake Elizabeth, in addition to the barriers installed in prior years. The
additional barriers will include five strips that are 10 feet wide and 200 feet long, one strip that
is 10 feet wide and 90 feet long, and one strip that is 10 feet wide and 135 feet long.
Thus, the additional coverage will be 12,250 square feet of new benthic barrier. With
benthic barriers installed in February 2024 and March 2025, the total covered by benthic barriers
will be about 19,850 square feet, out of about 245,000 square feet of lake surface area (about
8.1%).

Respectfully submitted,
