Crocker Jr. Hearing Room, 2nd Floor, 367 Main Street, Hyannis. The meeting will be televised live via Xfinity Channel 8 or high-definition Channel 1072. It may also be accessed via the Government Access Channel live stream on the Town of Barnstable’s website: http://streaming85.townofbarnstable.us/CablecastPublicSite/watch/1?channel=1 CALL TO ORDER – Introduction of Board Members and Staff NOTICE OF RECORDING – This meeting of the Barnstable Licensing Authority is being recorded and broadcast on the Town of Barnstable’s Government Access Channel. In accordance with Massachusetts General Laws Chapter 30A, Section 20, the Chair must inquire whether anyone else is recording this meeting and, if so, to please make their presence known. PUBLIC COMMENT APPROVAL OF MINUTES – July 23, 2025 NEW APPLICATIONS 1. FOUR (4) SPECIAL ONE DAY ENTERTAINMENT LICENSES Cirque Entertainment VI LLC doing business as Paranormal Cirque III, for four special one day entertainment licenses to hold the Paranormal Circus, a live performing arts show at 180 Falmouth Road, Hyannis, as noted below: Date Start time (not to exceed 11pm end time) August 29, 2025 (1 show) 7:30 p.m. August 30, 2025 (2 shows) 6:30 p.m. and 9:30 p.m. August 31, 2025 (2 shows) 5:30 p.m. and 8:30 p.m. September 1, 2025 (1 show) 7:30 p.m. 2. NEW SPECIAL ONE DAY BEER & WINE LICENSE An application has been filed by Kami Perry on behalf of the 1st Cape Cod Brazilian Independence Day, to be held at Aselton Park on September 7, 2025, from 2:00 p.m. to 7:00 p.m. Event organizers are seeking a one-day beer and wine license. Beer and Wine will be served by Fabio Lima – current TIPS certificate is on file. 3. AMEND ANNUAL §12 ALL-ALCOHOL COMMON VICTUALLER LICENSE – CHANGE OF MANAGER An application has been filed by GMRI, Inc. dba The Olive Garden Restaurant #1523, 1095 Iyannough Road, Hyannis, to amend the licensed alcohol manager from David Marshall to Megan Bettencourt. 4. AMEND ANNUAL §15 WINE AND MALT LICENSE – CHANGE OF MANAGER An application has been filed by LLH, LLC dba Trader Joe’s, 655 Iyannough Road, Hyannis, to amend the licensed alcohol manager from David Haley to Megan Ackerman. 5. AMEND NON-LIVE ENTERTAINMENT LICENSE An application has been filed by Hyannis LSOF Operating LLC dba Margaritaville Resort Cape Cod, to amend the existing non-live entertainment license to include recorded music below conversation level as well as 20 TV’s throughout the hotel including both indoor and at the outdoor pool deck. PUBLIC HEARINGS 1. NEW ANNUAL DAILY LIVE ENTERTAINMENT AND AMEND DAILY NON-LIVE ENTERTAINMENT LICENSE An application has been filed by 235 Ocean Partners LLC dba The Break, 235 Ocean Street, Hyannis, for a new annual daily live entertainment license and amending the daily non-live entertainment license. Applicant requests up to 3 live, amplified, performers on the outside covered patio, daily until 10:00 p.m. They propose to increase the daily non-live entertainment license by adding 2 TV’s on the 2nd floor (inside), 2 TV’s on the 1st floor (inside), 1 TV on the 1st floor covered patio (outside). Non-live entertainment will be commensurate with alcohol service hours. 2. NEW ANNUAL DAILY LIVE AND DAILY NON-LIVE ENTERTAINMENT LICENSE An application has been filed by Pour Decisions Wine Bar Inc., 388 Main Street, Hyannis, for an annual daily live and daily non-live entertainment license as follows: Daily Live entertainment to include up to 2, non-amplified, performers, inside; daily non-live entertainment to include recorded music at conversation level, 2 TV’s, and music videos, inside. Live and non-live entertainment are proposed daily from 11:00 a.m. to 11:00 p.m. 3. NEW CLASS II AUTO DEALER LICENSE An application has been filed by Cape Motors Inc, 711 Yarmouth Road, Hyannis, for a new Class II Auto Dealer license; maximum of 22 spaces which includes 7 display spaces, 1 handicapped accessible space, and 14 employee and customer spaces. Repairs of inventory vehicles only will be performed by Clerio Auto, 362 Yarmouth Rd, Hyannis. Daily hours of operation are Monday through Friday, 9:00 a.m. to 5:00 p.m., Saturday 9:00 a.m. to 2:00 p.m. 4. TRANSFER §12 LICENSE INCLUDING CHANGE OF LICENSE TYPE & NEW DAILY LIVE & NON-LIVE ENTERTAINMENT LICENSE An application has been made by Triton Beverage Group dba Cape Cod Beer, 1336 Phinney’s Lane, Barnstable, to accept the transfer of the §12 license from Cape Cod Beer Inc. Transfer includes a change of license type from a farmer brewer to a pub brewer license. The new owners propose to operate with the existing floor plan and fare. Propose alcohol license manager is Michael McNamara. Proposed hours of operation are Monday – Thursday, 12pm to 8pm, Friday & Saturday 12pm to 9pm and Sundays 12pm – 6pm. Live entertainment is proposed for a maximum of 6 performers. Non-live entertainment for music at conversation level. Hours of entertainment to be commensurate with alcohol service hours. DISCUSSIONS 1. Neptune’s, 541 Main Street, Hyannis – Update/discussion regarding the increased capacity as requested by the Authority at their March 26, 2025, public hearing. 2. Blue Moon, 430 Main Street, Hyannis – Discussion regarding recent police activity at or around the establishment. CORRESPONDENCE 1. Notice of violation has been received by the Alcoholic Beverages Control Commission for Bob’s Liquors, 167 Corporation Street, Hyannis, for the alleged sale or delivery of an alcoholic beverage to a person under the age of twenty-one.
