RE: LETTER OF SUPPORT – MILL POND PRESERVE LAND PROTECTION PROJECT
Dear Town Council President Tamash,
On September 8, 2025, the Open Space Committee voted unanimously, authorizing me to
prepare and submit this letter of support for the Barnstable Land Trust Inc. (BLT) application to
the Community Preservation Committee (CPC) for the purchase of a Conservation Restriction on
13 acres of ecologically important open space land at 3640 Falmouth Road in Marstons Mills.
The Mill Pond Preserve project on the Marstons Mills River will permanently protect a significant
area of ecologically important pond -front property serving as a scenic wildlife refuge and
protecting an active herring run for fish migrating upstream to spawn in Middle Pond. The Mill
Pond Preserve abuts extensive existing open space areas, including connections to the existing
trail network. This open space acquisition would satisfy many Town planning and CPC goals
related to scenic and natural resource protection and passive recreation.
The Open Space Committee has reviewed the proposed Conservation Restriction granted to the
Town of Barnstable and recommends Town Council acceptance and approval of the document,
subject to Town Attorney review and approval by the Secretary of Energy and Environmental
Affairs, who may make minor revisions thereto .
Please let me know if you have further questions.
Sincerely,
Lev Malakhoff, Chair
Open Space Committee
CC: Kris Clark, Town Council Liaison
Mark S. Ells, Town Manager
Lindsey Counsell, Chair, Community Preservation Committee
Thomas LaRosa, Assistant Town Attorney
