Mierzwa, Green Seal Environmental, LLC is pleased to submit the enclosed Request to amend Order of Conditions DEP case #SE3-6255 as recorded under Land Court DOC: 1,521,526 of April 18, 2025 to construct additions and Overall site improvements as shown on the plans listed on section A.8 of the Same OOC. The request is being made in response to an Enforcement Order dated August 8 and approved as written by the Board at a public hearing on September 9, 2025 for the Installation of two Art sculptures a cactus supported on a 2’x2’ Concrete pad and a Wolf Sculpture sitting on an irregular shape flagstone Base 8 square feet for a combined ground cover of 12 square feet within the 0-50 buffer of top of Coastal bank. During the overground vegetation cleanup also withing the 0-50 buffer of top of coastal bank just west of the above described Sculptures, an older double flagpole with associated concrete base was found partially buried, it was approximately 62 square feet and also 2 remains of flowable fill for electrical conduits with overall summary dimensions of 6.75’ long by 1.5’ wide or 8.6 square feet for a total impervious area removal of approximate 72.1 square feet. The above clearly indicates that the overall result of the unintentional violation is not only De Minimis but now the 0-50 will have a decrease of 60.1 SF, less square footage of hardscape compared to the approved proposal for features located at the southwest referenced area. Additionally, the applicant would like to request approval for additional modifications to the proposed improvement as shown printed blue on the revised plan included hereon. It is important to note that the bast majority of the items are within the approved limits of proposed landscape areas and perceived to be miscellaneous and already covered by the original approval. A summary as follows: 1) Installation of pool enclosure fence without a bottom beam to allow for wild live passage. Reason: The local zoning enforcement officer required it. 2) Installation of a chain link fence at the northern property line (194’ long) Reason: Security and safety, Abutting property Dogs without chain trespassing Green Seal Environmental, Inc. 2 3) Remove existing shed, ramp, piles, and wooded planters (275.1 sf ±) Reason: Safety, Coyotes sheltering in it, and visual impact, 4) Add square feet from shed removal credit to the proposed garage structure at the back. 5) Replace existing 2.5' wide stone & concrete wall with a new 12" wide concrete wall. (total existing length =133') total proposed wall length =76' Reason: Safety, Structural cracks, and mortar disrepair found in multiple sections. 6) replace partially buried stepping stones walk connecting the building to the proposed dock. (former walkway to access mini gulf holes). 7) New trees planted, replacement of preexisting sitting areas, Miscellaneous De Minimis improvements as shown on the revised “B” plan printed blue. To the best of or knowledge there will not be additional Impacts to the interest of the act & ordinance as a result of the above modifications minor in nature.
