The proposed Project includes the demolition of an existing sunroom, second-story deck, landing, and recessed exterior rinse station, and the construction of a new two-story, three-season room, along with the installation of a freestanding at-grade rinse station. The proposed Project activities will occur within coastal wetland resource areas subject to protection under the MA Wetlands Protection Act (MA WPA) and Chapter 237 of the Town of Barnstable General Ordinances. Work will occur within the Buffer Zone to Coastal Bank. This Notice of Intent also requests approval for an existing fire pit in the Buffer Zone that was installed prior to the Applicant’s purchase of the property. As the fire pit is located within the 0’ to 50’ Buffer, the NOI includes a Waiver for this request. Nine (9) copies of the NOI application are enclosed. An electronic copy of the application will be submitted to the Conservation Commission. Filing fees in accordance with the MA WPA and Barnstable Wetlands Protection Bylaw have been provided to the Commission with this submittal. The state share of the MA WPA filing fee will be sent to the MassDEP dropbox. We believe the attached narrative is sufficient to allow the Commission to issue an Order of Conditions, as the work will not compromise the interests of the WPA or the Barnstable Wetlands Protection Bylaw. Provide a completely filled-out (in all parts) NOI application as locally adopted for the Town of Barnstable, including MassDEP Vegetated Wetland Field Data Form. Indicate Assessor’s map and parcel of the project, as well as the street or road address, and pertinent village (i.e., Hyannis, Centerville, Barnstable, etc). b. For projects requiring mitigation plantings under Chapter 704 -3, 704-4, and 704-5, mitigation planting location(s) shall clearly be shown on landscaping planting plan. The planting plan shall include: 1. species (chosen from the Town of Barnstable Conservation Commission approved planting lists), sizes, densities and/or quantities. 2. area calculations in 0’ - 50’ and 50’ – 100’ separately for the amount of mitigation planting required. 3. the amount of mitigation planting proposed. 4. a note or indication stating the area between the proposed plants will either be planted with an appropriate native seed mix or left to naturalize. 5. a note stating mulch may only be used under the dripline of proposed plants. 6. demarcation markers along the landward side of the mitigation planting area. The type of demarcation marker shall be selected from the list approved by the Conservation Commission. e. Provide detailed, written street directions to the locus (site). f. Provide a copy of a U.S.G.S. locus map indicating the general area of the project site. g. Provide a check for the Town of Barnstable portion of the required filing fee. (The portion payable to the Commonwealth, see 7. e. below) h. Provide any other documentation, photographs, architectural renderings or other supporting data prepared by professionals competent in the field which may be relevant to the application. 6. The site plan shall also show: a. All existing and proposed contours at 2-ft. minimum intervals (1-ft. preferred). b. Clear delineation of all existing and proposed structures and features. Building structures must be accurately dimensioned (fixed location) from property lines and wetland resource areas. Plans shall provide sufficient detail to show all potential wetland impacts, mitigation, compensatory areas, engineered structures, utilities, landscaping, etc. within the area of jurisdiction. Project activities will occur within areas subject to protection under the Massachusetts Wetlands Protection Act (MA WPA; MGL c. 131 § 40) and its implementing regulations (310 CMR 10.00) and Chapters 237 (Wetlands Protection Bylaw) and 704 (Wetlands Buffer Zone Activity) of the Code of the Town of Barnstable. The proposed Project includes the demolition of an existing sunroom, second-story deck, landing, and recessed exterior rinse station, and the construction of a new two-story, three-season room, along with the installation of a freestanding at -grade rinse station. The NOI also seeks approval for an existing unpermitted firepit. 1.1 Overview of NOI This Notice of Intent (NOI) is being submitted pursuant to the Massachusetts Wetlands Protection Act (MA WPA; MGL c. 131 § 40) and its implementing regulations (310 CMR 10.00) and the Barnstable Wetlands Protection Bylaw (Chapter 237 of the Barnstable General Ordinances) and Regulations, as the proposed work will occur within the 100-foot Buffer Zone and local Buffer Zones. The NOI includes a request for a Waiver for work in the 50-foot Buffer Zone in accordance with Section 704-4(A) of the Code of the Town of Barnstable. Permanent activities in the 50-foot are limited to the existing firepit. Figures showing existing conditions, site-specific environmental resources, land use, FEMA flood-levels, and other site features are provided in Appendix A. Project Drawings are provided in Appendix B. Site Photographs are provided in Appendix C. Abutter Information is provided in Appendix D. 1.2 Schedule Permitting for the Project will occur in Fall 2025 with construction commencing in Winter 2025 or Spring 2026. SECTION 2 Tighe&Bond 71 Sunset Lane Renovations Notice of Intent 2-1 Section 2 Existing Environment This section provides a site description and resource area characterization for the Project site. Wetland resource areas and land use in the general vicinity were determined based on direct observations made during site visits and review of information obt ained from publicly available data through the Massachusetts Geographic Information System (MassGIS). The Project site is depicted on the figures in Appendix A. 2.1 General Site Description 2.1.1 Project Location As indicated above, the Project is located at a single-family home on a waterfront lot, 71 Sunset Lane (Parcel ID 301024), in Barnstable, MA, situated on the southern shoreline of Barnstable Harbor. The Project Site is an approximately 0.23-acre parcel within the RB (Residential B District) zoning district. The Project Site is situated directly north of Main Street/ Route 6A and Maraspin Creek. The Site is bordered to the east and south by residential properties, and to the west by a mix of residential properties and a parking lot associated with Millway Beach. 2.1.2 Project Locus and Project Site The Project Locus consists of a private single-family dwelling, lawn, and landscaped areas. The upland area of the property consists of a conventionally managed landscape surrounding the existing dwelling. The northern water-facing side of the dwelling consists of a small lawn area, an area of Coastal Bank consisting of rock revetment and dense vegetation, and areas of Coastal Beach seaward of the Bank. An existing set of stone stairs leads from the lawn to the beach. To the west of the property is a an access path and set of stairs that was recently improved with the approval of the Conservation Commission in accordance with SE 003-6266. The east side of the residence features a small three-season porch with a second-story deck and an exterior generator located to the south of the porch. The west side of the house features an outdoor rinse station that is currently inset with the western wall of the residence, a bulkhead, an air conditioner condenser, and several outdoor storage containers. The following are driving directions to the Project Site located at 71 Sunset Lane, Barnstable, MA, from 230 South Street, Hyannis, MA. From 230 South Street, Hyannis, MA 02601, head west and turn left toward South Street. Continue on South Street, then turn left onto Old Colony Road. Turn left onto Center Street, then turn right onto Barnstable Road. At the Airport Rotary, take the second exit onto Iyannough Road (Route 132). Continue for approximately 0.8 miles, then turn right onto Independence Drive. After 0.6 miles, turn left onto Kidd’s Hill Road. Turn right onto Phinney’s Lane, then continue onto Hyannis-Barnstable Road. Continue straight onto Millway. After approximately 0.5 miles, turn right onto Commerce Road. Turn left onto Sunset Lane; the destination, 71 Sunset Lane, Barnstable, MA 02630, will be on the left. The total distance is approximately 5.2 miles, with an estimated drive time of 16 minutes. Section 2 Existing Environment Tighe&Bond 71 Sunset Lane Renovations Notice of Intent 2-2 The Project Site/”limit of work” consists of approximately 470 square feet (sf) and is defined as the extent of temporary and permanent disturbance to areas subject to jurisdiction required for the residential property renovations; as well as any associated equipment laydown/staging areas and areas proposed for temporary site access during construction. The Project Site is located within and adjacent to jurisdictional resource areas as further described below. 2.2 Wetland Resource Areas The following wetland resource areas identified within the Project Site are subject to jurisdiction under the Massachusetts Wetlands Protection Act (MA WPA; M.G.L. c. 131 § 40), the MA WPA Regulations (310 CMR 10.00), and the Barnstable Wetlands Protection Bylaw (Chapter 237 of the Code of the Town of Barnstable): ▪ Coastal Beach ▪ Coastal Bank ▪ Land Subject to Coastal Storm Flowage (LSCSF) ▪ 100-foot Buffer Zone The following additional wetland resource areas identified within the Project are also subject to jurisdiction under the Barnstable Wetlands Protection Bylaw only: ▪ Coastal Bank (Barnstable definition) ▪ 0- to 50-foot Buffer Zone to Coastal Bank ▪ 50- to 100-foot Buffer Zone to Coastal Bank ▪ 0- to 35-foot No Construction Zone to MHW Descriptions of the jurisdictional wetland resource areas per the MA WPA and the Barnstable Wetlands Protection Bylaw and Regulations are provided below. Tidal datums were used to identify several of the wetland resource area bound aries and these lines were confirmed during the delineation. Table 2 -1 lists the datums utilized in the delineation, based on the historical NOAA Tide Station “Barnstable Harbor” Station #8447335 for the 1983 Tidal Epoch (NAVD88). Section 2 Existing Environment Tighe&Bond 71 Sunset Lane Renovations Notice of Intent 2-3 TABLE 2-1 Summary of Tidal Datums Utilized in the Wetland Resource Area Delineation Datum Elevation (ft, NAVD88) Barnstable Harbor VDatum and Buzzard’s Bay National Estuary Program Mean High Water (MHW) 4.24 2.04 NAVD88 0.00 0.00 Mean Low Water (MLW) -5.40 -2.96 Jurisdictional wetland resource areas and Buffer Zones (local and state) are depicted on the Project Drawings in Appendix B and Site Photographs in Appendix C. 2.2.1 Coastal Beach Per 310 CMR 10.27(2), a Coastal Beach means unconsolidated sediment subject to wave, tidal and coastal storm action which forms the gently sloping shore of a body of salt water and includes tidal flats. Coastal Beaches extend from the mean low water line landward to the dune line, coastal bank line or the seaward edge of existing man-made structures, whenever these structures replace one of the above lines, whichever is closest to the ocean. The Coastal Beach at the site extends from MLW to the bottom of Coastal Bank. No work is proposed in Coastal Beach. 2.2.2 Coastal Bank Per 310 CMR 10.30(2), A Coastal Bank means the seaward face or side of any elevated landform, other than a coastal dune, which lies at the landward edge of a coastal beach, land subject to tidal action, or other wetland. In accordance with the Barnstable Wetland Protection Bylaw, Coastal Bank is defined as: “The first significant break in slope beyond the one-hundred-year storm elevation on a seaward face or elevated landform, other than a coastal dune, which lies at the landward edge of a coastal beach, land subject to tidal action, or other coastal wetland. The slope of the bank must be greater than 18% and serve to contain storm flowage, rather than being inundated by it, or function as a sediment source.” The Coastal Bank was identified as the inland landform abutting the shoreline and is depicted in the Project Drawings in Appendix B. In accordance with the Town of Barnstable’s definition under Chapter 237 of the Wetlands Protection Bylaw, the Coastal Bank is characterized as a seaward-facing landform with a slope greater than 18%, located landward of a Coastal Beach. The top of Coastal Bank coincides with the first break in slope above the 100-year floodzone. The lower limit of Coastal Bank generally coinc ides with the toe of the stone revetment. While each set of guidelines specifies minimum slope requirements for the determination of Coastal Bank, both criteria are met is the same location based on the topography of the existing property. Section 2 Existing Environment Tighe&Bond 71 Sunset Lane Renovations Notice of Intent 2-4 The sloped Coastal Bank is presently stable and provides protection to the upland from storm surge and the influence of tidal fluctuations. Portions of the Coastal Bank are covered in vegetation including Beach rose, Wild radish, Seaside Goldenrod, and Virgina Creeper. 2.2.3 Land Subject to Coastal Storm Flowage (LSCSF) Per 310 CMR 10.04, LSCSF means land subject to any inundation caused by coastal storms up to and including that caused by the 100-year storm, surge of record or storm of record, whichever is greater. The (FEMA) flood map (Panel No. 25001C0558J, effective July 16, 2014) was consulted to evaluate the presence of LSCSF. According to the FEMA Flood Insurance Rate Map (FIRM), the Project Site falls within Zone VE, a flood hazard area subject to flooding and/or inundation by the 100-year storm with additional hazards associated with storm waves equal to 3 feet or greater. The Base Flood Elevation (BFE) in this region within Zone VE is 14 feet. Therefore, the area of the Project Site consisting of the existing beach access stone stairway is regulated as LSCSF as it falls within the jurisdictional 100-year coastal floodzone. A FEMA Firmette is provided in Appendix A. 2.2.4 100-Foot Buffer Zone Per 310 CMR 10.04, Buffer Zone means that area of land extending 100 feet horizontally outward from the boundary of any area specified in 310 CMR 10.02(1)(a). The Buffer Zone within the Project Site extends landward from the top of the Coastal Bank . 2.2.5 50-Foot and 50- to 100-Foot Buffer Zones Pursuant to the Barnstable Wetlands Protection Bylaw (Chapter 237) and Wetlands Buffer Zone Activity (Chapter 704), the Barnstable Conservation Commission regulates a 50-Foot Undisturbed Buffer Zone that extends horizontally outward from the landward most resource area boundary. At the Project Site, the 50-Foot Buffer extends from Coastal Bank. The 50 to 100-Foot Buffer Zone extends 50 feet horizontally outward from the boundary of the 50-Foot Buffer Zone and terminates at the outer edge of the 100 -Foot Buffer Zone. 2.2.6 35-Foot No Construction Zone At the Project Site, the 0- to 35-foot No Construction Zone extends 35 feet from the boundary of MHW and terminates at the seaward edge of the Coastal Bank. 2.3 Rare Species The Massachusetts Endangered Species Act (MESA) is implemented by the Natural Heritage and Endangered Species Program (NHESP) to protect areas determined to contain endangered, threatened or species of special concern. These areas are designated as “Priority Habitats of Rare Species” or “Estimated Habitats of Rare Wildlife” under the MESA Regulations 321 CMR 10.00 and are delineated state-wide in the Massachusetts Natural Heritage Atlas. The NHESP Atlas, 15th edition, effective August 2021, and MassGIS online mapping data were consulted during the preparation of this NOI. According to these sources, and as Section 2 Existing Environment Tighe&Bond 71 Sunset Lane Renovations Notice of Intent 2-5 shown on Figure 2 (Appendix A), no portion of the Site is mapped Estimated and Priority Habitat for state-listed rare species. 2.4 Area of Critical Environmental Concern (ACEC) MassGIS online mapping data was consulted during the preparation of this NOI. According to this source, and as shown on Figure 2 (Appendix A), a portion of the residential property at 71 Sunset Lane is located within the Sandy Neck Barrier Beach System ACEC. The ACEC boundary generally follows the 100-year floodplain elevation on the landward side and mean low water on the seaward side of Barnstable Harbor. The proposed Project is entirely outside the ACEC and will not involve any work within its boundary. SECTION 3 Tighe&Bond 71 Sunset Lane Renovations Notice of Intent 3-1 Section 3 Project Description 3.1 Proposed Activities 3.1.1 Residential Construction The proposed Project involves several activities described blow: ▪ On east side of the residence, the Applicant proposes removal of the existing enclosed porch and deck and the construction of a new two-story, three-season room in the same footprint as the existing porch and deck. The work will begin with the demolition and disposal of the current sunroom, second-story roof deck, and the landing/step. Following demolition of the existing sunroom and related exterior features, excavation will be carried out to a depth of approximately 5 feet below grade to accommodate new footings and foundation walls. This area will serve as a crawlspace rather than a full basement. The excavation is expected to extend approximately 3 feet beyond the edge of the footings shown on the Project Drawings and Appendix B and will be completed using machinery. The two-story addition will be constructed directly on the new foundation and integrated into the existing structure without the addition of an external doorway. A new roof will be built to cover the entire addition, tying into the existing roofline. The three-season porch is currently 117.84 sf, with the most seaward edge located 48.07 feet from the top of Coastal Bank. The proposed replacement will maintain the current size and distance from Coastal Bank. All construction activities including access and excavation will be located approximately 80 feet from MHW at the most seaward extent. ▪ The existing recessed exterior rinse station on the west side of the house will also be removed to allow for the installation of a new interior foundation wall, closing the existing recess and increasing the home’s interior square footage. An additional area requiring hand excavation to a depth of approximately 4 feet is planned where the new foundation wall will be installed in place of the removed recessed rinse station. A free-standing rinse station will be installed. The rinse station will feature wooden decking over existing grade. The rinse station will be plumbed and will not drain grey water to the exterior or feature a dry well. The proposed rinse station is 41.48 sf in area with the most seaward edge located 60 feet from the top of Coastal Bank. All construction activities including access and excavation will be located approximately 80 feet from MHW at the most seaward extent. ▪ The NOI also seeks approval for a firepit that was installed by the previous owners of the property. During pre-filing communication with the Conservation Administrator, it became apparent that no approvals had been sought for the firepit, which the Applicant proposes to maintain in place. Section 3 Project Description Tighe&Bond 71 Sunset Lane Renovations Notice of Intent 3-2 The firepit consists of a hollow ring of stone sitting on the ground. The firepit consists of 7.32 sf of hardscape. The most seaward edge of the firepit is 18.22 feet from the top of Coastal Bank. 3.2 Anticipated Construction Sequence All site access will be provided via the existing entrance at 71 Sunset Lane (the Project Site). Construction vehicles and equipment will utilize this access point throughout the duration of the Project. A designated materials and equipment staging area wi ll be located on the residence’s parking area on the street side of the property. Access to the east side of the house will be provided through removal of existing fencing segments to allow for equipment to access the necessary excavation area. Following demolition of the existing sunroom and landing area, the limits of the proposed add ition will be excavated to an approximate depth of 5 feet to allow for building footing and foundation wall construction. Upon backfill of foundation excavation, disturbed areas will be restored with loam and seed to establish vegetation as soon as practicable. Vertical building construction will continue with framing, roofing, window installation and exterior finishes. At the proposed rinse station on the west side of the building, excavation is required to expose foundation a beneath existing recessed shower. No machine work is anticipated as excavations will be performed by hand. Excavations will be performed to an approximate depth of 5 feet to allow for new footing and foundation wall construction. Following foundation construction, excavations will be backfilled. Rinsing station fencing and decking will be installed, and all disturbed areas will be restored with loa m and seed to establish vegetation as soon as practicable. The anticipated sequence of construction for the Project is generally outlined below. The actual sequence of construction is subject to the discretion of the selected contractor. Due to construction safety concerns, the contractor will be responsible for providing public safety protection measures, including temporary construction fencing around the limit of work to ensure that the public stays at a safe distance from active equipm ent and does not enter potentially unsafe active work areas. Truck deliveries and site work will be performed within hours limited by the Town , or as further defined by Project specifications. Performing site work within hours specified by the Town work hour requirements will help mitigate construction-related noise impacts on neighbors. The contractor will be required to maintain appropriate erosion and sedimentation controls at the downgradient side of all site work activities while working. Construction sequencing is anticipated to occur as follows: ▪ Notify pertinent regulatory agencies and abutters of the construction schedule ▪ Install sedimentation and erosion controls / protective measures at work site perimeter ▪ Schedule and conduct site walks with pertinent regulatory agencies to inspect construction-phase BMPs ▪ Site mobilization and material staging Section 3 Project Description Tighe&Bond 71 Sunset Lane Renovations Notice of Intent 3-3 ▪ Foundation excavation on east side of building ▪ Construction of building footing and foundation walls, crawlspace flooring poured ▪ Stabilize disturbed areas following backfill activities ▪ Vertical addition construction ▪ Hand excavation at west side of house for foundation construction ▪ Construct new footing and foundation wall ▪ Install rinse station ▪ Stabilize disturbed areas ▪ With Conservation Commission authorization, remove erosion and sedimentation controls / protective measures at work site perimeter and entrance/exit locations and properly dispose off-site ▪ Demobilize and perform final site cleanup 3.3 Construction Best Management Practices The following Best Management Practices (BMPs) will be implemented during construction to minimize the potential for impacts to jurisdictional resource areas. The Town and contractor will reserve the right to require supplemental and/or alternative constru ction BMPs during work depending on site and weather conditions. As noted below, in some instances specific construction means and methods will be determined by the contractor. However, the contractor will be restricted to the limit of work depicted on the Project Drawings. 3.3.1 Erosion and Sedimentation Controls The contractor will be required to maintain appropriate erosion and sedimentation controls at the downgradient side of all construction activities. Erosion and sedimentation control measures (silt fence) will be installed between proposed areas of disturbance and resource areas as shown on Project Drawings and as deemed necessary. Use of non-biodegradable mesh materials will be avoided. Supplemental and/or alternative construction BMPs may be required during work, depending on site and weather conditions. The contractor will be responsible for complying with permits issued for the Project. In addition: ▪ The contractor will be required to maintain a reserve supply of erosion and sedimentation control barriers on-site to make repairs, as necessary ▪ Protective measures will be inspected after significant precipitation events. Maintenance and repairs will be conducted, as necessary At the conclusion of the Project, the erosion control barriers will be removed and properly disposed of off-site following the stabilization of disturbed areas and Conservation Commission authorization. Section 3 Project Description Tighe&Bond 71 Sunset Lane Renovations Notice of Intent 3-4 3.3.2 Spill Prevention and Control The contractor will be required to conduct the work in an environmentally safe manner and in accordance with applicable regulations for the management of fuels, waste oils, and hazardous substances. 3.3.2 Soil Stockpiles A limited amount of material will be excavated during the installation of the new foundation for the Project. Excavated materials will be replaced immediately following foundation and fence post installation. Stockpiles will be surrounded by erosion contro ls to protect resource areas. 3.4 Site Stabilization and Restoration The areas of construction will remain in stable condition at the close of each construction day via the use of appropriate erosion and sedimentation control measures. Erosion control measures will be inspected at the close of each construction day and main tained or reinforced as necessary. All erosion and sedimentation control measures will be inspected, cleaned, or replaced during construction and will remain in place until permanent stabilization is achieved. Temporary construction access and staging areas will be restored to existing conditions following construction. All disturbed areas will be stabilized and restored . Existing surface treatments will be restored to proposed grades and elevations upon completion of work. These proposed conditions are depicted on the Project Drawings provided in Appendix B. SECTION 4 Tighe&Bond 71 Sunset Lane Renovations Notice of Intent 4-1 Section 4 Regulatory Compliance This section of the application outlines the Project’s compliance with applicable wetlands regulations including the MA WPA and Chapters 237 (Wetlands Protection Bylaw) and 704 (Wetlands Buffer Zone Activity) of the Code of the Town of Barnstable. 4.1 Summary of MA WPA Jurisdictional Activities Table 4-1 presents a summary of the resource area impacts from the proposed Project relative to existing conditions. Impact areas presented were calculated in AutoCAD. The Project Drawings in Appendix B also depict the proposed activities and resource areas. Permanent impacts in Buffer Zone are associated with installation of the rinse station and firepit. Impacts to wetland resource areas from temporary work in the Buffer Zone will be minimized and mitigated through the use of construction period best management practices. Temporary construction access and staging areas will be restored to existing conditions following construction. As described in this NOI, the Project has been designed to satisfy the requirements of 310 CMR 10.03(1)(a)(3). Further, as described in Section 3.3, construction-period erosion control barriers will be installed and maintained to protect wetland resource areas and define the limits of work. 4.2 Barnstable Wetlands Protection Bylaw The Town of Barnstable has established a Wetlands Protection Bylaw (Chapter 237 of the Code of the Town of Barnstable), effective December 1987, regarding activities within their jurisdiction as well as administrative procedures relative to proposed Projects . The Barnstable Conservation Commission also regulates activities within the 100-foot Buffer Zone under Chapter 704 of the Code of the Town of Barnstable. Of the Commission’s current regulations, the following are pertinent to the proposed activities. Section 4 Regulatory Compliance Tighe&Bond 71 Sunset Lane Renovations Notice of Intent 4-2 The Performance Standards outlined in Section 704-3 are applicable to projects requiring a Notice of Intent. ▪ Section 704-3A: A 50 ft undisturbed buffer zone shall be retained between the landward-most wetland resource areas and the limit of proposed site disturbance. The proposed Project is limited to renovations of an existing single-family dwelling. Portions of the existing residence and landscaped yard are located in the 50-foot Buffer Zone. A small portion of the existing three-season porch is located in the 50-foot Buffer; the seaward edge of the porch is 48 feet from the top of Coastal Bank. The footprint of the renovated porch will remain the same in the proposed condition. All hardscape associated with the new rinse station on the west side of the house is located outside of the 50-foot buffer. The proposed work includes 70.3 sf of temporary impacts in the 50-foot Buffer Zone on the east side of the residence for construction access to the three-season porch. The NOI also seeks approval for an existing firepit, which is located approximately 18.22 feet from the top of Coastal Bank. The area of new hardscape associated with the firepit is 7.32 sf; mitigation is proposed as summarized below. Although the Project does not meet the requirement for a 50-foot undisturbed Buffer Zone due to existing conditions, no adverse impacts to the adjacent wetland resource area are anticipated as a result of the temporary construction access or firepit. ▪ Section 704-3B: WHERE A 50 FT UNDISTURBED BUFFER ZONE, as measured in accordance with 704-2A, EXISTS prior to the proposed work and is proposed to remain intact, proposed work within the 50 to 100 ft. buffer zone shall not require further buffer zone enhancement. Due to existing conditions within the 50 -foot Buffer Zone, the Site does not meet the definition of an “undisturbed buffer” as outlined in §704-2A. The area within 50 feet of the Coastal Bank is already developed, containing portions of the existing single-family dwelling, landscaped yard, and a firepit. As such, this standard is not applicable. ▪ Section 704-3C: WHERE A 50 FT UNDISTURBED BUFFER ZONE, as measured in accordance with 704-2A, DOES NOT EXIST prior to the proposed work, any work proposed within the 100 ft. buffer zone shall be subject to mitigation planting requirements intended to restore, in so far as possible, both the dimensions of a 50 ft undisturbed buffer and its vegetation. For such work proposed within the 50 - 100 ft zone, the calculation of mitigation is set forth in 704 -3D. Due to existing conditions within the 50 -foot Buffer Zone, the Site does not meet the definition of an “undisturbed buffer” as outlined in Section 704-2A. The proposed Project includes work within the 50– to 100-foot Buffer Zone to Coastal Bank. In accordance with Section 704-3(C), this work triggers a requirement for mitigation planting intended to restore, to the extent practicable, both the vegetative composition and dimensional extent of a 50-foot undisturbed Section 4 Regulatory Compliance Tighe&Bond 71 Sunset Lane Renovations Notice of Intent 4-3 buffer zone. As discussed in more detail below, the Applicant requests that the Commission consider the Project Site to be a “mitigation-constrained site” and seeks approval to provide a fee in lieu of mitigation in accordance with Sections 704-5(B) and 704-5(D), respectively. ▪ Section 704-3D: CALCULATION OF MITIGATION FOR WORK PROPOSED WITHIN THE 50 TO 100 FT BUFFER – The amount of mitigation planting required for work proposed within the 50 to100 ft. buffer zone shall be determined by the following method: o Calculate area of proposed hardscape within the 50 to 100 ft. buffer zone; o Multiply the area found in 704-3D(a) by 3 to obtain the area of required mitigation at a 3:1 planting to disturbance ratio. o In no case shall the total area of mitigation plantings required be greater than that which is necessary to restore a 50 ft. undisturbed buffer in its entirety. The proposed Project includes 41.48 sf of new hardscape within the 50- to 100- foot Buffer Zone associated with installation of the new exterior rinse station. There is no increase in hardscape associated with the renovated portion of the residence on the east side. In accordance with Section 704-3D, mitigation planting is required at a 3:1 ratio; based on the area of new hardscape, a total of 124.44 sf of mitigation is required. This area has been used to calculate the proposed in lieu mitigation fee as noted below. ▪ Section 704-3E: LOCATION OF MITIGATION PLANTING - Mitigation planting location(s) shall clearly be shown on the site plan. The plan shall also provide area calculations for the amount of mitigation planting herein required, and the amount of mitigation planting proposed. The Applicant requests that the Commission allow an in lieu mitigation fee payment instead of plantings, given the mitigation constrained nature of the site. As such, no mitigation planting is shown on the Site Plan. ▪ Section 704-3F: BEST PRACTICES o The Conservation Commission shall exercise a preference for pervious surface types of hardscape. o Where possible and practical, proposed hardscape within the 50 to 100 ft. buffer zone shall be located no closer than 10 ft from the landward limit of the 50 ft buffer zone, so that attendant construction, landscaping and maintenance activities may proceed without impact to the 50 ft buffer zone. The hardscape associated with the proposed rinse station will be wooden decking with small gaps between each plank. No roof is proposed on the rinse station. The most seaward side of the proposed rinse station is located 60 feet from the top of Coastal Bank, in compliance with the second part of Section 704-3F. Section 4 Regulatory Compliance Tighe&Bond 71 Sunset Lane Renovations Notice of Intent 4-4 The Performance Standards for projects requiring a waiver for activities in the 50 -Foot Buffer Zone are outlined at Section 704-4. ▪ Section 704-4A: HARDSCAPE OR LANDSCAPE ALTERATION PROPOSED WITHIN THE 50 FT. BUFFER, (except as noted in Section 704-6 below) shall require a full or partial waiver of the Performance Standards found in Section 704-3. The Conservation Commission shall have the discretion to grant a waiver should it find that the overall project, when considered with its proposed mitigation, will protect the wetland interests contained in Ch. 237. The waiver shall specify the terms of acceptable mitigation in accordance with Section 704-4(B), and either Section 704- 4(C) or 704-5 below. To the extent feasible and practical, work should be avoided within the 50 ft buffer. Therefore, the granting of a waiver and acceptance of mitigation for work performed within the 50 ft. buffer should be cons idered only under exceptional, limited circumstances. In the absence of a waiver, hardscape or landscape alteration proposed within the 50 ft. buffer shall not be undertaken. The Applicant requests a Waiver from Performance Standards outlined in Section 704-3 for activities in the 50-foot Buffer Zone; such activities are limited to the existing firepit. The proposed renovations to the three-season porch and new rinse station do not involve permanent impacts or new hardscape in the 50 -foot buffer. The continued use of the fire pit will not adversely affect the adjacent Coastal Bank or the interests outlined in Chapter 237. Mitigation for the firepit has been calculated as noted below. ▪ Section 704-4B: CALCULATION OF MITIGATION UNDER A WAIVER – The minimum amount of mitigation planting required for a waiver of Performance Standards (Section 704-3) shall be determined using the following formula: o Calculate area of disturbance from proposed hardscape and landscape alterations within the 50 ft. buffer zone; and o Multiply the area found in Section 704-4(B)(1)a by 4 to obtain the area of required mitigation at a 4:1 planting to disturbance ratio. The area of the firepit in the 50-foot buffer is 7.32 sf. Mitigation is required at a 4:1 ratio; therefore, 29.28 sf of mitigation is required. This area has been used to calculate the proposed in lieu mitigation fee as noted below. ▪ Section 704-4C: ON-SITE MITIGATION UNDER A WAIVER – When the required mitigation is to be provided on site, mitigation planting location(s) shall clearly be shown on the site plan. The plan shall also provide area calculations for the amount of 50 ft buffer zone altered, the amount of mitigation planting herein required, and the amount of mitigation planting proposed. The Applicant requests that the Commission allow an in lieu mitigation fee payment instead of plantings, given the mitigation constrained nature of the site. As such, no mitigation planting is shown on the Site Plan. ▪ Section 704-5B: MITIGATION CONSTRAINED SITES - (1) Certain sites requiring mitigation may not, from the perspective of the Commission, lend themselves to mitigation planting or meadow restoration (in part or in full) because of their landscape setting. For example an existing house close to the top of a coastal bank Section 4 Regulatory Compliance Tighe&Bond 71 Sunset Lane Renovations Notice of Intent 4-5 may have limited space for an expanded buffer to mitigate under this Regulation. For such "mitigation-constrained" projects, the Commission may, at the applicant's request, consider off-site mitigation or in-lieu fees in order to achieve the required mitigation, as provided in Sections 704-5(C) and 704-5(D) below In accordance with the provisions of Section 704 -5B, the Applicant requests that the Commission find that the Project Site is “mitigation constrained.” The property features a small lawn area between the residence and the Coastal Bank, and narrow strips of lawn on each side of the house. As referenced in the criteria above, the existing house close to the top of a coastal bank has “limited space for an expanded buffer to mitigate under this Regulation .” The Applicant requests that the Commission allows an alternative to mitigation plantings given the constraints of the Site. ▪ Section 704-5D: REQUEST TO PAY FEES IN LIEU OF MITIGATION . (1) Request to Pay Fees in Lieu of Off-site Mitigation – For payment of fees in lieu of mitigation to be considered the following preconditions must be satisfied: a. the Commission must find that the project site is "mitigation-constrained"; b. the applicant/representative must request in writing that the Commission consider payment of fees in lieu of mitigation for the project; As noted above, through this NOI, the Applicant requests that the Commission make a finding that the Project Site is “mitigation constrained.” The NOI narrative constitutes the Applicant’s request in writing that the Commission consider payment of fees in lieu of mitigation. ▪ (2) In-Lieu Fees may be calculated as follows: multiply the total area of required mitigation planting calculated for the project by $3.50 per square foot or in accordance with the current Conservation Commission Fee Schedule. Alternatively, In -Lieu Fees may be made payable to the Town of Barnstable Conservation Fund, as established Section 4 Regulatory Compliance Tighe&Bond 71 Sunset Lane Renovations Notice of Intent 4-6 by MGL Ch 40A Sec 8 or other suitable entity acceptable to the Conservation Commission In-Lieu Fees shall paid at the time of recording of the Order of Conditions. Once received, such payments shall be non-refundable. Pending the Commission’s approval of the request to provide an in lieu mitigation payment, the amount calculated per Section 704-5D(3) will be provided to one of the funds described above. 4.2.1 Stormwater The Project will not increase stormwater flows or volume, or impact stormwater quality at the Site. Construction period and post-construction stormwater impacts have been minimized by design and use of Best Management Practices (BMPs) in accordance with the Massachusetts Stormwater Management Regulations. 4.2.2 Abutter Notification Abutters within 100 feet of the subject parcel were notified in accordance with the MA WPA and Barnstable Wetlands Bylaw and Regulations. Please refer to the materials provided in Appendix D. 4.3 Other Pertinent Regulatory Programs 4.3.1 Federal Permits 4.3.1.1 NPDES Construction General Permit (CGP) The Environmental Protection Agency (EPA) issues National Pollutant Discharge Elimination System (NPDES) Construction General Permits (CGP) as a part of the effort to minimize detrimental runoff caused by the clearing, grading, and excavating or general construction activities on construction sites. Since the land disturbance will not exceed the CGP impact threshold of more than one acre of land, a NPDES CGP permit is not required. 4.3.1.2 Army Corps of Engineers Section 10 / 404 PCN The Project does not involve work below MHW and is not subject to jurisdiction under Section 10 of the Rivers and Harbors Act of 1899 or to jurisdiction under Sections 40 4 or 404 of the Clean Water Act. 4.3.2 State Permits 4.3.2.1 Massachusetts Environmental Policy Act (MEPA) Review Massachusetts Environmental Policy Act (MEPA) review is required for projects that meet a MEPA review threshold at 310 CMR 11.03 and that involve a state agency action (i.e. permit, land transfer, or financial assistance). As proposed, the Project does not exceed any MEPA thresholds or involve a state action; therefore, MEPA review is not required. 4.3.2.2 Massachusetts Endangered Species Act (MESA) The Massachusetts Endangered Species Act (MESA) is implemented by the Massachusetts Natural Heritage and Endangered Species Program (NHESP) to protect areas determined to contain endangered, threatened or species of special concern. These areas are designated as “Priority Habitats of Rare Species” under the MESA Regulations (321 CMR 10.00) and are delineated state-wide in the Massachusetts Natural Heritage Atlas. Section 4 Regulatory Compliance Tighe&Bond 71 Sunset Lane Renovations Notice of Intent 4-7 The Project is not located within mapped NHESP habitat area and does not require review under the MA WPA or MESA. 4.3.2.3 Massachusetts Historical Commission (MHC Review) A project is subject to review by the Massachusetts Historical Commission (MHC) / State Historic Preservation Officer (SHPO) if it requires funding, permits, or licenses from any state or federal agencies. MHC reviews projects requiring state agency action in compliance with 950 CMR 71.00 and, for projects that require state and federal permits, in compliance with Section 106 of the National Historic Preservation Act of 1966 (as amended). The Project does not require state or federal agency review and there fore MHC review is not required. 4.3.3 Local Permits No other local non-ministerial permits are required from the Town of Barnstable.
