Box 6 • South Harwich, MA 02661 • Tel 508.255.6511 www.tighebond.com 27-5089-0350-01-01-01 November 7, 2025 Barnstable Conservation Commission C/o Edwin Hoopes, Conservation Administrator 230 South Street Hyannis, MA 02601 Re: Notice of Intent – Project Revision and Supplemental Information 71 Sunset Lane Renovation Project (DEP File # 003-6326) Dear Members of the Conservation Commission: On behalf of the Hamel Family 2018 Revocable Trust (the “Applicant”), Tighe & Bond is pleased to provide supplemental information in support of the Notice of Intent for the 71 Sunset Lane Renovation Project (referred to as “the Project”). The Notice of Intent (NOI) was submitted to the Barnstable Conservation Commission and MassDEP Southeast Regional Office (DEP SERO) on October 21, 2025. The MassDEP file number associated with the Project is 003-6326. Based on discussion at the November 4, 2025 Conservation Commission hearing, we understand that the Commission does not approve of the Applicant’s request to provide an in-lieu fee for mitigation . Mitigation is required for new hardscape in the Buffer Zone to Coastal Bank. As such, the Applicant now proposes mitigation plantings, as described in more detail below. Proposed Mitigation Plantings The proposed Project includes work within the Buffer Zone to Coastal Bank, and associated required mitigation, as follows: Buffer Zone Activity Area of New Hardscape (SF) Mitigation Ratio Total Mitigation Required (SF) Total Mitigation Provided (SF) 0- to 50- foot Buffer Firepit 7.32 sf 4:1 29.28 sf 29.28 sf 50- to 100- foot Buffer Rinse station 41.48 sf 3:1 124.44 sf 125.28 sf Proposed activities were described in the NOI. In accordance with Section 704-3(C), this work triggers a requirement for mitigation planting intended to restore, to the extent practicable, both the vegetative composition and dimensional extent of a 50-foot undisturbed buffer zone. The area of required mitigation was calculated in accordance with Section 704-3D and Section 704-4B. As depicted on the enclosed Planting Plan, the following plantings are proposed in the mitigation planting area: ▪ Carolina Rose (Rosa Carolina) - 2 - ▪ American Beach Grass (Ammophila Breviligulata) ▪ Bearberry (Arctostaphylos Uva-Ursi) The plantings will be installed in a portion of the Project Site that is currently occupied by installed non-native landscaping and lawn. A strip of lawn and the landscaping plants will be removed to install the native plantings. The mitigation plantings were selected based on the Cape Cod Cooperative Extension plant list on the Conservation Department’s website , and will help achieve the Commission’s goals with respect to pollution prevention, storm damage prevention, flood control, and wildlife habitat in Chapter 704. We respectfully request that the Commission consider these revisions and supplemental information at its November 18, 2025 meeting.
