Madam, Sirs:
Now we focus on parcel 71 Sunset Lane Certificate of Appropriateness [see a]
… which contains several, at best misleading representations.

Parcel 71 Sunset Lane in section Foundation, affirms “4 foot Crawl Space”. [see a1]

Kinlin Grover produced a specification sheet to market the parcel 71 Sunset Lane.

On page 4 the sheet states “BASEMENT” and also “Interior Entry” , “Full” and
“Finished” [see b1]
Kinlin Grover included several photos of the finished basement including a full
bathroom, furnished sitting areas, carpeting and an oak stairway to first floor. [see c1-
c2- c3]

The Kinlin Grover specification sheet stated that parcel 71 Sunset Lane lot size is
0.23 acre. [see b2]
The original deed for Land Court plan 17933-A, Lot 3 was dated March 11, 1940 .
[see d]
This deed states that un-burdened Lot 3 is sixty-feet wide along a private way; and
one-hundred feet deep along Lot 4.[see d1]
This is 6,000 sq. feet or 0.138 acre of buildable land unburdened by easement, much
less than the size parcel 71 Sunset Lane has promoted which includes a small
portion of the area marked “Bathing Beach” and a portion of one of the right of ways.
The 0.138 acre size is verified by the November 29, 1946, Land Court Decree of
Registration plan 17933 [see e] ,
… recorded as Certificate of Title 8594 by the Land Court , also recorded as
document 19184 in the Barnstable Registry of Deeds.
The Land Court Decree of Registration states, …There is appurtenant to the land
hereby registered the right to use the private ways shown on said plan, and the
right to use said “Bathing Beach” in common with others entitled thereto.
The Land Court recently affirmed this fact by Order of a plan 17933 Judgment dated
October 21, 2022. [see f]

I believe the parcel 71 Sunset Lane utilized the overstated, unburdened acreage size
in calculation of Zoning size guidelines and recommend these be reverified.
Also, the parcel 71 Sunset Lane firepit trespasses upon the plan 17933-H , lot 196
portion deeded easement area marked “Bathing Beach”;
… as the harborside portion of the fence also trespasses upon the plan 17933-H , lot
196 portion of the deeded easement of the area marked “Bathing Beach”. [see g]
It is necessary that the parcel 71 Sunset Lane Notice of Appropriateness be tabled
until these issues are corrected.
