February 2025 Page 1 CHAPTER 707 Regulation Governing Minimum Submission Requirements for a Notice of Intent Application The Barnstable Conservation Commission has adopted the following requirements in order to obtain more consistently complete submission documents necessary for a thorough and efficient review of all Notice of Intent (NOI) applications. Failure to complete any of the items in this checklist may result in your application being denied. Applicant or applicant’s agent should check each box denoting that the task has been completed or in certain instances, like field staking, denoting that the task will be completed. The following submission checklist covers the requirements of Chapter 237, Wetlands Protection, of the Part I General Ordinances of the Code of the Town of Barnstable. This checklist shall be submitted to the Barnstable Conservation Division with the NOI application. 1. Requirements a. The applicant understands, unless they’ve instructed otherwise, they are applying both under the Massachusetts Wetlands Protection Act M.G.L. c.131,§40 and Chapter 237 of the Town of Barnstable General Ordinances. b. Attach a written narrative to the NOI application (WPA Form 3), available at: www.mass.gov/eea/agencies/massdep/service/approvals/wpa-form-3.html describing any project impacts and proposed mitigation as they relate to the following: 1) Any of the interests of Chapter 237 of the General Ordinances and the MassDEP Wetlands Protection Act M.G.L. 131, §40. 2) The performance standards contained in the MassDEP Wetlands Protection Regulations (310 CMR 10.00) 3) Chapter 704: Regulation Governing Activity in the 100-ft. Buffer Zone. 4) Chapter 703: Private Docks and Piers. 5) Any other applicable regulations (310 CMR 10.00 or as promulgated under Chapter 237 of the General Ordinances). c. Enclose proper payment to cover the fee for Chapter 237 filings. Consult current Fee Schedule at www.townofbarnstable.us/Conservation d. Provide a copy of the list of abutters within a 100 ft radius of the project parcel. c. Provide a copy of the Assessor’s Map indicating the parcel of the project site and showing the 100 ft radius of the project parcel. d. Provide a copy of the abutter notification letter. Use the form letter provided in our Abutter Notification Regulation (Chapter 706), available on the Conservation Division website. e. Email copies of the green return receipts, from the certified mailings to the abutters, as proof of notification . If any mailings are returned, email a copy of the entire envelope, indicating by postal service stamp the reason for return. You will retain the receipts afterwards, not the Conservation Division. f. I further certify under the penalties of perjury that all abutters were notified of the Notice of Intent Application, pursuant to the requirements of Chapter 237 of the General Ordinances of the Code of the Town of Barnstable. Notice must be made in writing by certified mail to all abutters within 100 ft of the property line of the project location. _______________________________________ Signature of Applicant or Representative Date 3. Field Staking: a. On or before Tuesday, @ 8:30 a.m., one week prior to the scheduled public hearing, have your project staked by a professional engineer or registered land surveyor showing all outside corners of all proposed structures and the continuous proposed “limit of work” line. b. Have a wetland scientist or other qualified professional flag all wetland resource areas on or within 100 ft of the work area. Make sure that the flags are sequentially numbered. c. Provide a project identification stake with bright painted top and applicant name and address, easily visible from the street approaching the site. 4. Legal Advertisement Fees: a. Conservation will submit the legal ad for publication in a local newspaper. The applicant or his/her agent is responsible for payment, by check (payable to the Town of Barnstable), at the hearing or by mail. The cost of the legal ad will be pre-calculated and posted on the hearing agenda prior to the hearing. 5. Minimum Documentation for a Complete Application: a. Provide a completely filled-out (in all parts) NOI application as locally adopted for the Town of Barnstable, including MassDEP Vegetated Wetland Field Data Form. Indicate Assessor’s map and parcel of the project, as well as the street or road address, and pertinent village (i.e., Hyannis, Centerville, Barnstable, etc). b. Provide two (2) original project plans, stamped in blue or red ink (wet stamp). Plans must be signed and dated by a Massachusetts licensed, professional engineer, land surveyor, architect or landscape architect (as applicable), and shall be drawn at a readable scale (1" = 20' preferred). For multi-acre sites, a second site plan, drawn at larger scale showing the entire site, should also be provided. Chap 707/rev. February 2025 Page 3 c. Provide a signed Permission to Access Property, Form PA. The form must be signed by the property Owner, or legal representative and submitted with the NOI. . Form PA is available at www.townofbarnstable.us/Conservation/. d. For projects requiring mitigation plantings under Chapter 704 -3, 704-4, and 704-5, mitigation planting location(s) shall clearly be shown on landscaping planting plan. The planting plan shall include: 1. species (chosen from the Town of Barnstable Conservation Commission approved planting lists), sizes, densities and/or quantities. 2. area calculations in 0’ - 50’ and 50’ – 100’ separately for the amount of mitigation planting required. 3. the amount of mitigation planting proposed. 4. a note or indication stating the area between the proposed plants will either be planted with an appropriate native seed mix or left to naturalize. 5. a note stating mulch may only be used under the dripline of proposed plants. 6. demarcation markers along the landward side of the mitigation planting area. The type of demarcation marker shall be selected from the list approved by the Conservation Commission. e. Provide detailed, written street directions to the locus (site). f. Provide a copy of a U.S.G.S. locus map indicating the general area of the project site. g. Provide a check for the Town of Barnstable portion of the required filing fee. (The portion payable to the Commonwealth, see 7. e. below) h. Provide any other documentation, photographs, architectural renderings or other supporting data prepared by professionals competent in the field which may be relevant to the application. 6. The site plan shall also show: a. All existing and proposed contours at 2-ft. minimum intervals (1-ft. preferred). b. Clear delineation of all existing and proposed structures and features. Building structures must be accurately dimensioned (fixed location) from property lines and wetland resource areas. Plans shall provide sufficient detail to show all potential wetland impacts, mitigation, compensatory areas, engineered structures, utilities, landscaping, etc. within the area of jurisdiction. On complicated sites, existing and proposed conditions must be shown on separate sheets. c. Locus inset map of the site clearly showing its location relative to surrounding public streets. d. All wetland resource area flags by individual flag number (matched to the field) to clearly identify all resource areas on or within 100 feet of the work area. The individual who performed the flagging and date of flagging shall be identified on the plan next to the resource line. e. Section views showing changes in grade, cuts and fills. 7. SUBMISSION OF THE COMPLETED APPLICATION WITH PLANS: a. Email NOI application and all associated materials in PDF format to Kimberly.Cavanaugh@town.barnstable.ma.us AND Edwin.Hoopes@town.barnstable.ma.us Do not include copies of checks. Provide two (2) full NOI applications with folded plans (colored ink stamp) with signature/date to the Town of Barnstable Conservation Division Office for administrative use; Chap 707/rev. The property sits on top of a n inland coastal bank that is approximately 15 feet high which is sparsely vegetated. There is an existing rotted landscape timber stairway leading down to the waterfront area. Portions of the property are located within a Natural Heritage and Endangered Species Program regulated area. Project Description This proposal includes the following: - Installation of a seasonal pier/float that extends approximately 38.6’ from freshwater high water line in Long Pond - Reconstruction of elevated wooden stairway down the inland bank to allow adequate and safe access to the waterfront - Implementation of planting plan prepared by Environmental Consulting & Restoration, LLC. The proposed water dependent dock system consists of (4) aluminum sections that are 4’x10’ and one 8’10’ floating section.. The overall stairway width is 4 feet utilizing 2”x6” decking spaced at least ½” apart to allow for proper light penetration. The stairway will also be elevated above the bank to allow for vegetation growth and bank stabilization. Performance Standards Guidelines for Private Freshwater Docks, Piers and Floats The terms “dock, piers & floats” are used interchangeably. While each application for a freshwater pier will be reviewed on its own merits, the Commission expects that the proposed pier will generally comply with the following guidelines: 1. Seasonal: The pier should be seasonally deployed no earlier than April 1, and removed no later than November 1. Noted. 2. Materials: The pier should be manufactured from suitable materials such as aluminum, plastic or composite, but not pressure treated wood. Seasonal pier will be made from aluminum materials. 3. Length and width: The pier length should reflect that of existing nearyby piers on the pond or similar ponds. Floats should not be allowed to ground the substrate. The maximum pier width should be 4 feet. The end floats or platform for berthing vessels should be no gr eater than 96 square feet. The total length of the pier is 40’ and the square footage of the float is 80 SF. 4. Access: Access should be provided as a means for along -shore public traverse. If the pier is located on a great pond, *access is required by Ch. 91. Lateral access will be provided above the water line over the proposed pier and stairway. 5. Off-Season Storage – Pier sections should be stored in an upland location and not in the buffer zone. The pier will be restored on the property above the Top of Inland Bank. 6. Centering: The pier should be near the centerline of the lot and perpendicular to the shore. The pier is in line with the existing path/stairway. 7. Depth: When a motorboat is to be berthed at the pier, the minimum depth should be 12 inches under the draft of the boat, with the motor in the downward position so as to avoid damaging the substrate and causing re -suspension of sediments that could be harmful to any shellfish, finfish, or aquatic plant species that may be present. The amount of water at the end of the structure is proposed at approximately 4.1’. The proposed watercraft drafts approximately 18” so the water is 3.4’ deep at the downward position of the outboard motor. § 703-3. Filing protocols. A. A notice of intent is required for any new pier or dock, whether fixed or floating, permanent or seasonal; also for any substantial alteration or extension of an existing pier or dock. B. one copy of the notice of intent shall be sent to each person or office on the following list, by certified mail or hand -delivered, and a receipt obtained at the time of filing of the notice of intent with the Conservation Commission: (1) Shellfish Biologist/Marine and Environmental Affairs. (2) Harbormaster. (3) Waterways Committee. C. The applicant shall provide evidence to the Conservation Commission at the time of the notice of intent filing that such copies have been mailed or delivered. The project shall be clearly identified and staked or marked with a buoy at pier end within three weeks prior to the hearing. D. The notice of intent shall include: (1) Brief comments, where appropriate, on each of the Guidelines. (2) Length, draft and type of boats, horsepower and type of propulsion system intended for docking or use at the pier, including the depth of the propulsion system in its lowest position. (3) Locus identified by Town Assessor's map and parcel number, and by street number, street and village. (4) Locus shown on Assessor's map. (5) Daytime telephone number of applicant, or name and telephone number of applicant's agent. (6) A shellfish survey, including an analysis of shellfish habitat suitability, and substrate sediment analysis. The minimum area surveyed shall include a 50-foot radius from the proposed project. The actual samples shall represent no less than 0.5% of this ar ea. (7) The shellfish survey report shall include as a minimum: (a) The resume of the person(s) conducting the survey, including their qualifications for conducting such a survey; (b) The date, time of day and tidal conditions at the time of the survey; (c) A narrative explaining the methodology and equipment utilized, location and number of transects/quadrants utilized, results obtained, observations and conclusions. E. The project plans shall show: (1) A description of all materials to be used and the method of construction, including the method of pile installation; when near shellfish habitat, the type of precautions used to insure the barge and equipment used will not damage shellfish habitat. (2) Where the structure is seasonal or includes seasonal floats, a statement indicating the site for winter storage and the method of hauling, if any. (3) Soundings within 100 feet of the dock and from the dock to the closest marked channel. Depth shall be measured to the top surface of soft sediments. Soundings shall be of sufficient density to allow the exact determination of water depths around the propos ed pier and floats, and to the closest navigable channel. The soundings shall show the MLW in the areas where the proposed boat will be berthed. (4) Data shall be supplied to the Commission showing the time and date of the depth survey, the existing weather conditions, the state of the tide and the actual depths measured from water surface to the bottom. The methodology used to determine MLW and MHW sh all be given. If MLW or MHW is derived from NGVD or other reference Datum, an explanation of the calculations used must be included in the narrative. (5) Eel grass within 200 feet of dock. (6) Marked or recognized navigation channels within 200 feet of pier. (7) Any moorings within two hundred feet of the proposed pier and information affixed to those moorings (8) Location of existing Town, commercial and private piers, Town landings (ways to water), public or Association beaches, shellfish propagation or relay areas and designated Town shellfishing areas within three hundred feet of the proposed pier. (9) Approximate shoreward boundary of any existing public or commercial mooring area within 200 feet of the pier. (A recent aerial photograph, taken during the summer boating season, may be used for this purpose if desired.) Proximate moorings shall be shown o n plan. (10) Location of existing Town, commercial or private piers and docks, and Town landings, within 300 feet of pier. (11) The plan shall have the official stamp of a registered civil engineer or land surveyor. F. In addition to the above requirements, the applicant shall comply with the Submission Requirements Checklist available at the Conservation Commission Office. G. a notice of intent may not be accepted or approved by the Conservation Commission unless all of the foregoing requirements have been completed. If any section does not apply, such inapplicability shall be indicated. § 703-4. Regulations. A. Private, noncommercial docks, being structures accessory to and appurtenant to dwellings, will be permitted only on land contiguous to the dwelling being served, except where unusual circumstances of longstanding may apply, such as where the dwelling is se parated from the shore by a road. B. No dock, even if otherwise permitted, may be constructed when it is appurtenant to a residential dwelling until an occupancy permit has been issued for that dwelling. C. Only non -CCA material may be used in the construction of the dock. Lead caps are not permitted. No creosote treated materials may be used. [Note: CCA piles and structural timber three inches or more in thickness may continue to be used until such time as the Commission determines that suitable alternatives exist.] D. Lighting, if installed, shall not exceed a 25 watt incandescent bulb, set a minimum of 12 feet apart and a maximum of two feet high from the walking surface. These lights must be baffled or shaded to direct light downward only. The lights cannot utilize ti mers and should be switched at the beginning and end of dock. No lighting shall interfere with safe navigation. E. All piers and walkways shall be provided with access stairs at or proximate to MHW or other means provided for along shore public traverse. All structures shall be provided with suitable signage notifying the public of its right to free access as provided by the commonwealth, or equivalent. F. The DEP permit number shall be permanently and conspicuously placed on the dock so as to be visible from seaward. G. Storage of floats, other seasonal pier material, and boats shall not be allowed on marshes, dunes, or coastal banks. All such materials must be stored in a permitted area and transported thereto without causing damage to any resource area, or outside of conservation jurisdiction. H. Where the project includes the use of floats, the combined size of all floats shall be consistent with the impact of the entire project on the protected values at the site, but not greater than 200 square feet. A minimum depth of 12 inches of water measured at MLW is required under the floats. I. Plank spacing shall be a minimum of 3/4 inch. However, where any portion of the dock (walkways, ramps, pier, etc) crosses a salt marsh, a minimum of 65% light penetration is required. The maximum dock width shall be 4 feet, measured center of pile to center of pile. For single pile construction, maximum deck width shall be four feet. J. No dock, including pier, floats, dolphins, etc., shall extend further from shore than: (1) A point equaling 1/2 of the lot's water frontage measured in a straight line between the lot's waterfront corners. Owners of two adjoining lots may combine frontage and erect a shared pier, provided that such agreement is registered in perpetuity at the Registry of Deeds. (2) A point 35 feet from a publicly used channel, either a marked channel or a channel as defined by historic use. This dimension includes the beam of the vessel being berthed. (3) Is necessary to attain a depth of water at mean low water suitable for a private use of the pier that is consistent with protection of the wetland resources adjacent to the site and uses of the adjacent waters and wetlands by the public in pursuit of the i nterests protected under the Town of Barnstable Wetlands Protection Ordinance, but under no circumstances greater than 100 feet from mean low water, including all "ells" and "tees," regardless of configuration. (4) Twenty percent of the width of a linear waterway at MLW except where the location of an existing channel shall dictate otherwise. This width shall include the beam of the berthed vessel. In such waterways, i.e., rivers, narrow estuaries, etc., sufficient o pen water shall be maintained to sustain a variety of activities not simply related to safe transit. K. Notwithstanding any other provision pertaining to length, no dock shall be longer than is necessary to attain the minimum depths required herein, and may not obstruct waterways normally used for recreation. L. The base of the pier shall be as close as possible to the center line of the lot, and it shall project outwards at an angle as nearly perpendicular to the shoreline as possible. M. Within the limits of performance standards governing overall length of docks, the following depth requirements must be met for motorized vessels, with these draft requirements continuing over time: (1) In areas determined to be of high -value shellfish habitat, the minimum depth under the draft of the boat must be 30 inches at MLW. High - value shellfish habitats are those found to be significant to the provision or protection of the wetland values protecte d under Chapter 237, Wetlands Protection, of the General Ordinances of the Code of the Town of Barnstable.. Any area rated six or above on any maps or reports developed by the Natural Resources Division and filed with the Commission and the Town Clerk shal l be presumptively considered a high -value shellfish area. (2) In areas determined not to be high -value shellfish habitat, the minimum depth under the draft of the boat must be 12 inches at MLW. (3) For vessels using unconventional drive systems, such as but not limited to jet-drives, the applicant, in addition to meeting the above minimum depth requirements, must further demonstrate that the water depth is adequate to protect the interests herein referenced. (4) To prevent bottom scouring, the above-described minimum depths must exist not only at the dock where a boat(s) is to be berthed or used but also between the dock and the nearest navigable channel or open water. N. Notwithstanding any other provisions contained herein, no new or expansion of an existing dock shall be permitted within an ACEC (area of critical environmental concern). O. Private piers shall be constructed so as to not interfere with any longstanding public recreational use of the waterway, e.g., an area used by sailboats tacking through a narrow waterway, an area used by boaters or others because of unique wind or current conditions, a structure that would interfer e with public access to or from a way to water or public. P. Where there is a substantial expansion of an existing dock, the Commission may require compliance with all or part of these regulations. Q. (1) Boat lifts, boat elevators and boat davits are prohibited for any proposed new dock except where necessary for handicapped access for a resident of the property where the dock is proposed. Where there is no longer a demonstrated medical need, or when the property is transferred or sold, the boat lift, elevator or davits must be removed and the Conservation Division notified. (2) Boat lifts, boat elevators and boat davits are prohibited for any existing, permitted dock except: (a) where necessary for handicapped access for a resident of the property where the dock is located. Where there is no longer a demonstrated medical need, or when the property is transferred or sold, the boat lift, elevator or davits must be removed and the Conservation Division notified, or, (b) where extraordinary circumstances are proven to exist such as wind, tides, currents and boat wakes, and, where the commonly -used alternatives of boat whips and dolphins/tie-off piles are proven by the applicant as being unable to provide stability for vessels berthed at the dock. (3) Boat lifting devices that qualify above in paragraphs 1 or 2 must comply with the following: (a) be either mechanically operated or electrically driven. The use of hydraulic fluid is prohibited. (b) be painted a neutral color or anodized. (c) be elevated so that the hull of the vessel is no more than 12” above Mean High Water except that greater heights can be set for extreme tides, not to exceed the spring tide line. Notwithstanding this provision, elevated vessels should be removed during storm events. Due to extreme tidal range, boat lifts, elevators and davits are prohibited in Barnstable Harbor. (d) have a specific vessel identified with its use; such vessel having a neutral hull color and having either no bottom paint or a non -toxic bottom paint. The applicant will provide bottom paint specifications to staff for review. R. (1) Improvement dredging to create water depths to otherwise meet the requirements of these regulations is prohibited. Improvement dredging is not allowed to provide greater depths at a shallow site that otherwise would qualify only for either a non - motorized, dinghy dock or a small -draft motorized dock. (2) Improvement dredging to create greater water depths at the site of an existing, permitted pier and /or in a fairway from the permitted pier to the nearest channel is prohibited except that a waiver may be sought where accretion of sub-surface sediments has occurred as a result of either: (a) the littoral drift of sediments from nearby beaches, dunes and banks that have been artificially nourished, or, (b) the passage and re-passage in the nearest channel of large passenger/car/truck ferries or other large observation, freight or tanker vessels. Under either ‘a’ or ‘b’, improvement dredging is allowed to restore the depths that existed at the time the dock was permitted by the Commission. § 703-5. Presumption of adverse effect; burden of proof; cumulative impact. A. When a proposed project involves the dredging, removing, filling, altering or causing of a potentially adverse effect to an area subject to protection under the ordinance by the construction or enlargement of a dock, the Commission shall presume that the p roposed activity will have a significant or cumulative adverse effect upon the resource values specified in Chapter 237, Wetlands Protection, of the General Ordinances of the Code of the Town of Barnstable. These presumptions are rebuttable and may be over come only by a preponderance of evidence showing that the work does not have a significant or cumulative adverse effect upon the resource values. The burden of proof to overcome the presumption shall be borne by the applicant. Moreover, the Commission will consider the impact of both existing docks and future docks with pending applications in determining the cumulative effects upon the protected resource areas. Where appropriate, the applicant may be required to submit a drawing showing all possible docks (docks that may meet Commission guidelines) within 1/2 mile of the proposed dock or other agreed to cumulative physical location. The cumulative impact of such docks and the related boat use pattern on the values protected by the ordinance will be consider ed by the Commission. A project which may otherwise comply with these regulations and guidelines may be denied where its cumulative effect would result in an adverse impact upon the protected resource areas. B. In most cases seasonal piers present less impact to the resource because of their seasonal nature and because they can be constructed entirely with environmentally benign materials. Accordingly, the presumptions set forth herein may be more easily overcome for this type of construction. C. These regulations notwithstanding, the Conservation Commission will consider any and all pier proposals on a site -specific basis, disposing of each according to its merit and to the degree that the preponderance of evidence shall show that the statutory in terests have been preserved and protected. § 703-6. Construction protocol. A. The Natural Resources Department shall be given written notice by the applicant not less than 10 working days before the start of construction in order to arrange shellfish removal, reseeding, replanting, monitoring, and subsequent replanting if necessary, at the applicant's expense. B. The Conservation Commission shall be given written notice by the applicant not less than five business days before the start of construction. 1 C. All construction shall proceed in compliance with the plan of record and the order of conditions. No alterations for which revised plans have not been approved prior to construction will be allowed. Alternatives Analysis Option 1: Current proposal – construct pier to approximately 40’ beyond high water. This is the required distance to reach a depth of 4’ at the end of the pier . This does not extend or encroach into the navigational channel and will not interfere with nearby piers/docks. Option 2: Construct a smaller pier that extends approximately 30’ beyond mean high water. This would preclude the owner from utilizing their boat as it would result in only 3.1’ of depth at the end of the pier. Option 3: Construct a permanent wooden pier. This would not follow the regulations and would not be as environmentally beneficial as a seasonally removable pier. Construction Protocol The proposed work shall be performed with the minimum amount of equipment necessary to follow through with the project objectives. Staging areas for the proposed pier will be on the owner’s upland property only and accessed from the driveway or working barge. Pre-construction Meeting Prior to construction, a pre -construction meeting shall be held on -site with the Contractor, Property Owner, Conservation Commission and/or agent, and the Project Manager (WRS Engineering LLC). The purpose of the meeting is to clearly delineate the limits of work and access, as well as the staging area. The Contractor will describe the proposed means and methods for performing the work within the requirements of the plans, order of conditions and construction protocol. The contractor will comply with mit igation measures as established by the Conservation Commission. To be discussed at the meeting: - Existing property conditions, necessary precautions to be taken by the Contractor; - Means and methods for construction; - Necessary post-construction remedial efforts - Procedure for post construction inspection; - WRS Engineering’s responsibilities for inspections and project coordination During construction, the site shall be accessible for inspection during reasonable hours by all parties, members of the conservation commission and their agents, and the Project Manager. Post-construction meeting Upon completion of construction, but prior to equipment being removed from the site, a post - construction meeting shall be held on -site with the Contractor, Property Owner, Conservation Commission and/or Agent, and the Project Manager (WRS Engineering LLC). The purpose of this meeting is to determine that the project has been satisfactorily completed in accordance with all permits, and that no additional work or mitigation is required by the Contractor. Restoration of Project Area 1031 West Main Street – NOI 9/20/25 2 Upon completion of construction any and all areas disturbed by the construction effort shall be returned as much as practical to their pre-construction conditions to the satisfaction of the property owner and conservation agent. All disturbed marsh or veg etated areas shall be re- vegetated with indigenous or grass vegetation to match pre -construction conditions for the surrounding areas, or as determined during the preconstruction meeting. The goal of the Vegetation Management Plan is to restore and enhance the buffer zone to Long Pond with a native plant community as part of the proposed project. The proposed plan also includes vista pruning to allow for better views of Long Pond. The plan has been designed to remove non-native invasive plant species, install new native plantings, and manage the area to improve the overall capacity of the resource areas and buffers to protect the interest of the MA Wetland Protection Act (MA WPA) and the Town of Barnstable Wetland Bylaw (the Town Bylaw). Vegetation Management Activities Vegetation management is proposed throughout the buffer zone at the site. The management area is identified on the site plan prepared by others. Management activities include hand removal and selective herbicide application of non-native invasive plant species. Invasive species identified onsite include Morrow’s Honeysuckle (Lonicera morrowii), Multifloral Rosa (Rosa multiflora) and Oriental Bittersweet (Celastrus orbiculatus). Additionally, there is a significant amount of Greenbrier vine (Smilax rotundifolia) that is impacting the existing native vegetation at the site. Furthermore, the plan includes planting of native species and ongoing monitoring/maintenance of the site. Removal of Non-Native Invasive Species – The woody invasives are proposed to be treated and removed from the site utilizing the “cut & paint” method. The targeted plants will be flagged in the field by the overviewing botanist, flush cut at the base of their stem, and then removed from the site. Regarding invasive trees, only saplings less than 3” in diameter will be treated and removed to avoid potential disturbance caused by the removal of large mature trees. Upon cutting, the stems will be painted with herbicide to prevent stump sprouting and ultimately kill off the remaining root mass. The herbicide product proposed for usage will be chosen by the licensed herbicide applicator to include coordination of the product details with the Conservation Agent prior to application. Though labor intensive, this technique prevents herbicide exposure to non-target plants. All herbicide use will be completed by a licensed herbicide applicator in compliance with manufacturer guidelines. No foliar spraying of herbicide will occur. Planting Native Species – Following the treatment and removal of the non-native invasive species within the management area, the restoration area should be enhanced with new native plantings. Once the invasives have been removed, the management area shall be inspected by the overviewing wetland specialist to determine the quantity and placement location of new plants. Once installed, the root zones of the new plants will be covered with natural mulch or wood chips. The intent of new plantings will be to fill-in the areas void of vegetation following removal of invasives and restore the capacity of the buffer zone to protect the interest of the MA WPA and the Town of Barnstable Bylaw. The purpose of the review was to identify wetland resource areas on and near the site. The site is located to the south of West Main Street. The site consists of a single-family home with an associated paved driveway, wooden deck, yard area, etc. Wetland resource areas are located on and near the southern portion of the site. ECR placed Bordering Vegetated Wetland (BVW) flags (pink/black striped ribbons) #A1-1 to #A5 along the limit of the vegetated wetland located to the south of the site associated with Long Pond. The vegetated wetland was delineated following the methodology established by the Massachusetts Department of Environmental Protection (DEP) regulations found at 310 CMR 10.55 pertaining to the delineation of Bordering Vegetated Wetlands. The delineation was performed by analyzing vegetation, hydrology within 12 inches of the surface, and soil conditions within 20 inches of the surface. The wetland contains hydric soils, saturated soils, and dominant wetland indicator plants. ECR also delineated the Inland Bank (IB) of Long Pond to the south of the site. IB flags (blue ribbons) #IB1 to #IB5 were placed along the top of the well-defined Bank of the pond in order to identify this resource area located downgradient of the BVW described above. The Inland Bank was delineated in accordance with DEP’s requirements for Bank (310 CMR 10.54). As a result of ECR’s wetland delineation at the site, ECR confirms the site contains the following wetland resource areas and areas of Conservation Commission jurisdiction: • Bordering Vegetated Wetlands (BVW) • Inland Bank to pond • 100-foot Buffer Zone to BVW Also, a review of the MassMapper database reveals the following: 1. Yes _______ No ________ ____ () Vista Pruning Guidelines Vista pruning in these guidelines refers to the selective pruning of trees in order to improve a view through a pre-determined vista corridor/s. Vista pruning applies to work beyond the work limit line, i.e., on a coastal bank or within 50’ of the edge of wetland. Vista pruning requires an Order of Conditions or a Determination of Applicability which conveys approval by the Conservation Commission. No work is allowed in a wetland. Prior to site visit by Conservation agent, live trees and dead trees for which removal has been approved should be flagged with tape. Vista corridors within which pruning will occur should be delineated. Removal of trees is by flush cutting, not digging. Transport of the cut wood or brush to outside of the buffer zone should be by hand, not with the use of heavy equipment. Once completed, vista pruning may be maintained in a consistent manner over time. Live trees and dead trees Removal is generally not allowed. Exceptions would be 1) express approval of the Conservation Commission or 2 ) trees hazardous to the house - with prior approval. Limbing of branches is limited to no more than 20% on an individual tree. Limbing of dead wood on a live tree counts toward the 20% limit. Limbing of pitch pine is only permitted between October 1 and March 31. Topping is not permitted without express approval. Shrubs and bushes No cutting or thinning allowed except of dead material unless approved by Conservation staff. Ground cover No disturbance permitted Greenbriar and other Climbing Vines Removal, by hand-pulling or clipping around base of tree, is permitted with staff approval.
