Hand-pruning shrubs to maintain a limited view corridor. Removal of invasive vines (bittersweet). No stump removal, grading, or machinery. Debris to be removed off-site the same day. b. Identify provisions of the Wetlands Protection Act or regulations which may exempt the applicant from having to file a Notice of Intent for all or part of the described work (use additional paper, if necessary). 310 CMR 10.02(2)(b)(2)(c) Exempts vista pruning, provided the activity is located more than 50 feet from the Bordering Vegetated Wetland. Request for Determination of Applicability 256 Indian Trail Barnstable, MA PROJECT DESCRIPTION 1.0 INTRODUCTION & BACKGROUND The proposed project located at 256 Indian Trail (the Site) in Barnstable, MA is to construct a single-family home and associated amenities. This application is being submitted in accordance with the Massachusetts Wetlands Protection Act and the Town of Barnstable's Bylaw Chapters 237 and 704 regarding Wetlands Protection. 2.0 SITE DESCRIPTION The property located at 256 Indian Trail contains a single-family dwelling with associated lawn, pool, and landscaped areas. The property is bordered by single-family homes to the north, south and west, Cape Cod Bay to the north and coastal wetland associated with Cape Cod Bay and Barnstable Harbor to the north, south, and east. The wetland resource areas and areas of conservation jurisdiction on site that are protected under the Wetlands Protection Act and the Town of Barnstable's Bylaws include: • Top of Fragmented Coastal Bank • Bordering Vegetated Wetland The lot lies partially within FEMA Flood Zone AE (EL 12) at the bank toe and Zone X upland. A “No Mow Zone” presently exists along the upper Coastal Bank. 3.0 PROPOSED ACTIVITIES The purpose of this application is to authorize the following activities: Vista Pruning: The applicant seeks approval for selective vista pruning and vine removal within the buffer zone to the Coastal Bank and BVW and partially within the coastal bank. Activities will include: • Hand-pruning of woody vegetation to maintain a view corridor, reducing selected shrubs and saplings to a height of approximately 4 – 6 feet. • Removal of invasive vines (bittersweet) intertwined within existing native vegetation. • No cutting or disturbance of tree trunks greater than 3 inches DBH, no stump removal, and no grading or fill. • All roots will remain intact to preserve soil stability and prevent erosion. • All work will be conducted manually using hand tools. No mechanical equipment will be used, and all trimmings will be removed from the site immediately following pruning. • Some areas of work would fall under the WPA exemption for minor activities: 310 CMR 10.02(2)(b)(2)(c) Exempts vista pruning, provided the activity is located more than 50 feet from the Bordering Vegetated Wetland. Landscape areas area also exempt. The vista pruning will be done by hand, and all debris will be removed from the site immediately following pruning activities.
