The proposed activities within conservation jurisdiction consist of the temporary excavation to install the tank and connect to the adjacent existing sewer and restoring the surfaces to preconstruction conditions as described on the NOI Filing Form. These project elements will occur within the 50-foot Buffer Zone to Bordering Vegetated Wetland (BVW) described in our field report. Details of the proposed project are shown on the enclosed site plans and described in the attached project narrative. Enclosed, please find the two original-signed copies as well as seven additional copies of the NOI application, supporting documentation, and the site plans. This application has also been submitted to your office in PDF format. Filing fees and supporting calculations are also enclosed. Notifications to abutters will be provided with evidence of delivery. The proposed work is within the jurisdictional setback to a bordering vegetated wetland (BVW) and requires a Notice of Intent be filed with the Barnstable Conservation Commission. Anticipated list of required permits: A. Barnstable Conservation Commission Order of Conditions (OOC) B. Town of Barnstable Building Permit C. Barnstable DPW/Sewer Department Approval 1.0 GENERAL SITE DESCRIPTION The site is located in Hyannis at the Cape Cod Mall property, along the south face of the building outside the existing cinema entrance. The proposed project location is identified by the town Assessor’s Office as Parcel ID 293-024, and is split partially between the HB and B Zoning Districts. The parcel totals approximately 35 acres and contains a large retail building (mall). There is a fire access drive running approximately east-west, parallel to the building with a 5’ wide sidewalk running along the face of the building. The access way consists of a strip of lawn with grass pavers between the building sidewalk and the top of the slope leading to a large stormwater basin/BVW. The top of slope is demarcated by a chain link fence and some woody vegetation. 1.1 Soil and Groundwater Based on available data and maps from the US Department of Agriculture (USDA) Natural Resource Conservation Service (NRCS), the soil at the proposed site is Urban Land. DEP Data Forms were prepared and are attached to this report for the areas surrounding the BVW and can be viewed in Attachment F and overall soil mapping is detailed in Attachment A, Figure 3. The nearby stormwater pond was used as a reference to estimate groundwater at about elevation 33.00 ±. www.strongtree.engineering 4 (774) 559-3942 1.2 FEMA Designation According to the FEMA Flood Insurance Rate Map, Panel 25001C0542J, Dated 7/16/2014, the proposed project area is located within a Zone X, Area of Minimal Flood Hazard (see Attachment A, Figure 2.) 1.3 State-listed Rare Species Habitat, Estimated Rare Wildlife Habitat, and Vernal Pools According to the most recent version of the Massachusetts Natural Heritage Atlas 15t, Edition, August 1, 2021), per the Massachusetts Endangered Species Act (MESA), there are no Estimated Habitats of Rare Species, as administered by the Massachusetts National Heritage and Endangered Species Program (NHESP), in the project area - (see Attachment A – Figure 4). According to the MassGIS data layer, there are no certified or potential vernal pools on or near the Site. 1.4 Areas of Critical Environmental Concern (ACEC) According to Massachusetts Department of Conservation and Recreation (DCR) maps and regulations, no portions of the property or proposed work areas are within an Area of Critical Environmental Concern (ACEC) (see Attachment A, Figure 5). 1.5 Wetland and Other Resource Areas Wetland resource area evaluations were conducted by John F. McGrath, Jr., PWS, a Senior Wetland Scientist with Strong Tree Engineering, on September 23, 2025. A wetland resource area was delineated in accordance with Delineating Bordering Vegetated Wetlands (BVW) under the Massachusetts Wetlands Protection Act (WPA), Second Edition (September 2022), the US Army Corps of Engineers Wetlands Delineation Manual, Technical Report Y-87-1 (January 1987). Wetland Delineation Data Forms and a full report can be found in Attachment F. Bordering Vegetated Wetland: As defined in 310 CMR, 10.55, (2)(a) “Bordering Vegetated Wetlands are freshwater wetlands which border on creeks, rivers, streams, ponds and lakes. The types of freshwater wetlands are wet meadows, marshes, swamps and bogs. Bordering Vegetated Wetlands are areas where the soils are saturated and/or inundated such that they support a predominance of wetland indicator plants. The ground and surface water regime and the vegetational community which occur in each type of freshwater wetland are specified in M.G.L. c. 131, § 40.” Description of Wetland Resource Areas The Section below provides a detailed description of the wetland resource area identified within the project area (see Attachment F) www.strongtree.engineering 5 (774) 559-3942 1.6 Wetland Restriction Orders There are no Wetland Restriction Orders for this site. 2.0 PROPOSED PROJECT The Applicant proposes to temporarily dig a trench suitable for the installation of a precast concrete grease trap tank in the fire lane/lawn area just outside the foundation of the cinema building at the Mall. The excavated area will allow the tank installation with appropriate piping and fittings to connect to the existing sewer manhole adjacent to the proposed tank. The limit of work and details of work activity are shown on the Site Plans. 2.1 General Erosion and Sedimentation Control The Applicant will implement best management practices (BMP) for erosion and sediment control to protect wetland resource areas and downgradient properties by installing a sediment control barrier(s) before the start of any construction activities. Details of the proposed project are presented on the referenced Site Plans. The erosion controls will be maintained between the BVW and work limit during construction. 2.2 Stormwater Management The entire proposed permanent work is underground; the lawn, grass pave, and concrete sidewalk already at the site will be restored in kind upon completion of the installation of the grease trap. 3.0 PROTECTION OF RESOURCE AREAS A small amount of earth disturbance from the project will occur in the lawn area within the 0- 50 foot buffer zone. This area will be restored to its previous condition upon completion of the project. Table 1 details the temporary and permanent impacts by resource area and types of disturbance. The purpose of the inspection was to view the retention pond behind the mall and delineate the limit of the bordering vegetated wetlands located on the north side of the retention pond for a planned utility construction project (grease trap). The methodology considered for establishing and reviewing the BVW boundary follows the Massachusetts Department of Environmental Protection September 2022 publication, “Delineating Bordering Vegetated Wetlands”. The wetland boundary was delineated with blue survey ribbon. The delineation commences with boundary marker “ST-1”” near the northwest corner of the retention pond and extends to the east along the base of the pond and terminates with wetland boundary marker “ST-7” near the northeast corner. This retention pond area is shown on the DEP Mass Mapper as Open Water (OW). Inland wetland plant species identified during my inspection included Red maple, Scouler willow, Black willow, Woolgrass, Smartweed, Common soft rush, Grass-leaved goldenrod, Broadleaf cattail, and other wetland plants. Upland plant species identified above the BVW included Eastern red cedar, Pitch pine, Red oak, Bradford pear, Autumn olive, Multiflora rose, Virginia creeper, Oriental bittersweet, and other upland plant species. The Barnstable County Soil Survey information from the UCDAVIS NRCS website describes the site as “Urban land”.
