This comment is not offered in opposition to redevelopment of the proposed site. My request is that demolition and site preparation be conditioned in a manner that is fully consistent with the findings required under the Massachusetts Wetlands Protection Act and Barnstable’s local Wetlands Protection Bylaw. Specifically, I respectfully request that the Commission require protection of the multiple significant mature trees currently located on the site as part of the Notice of Intent. These trees contribute directly to protected resource area functions and interests, including storm damage prevention, flood control, groundwater protection, and water quality. As you know, existing tree canopy promotes infiltration, reduces runoff, stabilizes soils, and moderates site temperatures, thereby supporting the functional integrity of adjacent resource areas and buffer zones. Absent appropriate conditions, demolition and site clearing activities may result in the unnecessary removal of mature trees, increased impervious exposure, and soil disturbance. Such impacts would increase runoff and erosion potential and may adversely affect protected resource areas. These impacts cannot be fully mitigated through post-construction planting. I therefore request that the Commission condition any approval to ensure that demolition and associated site work will not adversely affect protected resource areas or the interests of the Wetlands Protection Act and the Barnstable Wetlands Protection Bylaw, by requiring preservation and protection of existing significant trees to the maximum extent feasible. Thank you for your careful consideration and for your continued work protecting Barnstable’s natural resources while supporting responsible development. Tree Protection and Limits of Disturbance Finding The Commission finds that, with appropriate conditions, the proposed demolition and associated site work will not adversely affect protected resource areas or the interests of the Massachusetts Wetlands Protection Act and the Barnstable Wetlands Protection Bylaw, including storm damage prevention, flood control, groundwater protection, and water quality. Tree Preservation Requirement All existing significant mature trees located within the project site and within any applicable buffer zone shall be preserved to the maximum extent feasible. No removal of such trees shall occur unless expressly authorized by the Commission in writing. Tree Protection Measures Prior to commencement of demolition or any land-disturbing activity, the Applicant shall install and maintain tree protection fencing at the outermost drip line / critical root zone of all trees designated for preservation. Fencing shall consist of sturdy construction fencing or equivalent, a minimum of four (4) feet in height. Fencing locations shall be reviewed and approved by the Commission or its agent prior to work commencing. Note: The attached photographs indicate a workload limit which may protect the tress in question Kindly enforce this demarcation with a condition. .
