Certified abutters list and Notice to Abutters 21 Hawes Ave. Property Description The property is located on the North Side of Hyannisport Harbor just West of Kalmus Beach; a tidal bay on Nantucket sound. The project site is approximately .5 miles inland from Nantucket Sound. The property is located on the East enf of the long concrete seawall fronting many properties on Hawes Ave. and subject to wind and waves from all Southerly directions. The waterfront consists of a concrete seawall, fronting revetment, beach stairs, and a sand area for recreation. The waterfront is subject to large waves of up to 4’ from the South (see attached photos). Due to the waves overtopping the seawall, and approximately 1’ of sea level rise the sand has been pulled out from the back yard area behind the seawall abnd also on the beach fronting the wall. The area upland of MHW is a coastal beach and dune area with grass, sand, and natural areas. The Coastal Bank consists of a concrete seawall, rock revetment and is shown on the project plans. 21 Hawes Ave. The site consists of 2 multi family condominium units, gravel and shell drive and patio on the South side. There is an existing grass strip on the East side of the units. Based on the latest MORIS maps, the scope of this project is located within NHESP jurisdiction for estimated or rare wildlife (see below). 21 Hawes Ave. Project Description Project Description This Notice of Intent filing proposes the replacing lost sand that extends from behind the seawall to the beach grass. The main reason for the project is to bring the elevation of the ground up to 7’ from existing 5.5’ as its being overtopped a lot more frequently and the sand is frequently washed out in storm events. The stairs will have the large boulder on the beach removed and 4 more stairs added in the same footprint. The equipment anticipated for the 21 Hawes Ave. project will be a small bobcat to move sand from the driveway to the sand area behind the wall. The same machine will bring materials to rebuild the stairs and move the rock. High Storm Tide Winter 2024 21 Hawes Ave. Waves breaking over jetty winter 2024 Resource Area Determination The project site is located in Lewis Bay which flows to and from Nantucket Sound. Mean High Water and Mean Low Water elevations were obtained from survey utilizing an rtk gps and referencing the conversions from NAVD88 in the project area. Please note that previous 21 Hawes Ave. licenses reference MLW as the project datum while this filing references NAVD88 vertical datum (conversion provided in plans). The project has a coastal bank determined by elevation and vertical wall. The coastal beach, Land under ocean, land containing shellfish, LSCSF are all identified on the plan. We are in the National Heritage mapped areas as verified on Mass Mapper. Performance Standards The project proposes the modification of an existing staircase that extends from the top of the existing coastal bank to coastal beach as shown on the project plans. The areas directly affected by the project are coastal bank, LSCSF, area containing shellfish, and land under ocean. The project as proposed will not have any adverse effects to the surrounding resource areas which include the areas listed above.310 CMR 10, sections 10.21 through 10.37. The work proposed in this area consists of removing some rocks and placing granite stairs. The remaining project item is just replacing lost sand above the coastal bank. The area consists of the coastal beach, land containing shellfish, land under ocean, and LCCSF. The construction is located in the footprint of the existing structures. Therefore, the project as proposed can be permitted under 310 CMR 10.30 (6) through (8). Land Containing shellfish – A portion of the work is temporary and is within land containing shellfish. The disturbance to the area consists of moving 1 stone and replacing with granite stairs. The disturbance to the area from the construction effort is expected to be minimal and will not adversely affect any shellfish as there is rock under the extent of the work. The project will not change what is relative to the bottom substrate, and therefore have no significant impact to the following interests: alterations of water circulation, alterations in the distribution of sediment grain size, alterations from natural drainage from adjacent land, or changes in water quality. This includes but is not limited to, fluctuations in level of salinity, dissolved oxygen, nutrients, temperature and turbidity, or the addition of pollutants. Therefore, the project as proposed will not have any significant adverse impacts to the coastal beach can be permitted under 310 CMR 10.34 (4) through (7). Alternatives Analysis for work The proposed work consists of re-constructing of a pre-existing stairway and sand renourishment. The project as proposed project occupies the same footprint as the existing structures as such, the following analysis is offered to describe the available options for this project. OPTION 1: Do Nothing – If nothing is constructed the water dependent use of the recreational portion of the property will be lost as sand continues to lost and eventually the 21 Hawes Ave. wall will collapse from the back. The stairs in their current condition are very dangerous and a public safety issue. There fore this is not a viable alternative. OPTION 2: Addition of sand only and leave the stairs alone. Due to loss of beach below the stairs they will eventually collapse and access to the beach will be lost. Therefore, this is not a viable alternative. OPTION 3: Re-constructing of a pre-existing stairway and sand renourishment. The project as proposed project occupies the same footprint as the existing structures s as shown in the project plans. The addition of sand has only positive impacts and the stairs do not function as originally constructed. This will be a 1 time activity for the stairs and a as needed addition of sand probably every 3-4 years that will have the least impact on the resource areas, Therefore this is the preferred option. CONSTRUCTION PROTOCOL Construction Protocol The proposed work shall be performed with the minimum amount of equipment required to obtain the project objectives. The staging area for materials will be from the owners driveway and the upland property. All equipment shall be stored on the driveway or away from the resource areas when not in use. When the equipment is not being utilized the bobcat shall not be parked by the water and a spill kit shall be stored on site. Construction Protocol The bobcat will trac on the existing path through the grass only and bring materials to extend the stairs. Anu grout work shall only be done at low tide and any stray grout or concrete will be cleaned up at the same time. After the stairs are completed sand will be moved onto place using the bobcat. All efforts will be made to stay off the beach grass and any disturbed grass shall be replanted. Pre-Construction Meeting Prior to construction, a pre-construction meeting shall be held on-site with the Contractor, Property Owner, Conservation Commission and/or agent, and the Project Manager (WRS Engineering LLC). The purpose of the meeting is to clearly delineate the limits of work and 21 Hawes Ave. access, as well as the staging area. The Contractor will describe the proposed means and methods for performing the work within the requirements of the plans, order of conditions and construction protocol. The Contractor will comply with mitigation measures as established by the Conservation Commission. To be discussed at this meeting: Existing property conditions, necessary precautions to be taken by the Contractor; Means and methods for construction; Necessary post-construction reparations and conditions; Procedure for post-construction inspection; WRS Engineering’s responsibilities for inspection and project coordination During Construction, the site shall be accessible for inspection during reasonable hours by all parties, members of the conservation commission and their agents, and the Project Manager. Post-construction meeting Upon completion of construction, but prior to equipment being removed from the site, a post-construction meeting shall be held on-site with the Contractor, Property Owner, Conservation Commission and/or agent, and the Project Manager (WRS Engineering). The purpose of this meeting is to determine that the project has been satisfactorily completed in accordance with all permits, and that no additional work or mitigation is required by the Contractor. Restoration of project area Upon completion of construction any and all areas disturbed by the construction effort shall be returned as much as practical to their pre-construction conditions to the satisfaction of the property owner and conservation agent. All disturbed marsh or vegetated areas shall be re-vegetated with indigenous or grass vegetation to match pre-construction conditions for the surrounding areas, or as determined during the pre-construction meeting. removing and driving 21 Hawes Ave. Salt Marsh – Both t shown on Extend stairs down to Grade 21 Hawes Ave. 21 Hawes Ave. NOTICE OF INTENT ABUTTER NOTIFICATION LETTER DATE: RE: Upcoming Barnstable Conservation Commission Public Hearing To Whom It May Concern, As an abutter within 100 feet of a proposed project, please be advised that a NOTICE OF INTENT application has been filed with the Barnstable Conservation Commission.
