The Notice shall give a description and location of any such object and the action taken or being taken to protect navigation. Until removal can be effected, the object(s) shall be properly marked in order to protect navigation. Should the Contractor neglect to report, remove, or refuse to promptly remove any such obstruction, the Engineer shall have the same removed and charge the cost against monies due to the Contractor or recover under his Bond. Spillage of oil or hazardous substances is specifically prohibited by Section 311 of the Clean Water Pollution Act, as amended. Approved spill containment equipment and absorbent material must be located at the project site in the event of a spill into the waterway or the shoreline. The U.S. Coast Guard must be notified immediately in the event a spill occurs. The Contractor shall bear the full responsibility for any costs associated with fines, cleanup activities, disposal and user costs associated with a spillage as a result of their work or activities. FY26 Oyster Harbors Bridge Rehabilitation Project Date: January 6, 2026 Barnstable, MA Notice of Intent Application Page 2 of 3 As there are no impacts to the ground or soil surrounding the bridge, no stormwater management practices will be implemented during construction. No permanent filling, dredging, or alteration of wetland resource areas is proposed, and work will be conducted from the bridge structure and necessary temporary shoring, with best management practices to prevent sedimentation or pollution into West-North Bay. The majority of the proposed work is to the bridge systems and not impacting land. The only ground alterations are minor clearing in the southeast corner of the project site for electrical system improvements. Staging The construction trailer, Porto-Potty and material stockpiling will be located in the northwest corner of the project site, as shown on Appendix I: Staging Location Map. Given the staging area's proximity to West-North Bay, erosion and sediment control best management practices (BMPs) will be installed and maintained throughout the duration of construction activities. These measures will fully surround the staging area to prevent the migration of sediment, stockpiled materials, or generated runoff into the resource area. BMPs will include, at a minimum, silt fencing and proper containment/stockpiling techniques for materials, in accordance with the Massachusetts Erosion and Sediment Control Guidelines and applicable project specifications. All controls will be inspected regularly, repaired as needed, and removed only after site stabilization.p Work Hours Construction work that impacts the traveled roadway, any boat navigation, or the ability for the draw span to operate will only be authorized from November 1st through April 30th, and is subject to all federal, state, and local permits including authorization of the Town and Coast guard as applicable. No work will be authorized on weekends or Town-observed holidays, unless otherwise approved in writing by the Town. Preventative Measures Preventative measures must be taken to prevent any hot work, debris or construction material from entering the waterway. This includes sandblasting material, paint, wastewater from machinery cleaning or purging operations, and any concrete work by-products. Welding and burning must cease upon the approach of a vessel and shall not start again until the vessel has passed the bridge. Should the Contractor, during the progress of the work, lose, dump, throw overboard, sink or misplace any material, plant, machinery or appliance which may be dangerous or obstruct navigation, the Contractor shall promptly recover and remove the same.
