March 2022 Page 1 CHAPTER 707 Regulation Governing Minimum Submission Requirements for a Notice of Intent Application The Barnstable Conservation Commission has adopted the following requirements in order to obtain more consistently complete submission documents necessary for a thorough and efficient review of all Notice of Intent (NOI) applications. Failure to complete any of the items in this checklist may result in your application being denied. Applicant or applicant’s agent should check each box denoting that the task has been completed or in certain instances, like field staking, denoting that the task will be completed. The following submission checklist covers the requirements of Chapter 237, Wetlands Protection, of the Part I General Ordinances of the Code of the Town of Barnstable. This checklist shall be submitted to the Barnstable Conservation Division with the NOI application. 1. Requirements a. The applicant understands, unless they’ve instructed otherwise, they are applying both under the Massachusetts Wetlands Protection Act M.G.L. c.131,§40 and Chapter 237 of the Town of Barnstable General Ordinances. b. Attach a written narrative to the NOI application (WPA Form 3), available at: www.mass.gov/eea/agencies/massdep/service/approvals/wpa-form-3.html describing any project impacts and proposed mitigation as they relate to the following: 1) Any of the interests of Chapter 237 of the General Ordinances and the MassDEP Wetlands Protection Act M.G.L. 131, §40. 2) The performance standards contained in the MassDEP Wetlands Protection Regulations (310 CMR 10.00) 3) Chapter 704: Regulation Governing Activity in the 100-ft. Buffer Zone. 4) Chapter 703: Private Docks and Piers. 5) Any other applicable regulations (310 CMR 10.00 or as promulgated under Chapter 237 of the General Ordinances). c. Enclose proper payment to cover the fee for Chapter 237 filings. Consult current Fee Schedule at www.townofbarnstable.us/Conservation d. The form must be signed by the property Owner, or legal representative and submitted prior to NOI being docketed and application advertised. Form PA is available at www.townofbarnstable.us/Conservation/. Do not send the abutter letter out until the form is submitted to the Conservation Division office. d. For projects requiring mitigation plantings under Chapter 704 -3, 704-4, and 704-5, mitigation planting location(s) shall clearly be shown on landscaping planting plan. The planting plan shall include species list (chosen from the Town of Barnstable Conservation Commission approved planting lists), sizes, densities and/or quantities. The plan shall also provide area calculations between 0 to 50 and 50 to 100 separately for the amount of mitigation planting required, and the amount of mitigation planting proposed. e. Provide detailed, written street directions to the locus (site). f. Provide a copy of a U.S.G.S. locus map indicating the general area of the project site. g. Provide a check for the Town of Barnstable portion of the required filing fee. (The portion payable to the Commonwealth, see 7. e. below) h. Provide any other documentation, photographs, architectural renderings or other supporting data prepared by professionals competent in the field which may be relevant to the application. 6. The site plan shall also show: a. All existing and proposed contours at 2-ft. minimum intervals (1-ft. preferred). b. Clear delineation of all existing and proposed structures and features. Building structures must be accurately dimensioned (fixed location) from property lines and wetland resource areas. Plans shall provide sufficient detail to show all potential wetland impacts, mitigation, compensatory areas, engineered structures, utilities, landscaping, etc. within the area of jurisdiction. On complicated sites, existing and proposed conditions must be shown on separate sheets. c. Locus inset map of the site clearly showing its location relative to surrounding public streets. d. All wetland resource area flags by individual flag number (matched to the field) to clearly identify all resource areas on or within 100 feet of the work area. The individual who performed the flagging and date of flagging shall be identified on the plan next to the resource line. e. Section views showing changes in grade, cuts and fills. 7. SUBMISSION OF THE COMPLETED APPLICATION WITH PLANS: a. Provide a signed Permission to Access Property, Form PA. The form must be signed by the property Owner, or legal representative and submitted prior to NOI being docketed and application advertised. Form PA is available at www.townofbarnstable.us/Conservation/. Do not send the abutter letter out until the form is submitted to the Conservation Division office. b. Email NOI application and all associated materials in PDF format to Kimberly.Cavanaugh@town.barnstable.ma.us AND Darcy.Karle@town.barnstable.ma.us . Do not include copies of checks. The proposed project is anticipated to consist of mechanical dredging of approximately 37,299 cubic yards (CY) of sediment. General Overview The Town of Barnstable (Town), acting through its Department of Public Works, is submitting a Notice of Intent (NOI) and supplemental documentation to conduct maintenance dredging in West and North Bay (see Locus Map, Exhibit A and Figure 1 Below). The proposed project includes the maintenance dredging of the West Bay channel to a depth of -11.0 ft MLLW and the North Bay Street channel to a depth of -8.0 MLLW. All areas will include an allowable one-foot overdredge with 3H:1V side slopes. Maintenance dredging is required to restore safe navigation to the active waterfront area that supports recreational and commercial boating needs. Vessel access and navigational safety are currently compromised due to shoaling presently observed within the West and North Bay Channels. Collectively the proposed project is anticipated to consist of mechanical dredging of approximately 37,299 cubic yards (CY) of sediments that are authorized for unconfined offshore disposal at Cape Cod Bay Disposal Site (CCBDS). Construction is anticipated to start in October 2026 and be completed prior to January 31, 2027. Figure 1: Project Locus 1.1 Site Description The Three Bays estuary in Barnstable, Massachusetts is made up of Princes Cove, North Bay, Cotuit Bay, and West Bay. West and North Bay Channels are located on the south side of Cape Cod and exit out into Nantucket Sound. Past the West Bay Inlet, in the town of Osterville, are a handful of well-equipped marinas and marine facilities and both channels are active waterways that support recreation, transient and commercial vessels. A bascule bridge with a 15-foot vertical clearance crosses the North Bay Inlet, connecting West and North Bay, and it opens on demand 24 hours a day. West and North Bay are located on the south Side of Cape Cod, MA and West Bay connects to Nantucket Sound by an existing tidal inlet. A hydrographic survey was conducted on July 10, 2024, to assess existing depths within the existing West and North Bay navigation channels to confirm the need for maintenance dredging. Datum information for this project is as NOTICE OF INTENT Foth • 6 WEST AND NORTH BAY MAINTENANCE DREDGING PROJECT TOWN OF BARNSTABLE, MA follows: Mean Lower Low Water (MLLW) = 0.00FT; Mean Low Water (MLW) = +0.25FT; Mean High Water (MHW) = +3.35FT; Annual High Tide Line (AHTL) = +4.60FT. 1.2 Project Need & Purpose Routine maintenance dredging is required to restore safe navigation and access to/from West and North Bay harbors. The channels are used year-round by commercial and recreational boaters and provide access for marinas, boat yards, charter b oats, fishing boats, and pleasure craft. Many businesses within the Town of Barnstable depend on safe and navigable waters, thus the shoaling that has occurred may have economic impacts on the surrounding areas. If dredging is not performed, the channels will continue to accrete sediments and will pose an even greater threat of vessel groundings with the channels potentially becoming unusable even during the higher tide cycles. 1.3 Scope of Work All Dredging activities to be performed will consist of maintenance within previously authorized/dredged limits and depths. No improvement dredging is being proposed as part of this project. The West Bay inner entrance channel will be dredged to -11.0 ft MLLW with a 1.0 ft allowable overdredge for a total of -12 ft MLLW. The North Bay Street Channel will be dredged to -8.0 ft MLLW with a 1.0 ft allowable overdredge for a total of -9.0 ft MLLW. All dredging will include 3H:1V side slopes. Including the overdredge and side slopes, the West and North Bay Channels require the removal of 37,299 CY of sediments to restore navigation to authorized depths. A breakdown of dredge volumes and areas based upon the survey conducted on 07/10/24 is presented below in Table 1. Species of concern are anticipated to include, but may not be limited to, Winter flounder, Horseshoe crabs, Quahogs, Piping P lover, and Least Tern. It is anticipated that work will begin in October 2026 and will be completed prior to January 31st, 2027. 2. Site Usage and History The Barnstable West and North Bay Channels have historically provided and continues to be a gateway for both recreational and commercial vessels to/from Nantucket Sound. The proposed areas of dredging being pursued by the Town are shown in the Dredge Plans provided in Exhibit E. Maintenance dredging is required on a periodic basis to restore/provide safe access within and use of navigable waters that benefit the general public. 2.1 Due Diligence Assessment A due diligence assessment was conducted and completed as part of the Town’s 10-year Comprehensive Dredge Permit (CDP) which is currently pending the initiation of the regulatory review process. The CDP, once issued, will provide a 10-year authorization for Town-wide maintenance dredging of navigational waterways and the beneficial reuse of sediments as nourishment along various shoreline areas. The West and North Bay Channel dredging proposed in this project were found not to be suitable for beach nourishment due to the presence of fine-grained sediments. The USACE, however, did find the material suitable for offshore disposal at the Cape Cod Bay Disposal Site (CCBDS). No further sampling or analysis of dredged material should be required for this project. 3. Dredge Site History WEST BAY Available record documentation indicates that the state first dredged a 6-foot deep Outer Entrance Channel from Nantucket Sound to West Bay under MA DWP Contract #160 in 1928. Subsequent dredging efforts were preformed to maintain navigation in 1934 (MA DWP Contract #397), with channel limits extending north through the jetties and into the formal bay area in 1937 (MA DPW Contract #487) and again in 1938 (MA DPW Contract #524). Record information indicates that a total of (7) dredging events within the West Bay area were performed by the State between 1946 and 1953: however, no corresponding plans were found to be available. In 1958, the State dredge the Outer Entrance Channel deepening it from 6 to 9 feet and extending to ten feet in 1966 (MA DPW Contract #2537) with maintenance dredging conducted in 1982 (MA DWP Contract #2974). In 1998, TBPI assumed the responsibility of maintaining and improving navigation within West Bay. In 2000, Maintenance dredging was performed within the West Bay Outer Entrance Channel to a depth of 8 feet. Additionally, improvement and maintenance dredging were done to establish a 11-foot-deep Inner Entrance Channel and the 8-foot-deep West Bay Spur Channel. A summary table of dredging and nourishment activities that have been previously authorized within West Bay is provided in Table 2. NOTICE OF INTENT Foth • 8 WEST AND NORTH BAY MAINTENANCE DREDGING PROJECT TOWN OF BARNSTABLE, MA NORTH BAY Available record documentation indicates that the State dredged the North Bay Channel, also referred to as the “Narrows,” in 1971 under MA DPW Contract #2681. Dredge sediments were beneficially reused as nourishment along four (4) private shoreline areas that were near the channel. In 1982, the State dredged a navigation channel north of the Bridge Street bridge under MA DEM Contract #3036. Dredge sediments were beneficially reused as nourishment along the east end of Dead Neck. A summary table of dredging and nourishment activities that have been previously authorized within North Bay is provided in Table 3 Table 3: Record Permit Authorizations Issued for the Navigational Dredging within North Bay and Reuse of Sediments as Nourishment Along Shoreline Areas Located within the Three Bays Region. 3.1 Alternatives Analysis 3.1.1 Dredging alternatives “No Dredge Alternative” Under the “No Dredge” alternative, no dredging would occur within the Barnstable West and North Bay Channels, thus promoting the continued deterioration of public access and safe navigation within the waterway. Shoaling would continue to increase the potential for vessel grounding, spills, and/or release(s) of other hazardous materials into the harbor. The bottom sediment would continue to be disrupted by vessels transiting over shoaled areas resulting in resuspension of sediment to the water column. Accordingly, the “No Dredge” alternative is not considered a viable option for the Town. The current authorized limits and depths of the West and North Bay Channels are adequate for the uses and needs of the boating community that uses the harbors. Maintenance Dredging The preferred dredging alternative will restore navigation and public access to/from West and North Bay by maintaining the previously authorized depths and limits of the existing West and North Bay Entrance Channels. The current navigational depths and limits of these channels adequately support vessel sizes and drafts, and ther efore, the Town is not seeking to widen or deep these channels. Side Slope Alternatives The Barnstable West and North Bay Channels have historically been maintained with 3H:1V side slopes, as have most channels throughout the Cape. A 3H:1V slope is typical for dredge prisms, since the natural angle of repose for wet sand is between 15 and 30 degrees. This allows the dredge to dig within the dredge prism, from toe-to-toe, without digging up the slope. As sand is removed from the toe, the slope is allowed to find its natural state as material sluffs in. If required, the dredge can clean up the toe with a final pass. An alternate 2H:1V side slope in design would not be constructible as the sands on the banks would naturally fall to a ~3H:1V slope. A more gradual slope of 4H:1V or greater is also not feasible for this project as the slope projection may impact important natural resource areas or undermine nearby structures such as jetties and marina infrastructure. Additionally, a 4H:1V would be difficult to construct and would require dredging outside of the toe of the channel. 3.1.2 Sediment Disposal Alternatives Analysis Beach Nourishment The USACE issued a Suitability Determination on August 1, 2022, under NAE-2015-01632 (see Exhibit G) authorized the portions of the West Bay Inner Entrance Channel (STA 0+00 to 4+75 and 19+25 to 24+50) for beneficial use as beach nourishment, as shown on the plans in Exhibit E. Those areas of the channel will be dredged by the Barnstable County Dredge under the 10-Year Comprehensive Permit and thus will be excluded from this project. During the sampling and analysis phase of the 10-Year Comprehensive Permit, the portions of West Bay Inner Entrance Channel from STA 4+75 to 19+25 and North Bay - Bay Street Channel from 24+50 to 47+50 were not found to be suitable for beach nourishment. Upland Disposal The upland disposal of dredge sediments at a permitted landfill facility has been considered for the proposed project and will require the transferring of dredge sediments from water to land, dewatering, reloading of dried sediments into trucks and transportation and disposal of sediments at a landfill facility, which in turn will result in considerable additional time and costs to the project. Other potential additional costs associated with this option may include tipping fees and/or any additional permitting and/or analytical testing that would be required for disposal of dredge sediments at a landfill. Typically, tipping fees range between $25 and $100 per CY. Depending upon the proximity of the landfill, trucking costs could range between $15 and $25 per CY. Furthermore, the hauling of sediments to a landfill facility would create a significant burden on local traffic. The project site is located near fully developed areas of Town, and within an area NOTICE OF INTENT Foth • 10 WEST AND NORTH BAY MAINTENANCE DREDGING PROJECT TOWN OF BARNSTABLE, MA of town that is densely populated with both residential and commercial properties. Assuming a typical truck load capacity of 20 CY, the hauling of ±37,000 CY of sediment would generate approximately 1,850 truck trips from the site. This anticipated volume of traffic would be extremely disruptive. Other impacts may include nuisance odors generated from the dewatering of dredge sediments along with the amount of time that sediments would need to remain on-site to sufficiently dry out prior to hauling off-site to a landfill. Based upon the anticipated impacts and costs associated with upland disposal at a landfill facility and the lack of a suitable land area located in close proximity to the waterfront for the purposes of dewatering, this alternative is not the preferred alternative. Offshore Disposal at CCBDS Offshore ocean disposal alternatives have been considered for the proposed project. Alternatively, nearshore disposal involves the placement of dredge material in nearshore area(s) from which it can be moved by littoral processes onto beach areas. Since the dredge material associated with this project has been characterized predominantly as fines, it is not considered suitable material for nearshore disposal. Upland disposal options have been demonstrated not to be feasible and/or economical, and sediments are not considered suitable for the purposes of beneficial re-use or nearshore disposal, unconfined offshore disposal at the CCBDS is the preferred disposal alternative for the proposed project. Sediments will be mechanically dredged using an excavator or crane and placed into a dump scow for offshore disposal. This option is the most economical as sediments will not need to be dewatered and re-handled multiple times as required with upland/beneficial re-use options. Due to the proposed dredge volume of ±37,299 CY, offshore disposal at CCBDS will be the most efficient and cost-effective way of clearing the channels to their advertised depths. While the USACE SD (NAE-2015-01632) was focused primarily on identifying beneficial use, the Army Corps did specify areas with material suitable for offshore disposal at the Cape Cod Bay Disposal Site (CCBDS). The USACE confirmed that the material proposed to be dredged under this project is suitable for disposal at CCBDS in email correspondence included in Exhibit C. A formal amendment to the SD will confirm the dredged material proposed under this project (West Bay Inner Entrance Channel from STA 4+75 to 19+25 and North Bay - Bay Street Channel from 24+50 to 47+50) has been found suitable for CCBDS. 3.2 Available Bathymetric and Topographic Information Foth Infrastructure and Environment, LLC. (Foth) performed a hydrographic survey within the West and North Bay channels on July 10, 2024. This survey information has been utilized to establish existing bathymetric conditions within West and North Bay, identify wetland resource areas, and determine dredge quantities. The existing conditions are presented in the Dredge Plans found in Exhibit E. 4. Sediment Sampling Analysis/Suitability Determination Sediment Sampling and Analysis was performed at the proposed site as part of the Barnstable 10-Year Comprehensive Permit (CP) following the Sampling and Analysis Plan (SAP) issued by the USACE under NAE-2015-01632 on April 8, 2020, and the Supplemental Sampling and Analysis Plan issued on March 3, 2021. Sample locations from these events are shown on the Dredge Plans found in Exhibit E. The purpose of the 10-Year CP was to identify and authorize channels with sandy material composition for dredging with beneficial use at the Town’s many beaches. NOTICE OF INTENT Foth • 11 WEST AND NORTH BAY MAINTENANCE DREDGING PROJECT TOWN OF BARNSTABLE, MA The results of sampling and testing were reviewed by the USACE for dredge sites and compatible beach locations, and where applicable the USACE identified areas where dredged material would be suitable for offshore disposal. As mentioned in Section 3.1.2, the USACE issued a Final Suitability Determination (SD) on August 1, 2022, under NAE-2015-01632 (see Exhibit G) for the CP. The SD authorized the North Bay – Bay Street Channel for disposal at CCBDS. Later, the USACE responded to a request from Foth to review the sediment data in West Bay to see if it is suitable for CCBDS as well. The USACE confirmed suitability and will need to issue an amendment to the SD to include the portions of West Bay Inner Entrance Channel during the project permitting process. 5. Dredging & Disposal Operation The Town’s objective for the proposed project is to secure all regulatory approvals required for the dredging of West Bay and North Bay sediments so that construction can occur during the upcoming Fall 2026-Winter 2027 dredge season. For the proposed dredging, the removal of material via mechanical means is the most economically viable and least environmentally impactful method. This method of dredging includes the use of a barge mounted crane/excavator with disposal into a 1,000 CY to 1,500 CY capacity dump scow. The loaded scows will then be transported to the Cape Cod Bay Disposal Site (CCBDS) via tug where the material will be properly disposed of offshore. It is anticipated that dredging operations will be underway for 24 hours a day for the duration of the project or as weather allows for the safe transit of support tugs bringing loaded scows offshore to the CCBDS. 6. Regulatory Approvals 6.1 General Overview Based upon review of the collective site history and previously authorized work presented in Tables 2 and 3 (See Section 3, Dredge Site History), the activities to be authorized for the proposed project are considered to be maintenance since all dredging will be performed within the previously established/authorized vertical and horizontal limits. In addition to the NOI being submitted herein, the following permits/approvals are anticipated to be required for the proposed Barnstable Best and North Bay Channel Maintenance Dredging Project: • Order of Conditions from Barnstable Conservation Commission • NHESP MESA Determination (through Notice of Intent review process) • MA DEP 401 Water Quality Certification • MA DEP Chapter 91 Waterways Permit • U.S. Army Corps of Engineers (USACE) Permit • MA CZM Federal Consistency (through USACE review) 7. Performance Standards to Avoid, Minimize and Mitigation Impacts to Coastal Resource Areas & Habitat The proposed project is a water-dependent project that has been designed, and will be performed, using the best available measures to minimize adverse impacts to coastal resource areas. The following coastal wetland resource areas have been identified within the vicinity of the project area as defined under the Massachusetts Wetland Protection Act (MA WPA) and per M.G.L. c. 131 s. 40 and Regulations 310 CMR 10.00: Land Under the Ocean (LUO), and Land Containing Shellfish (LCS). Coastal resources areas are delineated on the Dredge Plans provided in Exhibit NOTICE OF INTENT Foth • 12 WEST AND NORTH BAY MAINTENANCE DREDGING PROJECT TOWN OF BARNSTABLE, MA E. It is noted that the project site is located entirely in Estimated Habitats of Rare Wildlife/Priority Habitats of Rare Species as most recently mapped by the MA NHESP on August 1, 2021 (see Exhibit H). Pursuant to 310 CMR 10.00, the above listed coastal resource areas are to be regulated in order to contribute to the following public interests: • Flood control. • Storm damage prevention; and/or • Protection of marine fisheries and wildlife habitat. The proposed project will restore and enhance safe public use and navigable access within the West and North Bay/Nantucket Sound interface as required to continue to support commercial and recreational uses. All work will be performed when marine activity is least active, within the established TOY restrictions for all species of concern and conditions identified by permit authorizations issued for the project. The paragraphs presented below provide the following information: • Identification and definition of each coastal wetland resource areas to be permanently or temporarily impacted by proposed activities. • An assessment of the magnitude of anticipated impacts from proposed activities on each coastal wetland resource area; and • Discussion on how proposed activities meet the performance standards for each coastal wetland resource area impacted.  LAND UNDER THE OCEAN (310 CMR 10.25) Land Under the Ocean (LUO) is defined as “land extending from the mean low water line seaward to the boundary of the municipality’s jurisdiction and includes land under estuaries.” LUO, particularly the nearshore area, is presumed significant to the protection of marine fisheries, protection of wildlife habitat, storm damage prevention and flood control (310 CMR 10.25). Table 4 below presents a summary of volumes removed and areas impacted from dredging within LUO. The limits of LUO located within the project site are shown on the Dredge Plans provided in Exhibit E. According to 310 CMR 10.25 (4), “maintenance dredging for navigational purposes affecting land under the ocean shall be designed and carried out using the best available measures so as to minimize adverse effects on such interests caused by changes in productivity which will result from the suspension or transport of pollutants, increase in t urbidity, the smothering of bottom organisms, the accumulation of pollutants by organisms, or the destruction of marine fisheries habitat or wildlife habitat”. Marine productivity will not be adversely impacted by the proposed maintenance dredging since operations will be conducted during the time of year when biological activity is least active and in accordance with the TOY restrictions established by MA DMF. Short-term/minimal increases in turbidity and suspended solids are expected to occur during the time of active dredging. Given the limited duration that it will take for the dredging to be completed, it is expected that any increase in turbidity and suspended solids will be short in duration and temporary. Accordingly, turbidity levels/impacts are expected to be limited and minimal. Dredging will also help reduce turbidity over the long-term by minimizing the potential for vessel groundings and propeller wash (or scouring). In accordance with 310 CMR 10.25 (6), the proposed project has been designed and will be constructed using the best available measures to minimize adverse effects on marine fisheries habitat or wildlife habitat as follows: • Water Circulation: Water circulation is created by the tidal exchange and currents that exist between West Bay and Nantucket Sound. Dredging is exp ected to improve the overall water circulation through the increased tidal exchange tha t will occur through the removal of the shoals. The proposed project is not expected to have any long -term negative effects on water circulation or the overall hydrological or littoral processes. • Destruction of Eelgrass or Widgeon Grass Beds: Based upon review of available MA GIS information, eelgrass (Zostera marina), has not been mapped in the vicinity of the project. No dredging is proposed to occur within previously mapped areas. NOTICE OF INTENT Foth • 14 WEST AND NORTH BAY MAINTENANCE DREDGING PROJECT TOWN OF BARNSTABLE, MA • Distribution of Sediment Grain Size: Dredging will not alter the sediment quality in the project area. The sediments that will be removed by the proposed dredging have accumulated over time from the dynamic natural littoral process and currents that exist within the West and North Bay and Nantucket Sound. • Water Quality: Short term increases in turbidity and suspended solids are expected to occur during the time of active dredging. However, given the nature of the material anticipated to be dredged from the navigation channel (i.e., silts and silty sand) and the limited duration of the project, it is expected that the increases in turbidity and suspended solids will be short-term and temporary. The daily tidal exchange will naturally help maintain water quality throughout construction. Water quality is anticipated to improve following the completion of dredging since there will be a reduction in potential for turbidity resulting from vessel/float groundings and vessel propeller wash (or scouring). • Shallow submerged lands with high densities of polychaetes, mollusks or macrophytic algae: The project site is not known to support high densities of polychaetes, mollusks or macrophytic algae.  LAND CONTAINING SHELLFISH (310 CMR 10.34) Land Containing Shellfish (LCS) is defined as “land under the ocean…when any such land contains shellfish.” Land Containing Shellfish shall be found significant when it has been identified and mapped as follows: by the Conservation Commission or the Department in consultation with DMF and based upon maps and designations of DMF; or by the Conservation Commission or the Department based on maps and written documentation of the shellfish constable or the Department. In making such identification and maps, the following factors shall be considered and documented: the density of shellfish, the size of the area and the historical and current importance of the area to recreational or commercial shellfishing. According to the most current available MA GIS data pertaining to MA DMF mapped suitable shellfish habitat, the proposed dredging within the West and North Bay Channels are located within LCS. It is noted that areas mapped by MA DMF include sites where shellfish have historically been sighted but may not currently support any shellfish. The shellfish suitability areas were not verified in the field, and the boundaries were not surveyed. The Town of Barnstable provides Open/Closure maps for shellfishing, including aquaculture lease areas, and shellfish relay areas. The map for the Three Bays Region, effective November 6, 2024, can be found in Exhibit H. Areas of mapped LCS are currently designated as approved for shellfish harvesting areas according to available data from MA GIS. Impacted areas of mapped LCS include areas that have been previously authorized/dredged are considered to be Routine Maintenance which occur periodically. Dredging within LCS is necessary to remove sediments that have migrated into the established navigation areas primarily from sediment transport caused by storm events and currents in West and North Bay and Nantucket Sound. Accordingly, it is reasonable to assume that LCS areas impacted by dredging will readily self-recolonize over time. Details pertaining to the quantity and assessment of potential LCS impacts resulting from dredging activities are presented in Table 5 below. The limits of LCS located within the project site are shown on the Dredge Plans provided in Exhibit E. Habitat maps are provided in Exhibit H. All dredges and auxiliary equipment will be water-based and will consist of floating barges and support vessels. All temporary construction features and construction access will be returned to pre-construction conditions when dredge activities are completed. The impact area within the NHESP mapped area is quantified as ±317,341 SF. 7.1 Minimization of Impacts The proposed project has been designed to minimize the impacts to the existing coastal resource areas and habitats to the greatest extent possible. All dredging activities will be performed during the TOY established by permits. Although a “No Dredge” alternative would result in no environmental impacts, there is a potential for environmental impacts resulting from vessel ground-outs along the shoaled in areas present in the West and North Bay Channels. Not only do vessel ground-outs present the potential for oil spills or release of other hazardous materials into the harbor, they result in an increase of turbidity within the water column from the resuspension of sediments. Furthermore, a “No Dredge” alternative presents a public safety concern and diminishes public access to the waterfront. 8. Summary The Town of Barnstable is proposing to perform maintenance dredging within the existing West and North Bay Navigation Channels. Dredging is required to address shoaling, restore navigation and safe public access and use of the waterway. The proposed maintenance project will consist of dredging a total combined area of ±342,017 SF of sediment, including 3H:1V sideslopes and a 1-foot allowable overdredge. The Town is now seeking to permit and dredge some of those sites, specifically the West Bay Inner Entrance Channel (-11') and the North Bay Bay Street Channel (-8'), with offshore disposal as the preferred alternative.   In the SD referenced above, it is clear that the North Bay Bay Street Channel is marked as "Unsuitable for Beach Placement; Suitable for CCBDS" but the West Bay Inner Entrance Channel does not specify any suitability for offshore disposal at CCBDS. I am hoping that you can confirm that this area is suitable for placement at CCBDS so that these areas can be permitted and dredged on the same timeline. I have attached the two pages from the SD that I am looking at.    The other work proposed will be in Barnstable Harbor (Mid-Entrance Channel and Blish Point Boat Ramp Access Channel). These areas were always assumed to be fine-grain silty sands and were not tested under the 2-phase SAP.
