An ENF and EIR were categorically required at the time of filing because the Wetlands Protection Regulation/MEPA threshold of dredging and nourishing greater than 10 acres of protected resource areas was met. While the Cape Cod Commission did not review the original application and has not formally reviewed the Notice of Project Change, Commission staff offers the following comments. 8 PROJECT BACKGROUND Dredging of the Three Bays area was previously reviewed in 1985, 1997, and 1998. EOEA 11692 Final Decision Issued 9/6/98 maint: 124,136 improve: 186,790 EOEA 11692 Notice of Project Change 9/9/00 maint: 124,136 improve: 193,790 i The project proposal in 1997 included"more than 125,000 yards of improvement dredging," which was eliminated from the proposal through a Notice of Project Change"based on comments provided by the Massachusetts Environmental Protection Act (MEPA) Unit,National Marine Fisheries Service NMFS), the Massachusetts Coastal Zone Management Office (MCZM), and the US Army Corps of Engineers (USACE)." Staff is concerned that through subsequent filings and review of this project,the volume of improvement dredging has gradually increased to an amount in excess of the volume found in 1997 to be cause for concern by these permitting agencies. Dead Neck Island Dune Restoration,Notice of Project Change,EOEA#11692 1 September 29,2000 t~J A r A e• Because many aspects of the previous proposal were already reviewed and permitted, the Commission staffs comments will concentrate primarily on the expanded improvement dredging described in this Notice of Project Change. PROJECT DESCRIPTION The beach/dune nourishment design of the original proposal was identified in the July, 1998 ENF as exactly the same as what was approved and permitted earlier this year". The dredging design described in the current Notice of Project Change involves an additional 7,000 cubic yards amounting to a 3% increase in the volume of material to be dredged. The applicant has also provided an additional template to illustrate the profile of material proposed for placement on Sampson's Island (at the western end of Dead Neck Island). The Project Description states that the impetus for increasing the dredged area is the improvement of storm protection and channel navigability,habitat restoration, and improved circulation in the South Barnstable Bay System. The Notice of Project Change does not provide specific information regarding past maintenance of the area proposed for additional dredging. PROPOSED DREDGING The proposed dredging project encompasses approximately 7,000 cubic yards to be removed from the channel leading into Cotuit Bay from Nantucket Sound. The dredged material is proposed for use as beach nourishment on Sampson's Island, which comprises the western extent of Dead Neck Island. According to the Notice of Project Change,the dredge area was sampled using core samples and surface grabs, and the substrate was found to be comprised of"only beach-compatible sand". However, no information regarding the analysis of the material in this new area was provided. SHELLFISH RESOURCES The original permit application clearly states that"past dredging operations have been conducted with documented adverse impacts to shellfish populations". The Notice of Project Change does not stipulate whether the proposed expansion of dredging is in an area of past dredging activity. The Notice of Project Change also states that the Town of Barnstable Shellfish Biologist performed a shellfish survey and that the project was designed to account for shellfish interests in the area. However, the applicant does not describe the results of the survey, does not characterize potential impacts, and does not stipulate what mitigation measures are proposed. The original application also refers to a shellfish seeding program and relocation of any resources found within the project area, however the scope and intensity of the mitigation is not described. SUBMERGED AQUATIC VEGETATION The original ENF stated that no `significant' aquatic vegetation exists within the proposed dredging area. The Notice of Project Change is silent on the issue of submerged aquatic vegetation. Plans illustrating the additional dredging proposed in the Notice of Project Change should depict known areas of and type of aquatic vegetation. WATER QUALITY Water quality problems do exist in the Southwest Barnstable Embayment System (Cotuit Bay, West Bay,North Bay and Prince Cove) particularly in the upper reaches, as outlined in the 1995 final report Field Data Collection and Flushing Model Development of the Southwest Barnstable Embayment System"provided by ASA, Inc.. to the Town of Barnstable, and the 1998 Cape Cod Coastal Embayment Project promulgated by the Cape Cod Commission. The original proposal to dredge material from navigable channels likely resulted in larger volumes of tidal water entering this system. While this may Dead Neck Island Dune Restoration,Notice of Project Change,EOEA#11692 2 September 29,2000 a appear to potentially improve water quality due to dilution, the.Notice of Project Change does not address Commission staff s concerns (already articulated in letter dated July 14, 1998)that the additional `residence time' of water in the system may further impact its ability to flush nutrients. BEACH RENOURISHMENT The beach re-nourishment profile provided by the applicant is difficult to interpret, and a description of planting measures for the additional nourishment area was not provided. However, it seems apparent that two areas that currently allow stormwater to overwash the barrier will be filled. While the additional massing of a dune on Sampson's Island will enhance its ability to serve as a sacrificial storm buffer, filling of overwash areas may exacerbate damage to the dune during extreme conditions. Once the nourishment material is placed on site, appropriate vegetation should be planted to increase the longevity of the project. Natural inundation of the beach areas and the effects of wind erosion will ensure that adequate nesting area for shorebirds persists. SUMMARY Commission staff has concerns regarding yet another enlargement of the previously permitted dredging project. We are satisfied that the timing and phasing limitations applied to the original project are suitable safeguards for the work proposed under the Notice of Project Change. And, given the erosive nature of the barrier island in the vicinity of the proposed project and the concomitant potential for damage to landward property in the event of a significant coastal storm, we do not wish to unduly delay the proposed project. However, we recognize that alterations to the flushing rate of the Southwest Barnstable Embayment System must be handled with care, and that the potential for increased storm damage to properties adjacent to the proposed dredging area must be considered. Minimum Performance Standard 2.2.3.7 of the 1996 Regional Policy Plan stipulates that".New dredging projects or expansion of existing dredging projects shall not occur unless a substantial public benefit can be demonstrated including but not limited to enhancement of fish or shellfish habitat, improvements to the flushing capacity of nitrogen sensitive embayments, or necessary improvements to navigational safety". The ENF does not demonstrate that potential public benefits outweigh the possible detriments of the project. However, staff do concur that some improvements in the areas described in the Minimum Performance Standard may result from the project, and that other public benefit in the form of critical species habitat and storm damage prevention will be realized. We would support the approval of the work described under the Notice of Project Change and the ' applicant's request to maintain the waiver from the EIR requirement provided that: 1) sufficient planting measures are required to enhance the resilience of newly placed material, and 2) shellfish interests are protected and the proposed mitigation strategy (seeding program,relocation) designed in cooperation with the Town of Barnstable Shellfish Biologist is submitted to the permitting agencies for review. We remain willing to work with the regulatory agencies,particularly the Barnstable Conservation Commission, during its review of any extension application or amendment that will be forthcoming through the local permitting process. Special Conditions of Approval: 1.General Conditions 1-12 on the preceding page are binding,and demand both your attention and compliance. 2.Within one month of receipt of this Order of Conditions and prior to the commencement of any work approved herein,General Condition number 8 (preceding page)shall be complied with. 3.The applicant shall pay for their legal advertisement as invoiced. 4.This permit is valid for 3 years from the date of issuance, unless extended at the request of the applicant. 5.The applicant shall provide project contractors with copies of the Order of Conditions and approved_plans prior to the start of their work. 6.The Natural Resources Dept.shall be notified at least 21 working days prior to the start of work at the site,to inspect the areas for shellfish. If deemed necessary by the Shellfish Constable, shellfish shall be removed from the work area to a suitable site and/or replanted at the locus following construction. The foregoing measures for shellfish protection shall ensue at the expense of the applicant. 7.No work on the project shall take place between April 1 and October 15. S.Sand for nourishment shall be clean and compatible. No silt or clay chunks shall be placed upon the barrier beach. 9.Saltmarsh shall not be disturbed during the project. The slope of the constructed dune shall gently feather out,on the Seapuit River side with its end point no closer then 3' off the marsh edge prior to any work near the marsh. 10. The slurry pipe shall not be placed in the saltmarsh,nor shall any heavy equipment be operated in the marsh. Foot traverse through the marsh shall be avoided. 11. This Order,anticipatingwhileanticiatin Phases 2 and 3 of the project,in future years only approves Phase 1 for start-up. Prior to the start of work for Phases 2(and 3),provided the Order of Conditions is still valid,plan amendments and work protocols shall be submitted,and a legally-noticed discussion with the Commission shall ensue. The Commission must have approved all amendments and protocols prior to the start of work. 12. A post-dredging bathymetric survey shall be performed by the project engineer and results submitted to the Conservation Commission for compliance review purposes. 13. It is the responsibility of the applicant, owner and/or successor(s)to ensure that all conditions of this Order are complied with. The project engineer and contractors are to be provided with a copy of this Order and referenced documents before the commencement of construction. The foregoing condition shall not be construed to exempt project contractors from responsibility for any work performed in deviation with provisions of the Order of Conditions or with the detail of the plans of record. 14. The Conservation Commission,its employees,and its agents shall have a right of entry to inspect for compliance with the provisions of this Order of Conditions. 15. At the completion of work,or by the expiration of the present permit,the applicant shall request in writing a Certificate of Compliance for the work herein permitted. Where a project has been completed in accordance with plans stamped by a registered professional engineer, architect, landscape architect or land surveyor, a written statement by such a professional person certifying substantial compliance with the plans and setting forth what deviation, if any, exists with the record plans approved in the Order shall accompany the request for a Certificate of Compliance. 16. This Amended Order shall expire Sept. 10,2000. 17. The Seaview Avenue unloading area shall be fully restored at the conclusion of work with all sheeting removed and the substrate returned to original grade and productivity. is.
