CALL TO ORDER – Chair Flores introduced Authority members and staff. Noting the following were present: Decker, Karlson-Lidman, Sylver, Murphy, and Trovato. Staff present were Logan and Kelsey. PUBLIC COMMENT – There was no public comment made PUBLIC HEARINGS – Chair Flores opened the public hearings. 1. Transfer §15 Annual All Alcohol License An application was filed by Shri Jogmaya, Inc. dba Seven G’s Liquor Shoppe, 990 Main Street/Route 6A, West Barnstable, for the transfer of the §15 off-premises annual all-alcohol package store license from Seven G’s Discount Liquor, Inc. The proposed alcohol manager is Rishab M. Patel. The proposed hours of operation are Monday – Saturday 8:00 a.m. to 9:00 p.m. and Sunday 10:00 a.m. to 8:00 p.m. The application includes a pledge of the license to Customers Bank. The applicant was represented by Attorney Arthur Pearlman. Proposed manager, Rishab Patel was also present. Pearlman proposed the transfer of the pkg store license at 990 Main Street. Customers Bank is financing the purchase of business. Sanja Patel is the sole operator. Rishab Patel is the proposed alcohol manager. Sanja owns and manages an all alcohol liquor store in Shrewsbury MA. Rishab will be moving to this area to manage the store. and is currently working at a liquor store in Shrewsbury. Rishab Patel and Sanja Patel are familiar with the laws, and both have completed TIPS certification. There was no public comment. Karlson Lidman moved, seconded by Decker, to approve the application as submitted including the pledge of the license. So voted, aye, unanimously (Flores, Decker, Karlson-Lidman) NEW APPLICATIONS 1. New Special One-Day Wine and Entertainment An application was filed by Beth Walsh Dance Centre to hold a Competition Dance Showcase at 2240 Iyannough Road, West Barnstable, In the Tilden Arts Center Auditorium, on January 10, 2026, from 4pm to 9pm. The applicant proposes to provide wine to attendees. Holly Robillard, Treasurer of the parent organization for the dance studio, was present. She proposed to serve wine at the event. Logan, advise she needs to purchase wine from state approved wholesaler. Kalson-Lidman moved seconded by decker. So voted aye unanimously (Flores, Decker, Karlson-Lidman) 2. Amend §12 Annual Wine & Malt Innholder License An application was filed by 867 Hyannis Operating LLC dba Fairfield Inn & Suites Hyannis, 867 Iyannough Road, Hyannis, for a change of manager from Sarah Hobbs to Kelly Hamel. Kelly Hamel was present to represent the application. Logan advised that her husband is employed by Fairfield Inn & Suites Hyannis and that she has filed the appropriate disclosures with the Town Manager, Town Clerk and State Ethics Commission. Hamel has been with the property for about 5 years in a sales capacity. She is now the General Manager. Hamel noted that everyone on staff is TIPS certified. Karlson-Lidman moved, seconded by Decker to approve the application as submitted. So voted, aye, unanimously (Flores, Decker, Karlson-Lidman) 3. Amend §15 Annual Wine & Malt Package Store An application was filed by MPG Corporation dba Garrett’s Family Market, 1617 Falmouth Road, Centerville, for a change of manager from James Couture to Richard Cleary. Meghan Jacobs and Richard Cleary were present to represent this application. Richard Cleary is currently the store manager. Cleary has been with Garrett’s for 12 years. He is moving permanently to this store. Logan had advised the Authority that the Alcoholic Beverages Control Commission sent correspondence regarding an alleged violation of alcohol sales to a minor. Jacobs confirms they have a zero-tolerance policy and the manager accused of the violation was fired. Karlson-Lidman moved, seconded by Decker to approve the application as submitted. So voted aye, unanimously (Flores, Decker, Karlson-Lidman) RENEWAL APPLICATIONS 1. A renewal application was filed by KSMP Enterprises Inc. dba Sea Street Food Mart, 231 Sea Street, Hyannis, to renew their annual, §15 off-premises wine and malt package store license. Logan advised that the Alcoholic Beverages Control Commission sent correspondence advising that a 1-day suspension was imposed on this license for a violation of serving alcoholic beverages to a person under 21 years of age. Logan recommended approval of the renewal noting the 1-day suspension to be served on January 26, 2026. Pasang Sherpa, the owner and manager, was present. She expressed her intention for no further violations. Karlson- Lidman moved, seconded by Decker to approve the renewal noting the 1-day suspension to be served on January 26, 2026. So voted aye, unanimously (Flores, Decker, Karlson-Lidman) CORRESPONDENCE 1. Notice of Violation was received on November 28, 2025, from the Alcoholic Beverages Control Commission , for MPG Corp dba Garrett’s Family Market, 1617 Falmouth Road, Barnstable, alleging 1 count of sale or delivery of an alcoholic beverage to a person under twenty-one (21) years of age. Ref. MGL Ch.138 §34 2. Notice of Violation was received on November 28, 2025, from the Alcoholic Beverages Control Commission, for South Sea Village Inc. dba Bamboo, 574 Iyannough Road, Barnstable, alleging 5 counts of possession of an alcoholic beverage by a person under twenty-one (21) years of age. Ref. MGL Ch.138 §34 C 3. Notice of Suspension was received on December 3, 2025, by the Alcoholic Beverages Control Commission (ABCC), for KSMP Enterprises Inc. dba Sea Street Food Mart, 231 Sea Street, Barnstable; The Commission suspends the license for a period of one (1) day to be served on Monday, January 26, 2026, for violating MGL Ch.138 §34 sale or delivery of an alcoholic beverage to a person under twenty-one (21) years of age, 1 count. Logan advised of the correspondence received from the Alcoholic Beverages Control Commission alleging violations at Garrett’s Family Market and Bamboo for serving persons under the age of 21 years. The notice for Sea Street Food Mart was for a violation in which the establishment was found guilty and ordered to serve a 1-day suspension. DISCUSSIONS The Dolphin Restaurant, 3250 Main Street, Barnstable – Discussion regarding alleged intoxicated patron Det. Kelsey advised that SHOW CAUSE HEARING OF RENEWAL In accordance with MGL c.138, the Barnstable Licensing Authority will hold a Show Cause Hearing to consider renewal of the §12 Annual All Alcohol Common Victualler license for Nonno Pizza, Inc. d/b/a Nonno Pizza, 640 Main Street, Hyannis, citing several potential violations including the following: MGL c. 138 §15A Application for licenses; statement of beneficial interests; corporate stock transfers; filing notation; publication of notice; hearing; plan of premises; transfers; notice to abutting property owners; complaints; appeals; cancellation of licenses; MGL c. 138 §16A Renewal of annual licenses; number limitation; rejections of application; appeal; Barnstable Licensing Rules & Regulations 501-5 (f) Responsibilities of License Holder; 501-12 (d)(g)(h) Business Assignments of Licenses; 501- 14 (b)(1) (b)(2) Other causes for revocation, suspension and modification; Logan advised that the applicants attorney requested to withdrawal the renewal application (non-renewing the license).
