Dear Members of the Commission:
On behalf of the Applicant, the Town of Barnstable Department of Public Works, LEC Environmental
Consultants, Inc (LEC), in collaboration with Stantec, is submitting this Request for Determination of
Applicability (RDA) for proposed construction of a sidewalk along North Street, between the West Main
Street roundabout and Stevens Street, in east Barnstable. Portions of the proposed work activities are
located within the 100-foot Buffer Zone to Bordering Vegetated Wetlands (BVW) and Bank/Mean
Annual High Water (MAHW), and within Riverfront Area. These areas are protected under the
Massachusetts Wetlands Protection Act (M.G.L. c. 131 § 40, the Act) and its implementing Regulations
(310 CMR 10.00, the Act Regulations), and the Town of Barnstable’s Wetlands Bylaw (Chapter 704) and
its implementing Regulations.
The North Street shared use path project is part of a larger project referred to as the Downtown Hyannis
Great Streets Project, designed to enhance and improve accessibility to businesses, provide accessibility
of streets for the year-round residents of Downtown Hyannis, as well as tourists. The North Street project
is the only portion of the overall project located in the vicinity of protected Wetland Resource Areas.
Details of the proposed project are depicted on the Roadway Plan, prepared by Stantec Inc., dated
February, 11, 2026 (Attachment B).
General Site Description
The project footprint is located within an approximately 1,200 foot segment of the North Street right-of-way
(ROW), extending from the West Main Street roundabout to the southwest to the intersection of North
Street and Stevens Street to the northeast, within the eastern vicinity of Barnstable (Appendix A, Figure 1).
North Street is a mixed-use urban roadway consisting of single east/west-oriented paved asphalt travel lanes
approximately 10 feet in width. The roadway includes several catch basins, associated drainage
infrastructure, and a marked crosswalk. The ROW does not currently include sidewalks.

Guardrails are present along select sections of North Street within the southerly portion of the project
footprint, where adjacent roadside slopes are generally steep along the west side of the roadway. Overhead
electric and telecommunications lines supported by wooden utility poles are located within the ROW on
both sides of North Street. Additional utility infrastructure is present belowground within the ROW.
The project footprint is generally bordered by commercial and residential development along North Street,
municipal buildings, a condominium complex with associated landscaping, and several paved and gravel
parking areas. Aunt Betty’s Pond is located west of the site. The perennial Stewart’s Creek bisects the
project footprint via a culvert that passes beneath North Street.
Where present, forested scrub-shrub uplands located in the vicinity of the project footprint include a canopy
of Norway maple (Acer platanoides), northern red oak (Quercus rubra), white oak (Quercus alba), red
maple (Acer rubrum), black cherry (Prunus serotina), and eastern white pine (Pinus strobus). The
understory includes dense entanglements of multiflora rose (Rosa multiflora), common greenbrier (Smilax
rotundifolia), Asiatic bittersweet (Celastrus orbiculatus), tatarian honeysuckle (Lonicera tatarica), staghorn
sumac (Fallopia japonica), European privet (Ligustrum vulgare), and Japanese barberry (Berberis
thunbergii). Entanglements of multiflora rose, Asiatic bittersweet, fox grape (Vitis labrusca), and poison
ivy (Toxicodendron radicans) are common throughout all upland areas.
According to the Natural Resource Conservation Service (NRCS) Soil Survey (Web Soil Survey and
Barnstable County, Massachusetts, Version 16, September 9, 2022), most of the upland areas located
onsite are primarily mapped as Urban Land (602). NRCS describes the Urban Land soil series as
consisting of nearly level to moderately steep areas where the soils have been altered or obscured by
urban works and structures. Buildings and pavement cover more than 85 percent of the surface. LEC
inspected soil conditions within the adjacent upland areas using a hand-held, Dutch-style auger, and
observed a variety of upland soils. Within the scrub-shrub upland, upgradient of the wetland, LEC
observed a two-inch-thick, fine sandy loam topsoil (A-Horizon) with a soil matrix color of 10YR 2/1,
directly underlain by a 22-inch-thick, fine sandy loam subsoil (Bw-Horizon), with a soil matrix color of
2.5Y 3/2. No redoximorphic features were observed within the soil profile. This soil profile is not
considered ‘hydric’ in accordance with the Field Indicators for Identifying Hydric Soils in New England
(Version 4, June 2020).
Floodplain Designation
According to the Federal Emergency Management Agency Flood Insurance Rate Maps, dated July 16,
2014, for Barnstable County, Massachusetts (Community Panel #25001C0568J), the site is mapped as
Zone X (unshaded) - Areas determined to be outside the 0.2% annual chance floodplain; therefore, there
is no Bordering Land Subject to Flooding (BLSF) associated with the property (Attachment A, Figure 3).
NHESP Designation
According to the 15th Edition of the Massachusetts Natural Heritage Atlas (effective August 1, 2021)
published by the Natural Heritage & Endangered Species Program (NHESP), the site is not located within
an Estimated Habitat of Rare Wildlife/Priority Habitat of Rare Species. There are no Certified Vernal

Pools (CVP) or Potential Vernal Pools (PVP) in the vicinity of the site according to the MassGIS data
layer (Attachment A, Figure 2).
Wetland Resource Area Descriptions
On December 23, 2025, LEC conducted a site evaluation to identify and characterize existing protectable
Wetland Resource Areas located in proximity to the site.
Wetland Resource Areas located within proximity to the project footprint include BVW, Bank/MAHW,
and Riverfront Area. The Wetland Resource Areas are further described below.
Bordering Vegetated Wetland
According to the Act Regulations [310 CMR 10.55(2)], Bordering Vegetated Wetlands are defined as:
freshwater wetlands which border on creeks, rivers, streams, ponds, and lakes…Bordering Vegetated
Wetlands are areas where the soils are saturated and/or inundated such that they support a
predominance of wetland indicator plants…The boundary of Bordering Vegetated Wetlands is the line
within which 50% or more of the vegetational community consists of wetland indicator plants and
saturated or inundated conditions exist.
The A-series BVW complex, demarcated in the field with wetland flags A1-A18, is hydrologically
associated with the eastern Bank of Aunt Betty’s Pond located to the west of the project footprint. This
wetland series extends approximately three feet upgradient from the edge of water, extending south to
north along a gentle break in topography, coincident with a transition from wetland vegetation to upland
vegetation.
Wetland vegetation associated with Aunt Betty’s Pond includes a canopy dominated by red maple, with
American elm (Ulmus americana), and willow (Salix sp.). The understory contains saplings from the
canopy, winterberry (Ilex verticillata), sweet pepperbush (Clethra alnifolia), highbush blueberry
(Vaccinium corymbosum), silky dogwood (Cornus amomum), and tatarian honeysuckle, and
entanglements of Asiatic bittersweet.
LEC inspected soil conditions within the BVW using a hand-held, Dutch-style auger. Within the A-series
BVW, LEC observed a one-inch-thick, organic peat layer (Oi-Horizon) with a matrix color of 10YR 2/2.
The Oi -Horizon was directly underlain by an eight-inch-thick, very fine sandy loam topsoil (A-Horizon),
with a soil matrix color of 2.5Y 2/1. The A-Horizon is directly underlain by a 16-inch-thick, fine sandy
loam subsoil (Bg-Horizon), with a soil matrix color of 60% 2.5Y 4/2, 35% 2.5Y 5/1 and 5% 2.5 5/6. This
soil profile is considered a hydric soil in accordance with Field Indicators for Identifying Hydric Soils in
New England (Version 4, June 2020), as it meets the indicator A11: Depleted Below Dark Surface.
Bank-Mean Annual High Water
According to the Act Regulations, Bank is the first observable break in slope or the mean annual flood
level, whichever is lower. The lower boundary of a Bank is the mean annual low flow level [310 CMR
10.54 (2) (c)].

According to the Act Regulations, Mean Annual High Water (MAHW) is defined as the line that is
apparent from visible markings or changes in the character of soils or vegetation due to the prolonged
presence of water and that distinguishes between predominantly aquatic and predominantly terrestrial
land. Field indicators of bankfull conditions shall be used to determine the mean annual high-water line.
Bankfull field indicators include but are not limited to: changes in slope, changes in vegetation, stain
lines, top of pointbars, changes in bank materials, or bank undercuts… [the Act Regulations, 310 CMR
10.58(2)(a)(2)].
The Bank-MAHW Line to the perennial Stewarts Creek occurs within a well-defined channel located to the
west of North Street. The stream diverges from the eastern Bank of Aunt Betty’s Pond, flowing directly east
for approximately 50 feet before extending beneath North Street in a culvert situated within a headwall. The
stream daylights immediately after crossing beneath the ROW, flowing further east within the business plaza
located at 720 Main Street/407 North Street.
To the west of North Street, the perennial stream channel measures between five and seven feet wide and is
contained within moderately steep vegetated Bank which extends towards the headwall/culvert crossing.
East of North Street, flow is conveyed easterly within well defined, near linear Banks measuring between two
and three feet wide amidst manicured and landscaped lawn.
Riverfront Area
Riverfront Area is the area of land between a river’s mean annual high waterline measured horizontally
outward from the river and a parallel line located 200 feet away… In tidal rivers, the mean annual high-
water line is coincident with the mean high water line determined under 310 CMR 10.23. [310 CMR
10.58(2)(a)].
Riverfront Area extends 200 feet horizontally from the Bank-MAHW Line of the perennial stream Stewarts
Creek and includes portions of the project footprint as it extends along North Street.
Proposed Project
This project involves the construction of an approximately 8-foot-wide bituminous shared-use path along
the west side of North Street. The primary goal is to improve pedestrian access, mobility, and safety
within the project area by providing a continuous, dedicated shared use path. The proposed path will
enhance connectivity to nearby residential, commercial, and public destinations along North Street
between the West Main Street roundabout to the southwest, and Stevens Street to the northeast.
The shared use path will extend from the existing curb, with current curbs generally defining the limits of
milling. Pavement patches will match existing materials. The project also includes the construction of
two crosswalks across North Street and Mitchell’s Way. In addition, a cobra head streetlight fixture is
proposed to be mounted on an existing utility pole located east of the West Main Street roundabout.
The scope of work includes site preparation, excavation, grading, and installation of the shared use path in
accordance with applicable local, state, and federal standards, including ADA accessibility requirements.
Additional work may include curb and gutter modifications, driveway tie-ins, drainage improvements,

installation of detectable warning surfaces at crossings, and restoration of adjacent areas disturbed during
construction.
Erosion and Sedimentation Control
The Applicant proposes to implement an erosion control program to protect the adjacent resource areas and
properties from sedimentation during construction activities. The plan for the control of potential impacts to
the adjacent resource areas is based on DEP guidelines and will be comprised of staked, 12-inch-diameter
compost filter tubes. The compost filter tubes will be installed along the edge of the existing lawn and will
define the Limit-of-Work. All erosion control measures will remain in place until disturbed areas are
stabilized by vegetation.
Summary
On behalf of the Applicant, the Town of Barnstable Department of Public Works, LEC is filing this RDA
for construction of a sidewalk along North Street. Portions of the proposed work activities are located
within the 100-foot Buffer Zone to Bordering Vegetated Wetlands (BVW) and Bank/MAHW, and within
Riverfront Area.
Based on the negligible disturbance caused by the work, the Applicant respectfully requests that the
Conservation Commission issue a Negative Determination confirming that the proposed work is “within
an area subject to protection under the Act, but will not remove, fill, dredge, or alter that area, and does
not require the filing of a Notice of Intent” (WPA Form 2, § B (2) - Negative Determination).
