(A&M) is pleased to submit this Notice of Intent (NOI) to the Barnstable Conservation Commission for the work completed at 536 Shootflying Hill Road. The 536 Shootflying Hill property includes a one-story, three-bedroom, single-family house on a 0.4-acre parcel. This NOI is being filed because in the Spring 2025 a new patio and fire pit were constructed on the property. The work occurred within the Commonwealth of Massachusetts 100-foot buffer zone and the Town of Barnstable 50-foot buffer zone. Subsequently, an Enforcement Order was issued directing the applicant to submit a Notice of Intent for approval of the work completed. This NOI is being filed under the Massachusetts Wetlands Protection Act and its implementing regulations 310 CMR 10.00. The property fronts on Wequaquet Lake, with the existing house approximately 12 feet from the water’s edge. The work already performed entailed the removal of an existing brick paver patio (174 square feet) in front of the house and installation of a new patio/walkway (443 square feet), resulting in a net increase of 421 square feet in paver coverage. The project also included the installation of 691 square feet of new landscaped areas. Notably, the new installation used permeable pavers, designed with gaps between the stones which allow stormwater to pass through. These pavers are set over a base of coarse stone, which provides both storage and infiltration of the runoff, reducing the peak rate and volume compared to the previous conditions. Per Section 704-4 of the Barnstable Code, the applicant hereby requests a waiver of performance standards for projects within the 50-foot buffer. The applicant proposes to install an additional 2,070 square feet of landscaped areas, bringing the total into compliance with the 4:1 planting-to-disturbance ratio required by Section 704-4.B.(2). Landscaping plans are included herewith. (A&M) is pleased to submit this Notice of Intent (NOI) to the Barnstable Conservation Commission for the work completed at 536 Shootflying Hill Road. As required, this NOI is being filed under the Massachusetts Wetlands Protection Act and its implementing regulations of 310 CMR 10.00. The purpose of this NOI is to gain approval for the work within 100 feet of the bank associated with Wequaquet Lake. Existing Conditions The 536 Shootflying Hill Road property includes a one-story, three-bedroom, single-family house on a 0.4-acre parcel, identified on Assessor’s Map 193 as Lot 29. The house, and large portion of the property, are less than 50 feet from the bank and the entire parcel is less than 100 feet from the bank. This NOI is being filed because in the Spring 2025 a new patio and fire pit were constructed on the property. The work occurred within the Commonwealth of Massachusetts 100-foot buffer zone and the Town of Barnstable 50-foot buffer zone. Subsequently, an Enforcement Order was issued directing the applicant to submit a Notice of Intent for approval of the work completed. Single-family homes abut the site to the east, west, and north and Wequaquet Lake abuts the site to the south. The site topography slopes gradually from north to south, from Shootflying Hill Road down to the lake. Ground cover, other than the home and patio, includes a paved driveway, lawn, and mature trees. FEMA Flood Zone The latest Federal Emergency Management Agency (FEMA) Flood Insurance Rate Map (FIRM) map 25001C0561J, effective July 16, 2014, was reviewed and indicates that the northern portion of the property is within Zone X, Area of Minimal Flood Hazard, while the southern portion of the property is within Zone X, Area of 0.2% Annual Chance of Flood Hazard (500-year). No portion of the property is within a Zone A or Zone AE (100-year floodplain). A figure is provided in Section 2.0 Exhibits. Water Supply Protection Area The site is not located within a Water Supply Protection Area. Resources Area The limit of work is located within 100 feet of the bank associated with Wequaquet Lake, which is subject to MADEP jurisdiction. The work is also located within the 50-foot buffer zone, as described in section 704-2 of the Barnstable Code. NHESP Priority & Estimated Habitat A review of the latest Massachusetts Natural Heritage Atlas; 15th Edition, reveals that there are no Estimated Habitats nor Priority Habitats on the site. A figure is provided in Section 2.0 Exhibits. Outstanding Resource Waters / Areas of Critical Environmental Concern A review of the Outstanding Resource Waters (ORW) layer available through MassMapper indicates there are no Areas of Critical Environmental Concern (ACEC) or other ORWs located on the site. A figure is provided in Section 2.0 Exhibits. NOTICE OF INTENT 536 Shootflying Hill Road, Centerville, MA 6 Proposed Project In this NOI, the applicant seeks to gain approval for the work already performed, which entailed the removal of an existing brick paver patio (174 square feet) in front of the house and installation of a new patio/walkway (443 square feet), resulting in a net increase of 421 square feet in paver coverage. The project also included the installation of 691 square feet of new landscaped areas. As mentioned above, the work, and the existing house, are located within the local 50-foot buffer zone, meaning any site disturbance requires a waiver of the performance standards, per section 704-4 of the Barnstable Code. A total of 690 square feet of new disturbances were produced within the buffer area. Mitigation is required in the form of plantings, at a 4:1 planting-to- disturbance ratio. Given that 691 square feet of new plantings were installed as part of the project, a total of 2,070 square feet of additional plantings are required. A Planting plan has been prepared detailing the type and location of the proposed plantings, and is included with this submission. The plan shows that an additional 2,117 square feet of plantings are proposed. It is worth noting that the new paver patio installation used permeable pavers, which are considered a “Best Practice” per 704-3.F.(1) of the Barnstable Code. Permeable pavers are set with gaps between the stones which allow stormwater to pass through, into the base of coarse stone below, which provides both storage and infiltration of the runoff. MassDEP Stormwater Performance Standards The Stormwater Performance Standards do not apply because the use is a single-family house. With that said, a Stormwater Report has been prepared, documenting how the project meets the Standards, to the maximum extent practicable. Included is an analysis of the stormwater runoff from the site, for the condition prior to installing the new patio, and after. The Stormwater Report shows by means of narrative, calculations, and exhibits that there is no increase in peak rate of runoff from the site at the study point for all design storm events. See the separate Stormwater Report for a detailed analysis of how the project meets the MassDEP Stormwater Standards to the maximum extent practicable. Additionally, appropriate erosion controls were used during construction, and an operation and maintenance plan has been developed. These erosion controls included tubular barriers at the downhill limit of disturbance. These can be seen in the included site photos. Interests of the Wetlands Protection Act By installing stormwater best management practices on the project site, the proposed project will protect the interests of the Wetlands Protection Act, including protection of private/public water supply, protection of groundwater supply, providing flood control, prevention of storm damage, and prevention of pollution. No direct or indirect impacts of any wetland resource resulted from the construction of the new patio. Narrative Conclusion The applicant respectfully submits the proposed project for review by the Barnstable Conservation Commission. The site improvements provided a significant benefit to the owner without negatively impacting the existing resource areas. This project meets the Performance Standards of the MA Stormwater Performance Standards to the maximum extent practicable. Currently, stormwater from the site flows to the lake. The permeable pavers provide infiltration, which is a benefit to the site as well as to the surrounding area. Adverse impacts have been minimized, and the interests of the Massachusetts Wetlands Protection Act and the Barnstable Conservation Commission regulations have been protected.
