A. The Request for Detennination of Applicability is typically used for minor projects. Advance consultation with Conservation Division staff is encouraged. B. Fonn PA is available at https://barnstable.gov/departments/Conservation Do not send abutter letters out until Fonn PA is signed and submitted to the Conservation Division office. Your sketch of the project on an existing engineering plan, GIS plan or aerial image. The sketch or plan shall be drawn to approximate scale and shall depict both the project footprint and the offset distances to a wetland resource area (i.e. wetlands, coastal banks, dunes, etc.) The sketch shall also be signed and dated by the preparer. GIS plan may be obtained in Conservation. A copy of the locus map may be obtained from Conservation. Indicate project site with an arrow and write the word LOCUS. A list of direct abutters and Assessors map of their location. These are available on the town web site at town.barnstable.gov or you may request assistance from Conservation staff. Under Chapter 237, Wetlands Protection, of the General Ordinances of the Code of the Town of Barnstable, property owners actually touching on the subject parcel upon which work is proposed shall be notified. A copy of the abutter notification letter. Complete the letter supplied to you. The staff will issue you a date and time the public hearing will be held when the application is ready to be submitted. The notification letter should be sent by certified mail, the same day the application is submitted. Please plan on attending the hearing. A completed copy of this checklist. Conservation will submit the legal ad for publication in a local newspaper. The applicant or his/her agent is responsible for payment of the legal ad fee prior to the hearing. The exact amount of the fee will be pre-calculated and posted on the Conservation Commission agenda on the Town Clerks website the Thursday before the hearing. The subject property consists of approximately 63,995 square feet of upland area and is located in a single-family residential zoning district. The site is currently developed with a 5-bedroom. single-family dwelling, originally constructed in 1983 per the Town Assessor's records. A Salt Marsh occupies the perimeter of the property along its frontage on Scudder Bay, an em.baym.ent of Bumps River. A Coastal Bank occupies the southeastern portion of the parcel. The property lies partially within Land Subject to Coastal Storm Flowage (AE el. 12), (AE el. 13), and areas of minim.al flood hazard. All proposed work is located outside of Land Subject to Coastal Storm Flowage. It should be noted that no work is proposed within any areas mapped as Priority Habitat or Estimated Habitat for Endangered Species by the Massachusetts Natural Heritage and Endangered Species Program. (NHESP). Proposed Work The existing 5-bedroom. dwelling is currently served by a septic tank which connects to a leaching pit. The proposed Title 5 septic system. upgrade will utilize the existing septic tank connecting to a new 1,500-gallon septic tank. The septic tank effluent will be gravity-fed to a distribution box connecting to four 500-gallon leaching chambers surrounded by 4 feet of stone around. The proposed leaching facility is situated 85.5 feet at its closest point to the top of the Local Coastal Bank, while the proposed septic tank will be 85.8 feet at its closest point to the top of the Coastal Bank. Both the proposed leaching facility and septic tank will be located outside of the 50-foot buffer to the Salt Marsh. The bottom. of the leaching facility will be 8.5 feet above the estimated groundwater elevation. A portion of the existing paved driveway is expected to be removed to accom.m.odate the leaching facility installation. Upon completion of the septic work, the pavement will be repaired within its original footprint to match the existing conditions. The proposed leaching facility is located as far from. the resource area as practical given the site's existing topography. 310 CMR 10.30 Coastal Banks (Barnstable Conservation Commission Ch. 705) The Coastal Bank was delineated in accordance with Barnstable Conservation Com.mission Coastal Bank Definition and Delineation Policy, Chapter 705. Site slopes exceed 18% throughout the majority of the property, and the southwestern portions of the parcel are exclusively seaward-facing. The slopes along FEMA Flood Zones AE (El. 12) and AE (El. 13) likewise exceed 18%. The Coastal Bank delineation terminates at the landward extent where slopes are less than 18%. No work is proposed on the bank. A silt fence work limit line will be provided generally along the top of the Coastal Bank to maintain bank stability throughout construction. The existing stable Coastal Bank will continue to provide coastal flood containment, and flood control capacity will remain unaffected by the proposed work. 310 CMR 10.32 Salt Marshes A Salt Marsh resource area extends along the perimeter of the property along the toe of the coastal bank. Wetland boundaries were delineated by Bradford Hall of BLH Environmental Consulting on January 15, 2026, and located by Down Cape Engineering, Inc. during a field survey. To protect the resource area during construction, a silt fence work limit line is proposed along the southeast portion of the property downgradient of the proposed work. All erosion and sediment control measures will be installed prior to the commencement of any site work and will be maintained until all disturbed areas have been stabilized. Construction Protocol All construction equipment will access work areas through the existing paved driveway from Cove Island Road. Prior to commencement of any site work, the surveyor will place work limit stakes in accordance with the approved plans. The contractor will install and maintain a silt fence, along the designated work limit line. The construction sequence will proceed as follows: (1) installation of erosion controls; (2) excavation and removal of the existing septic system; (3) installation of septic system components; and (4) final site stabilization and repaving. Erosion and sediment control measures will remain in place and be properly maintained until all disturbed areas have been stabilized with loam and seed or restored to existing conditions.
