The proposed Arborvitae’s that were part of the mitigation plan from previous hearings that abutted the driveway have been removed from the plan in the last revisions. Our mitigation plan is focused on planting all within the 50’ buffer zone. As for the existing Emerald Green Arborviates (Thuja occidentalis'Smaragd') are proposed to remain. In the email they were called out as “green giant arborvitae” that grow 3-5’ per year and max out at 60’. I assure you that this is not the case and Emerald greens only max out around 12-14’ and only 6-12” per year. The intent of planting in their location is to screen sound and vision for privacy for my family. They are planted at elevation 38’ which is approximately 10’ lower than the street elevation. All of the proposed mitigation is outside of abutting properties including parcel 193262 owned by Town of Barnstable that Mr. Tlapa mentioned a deeded right of way. We have proposed to install wooden posts with conservation tags that run along the mitigation line at the property boundary. As for the mention from Mr. Tlapa regarding the mention of a fence installed directly in the deed path, this fence has been existing for decades well preceding his ownership of his property. I have attach ed a few photos dating back to 2007. As for the comments regarding his view of Wequaquet lake, as I respect his wishes when he purchased the property the view was already obstructed. My brother and I had a conversation back in June of 2023 where Guy had requested for some of the brush to be cut back by the driveway in which we spent a few hours being a good neighbor. Unfortunately this extension of good faith was overreached and the tree that is labeled to the left of the patio in the NOI plan had been topped by 10’+ in which we did not give permission for such actions to be taken. In the past two hearings Mr. Tlapa has attended the hears to object the potential loss of his view in which both occurrences Tom Lee has stated the commission has no jurisdiction over private views. We have listened and accommodated to Guy’s concerns.
