Please find below a project narrative describing proposed work including construction of an addition to an existing single-family dwelling and associated site work/disturbance to existing conditions at the property located at 76 Nyes Neck Road East, Centerville, MA. The proposed project falls under review and is subject to the Massachusetts Wetlands Protection Act, MGL Chapter 131, Section 40 and Chapter 237 of the Town of Barnstable Wetlands Protection Ordinance, and Chapter 704, Regulation Governing Activity in the 100-Foot Buffer Zone. Existing Conditions The property is located at 76 Nyes Neck Road East (Map 233, Parcel 035) and contains approximately 11,300 square feet (0.26± acres) of land area, of which approximately 10,485 square feet is upland and 815 square feet occurs within bordering vegetated wetland resource areas. The site is developed with an existing 1,415 square foot single-family dwelling, driveway, private well, and a recently upgraded Title 5 septic system. The property is situated between two separate bordering vegetated wetland (BVW) resource areas associated with Bearse Pond and adjacent wetland systems located to the east and west of the developed lot. The BVW boundaries were delineated in the field by Bradford Hall on March 12, 2026 and are depicted on the accompanying site plans. Wetland data forms documenting the delineation are included with this filing. The property was previously reviewed by the Barnstable Conservation Commission under a Request for Determination of Applicability associated with a septic system upgrade completed in 2022. Existing site conditions consist primarily of maintained lawn, driveway, dwelling footprint, and associated residential improvements. Proposed Conditions The proposed project consists of a minor addition of approximately 318 square feet added to the existing dwelling and associated site improvements within the 50 ft. Buffer Zone to both Bearse Pond and the BVW. The addition is proposed immediately adjacent to the existing structure and within an area that has been previously disturbed and maintained as residential lawn and developed yard area. No work is proposed directly to the BVW or within Bearse Pond, and no direct alteration of any wetland resource area is proposed. The project is designed to utilize the existing developed footprint to the maximum extent practicable while minimizing encroachment into undeveloped portions of the site. The proposed addition is located approximately 40.2 feet from the eastern BVW boundary and approximately 66.1 feet from the western BVW boundary, as shown on the accompanying plans. Construction activities will be confined to the proposed limits of work shown on the accompanying plans. Prior to commencement of work, erosion and sedimentation controls consisting of straw wattles and silt fence shall be installed along the proposed work limits and maintained throughout construction. Any disturbed areas shall be stabilized and returned to pre-existing conditions. Temporary stockpiling of excavated materials shall occur only within the approved limits of work and shall be protected by appropriate erosion controls. Excess excavated foundation material shall be removed from the site by truck and disposed of at an approved upland location. Although the proposed work is located within the Buffer Zone to Bearse Pond and the BVW, the project represents a limited expansion of existing residential use within an already developed and maintained portion of the property. All work has been designed to avoid direct impacts to wetland resource areas, minimize temporary construction-related disturbance, and preserve the existing functions and values of the adjacent wetland systems. Given that the proposed addition is located within a previously disturbed and maintained portion of the Buffer Zone and does not result in any direct alteration of wetland resource areas, the Applicant respectfully requests a waiver of the Chapter 704 performance standards for work within the 50-foot buffer zone. The proposed project represents a minor expansion of an existing single- family residence within a developed residential lot and has been designed to avoid and minimize impacts to adjacent wetland resource areas to the maximum extent practicable. The property is considered mitigation-constrained due to its small lot size, the location of bordering vegetated wetlands on both sides of the developed lot, and the presence of existing site improvements including the dwelling, driveway, private well, and recently upgraded septic system. Should the Commission determine mitigation is required under Chapter 704, the Applicant respectfully requests consideration of a fee-in-lieu contribution in accordance with Chapter 704- 5(D), as opportunities for meaningful on-site mitigation are limited. The proposed work will not result in the filling, dredging, excavation, or alteration of bordering vegetated wetlands, Bearse Pond, or any other protected wetland resource area. Given the limited scale of the project, its location within an existing developed residential setting, and the absence of any direct wetland alteration, the proposed work is not anticipated to contribute to adverse impacts to adjacent wetland resource areas. No adverse impacts to water quality, stormwater runoff characteristics, erosion control functions, wildlife habitat, or other interests protected under the Massachusetts Wetlands Protection Act, Chapter 237, or Chapter 704 are anticipated. Accordingly, the project is respectfully submitted for review and approval.
