Call to Order Introduction of Board Members Planning Board Chair Public Comment Statement General Public Comment – None Ray Sexton moves to open the public hearing, seconded by Michael Mecenas, Roll Call Vote: Catherine Finkenstaedt - aye Ray Sexton – aye Matt Teague – aye Tim O’Neill – aye Michael Mecenas – aye Stephen Robichaud - aye Special Permits (Public Hearing) William Hanney has submitted a special permit application for property located at 82 School Street, Hyannis, Map 327 Parcel 239-002 Town of Barnstable www.barnstable.gov/PlanningBoard 2 Kyle Pedicini gives an update. No review needed from Site Plan Review. Attorney Robert Mills in attendance, representing William Hanney. Jim Griffith’s the owner’s representative in attendance. Plans on putting in sports bar and cabaret at Mall, would like to use this house for the entertainers to stay at. Doesn’t represent anything bad for the community. Will be transported while the performers are performing, transient. No construction is contemplated. One exterior renovation for some shingling on one side of the building. Doesn’t need historic relief, non viewable. Hours will be like they are now. Currently CHAMP there now and they will be having a new facility built across the street. Probably take a year to get the set up for the entertainment. Chair Stephen Robichaud asks what is the current use? How is Champ using now? Jim Griffith, currently people are there for sober house atmosphere. Parking is for people that work there as well/staff. Chair Stephen Robichaud, seems like relatively same use, arts and creative entertainment is good. Catherine Finkenstaedt, dormitory, transitional housing now. Ray Sexton, timeline? About a year? Attorney Mills, yes. This will coincide with the Champ building as well, their new building. Chair Stephen Robichaud, parking for 82 School St is to the North? Parking for South is for Greenery? Attorney Mills, yes. Tim O’Neill, prepared meals, cafeteria now? Any intention to keep that use? Catherine Finkenstaedt, industrial kitchen now. Attorney Mills, haven’t gotten that far yet. Tim O’Neill, trash and/or late night food impact, concerns if so. Chair Stephen Robichaud asks for any public comment? Greg Schnipke, 89 Lewis Bay Rd., just wants to caution on parking. People use our parking lot sometimes. Wants to make sure the new tenants would have ample parking. Chair Stephen Robichaud, if any additional relief needed - let Planning Dept. know Chair Stephen Robichaud moves to close the public hearing, seconded by Matt Teague, Roll Call Vote: Catherine Finkenstaedt - aye Ray Sexton - aye Matt Teague - aye Tim O’Neill - aye Michael Mecenas - aye Stephen Robichaud - aye 3 Ray Sexton moves to approve the Special Permit 2026-002, 82 School Street with the following Findings and Conditions: Chair Stephen Robichaud reads Findings, 1. The property location is 82 School Street, Hyannis, Hyannis is shown on Assessor’s Map 327 Parcel 239-002 in the Downtown Neighborhood district. 2. The Applicant, William Hanney, seeks a Special Permit pursuant to section 240-24.1.5.B(b)(iv). The applicant proposes a lodging house where the previous use was a lodging house. 3. The Planning Board finds that the issuance of the Special Permit is consistent with the Design and Infrastructure Plan and that the development meets the following criteria: a. Provide housing that supports a mix of income levels and provides both ownership and rental housing. b. Support development that recognizes a culture-based economy including businesses, individual artists and not for profits. c. Support locally owned businesses and businesses that employ Cape Cod residents. 4. The application falls within a category specifically excepted in the ordinance for a grant of a Special Permit. Section 240-24.1.5.B(b)(iv) allows the Planning Board to approve the change from one non-conforming use to another non-conforming use within the same category by Special Permit. 5. After an evaluation of all the evidence presented, the proposal fulfills the spirit and intent of the zoning ordinance and would not represent a substantial detriment to the public good or the neighborhood affected. 6. The Building Commissioner determined that pursuant to Chapter 240-101(B) of the Town code, the proposal is of no significant detriment to the purposes outlined in Chapter 240 -99 which require Site Plan Review approval. Therefore, site plan review is not required for this project. 7. The proposed repairs, alterations and/or expansion are not substantially more detrimental to the surrounding neighborhood, seconded by Tim O’Neill, Roll Call Vote: Catherine Finkenstaedt - aye Ray Sexton – aye Matt Teague - aye Tim O’Neill - aye Michael Mecenas - aye Stephen Robichaud - aye General Correspondence Chapter 91 150 Carriage Rd., West Bay Osterville, McParland – pier, end platform and kayak rack Chapter 91 Town of Barnstable, West Bay and North Bay Channels, Three Bays – maintenance dredging Staff Updates Kyle Pedicini - Town Open Space has been approved by the State, next 10 years and LCP approved. All Dept. heads are aware. Next is Hazard Mitigation plan. In process of getting a grant for that. Ray Sexton, strategic level plans and now have to move to the tactical. Are the Dept. heads going to submit any plans of their own? 4 Kyle Pedicini, implementation – LCP go to Town Council (TC). Review and this is the conduit. Goals are that this body will look at on an annual basis. Then report to TC to state how accomplishing goals. Open Space Committee will be working on the check of how goals are progressing. Ray Sexton confirms that TC has to identify and prioritize. Allocations to various departments. Oversight. Projects funded by the TC and accountability. Chair keep the momentum going and follow up with some plans on how to do this. Zoning Subcommittee Updates Chair Stephen Robichaud, have not met since last here. Home occupation have some tiers, site plan review. Building Commissioner giving info on how review works/checklist. They do a deep review. Any memorandums or minutes send to Planning Board. Matters Not Reasonably Anticipated by the Chair Approval of Minutes June 8, 2026 Draft Minutes Matt Teague moves to approve Draft Minutes, seconded by Ray Sexton, Roll Call Vote: Catherine Finkenstaedt - aye Matt Teague - aye Ray Sexton - aye Tim O’Neill - aye Michael Mecenas - aye Stephen Robichaud - aye Terry Duenas and Lyndsey Counsell have retired from the CPC. Lyndsey has had over 20 years of service. Still involved with. Chair Stephen Robichaud has been elected as Chair for CPC. A lot that goes on with CPC. Meets once a month.
