Re: Great Marsh Development LLC/Appeal No. 2025-025
Dear Members of the Board,
Attached for submission to the Board in advance of the continued hearing scheduled for July 8, 2026,
are the following materials:
1. Revised and updated TIAS prepared by VHB and dated June, 2026;
2. Revised site layout plans by Baxter & Nye showing a) alternative access on Great Marsh
Road closer to Phinney’s Lane (4 sheets) and b) updated sight distance at original access
location (1 sheet); and
3. One additional Waiver to maximize vegetated buffer zone and avoid additional tree clearing
along Great Marsh Road, a Scenic Road.
At the last meeting with the Board, there was discussion about the potential need for the VHB TIAS to
be peer reviewed in addition to the peer review already completed by the Barnstable DPW, COMM Fire, and
the Cape Cod Commission. In response and though not legally required, the Applicant agreed to have the
TIAS updated to clarify and answer some of the questions raised by Mr. and Mrs. Temple (see No. 1 above)
and to analyze the effect of alternative access approximately 150 ft. further down the road (see No. 2 above).
Although not a legal standard under Chapter 40B (nor Chapter 40A), there is no compelling reason to shift the
access (however the term compelling is defined). Notwithstanding the foregoing, the Applicant is willing to
discuss the two access options with the Board and to construct either one based on the assumption that the
Board is willing to close the public hearing and begin deliberating the draft Decision with reasonable
conditions previously prepared by Town Counsel and hopefully to vote at the July 8, 2026, meeting.
