ISLANDS ENGINEERING, INC. in collaboration within Wilkinson Ecological Design, is submitting this Notice of Intent (NOI) application, on behalf of the applicant and owner, Brian Bunn, for the proposed landscape improvements and restoration work at 1000 Main Street in Cotuit, Barnstable. The work includes the construction of a shed, driveway expansion, the in-kind replacement of a walkway and patio, fence replacement, installation of an irrigation well, as well as an expansive restoration plan including plantings, invasive species management, and the installation of a rain garden. Work will occur within Coastal Bank, Land Subject to Coastal Storm Flowage (LSCSF) and within the 100-feet of jurisdictional resource areas. 1.2 Applicable Regulations This application has been filed jointly with the Department of Environmental Protection, pursuant to the Commonwealth of Massachusetts Wetlands Protection Act (MWPA, M.G.L. Chapter 131, Section 40) in accordance with its implementing regulations (310 CMR 10.00); and the Town of Barnstable, pursuant to Town of Barnstable Wetlands Protection Bylaw (Chapter 237 of the Town Code) and implementing regulations. 2.0 BACKGROUND 2.1 Existing Conditions The project site is located at 1000 Main Street is a private residentially developed property with frontage to Cotuit Bay to the east. The lot is occupied by a single-family dwelling with a deck, patios, walkway, a paved driveway, fencing, walls, and gravel path leading to the shoreline. Open space consists of maintained lawn and trees, native and invasive vegetation, and Salt Marsh. 2.2 Property History The property at 1000 Main Street is a 44,051 square foot (sf) developed lot shown on the Town of Barnstable Assessors as Map 034 Parcel 061. The lot is recorded in the Barnstable Registry Land Court under Certificate of Title 239837. Book 37166 Page 50. The property was originally developed in 1974 per the Town Assessors records. The following environmental permits have been issued for the property: Permit Purpose Order of Conditions 3-0812 1982 Site Plan (certificate of Compliance issued 6/5/2018) 2.3 Site Characteristics Jurisdictional wetland resources identified on or within 100 feet of the property include Coastal Bank, Salt Marsh, Coastal Dune, Coastal Beach and LSCSF. The limits of the resource areas were ground surveyed in the field, and are shown on the plans. According to the Federal Emergency Management Agency (FEMA) Flood Insurance Rate Map (FIRM) Community Panel No. 25001C0757J, Effective July 16, 2014, a portion of the property is located the NOTICE OF INTENT APPLICATION 1000 MAIN ST, BARNSTABLE, MA Project Narrative Page 2 100-year floodplain defined by Flood Zone AE (E.L. 13) and VE (EL. 14) (NADV 88) as well as within the Limits of Moderate Wave Action. The Massachusetts Natural Heritage and Endangered Species Program (NHESP) Atlas (15th edition, August 1, 2021) and MassGIS online were consulted, and the project site does not fall within Estimated Habitats of Rare Wildlife or Priority Habitats of Rare Species. There are no vernal pools within 100 feet of the site. The property does not fall within mapped Areas of Critical Environmental Concern, Outstanding Resource Waters, or Interim or Zone II Wellhead Protection Areas. The project involves work on a single-family dwelling and is exempt for Massachusetts Stormwater Standards. 3.0 PROPOSED PROJECT 3.1 Scope of Work The applicant proposes several landscape improvements along with expansive restoration work on the residential property. Additions include a 12-foot by 12-foot shed with a 4-foot by 6-foot ramp as well as a 100 sf expansion to the existing driveway for an improved turning radius. The existing walkway and patio along Main Street is proposed to be rebuilt in the same location. An irrigation well is also proposed by the front of the house. Restoration work consists of the removal of 11,275 sf of invasive plants and the area to be revegetated with native planting. A 970 sf area of lawn east of the house is proposed to be restored to meadow plantings. Finally invasive plant management and an ornamental garden is proposed within a 1,450 sf area on the street side of the existing house. Please refer to the plan by Wilkinson Ecological Design for restoration details and a list of proposed plants. 3.2 Construction Methodology Prior to the start of work, the Order of Conditions and DEP File Number will be posted at the site, and the Conservation Commission will be notified in advance that work will be starting on site. The limit of work will be established and sedimentation controls consisting of a sediment stop or silt fencing will be installed as necessary as identified on the plan and maintained throughout the construction phase. Efforts will be coordinated to minimize construction time and disturbance within and around the subject resource areas. The contractor will first perform landscape improvements including rebuilding the patio and walkway, construction of the shed, and driveway expansion. A small 8”’ deep rain garden will be installed on the down slope of the driveway to accommodate rain runoff from the driveway before running into the salt marsh. No debris, equipment or materials will be stored outside the designated work limits. The work limits will be kept clean during construction, and any loose debris will be removed. Restoration work will be performed in accordance with the land management plan and final plantings are noted on the Restoration Plan by Wilkenson Ecological. After the planting has been installed, the site will be stabilized, and all construction materials will be removed from the site. Any temporarily disturbed areas will be returned to pre-existing conditions. Once the work is found to be satisfactory in accordance with approved permits a request for a Certificate of Compliance will be filed with the Barnstable Conservation Commission to close out the project. 3.3 Avoidance and Minimization Measures Prior to the commencement of any construction activities, erosion and sedimentation controls, (e.g. siltation fence) will be installed as needed. This erosion and sedimentation control keeps sediment NOTICE OF INTENT APPLICATION 1000 MAIN ST, BARNSTABLE, MA Project Narrative Page 3 within the limits of work and will also serve to define the limit of construction to site workers. Erosion and sedimentation controls will be maintained in good condition at the site until the vegetation has stabilized. Any staging areas will be located on the existing lawn and away from resource areas. Any temporary disturbances to resource areas will be restored to pre-construction conditions after work is complete. Adjacent resource areas will be avoided to the maximum extent possible. Upon completion, temporarily disturbed areas will be restored preexisting conditions as maintained lawn upon completion. 3.4 Mitigating Measures The restoration area shown on this plan was designed as a result of the unauthorized work including vegetation removal. A total of 11,275 sf of restoration through the installation native plantings will be implemented across most of the open space around the developed footprint. A 970 sf lawn area located east of the driveway will be restored with native plantings. Lastly a 1,450 sf area next to the house and a 190 sf area along the fenceline will undergo invasive species management and the area by the house will then be planted with an ornamental garden. The restoration work will occur within LSCSF, Coastal Bank, and within 100-feet to the Top of Costal Bank. Please refer to the Restoration Plan and Land Management Plan prepared by Wilkinson Ecological Design for more information. The proposed project activities will not induce cumulative impairment of the resource area’s functional characteristics. The proposed work will, in fact, increase the natural capacity of the resource areas by restoring the proper growth of natural vegetation. 5.0 WAIVER The 0-100-foot Buffer Zone is considered disturbed as a portion of the dwelling is located within 0-50 feet. Work within 50-feet to the Top of Barnstable Coastal Bank includes the previously described restoration work. A portion of the restoration work as well as the rain garden and fence relocation also fall directly within resource areas. The proposed shed is designed outside of the 50-foot Buffer Zone. There will be no increase in structured or hardscapes within jurisdictional resources areas or within the 50-foot Buffer Zone. The project serves to benefit and vegetate as well as remove an existing fence within the 0-50-foot Buffer Zone and therefore exempt from waiver requirement per Chapter 704-6(4) of the Barnstable Town Code. 6.0 APPLICABLE PERFORMANCE STANDARDS The following is a discussion of how the proposed project meets the performance standards under the state and local regulations for each jurisdictional resource area impacted as a result of the project activities. The work will result in a 241 sf net increase in hardscape on the lot with a total of 13,885 sf in restoration and invasive management work. 6.1 Buffer Zone Definitions and performance standards for activities in the Buffer Zone are set forth locally in Chapter 704 of the Barnstable Town Code. The 0-50-ft and 50-100-foot Buffer Zones are defined from the most landward resource from the Top of Coastal Bank as defined by Barnstable regulations. The entire lot falls within 100-feet of Coastal Bank and most of the developed footprint falls within the 0-50-foot Buffer Zone. The 0-50-ft Buffer Zone is not undisturbed and consists of a significant portion of the developed footprint, maintained lawn, walls, and fencing. A portion of the minor driveway expansion as well as patio and walkways reconstruction and irritation well installation falls within 50-feet of Coastal Bank. However, the large-scale restoration work and invasive management will serve as a net improvement NOTICE OF INTENT APPLICATION 1000 MAIN ST, BARNSTABLE, MA Project Narrative Page 4 to the 0-50-foot Buffer Zone and beyond the 4:1 mitigation ratio required by the town. No new hardscape or structures are proposed within the 50-foot Buffer Zone. The proposed shed as well as a portion of the driveway expansion and the remaining walkway/patio reconstruction will occur within the disturbed 50-100-foot Buffer Zone. The work will be mitigated by restoration plantings and invasive management work, totaling more than required by the 3:1 mitigation ratio. The project will result in the restoration and enhancement of Buffer Zone functions through extensive habitat improvements. The proposed rain garden and native plantings will help filter stormwater, reduce erosion potential, and minimize nutrient transport associated with conventional lawn areas. As designed, the project results in a net environmental benefit and is consistent with the intent of Chapter 704 by protecting wetland interests while enhancing the ecological functions. 6.2 Coastal Bank Definitions and performance standards for activities within Coastal Bank are set forth in 310 CMR 10.30 and are referenced in Chapter 705 of the Barnstable Town Code. The top of Coastal Bank was delineated according to Policy 92-2 and is defined where the slope becomes greater than 4:1 and less than 10:1, while the Barnstable Top of Coastal Bank is defined at an 18% slope. Work within the locally defined Coastal Bank includes the fence replacement, installation of a rain garden, and restoration plantings. The Coastal Bank is not considered an eroding bank according to the CZM Coastal Erosion Analysis Tool. Best management practices will be implemented to avoid disturbances Coastal bank and erosion controls will be installed to protect the slope. The proposed work will not impact the stability of the bank or clear any naturally vegetated areas or wildlife habitat. The restoration and management work will serve to benefit the area and restore wildlife function and value. No new structures or hardscapes are proposed directly within Coastal Bank. The proposed project activities will not induce any impairment to the Coastal Bank’s function or ability to protect against flood waters. 6.3 Land Subject to Coastal Storm Flowage (LSCSF) Performance standards for LSCSF are not defined on a state or local level. A portion of the proposed work falls within the 100-year floodplain as defined by FEMA Flood Zone AE (EL. 13). Approximately 4,820 sf of the limit of work falls within LSCSF. No change is proposed in the topography, vegetative community or any significant elevation or horizontal movement of existing landforms. The work will not adversely impact LSCSF beyond existing conditions. Rather, the mitigation plantings and installation of a drywell will serve to improve the structures’ ability to protect against storm surges and flood events. 6.4 Salt Marsh Salt Marsh as defined in the MA WPA is located within the eastern extent of the lot as identified in the field and on the attached project plans. There is no work proposed within the Salt Marsh. The proposed project activities will not induce any impairment of the Salt Marsh functional characteristics. 7.0 SUMMARY 7.1 Performance Standard Metrics The existing wetland resources, anticipated project impacts and the proposed impact reduction measures associated with this project have been fully documented within this Notice of Intent application. Based on the information provided in this application it is asserted that the following NOTICE OF INTENT APPLICATION 1000 MAIN ST, BARNSTABLE, MA Project Narrative Page 5 project features would result in no a benefit to the associated resource area will have no adverse effect on the subject resource area(s) values and functional characteristics. The project should be approved for the following reasons: • All work will take place within previously disturbed and legally altered areas. Proposed additions and expansions are kept largely to the 50-100-foot Buffer Zone. • The restoration plantings will restore previously disturbed areas and improve the value of resource areas and associated buffer zones. • The project has been designed for overall benefit to the area through the installation of mitigation plantings and a rain garden. The project will not cause unacceptable significant or cumulative effect upon resource area values, functions, or characteristics. The proposed drywell will serve to benefit resource area. The project conforms to the Massachusetts Wetlands Protection Act, (MWPA, M.G.L.
