Dear Anna, Jake Dewey and the board,
On behalf of the Wequaquet Estates Beach Association, we want to thank you all for the
time and efforts you put in listening to all of our concerns and working through this permit
process with us for these last several months.
We appreciate and respect the applicant’s willingness to move the entrance to the new
subdivision to the newly proposed 51 Great Marsh location after considering our and the
zba’s concerns. We believe this is a safe and most viable location for the following
reasons.
1) This new location meets both the Aashto and the Barnstable safety code 801-13 for safe
stopping sight distances.
2) It meets them not only at the posted 30 MPH speed but also at the ACTUAL speed of37
MPH as noted in the traffic study provided by the applicant’s expert VHB.
3) This therefore eliminates the need for the ZBA to approve the 802-13 waiver which we
submit has the potential to set a precedent against prioritizing safety.
4) The former 4way entrance at Juniper does NOT meet all the criteria for safety above,
failing local code at actual speeds. The traffic expert was clear that he did not use the
existing and necessary Barnstable safety code, as required by code, in the original traffic
study or in the updated one but instead chose AASHTO which allows for more relaxed
safety rules. Because this has come to light they have now requested a waiver.
5) Choosing the newly proposed entrance at 51 Great Marsh road allows drivers to travel
more safely by eliminating the 4 Way and reducing crash conflict points by 40%.
These points we contend, are compelling and obvious reasons to accept the newly
proposed 51 entrance.
We believe this process worked, and demonstrated that a developer can achieve their
goals, the community can benefit from much needed affordable housing, both without
compromising safety or causing hardship to its neighbors. For this we are thankful.
Therefore we propose:
1) the board accept the revised intersection location at 51 Great Marsh Road
2) the board deny the unnecessary waiver of 801-13 as this new location meets the safety
code.
3)the board include a condition “that no construction or project related vehicles be
allowed to travel through or park within the WEBA neighborhood during the entirety of the
construction project”
This has been a long process and now we respectfully believe we have concluded with a
safe and viable project that will support affordable housing while achieving the applicants
goals. We support an expeditious end to this pending permit and support for the applicant
in their acceptance process into commonwealth builders.
