ISLANDS ENGINEERING, INC. is submitting this Notice of Intent (NOI) application, on behalf of the applicant and owner, Danny Capasso of CRC Realty Investment, LLC, for the proposed landscaping improvements including new patios, a walkway, and fencing as well as plantings, garden beds and tree replacement at 7 George Street (Property ID: 319-066) in Barnstable. Work will occur within Land Subject to Coastal Storm Flowage (LSCSF) and within the 100-feet of jurisdictional resource areas. 1.2 Applicable Regulations This application has been filed jointly with the Department of Environmental Protection, pursuant to the Commonwealth of Massachusetts Wetlands Protection Act (MWPA, M.G.L. Chapter 131, Section 40) in accordance with its implementing regulations (310 CMR 10.00); and the Town of Barnstable, pursuant to Town of Barnstable Wetlands Protection Bylaw (Chapter 237 of the Town Code) and implementing regulations. 2.0 BACKGROUND 2.1 Existing Conditions The project site is located at 7 George Street is a private residentially developed property with frontage to the Sandy Neck Barrier System to the south, across Commerce Road. The lot is occupied by a single-family dwelling, with two decks, a rinse station, a paved driveway, fencing, and shed. Open space consists of maintained lawn and trees. 2.2 Property History The property at 7 George Street is a 9,863 square foot (sf) developed lot shown on the Town of Barnstable Assessors as Map 319 Parcel 066. The lot has been recorded in the Barnstable County Registry under Book 37166 Page 50. The property was originally developed in 1967 per the Town Assessors records. No known environmental permits have been issued for the property. 2.3 Site Characteristics Jurisdictional wetland resources identified on or within 100 feet of the property include Coastal Bank, Salt Marsh and LSCSF. The limits of the resource areas were ground surveyed in the field, and are shown on the plans. According to the Federal Emergency Management Agency (FEMA) Flood Insurance Rate Map (FIRM) Community Panel No. 25001C0757J, Effective July 16, 2014, the entire property is located the 100- year floodplain Flood Zone AE (E.L. 12) (NADV 88). The Massachusetts Natural Heritage and Endangered Species Program (NHESP) Atlas (15th edition, August 1, 2021) and MassGIS online were consulted, and the project site does not fall within Estimated Habitats of Rare Wildlife or Priority Habitats of Rare Species. There are no vernal pools within 100 feet of the site. NOTICE OF INTENT APPLICATION 7 GEORGE ST, BARNSTABLE, MA Project Narrative Page 2 The lot falls outside of mapped Areas of Critical Environmental Concern, Outstanding Resource Waters, or Interim or Zone II Wellhead Protection Areas. The project involves work on a single-family dwelling and is exempt for Massachusetts Stormwater Standards. 3.0 PROPOSED PROJECT 3.1 Scope of Work The applicant requests permission to demolish the existing decks to construct a 610 sf stone patio at the back of the house and an in-kind patio at the front of the house, as well as construct a 166 sf stone walkway connecting the house to the existing driveway. A 6-foot tall fence enclosing the backyard is proposed to run along the northern and western extents of the property along Harbor View Road and three post and rail fences will be installed, two of which are within the 50-100-foot Buffer Zone. Several landscaping improvements are proposed throughout the lot. The existing trees along the western side of the property are proposed to be removed and replaced with dark American arborvitaes. Two trees which drop a lot of branches are a nuisance and becoming a safety hazard, are to be replaced with maple trees. Ornamental plantings are proposed along the southern extent of the dwelling and new patio as well as raised planting beds within the 50-100-foot Buffer Zone. A total of 509 sf of mitigation plantings are proposed for the increase in impervious surfaces that would revegetate the 0-50-foot Buffer Zone on the lot as much as practical. A small area, about 68 sf, within the 0-50’ Buffer which is inside of the boundary of the parcel is paved which provides access from George Street to Commerce Road. Two drywells will also be installed to account for the increase in impervious surfaces. 3.2 Construction Methodology Prior to the start of work, the Order of Conditions and DEP File Number will be posted at the site, and the Conservation Commission will be notified in advance that work will be starting on site. Erosion control will be used to establish the limit of work and maintained throughout construction until ground surfaces are stabilized. Efforts will be coordinated to minimize construction time and disturbance within and around the subject resource areas. The contractor will first demolish the existing timber decks. The new patios and walkway will then be constructed before the fencing and landscaping work is executed. Typical construction practices for the installation of stone patios will be implemented. One drywell will be installed within the southern extent of the lot to account for draw down. Debris will be removed daily from the construction area, away from resources areas during construction and properly disposed of upon completion. Construction level access and staging will occur from the existing lawn. Areas temporarily disturbed by construction activities will be stabilized and returned to pre-existing conditions. After all the work has been completed a site inspection will be carried out by the engineer and a request for a Certificate of Compliance submitted to the Commission once all applicable conditions have been satisfied. 3.3 Avoidance and Minimization Measures Prior to the commencement of any construction activities, erosion and sedimentation controls, (e.g. siltation fence) will be installed as needed. All ground disturbances will be kept to the minimum necessary to complete the construction and installation(s). No debris, equipment or materials will be stored outside the designated work limits. The work limits will be kept clean during construction. Any loose debris will be removed and disturbed areas will be restored immediately following construction. NOTICE OF INTENT APPLICATION 7 GEORGE ST, BARNSTABLE, MA Project Narrative Page 3 Any staging areas will be located on the existing lawn and away from resource areas. Any temporary disturbances to resource areas will be restored to pre-construction conditions after work is complete. Adjacent resource areas will be avoided to the maximum extent possible. Upon completion, temporarily disturbed areas will be restored preexisting conditions as maintained lawn upon completion. 3.4 Anticipated Impacts The proposed landscape project will not result in significant impacts to resource area function or values beyond existing conditions. The work will result in a 453 sf net increase in hardscape on the lot with 509 sf of mitigation that would revegetate the 0-50-foot Buffer Zone as much as practical. 5.0 WAIVER Approximately 509 sf of mitigation planting fall within the existing 0-50-ft Buffer. The 0-100-foot Buffer Zone is considered disturbed as a portion of the dwelling is located within 50-100-feet and the remaining area consists of maintained lawn. The project serves to benefit by revegetating and removing an existing fence within the 0-50-foot Buffer Zone and therefore exempt from waiver requirement per Chapter 704- 6(4) of the Barnstable Town Code. 6.0 APPLICABLE PERFORMANCE STANDARDS The following is a discussion of how the proposed project meets the performance standards under the state and local regulations for each jurisdictional resource area impacted as a result of the project activities. Work will occur within LSCSF and within 0-100-feet to jurisdictional resource areas. 6.1 Buffer Zone Definitions and performance standards for activities in the Buffer Zone are set forth locally in Chapter 704 of the Barnstable Town Code. The 0-50-ft and 50-100-foot Buffer Zones are defined from the most landward resource from the Top of Coastal Bank to the Sandy Neck Barrier Beach System. The 0-50-ft Buffer Zone is not undisturbed and consists of maintained lawn, small portion of pavement for George Street and existing fencing on the subject parcel. The remainder of the 0-50’ Buffer consists of Commerce Road, which is a public Road. The mitigation planting work will serve as a net improvement to the 0-50-foot Buffer Zone. A majority of the hardscape and landscape work will occur within the 50-100-foot Buffer Zone. The work will result in a 453 sf increase in hardscape in the 0-50’ Buffer in previously disturbed areas that will be mitigated by 509 sf of mitigation plantings, revegetating the 0-50-foot Buffer Zone as much as practical. Per Chapter 704-3(D)(c) “In no case shall the total area of mitigation plantings required be greater than that which is necessary to restore a 50 ft. undisturbed Buffer in its entirety”. 6.2 Coastal Bank Definitions and performance standards for activities within Coastal Bank are set forth in 310 CMR 10.30 and are referenced in Chapter 705 of the Barnstable Town Code. The top of Coastal Bank was delineated according to Policy 19-2 and is defined where the slope becomes greater than 4:1 and less than 10:1. The top of slope was ground surveyed and flagged in the field as shown in the project plans. Commerce Road separates the property from the resources associated with Sandy Neck Barrier Beach System and no work will be performed directly within Coastal Bank. The Coastal Bank is not considered an eroding bank according to the CZM Coastal Erosion Analysis Tool. The proposed work will not impact the stability of the bank or clear any naturally vegetated areas or wildlife habitat. The mitigation work will serve to benefit the area and best management practices NOTICE OF INTENT APPLICATION 7 GEORGE ST, BARNSTABLE, MA Project Narrative Page 4 will be implemented to avoid adverse impacts. No new alterations are proposed in Coastal Bank and no cumulative adverse impacts are anticipated. 6.3 Land Subject to Coastal Storm Flowage (LSCSF) Performance standards for LSCSF are not defined on a state or local level. The entire lot and all of the proposed work falls within the 100-year floodplain as defined by FEMA Flood Zone AE (EL. 12). Approximately 3,180 sf of the limit of work falls within LSCSF. No change is proposed in the topography, vegetative community or any significant elevation or horizontal movement of existing landforms. The work will not adversely impact LSCSF beyond existing conditions. Rather, the mitigation plantings and installation of a drywell will serve to improve the structures’ ability to protect against storm surges and flood events. 7.0 SUMMARY 7.1 Performance Standard Metrics The existing wetland resources, anticipated project impacts and the proposed impact reduction measures associated with this project have been fully documented within this Notice of Intent application. Based on the information provided in this application it is asserted that the following project features would result in no a benefit to the associated resource area will have no adverse effect on the subject resource area(s) values and functional characteristics. The project should be approved for the following reasons: • All work will take place within previously disturbed and legally altered areas. • The entirely of the 0-50-foot Buffer Zone is proposed to be restored and revegetated as much as practical. • The project has been designed for overall benefit to the area through the installation of mitigation plantings and a drywell. The project will not cause unacceptable significant or cumulative effect upon resource area values, functions, or characteristics. The proposed drywell will serve to benefit resource area. The project conforms to the Massachusetts Wetlands Protection Act, (MWPA, M.G.L. Chapter 131, Section 40) and its implementing regulations (310 CMR 10.00) and the Barnstable Wetlands Protection Bylaw, (Chapter 237 of the Town Code) and implementing Regulations (Part VI of the Town Code). 7.2 Request for Order of Conditions The Applicant has demonstrated and documented evidence that this project meets or exceeds all the relevant performance standards set forth in the governing regulations and respectfully request this project be approved and that an Order of Conditions be issued to the Applicant through its representative. 7.3 Contact Information In an effort to reduce the amount of paper required for filings, the entire application can be emailed upon request to regulatory staff and commission members.
