Re: Notice of Intent Filing – 470 Whistleberry Drive, Marstons Mills, MA 02648
Dear Members of the Commission,
The proposed project is the construction of a four-bedroom single-family dwelling within the
100-foot buffer zone to a Bordering Vegetated Wetland (BVW). No work is proposed within the
50-foot buffer zone or the BVW itself.
Existing Conditions
The subject property is an approximately 61,695-square-foot (1.42-acre) undeveloped lot. There
are approximately 50,468 square feet of upland and approximately 11,227 square feet of wetland
on the property. The BVW occupies the southern portion of the property and is delineated by
wetland flags BVW 1 through BVW 6. The wetland boundary was delineated by Brad Hall and
Darren Meyer on August 17, 2026.
Proposed Conditions
The project proposes construction of a new four-bedroom single-family dwelling with an
approximately 4,104-square-foot building footprint. Approximately 1,041 square feet of the
dwelling will be located within the 100-foot buffer zone to the BVW, with the remaining
approximately 3,063 square feet located outside the buffer zone. The proposed foundation will
be approximately 77.7 feet from the BVW at its closest point.
Work within the 100-foot buffer zone will consist of the portion of the dwelling, associated
grading, and roof-drainage improvements. Roof runoff will be directed to subsurface drywells.
The proposed limit of work will be approximately 60.2 feet from the BVW at its closest point.
Disturbed areas will be stabilized and revegetated upon completion. No work is proposed within
the BVW or the 50-foot undisturbed buffer. The driveway and subsurface sewage disposal
system will be located outside the 100-foot buffer zone.
Resource-Area Impact and Chapter 704 Compliance
The project retains a continuous natural 50-foot undisturbed buffer between the BVW and the
proposed limit of work. The limit of work is approximately 60.2 feet from the BVW, and the
dwelling foundation is approximately 77.7 feet from the BVW at their closest points. Because
the existing 50-foot undisturbed buffer will remain intact, no buffer-zone enhancement or
mitigation planting is proposed with this filing.
Construction Methods
Anticipated equipment includes an excavator, skid-steer loader, concrete truck, a dumpster, and
other conventional residential construction equipment as may be necessary. Equipment will
access the site directly from Whistleberry Drive. Equipment, materials, and stockpiles will
remain within the approved upland work staging areas. Fueling, maintenance, and storage of
petroleum products will occur offsite.
Excavated material will be contained within the delineated work area, and surplus soil and
construction debris will be removed from the property. Disturbed areas will be restored to plan
grade and permanently stabilized. Roof runoff and other clean stormwater will be directed to
subsurface drywells to avoid erosion and concentrated flow at the buffer.
Erosion Controls and Work Limits
Before excavation or other land disturbance begins, the proposed work area will be staked, and a
continuous silt fence will be installed along the limit of work identified on the site plan. The silt
fence will serve both as the sediment-control barrier and as the construction limit and will remain
outside the 50-foot buffer to the BVW. No equipment, materials, excavated soil, stockpiles, or
construction debris will be placed beyond the limit of work barrier.
The silt fence will be inspected and maintained throughout construction, and accumulated
sediment will be removed as necessary. Any erosion or sediment migration will be corrected
promptly. The barrier will remain in place until disturbed soils are permanently stabilized and
will be removed only after site stabilization and any required inspection or authorization by the
Conservation Commission or its staff.
Conclusion
The proposed project avoids all alteration of the BVW and retains a continuous natural 50-foot
undisturbed buffer consistent with the performance standards of Chapter 704. The defined limit
of work, temporary erosion controls, controlled construction access, subsurface roof-runoff
infiltration, and permanent stabilization will protect the BVW during and after construction.
Accordingly, the proposed work will not adversely affect the wetland interests protected by the
Massachusetts Wetlands Protection Act, 310 CMR 10.00, Chapter 237, or Chapter 704. The
applicant respectfully requests that the Barnstable Conservation Commission approve the project
and issue an Order of Conditions.
