General Overview The Town of Barnstable (Town) is submitting this Notice of Intent (NOI) and supporting documentation to obtain authorization to conduct ongoing maintenance dredging at the Blish Point Boat Ramp. Sediment shoaling has developed along the northern portion of the boat ramp and access channel, restricting vessel access during lower tidal conditions and creating a navigational hazard for boaters. Periodic maintenance dredging is necessary to maintain safe navigation and public access to Commonwealth waters. Recent survey data indicates that approximately ±175 cubic yards (CY) of sediment have accumulated within the authorized dredge area and requires removal. The proposed project consists of mechanically dredging the accumulated sediment from the existing boat ramp and access channel to previously authorized grades and depths. Dredged material will be transported offsite to an approved upland disposal facility. Figure 1 provides a site locus of the proposed dredge area. Figure 1: Project Locus The Barnstable Harbor Mid-Entrance Channel and Blish Point Boat Ramp Access Channel were recently dredged by the Town in January 2026. Maintenance dredging of the entrance channel and boat ramp are frequently required and performed on a ±5-year and ±3-year basis by the Town, respectively. A total of ±2343 cubic yards (CY) of sediments was mechanically dredged and disposed at Childs Reclamation Facility at 131A or 141 Great Western Rd in Dennis, depending on chemistry. PROPOSED DREDGE AREA NOTICE OF INTENT Foth•4 BARNSTABLE BLISH POINT BOAT RAMP MAINTENANCE TOWN OF BARNSTABLE, MA Prior to the 2025 maintenance dredging event, approximately 5,500 cubic yards (CY) of sediment were mechanically dredged from Barnstable Harbor navigation areas in 2021 and disposed of at the Cape Cod Bay Disposal Site (CCBDS). The Outer Entrance Channel was subsequently dredged in 2022, with compatible sandy material transported to Sandy Neck Beach for beneficial reuse as beach nourishment. The Blish Point Boat Ramp Access Channel was first dredged by the Town as a navigation improvement project during the 2012-2013 season. A total of 342 CY of sediments were removed using mechanical methods as part of this effort. Although the boat ramp access channel is typically maintained on an approximate three-year cycle, sediment has accumulated since the 2025 dredging event, resulting in reduced water depths and impaired navigability within the boat ramp area. The observed shoaling has created conditions that restrict vessel access and warrants additional maintenance dredging to restore safe use of the facility. For this proposed dredging event, the Town seeks authorization to mechanically dredge the Blish Point Boat Ramp and Access Channel to previously authorized depths as needed to restore navigability. Approximately ±175 CY of sediment will be removed and transported to an approved upland disposal facility. Construction is anticipated to begin in Fall 2026 and will be completed subsequently, when the ramp shows signs of more sand deposition. 1.1 Site Description Barnstable Harbor is located on the north side of Cape Cod, MA and directly connects to the rest of Cape Cod Bay. The Sandy Neck Barrier Beach System ACEC (Area of Critical Environmental Concern) contains most of Barnstable Harbor but does not extend past the Blish Point Boat Ramp heading inbound. The site experiences a 10–12-foot tide swing, thus massive amounts of water are exchanged throughout the harbor daily. The large tide swing accompanied by coastal storms have the ability to transport quantities of sediment, with the finer sands and silts settling out in the mid-entrance and inner harbor area. Navigational concerns of shoaling at the boat ramp and poor navigability at low to mid-tide were identified by the local Harbormaster. A combined hydrographic and topographic survey was conducted on June 18th, 2026, to assess existing depths at the boat ramp and confirmed the need for additional maintenance dredging. The Blish Point Boat Ramp is located Off Route 6A, 329 Millway Road in Barnstable MA and is one of the busiest boat ramps on the north side of the Cape. The proposed maintenance area is approximately 93 feet long by 53 feet wide, as the shoal currently sits. The exact dimensions and volumes will vary event to event. Approximately ±175 CY of sediments are proposed to be removed from boat ramp and access channel, for the first event. The Project Site is located within Zone AE El. 12 (17.67 feet MLLW) on Map 25001C0394J (eff. 7/16/2014). FEMA Flood Insurance Rate Maps for the project can be found in Exhibit D. The tidal datum for this project has been established using NOAA’s VDatum Online, Version 4.5.1, as follows: Mean Lower Low Water (MLLW) = 0.0 feet; Mean Low Water (MLW) = +0.28 feet; Mean NOTICE OF INTENT Foth•5 BARNSTABLE BLISH POINT BOAT RAMP MAINTENANCE TOWN OF BARNSTABLE, MA High Water (MHW) = +9.91 feet; and Annual High Tide Line (AHTL) = +12.54 feet. The conversion between the North American Vertical Datum of 1988 (NAVD88) to MLLW is +5.67 feet. 1.2 Project Need & Purpose The purpose of the proposed project is to obtain the necessary regulatory approvals to conduct maintenance dredging at the Blish Point Boat Ramp. Since the completion of the 2025 dredging event, sediment has accumulated within the boat ramp area, resulting in shallower water depths and reduced navigability. The proposed dredging is necessary to restore adequate water depths and maintain safe and reliable vessel access to the facility. The project will consist of mechanical dredging of the existing boat ramp to previously authorized depths to clear the sediment away from the existing boat ramp. As in past maintenance events within the Barnstable Harbor Mid-Entrance Channel & Blish Point Boat Ramp Access Channel, dredge sediments are not anticipated to be suitable for beneficial reuse. Dredge Sediments are expected to be suitable for upland disposal at an approved facility. The last maintenance dredging of the Mid-Entrance Channel was completed by the Town in January 2025. This effort was necessary to removed shoaling that had occurred since the last dredging event in 2021. A hydrographic survey of the boat ramp was performed on June 18th, 2026, approximately 6 months after the last dredging event. As shown on the Dredge Plan included in Exhibit E, sediment has again accumulated within the boat ramp area, resulting in reduced navigable depths and impacting safe vessel access and operation. The proposed maintenance dredging will restore the boat ramp to its previously authorized condition and ensure continued public use of the facility. 1.3 Scope of Work The proposed maintenance dredging area is based on the extent of sediment accumulation present at the time of dredging and is currently estimated to be approximately 93 feet long by 53 feet wide. The dimensions of the dredge area and resulting dredge volumes are expected to vary from event to event depending on the location and extent of shoaling. For this maintenance dredging event, approximately 175 cubic yards (CY) of sediment are proposed to be removed from the Blish Point Boat Ramp and Access Channel to restore the facility to its intended operational condition. This channel was first dredged by the Town in 2012-13 to improve navigable access from the Blish Point Public Access Boat Ramp to the Barnstable Harbor Entrance Channel. The proposed maintenance dredging of the Boat Ramp will be performed within authorized limits and depths using mechanical methods with dredging being performed to -6 feet Mean Lower Low Water (MLLW) and including a 1-foot allowable over depth (OD) to -7 feet MLLW, 3H:1V sideslopes, and a 5H:1V boat ramp slope. Sediments removed from the maintenance dredging last conducted in 2025 were too fine-grained to be beneficially reused for the purpose of nourishment. In the 2025 dredge event, sediments were suitable for the Robert Child’s Waste Reclamation Facility. As shown on the Permit Plans provided in Exhibit E, and Figure 3 below, the northern portion of the Boat Ramp has filled-in, and there is very limited water depth existing during periods of low tide. The proposed maintenance dredging of the boat ramp access channel is anticipated to consist of an estimated ±175 cubic yards (CY), 5H:1V boat ramp slope, and 3H:1V side slopes NOTICE OF INTENT Foth•6 BARNSTABLE BLISH POINT BOAT RAMP MAINTENANCE TOWN OF BARNSTABLE, MA Figure 3: View of Severe Shoaling at Blish Point Boat Ramp before low tide on April 15, 2026 The prior Order of Conditions was closed out following the completion of the Mid-Entrance Channel and Boat Ramp dredging in 2025. The existing Chapter 91 Dredge Permit will remain valid and authorizes the boat ramp work until 2036. The USACE permit was issued for a single dredge event; however, the Corps and MassDEP 401 Water Quality Certification Program are working on modifications to allow for the continued ramp maintenance as proposed herein. Sediments will be analyzed for grain size and if necessary, chemistry testing will be performed prior to final upland disposal. For each disposal event, the Town will pursue MADEP confirmation that the sediments are suitable for the final upland disposal. Sediment Sampling for the 2025 dredge event occurred on April 30, 2025, and is described below in Section 2.1. Copies of all record permits are provided in Exhibit I. 2. Site Usage and History Based upon record documents research and information found to be available for the Barnstable Harbor region, the Entrance Channel was first dredged under MA DPW Contract #535 in 1938. Subsequent dredging efforts were performed by the State in 1962 (MA DPW Contract #2376), 1974 (MA DPW Contract #2779) and 1998 (MA DEM Contract #3356-D). Following the 1998 event by the State, the Town assumed the direct responsibility for performing maintenance dredging during the 2005-06, 2008-09, 2015-16 and 2016-17 seasons with the most recent effort being completed in January 2021. The existing 6-foot-deep Entrance Channel in its’ entirety is 60 feet wide, 2,080 feet long and commences from just south the Blish Point Public Access Boat Ramp and extends seaward into Barnstable Harbor. The Entrance Channel is sub-divided into “Outer” and “Mid” sections due to the physical characteristics of dredge sediments. Outer Entrance Channel sediments have historically consisted of beach quality sand suitable for the purpose of beneficial reuse as nourishment at Town-owned beaches which have included Millway Beach, Sandy Neck Public Beach and the Sandy Neck Cottage Area. Sediments within the Mid-Entrance Channel and Boat Ramp have historically yielded clean (uncontaminated) sediments that have been too fine-grained for beneficial reuse along beach areas, so they were pumped/stored in the nearby Blish Point Dredge Spoil Containment Basin (BPDSCB) from the 1970s through 2009. This sediment disposal option, however, became unavailable due to storm damages/erosion that NOTICE OF INTENT Foth•7 BARNSTABLE BLISH POINT BOAT RAMP MAINTENANCE TOWN OF BARNSTABLE, MA occurred to the dune that housed the BPDSCB during the winters of 2012 and 2013. In 2017, the Town obtain authorization for sediments to be disposed at CCBDS. The maintenance dredging of the Boat Ramp and Mid-Entrance Channel was last authorized under the regulatory approvals identified in Table 1 below. 2.1 Sediment Sampling and Analysis Sediment sampling and analysis were previously conducted within the Blish Point Boat Ramp and adjacent navigation areas as part of the Town's maintenance dredging program for the most recent dredging event. Sampling was completed in coordination with the U.S. Army Corps of Engineers (USACE) and the Massachusetts Department of Environmental Protection (MassDEP), and the collected sediments were evaluated for disposal suitability. Based on the analytical results, the dredged material was determined to be suitable for placement at the Cape Cod Bay Disposal Site (CCBDS) and at approved upland disposal facilities. The four sample locations showed no stratification upon processing the cores. Cores were collected and processed following Foth’s Standard Operating Procedure for New England Vibrocore Sediment Sampling. Field classification (ASTM-D2488) resulted in a predominately sandy silt at the Boat Ramp (BH-2) and marine silt with organics in the Mid-Entrance Channel (BH- 1, BH-3, & BH-4). This material consists of sediment that repeatedly shoals into the same dredge footprint from the surrounding harbor system. The physical characteristics of the material are anticipated to remain generally consistent between maintenance dredging events. Accordingly, grain size analyses will be conducted during each dredging cycle to verify sediment characteristics, while additional chemical testing will be performed as required by the contractor performing the work and approved by MassDEP and the receiving facility. The collection of vibrocore samples during every maintenance dredging event would represent a significant cost to the Town and is not expected to provide substantially different results given the recurring nature and source of the shoaled material. Prior to final disposal, dredged material will be transported to an approved upland facility where it will be binned or stockpiled with erosion controls, sampled as necessary, and evaluated for appropriate management. The Town's preferred disposal location is the Robert Childs Waste Reclamation Facility in South Dennis, Massachusetts. The facility maintains designated areas for the management of both clean sediments and material requiring additional handling or controls. Final placement of the dredged material will be determined based on the results of facility acceptance testing and applicable regulatory requirements. 3. Dredge Site History A comprehensive research effort through the Barnstable Conservation Commissions, MA Department of Conservation & Recreation Office of Waterways (DCR Waterways), the MADEP (401 Water Quality Certification and Chapter 91 Waterways Program) and the USACE has been conducted to determine the site history as it relates to previous dredging events. Table 1 presents a historical summary of the available record documents and permits associated with the site, while Table 2 summarizes all permits and authorizations that will remain active at the time of this application. Dredging of the channel and boat ramp was most recently authorized in 2025 and completed in January 2026. While the most recent U.S. Army Corps of Engineers (USACE) authorization was issued as a one-time dredging event, the Town is currently coordinating with the USACE to modify the permit to allow future maintenance dredging of the boat ramp and access channel on an as-needed basis to address recurring shoaling and maintain safe navigational access. Copies of available record documents presented in Table 1 are provided in Exhibit G. Current Permit Plans shown in Table 2 are provided in Exhibit F. NOTICE OF INTENT Foth•9 BARNSTABLE BLISH POINT BOAT RAMP MAINTENANCE TOWN OF BARNSTABLE, MA 3.1 Alternatives Analysis 3.1.1 Dredging Alternatives “No Dredge Alternative” Under the “No Dredge” alternative, no dredging would occur within Barnstable harbor, thus promoting the continued deterioration of public access of the channel and boat ramp, and safe navigation within the waterway. Shoaling would continue to increase the potential for vessel groundings, spills and/or release(s) of other hazardous materials into the harbor. The bottom sediment would continue to be disrupted by vessels transiting over shoaled areas resulting in resuspension of sediment to the water column. Accordingly, the “No Dredge” alternative is not considered a viable option for the Town. Improvement or New Dredging Improvement Dredging consists of deepening the channel to allow for deeper draft vessels, while New Dredging would include deepening and/or widening the channel to increase capacity, improve maneuverability, and allow for larger vessels to use the harbor. The current authorized limits and depths of the Boat Ramp Facility are adequate for the uses and needs of the boating community that use the harbor, when those depths are available. Widening and/or deepening the channel could negatively impact the surrounding coastal resource areas and infrastructure over time. It should be noted that the Town and Commonwealth of Massachusetts are actively pursuing a long-term solution for the rapid infill at the facility. Maintenance Dredging of Blish Point Boat Ramp & Access Channel The preferred dredging alternative will restore navigation and public access to/from The Blish Point Boat Ramp by maintaining the previously authorized depths and limits of the existing channel and the ramp itself. The current navigational depths and limits of these channels adequately support vessel sizes and drafts, and therefore, the Town is not seeking to widen or deepen these channels and wishes to perform dredging of both proposed areas. Side Slope Alternatives The Barnstable Habor Blish Point Boat Ramp Access Channel has historically been maintained with 3H:1V side slopes, as have most channels throughout the Cape. A 3H:1V slope is typical for dredge prisms, since the natural angle of repose for saturated sand is between 15 and 30 degrees. This allows the dredge to dig within the dredge prism, from toe-to-toe, without digging up the slope. As sand is removed from the toe, the slope is allowed to find its natural state as material sluffs in. If required, the dredge can clean up the toe with a final pass. An alternate 2H:1V side slope in design would not be constructible as the sands on the banks would naturally fall to a ~3H:1V slope. A more gradual slope of 4H:1V or greater are also not feasible for this project as the slope projection may impact important natural resource areas or undermine nearby structures such as jetties and marina infrastructure. Additionally, a 4H:1V would be difficult to construct and would require dredging outside of the toe of the channel. The boat ramp will be maintained to its existing 5H:1V configuration, with the work restoring access to the previously constructed and permitted boat ramp structure. NOTICE OF INTENT Foth•10 BARNSTABLE BLISH POINT BOAT RAMP MAINTENANCE TOWN OF BARNSTABLE, MA 3.1.2 Sediment Disposal Alternatives Analysis Based on the field soil classification from the April 30th, 2026 sediment sampling, the physical characteristics of sediments found within the boat ramp area consist of mostly sand with some fine-grained sediments mixed in. Due to the percentage of fine-grained sediments, the material will not be suitable for the purpose of nourishing local beaches through direct placement or in- water disposal at an authorized nearshore location. Furthermore, fine-grained sediments are also not anticipated to be suitable for reuse as structural fill. Therefore, beach nourishment, nearshore disposal or upland reuse as structure fill are not considered to be a viable reuse/disposal alternatives for the proposed project. Unconfined Offshore Disposal at CCBDS The Cape Cod Bay Disposal Site is an offshore disposal ground for dredged material that is unsuitable for beneficial reuse. The site is located in the central region of Cape Cod Bay (see Figure 4) and requires specialized bottom-dumping scows. In order to authorize such disposal, the Town would need to submit a Request for Sediment Sampling and Analysis Plan to the USACE, test the material under USACE and EPA protocols, and then wait to receive a positive or negative Suitability Determination. The sampling and testing process is not economically feasible, nor is the act of employing the heavy equipment, tug boats, and scows needed to complete the work feasible for the volume of material proposed to be disposed. Figure 4: Cape Cod Bay Disposal Site (CCBDS) Locus NOTICE OF INTENT Foth•11 BARNSTABLE BLISH POINT BOAT RAMP MAINTENANCE TOWN OF BARNSTABLE, MA Upland Disposal The Town of Barnstable has performed multiple successful projects utilizing the Cape’s upland disposal sites. Recently in January 2026, AGM Marine Contractors, Inc. successfully dredged +/. 2,500 CY of material from the Boat Ramp and Mid-Entrance Channel, dewatered the sediments in a scow, and transloaded the material into dump trucks for final disposal. For the proposed ongoing maintenance of the Boat Ramp, the Town prefers to perform the work by land, using a long reach excavator. The material will be temporarily stockpiled within the ramp and work footprint to be dewatered to the best extent practicable prior to loading into sealed tri-axle trucks. The proposed upland disposal sites include the Robert Childs Waste Reclamation Facility located in South Dennis. Both sites will likely be able to beneficially use the dredged sediments. The project is not limited to these two sites as the Town is continuously looking for beneficial use options for fine-grained sediments. The suitability for upland sediment reuse/placement will be determined through the MADEP 401 WQC review process. Sediment Sampling and Analysis has been conducted in accordance with the USACE SAP and MADEP 401 Water Quality Certification Regulations for Discharge of Dredged or Fill Material, Dredging, and Dredged Material Disposal in Waters of the United States within the Commonwealth (314 CMR 9.00). 3.2 Avalible Bathymetric and Topographic Information Foth Infrastructure & Environment, LLC (Foth) performed bathymetric surveys at the project site on June 18th, 2026. The data collected from each event has been incorporated into the dredge plan provided in Exhibit E. All data presented is relative to MLLW datum. 4. Dredging & Disposal Operation The Town’s objective for the proposed project is to secure all regulatory approvals required for the dredging, dewatering as required, and upland disposal of the Barnstable Blish Point Boat Ramp and Access Channel sediments so that construction can as needed. Dredging will be performed using mechanical methods, (i.e. long reach excavator) for the Blish Point Boat Ramp and Access Channel. The excavator will be adequately sized for the work, and will utilize an appropriate sized bucket. Dredged sediments will placed within the proposed work area for dewatering and then will be loaded into sealed tri-axle dump trucks for transport. Dredging rates will be balanced with dewatering rates such that effluent returning to the harbor does not flow excessively. Siltation barriers, such as hay bales, may be required around the temporarily stored material should the effluent increase turbidity. Since the majority of the work is proposed to occur during the low tide cycles, turbidity will be limited to those hours of the day, and is anticipated to return to normal conditions upon the higher tides. The proposed dredging will consist of a total removal of up to 175 CY from the Boat Ramp Access Channel and Boat Ramp. The Town may elect to self-perform the some of the removal of material from the ramp. NOTICE OF INTENT Foth•12 BARNSTABLE BLISH POINT BOAT RAMP MAINTENANCE TOWN OF BARNSTABLE, MA The material is proposed to be reused at the Robert Childs Reclamation Facility in South Dennis, MA. At the facility, the material will be “binned” or stockpiled with appropriate sediment containment until sediment testing is completed. Testing results will be shared with MassDEP for review prior to final disposal at the facility’s various handling areas. 5. Regulatory Approvals Based upon review of the collective site history and previously authorized work presented in Table 1 (See Section 3, Dredge Site History), the activities to be authorized for the proposed project are considered to be maintenance since all dredging will be performed within the previously established/authorized vertical and horizontal limits. The following permits/approvals are anticipated to be required for the proposed Barnstable Blish Point Boat Ramp Maintenance Dredging Project: • Order of Conditions from Barnstable Conservation Commission • MA DCR Construction Access Permit (In Progress) • MA DEP 401 Water Quality Certification Amendment (Received 7/23/26) • MA DEP Chapter 91 Waterways Permit (Current) • U.S. Army Corps of Engineers (USACE) Permit Modification (In Progress) 6. Performance Standards to Avoid, Minimize and Mitigation Impacts to Coastal Resource Areas & Habitat The proposed project is a water-dependent project that has been designed, and will be performed, using the best available measures to minimize adverse impacts to coastal resource areas. The following coastal wetland resource areas have been identified within the vicinity of the project area as defined under the Massachusetts Wetland Protection Act (MA WPA) and per M.G.L. c. 131 sec 40 and Regulations 310 CMR 10.00: Land Under the Ocean (LUO), Land Containing Shellfish (LCS), and Coastal Beach. Coastal resources areas are delineated on the Permit Plans provided in Exhibit E. In terms of USACE jurisdiction, the entire dredging aspect of the project lies within Waters of the United States, as in, land below and seaward of the annual high tide line. Disposal only occurs in Waters of the U.S. if the CCBDS is approved and utilized for the project. Pursuant to 310 CMR 10.00, the above listed coastal resource areas are to be regulated in order to contribute to the following public interests: • Flood control; • Storm damage prevention; and/or • Protection of marine fisheries and wildlife habitat. The proposed project will restore and enhance safe public use and navigable access at the Barnstable Blish Point Boat Ramp and Access Channel as required to continue to support commercial and recreational uses. The paragraphs presented below provide the following information: NOTICE OF INTENT Foth•13 BARNSTABLE BLISH POINT BOAT RAMP MAINTENANCE TOWN OF BARNSTABLE, MA • Identification and definition of each coastal wetland resource areas to be permanently or temporarily impacted by proposed activities; • An assessment of the magnitude of anticipated impacts from proposed activities on each coastal wetland resource area; and • Discussion on how proposed activities meets the performance standards for each coastal wetland resource area impacted.  LAND UNDER THE OCEAN (310 CMR 10.25) Land Under the Ocean (LUO) is defined as “land extending from the mean low water line seaward to the boundary of the municipality’s jurisdiction and includes land under estuaries”. LUO, particularly the nearshore area, is presumed significant to the protection of marine fisheries, protection of wildlife habitat, storm damage prevention and flood control (310 CMR 10.25). Table 2 below presents a summary of volumes removed and areas impacted from dredging within LUO. The limits of LUO located within the project site are shown on the Permit Plans provided in Exhibit E. Table 3: Summary of Impacts to Land Under Ocean (LUO) from Proposed Dredging of The Barnstable Harbor Mid-Entrance Channel and Blish Point Boat Ramp Access Channel LOCATION PROPOSED WORK PROP. According to 310 CMR 10.25 (4), “maintenance dredging for navigational purposes affecting land under the ocean shall be designed and carried out using the best available measures so as to minimize adverse effects on such interests caused by changes in productivity which will result from the suspension or transport of pollutants, increase in turbidity, the smothering of bottom organisms, the accumulation of pollutants by organisms, or the destruction of marine fisheries habitat or wildlife habitat”. Short-term/minimal increases in turbidity and suspended solids are expected to occur during the time of active dredging due to the physical make up of sediments which is anticipated to fine grained silts and sands. Given the limited duration that it will take for the dredging to be completed, it is expected that any increase in turbidity and suspended solids will be short in duration and temporary. Dredging will also occur around lower tide cycles, therefore the site will be flushed daily. Accordingly, turbidity levels/impacts are expected to be limited and minimal. Dredging NOTICE OF INTENT Foth•14 BARNSTABLE BLISH POINT BOAT RAMP MAINTENANCE TOWN OF BARNSTABLE, MA will also help reduce turbidity over the long-term by minimizing the potential for vessel groundings and propeller wash (or scouring). In accordance with 310 CMR 10.25 (6), the proposed project has been designed and will be constructed using the best available measures so as to minimize adverse effects on marine fisheries habitat or wildlife habitat as follows: • Water Circulation: Water circulation is created by the tidal exchange and currents that exist within Barnstable Harbor and Cape Cod Bay. Dredging is expected to improve the overall water circulation through the increased tidal exchange that will occur through the removal of the shoals. The proposed project is not expected to have any long-term negative effects on water circulation or the overall hydrological or littoral processes. • Destruction of Eelgrass or Widgeon Grass Beds: Based upon review of available MA GIS information, eelgrass (Zostera marina) is not expected to be present within the project site. The closest MA DEP mapped area is over four and a half miles to the east of the Barnstable Harbor Entrance Channel, therefore, the proposed dredging and disposal of dredge sediment is not expected to result in impacts to eelgrass. • Distribution of Sediment Grain Size: Dredging will not alter the sediment quality in the project area. The sediments that will be removed by the proposed dredging have accumulated over time from the dynamic natural littoral process and currents that exist within the harbor and Cape Cod Bay. • Water Quality: Short term increases in turbidity and suspended solids are expected to occur during the time of active dredging. However, given the nature of the material anticipated to be dredged from the navigation channel and the limited duration of the project, it is expected that the increases in turbidity and suspended solids will be short- term and temporary. The daily tidal exchange will naturally help maintain water quality throughout construction. Water quality is anticipated to improve following the completion of dredging since there will be a reduction in potential for turbidity resulting from vessel/float groundings and vessel propeller wash (or scouring). • Shallow submerged lands with high densities of polychaetes, mollusks or macrophytic algae: The project site is not known to support high densities of polychaetes, mollusks or macrophytic algae.  COASTAL BEACH (310 CMR 10.27) Coastal Beach is unconsolidated sediment subject to wave, tidal and coastal storm action that forms the gently sloping shore of a body of salt water and includes tidal flats (310 CMR 10.27). Coastal Beaches extend from the MLW line landward to the dune line, coastal bank line or the seaward edge of existing man-made structures, when these structures replace one of the above lines, whichever is closest to the ocean. Coastal Beaches may play an important role in storm damage prevention, flood control and the protection of marine fisheries similar to LUO. They may also be significant to the protection of Land Containing Shellfish when shellfish are present. Coastal Beaches may reduce wave energy, and natural beaches provide sediment to LUO, which serves as a buffer to storm waves. Table 3 below presents a NOTICE OF INTENT Foth•15 BARNSTABLE BLISH POINT BOAT RAMP MAINTENANCE TOWN OF BARNSTABLE, MA summary of volumes removed and areas impacted from dredging within Coastal Beach. The limits of Coastal Beach located within the project site are shown on the Permit Plans provided in Exhibit E. Table 4: Summary of Impacts to Coastal Beach from Proposed Dredging of The Barnstable Harbor Mid-Entrance Channel and Blish Point Boat Ramp Access Channel LOCATION PROPOSED WORK PROP. DREDGE DEPTH (FT MLLW) TOTAL VOLUME REMOVED FROM COASTAL BEACH (CY) TOTAL COASTAL BEACH AREA IMPACTED (SF) Boat Ramp and Access Channel Maintenance Dredging -6.0’ w/ 1’ O.D. ±128 ±1534 *The Blish Point Boat Ramp dredge area will be dredged with 5H:1V side slopes *The Boat Ramp Access Channel will be dredged with 3H:1V side slopes *O.D. = Allowable Over depth MAINTENANCE DREDGING All anticipated impacts resulting within Coastal Beach are anticipated to occur within the intertidal zone (between MLW and MHW). Intertidal dredging is only proposed within the Boat Ramp and Boat Ramp Access Channel (including the sideslopes) and is a result of in-filling that has occurred in the vicinity of the ever-dynamic Millway Beach and Barnstable Harbor area. To properly maintain the full limits of the authorized the Barnstable Blish Point Boat Ramp and Access Channel, intertidal dredging is considered to be a necessary component associated with the periodic maintenance required to sustain safe navigation and public use/access of the waterway. Land-based equipment required for mechanical dredging and management of the boat ramp will occur within Coastal Beach. All temporary construction features and construction access will be returned to pre-construction conditions when dredging activities are completed. As described below, the Coastal Beach areas affected by the proposed maintenance dredging do not significantly alter the resource area’s ability to provide storm damage prevention/protection, flood control or to protect marine fisheries or wildlife habitat: Storm Damage/Flood Control • Volume (Quantity of Sediments) and Form: The proposed dredging will increase flood storage capacity. • Ability to Respond to Wave Action: Dredging will not result in a change in wave heights/velocities impacting the shoreline or compromise the ability of the resource area to respond to wave action. Protection of Marine Fisheries or Wildlife Habitat • Distribution of Grain Size: Dredging will not significantly alter the sediment quality within the Barnstable Harbor and Blish Point Boat Ramp Access Channel area. Sediments removed from the Boat Ramp and Access Channel consists of sand that will be placed at NOTICE OF INTENT Foth•16 BARNSTABLE BLISH POINT BOAT RAMP MAINTENANCE TOWN OF BARNSTABLE, MA an upland disposal site. Dredge sediments have been determined to be compatible with existing site conditions. • Water Circulation: The proposed dredging will not impact water circulation, resulting in an adverse change in flushing rate, temperature, or turbidity levels. The water circulation within the project area is primarily a result of tidal flushing. The proposed dredging will not affect flushing rates or temperature. • Water Quality: Turbidity and the re-suspension of solids are anticipated to be minimal and temporary due to the sediments consisting primarily of a well-graded sand with some gravel. Hydraulic dredge methods will also help minimize the occurrence of turbidity, and water quality is anticipated to improve following the completion of work since the potential for turbidity resulting from vessel groundings and propeller wash (or scouring) will be reduced. • Relief and Elevation: The proposed dredging will result in a minor modification along the shoreline; however, it will also result in a significant reduction in the potential for vessel groundings and propeller wash (or scouring). Storm Damage Prevention, Flood Control or Protection of Wildlife Habitat • Increasing Erosion: Dredging will not result in a change in wave heights/velocities, and as such, it will not increase erosion. • Decreasing Volume: Dredging will not result in a significant volume loss within Coastal Beach. Accordingly, the ability for Coastal Beach to provide storm damage, flood control or protection to wildlife will virtually remain unaffected. • Changing Form of Any Coastal Beach or an Adjacent or Downdrift Beach: Dredging of the boat ramp access channel and removal of sediment covering the concrete boat ramp will have temporary impacts to the adjacent Millway Beach, as it stabilizes over time.  LAND CONTAINING SHELLFISH (310 CMR 10.34) Land Containing Shellfish (LCS) is defined as “land under the ocean…when any such land contains shellfish”. Land Containing Shellfish shall be found significant when it has been identified and mapped as follows: by the Conservation Commission or the Department in consultation with DMF and based upon maps and designations of DMF; or by the Conservation Commission or the Department based on maps and written documentation of the shellfish constable or the Department. In making such identification and maps, the following factors shall be taken into account and documented: the density of shellfish, the size of the area and the historical and current importance of the area to recreational or commercial shellfishing. According to the most current available MA GIS data pertaining to MA DMF mapped suitable shellfish habitat, the proposed dredging at The Barnstable Blish Point Boat Ramp Access Channel may be located within LCS. It is noted that areas mapped by MA DMF include sites where shellfish have historically been sighted, but may not currently support any shellfish. The shellfish suitability areas were not verified in the field and the boundaries were not surveyed. Accordingly, this information should be used only as a guide to the approximate locations of NOTICE OF INTENT Foth•17 BARNSTABLE BLISH POINT BOAT RAMP MAINTENANCE TOWN OF BARNSTABLE, MA potential habitats. Areas of mapped LCS are currently designated as approved for shellfish harvesting areas according to available data from MA GIS. Impacted areas of mapped LCS include areas that have been previously authorized/dredged and nourished are considered to be Routine Maintenance which occurs periodically. Dredging within LCS is necessary to remove sediments that have migrated into the established navigation areas primarily from sediment transport caused by storm events and currents in Barnstable Harbor and Cape Cod Bay. Accordingly, it is reasonable to assume that LCS areas impacted by dredging will readily self- recolonize over time. Details pertaining to the quantity and assessment of potential LCS impacts resulting from dredging activities are presented in Table 4 below. The limits of LCS located within the project site are shown on the Permit Plans provided in Exhibit E. Table 5: Summary of Impacts to Land Containing Shellfish (LCS) from Proposed Dredging of The Barnstable Harbor Mid-Entrance Channel and Blish Point Boat Ramp Access Channel LOCATION PROPOSED WORK PROP. All dredging and disposal activities will be performed during the TOY established by permits. Although a “No Dredge” alternative would result in no environmental impacts, there is a potential for environmental impacts resulting from vessel ground-outs along the shoaled in areas present on the Blish Point Boat Ramp. Not only do vessel ground-outs present the potential for oil spills or release of other hazardous materials into the harbor, they result in an increase of turbidity within the water column from the resuspension of sediments. Furthermore, a “No Dredge” alternative presents a public safety concern and diminishes public access to the waterways. The Contractor shall minimize impacts to coastal resource areas at all times during the proposed work. Anticipated impacts during construction are further assessed below: Effects on Marine/Wildlife Habitat: Through USACE Consultations with NOAA and FWS (initiated by the Town and included in Exhibits H and I) and with the MA DMF, the proposed project will ahere to any conditions required by the agencies. The work will be conducted during the time of year when marine and shoreline life is least active. Effects on Essential Fish Habitat: The proposed dredging operations are not expected to have any significant long-term negative effects on finfish inhabiting the vicinity of Barnstable NOTICE OF INTENT Foth•18 BARNSTABLE BLISH POINT BOAT RAMP MAINTENANCE TOWN OF BARNSTABLE, MA Harbor and Blish Point Boat Ramp. No eelgrass has been located within the vicinity of the project. Short term and temporary increases in turbidity/suspended solids are anticipated to occur during the time of active dredging. Biological Impacts: The proposed dredging is not expected to have significant cumulative impacts to the biological resources in the vicinity. Archeological and Historic Resources: No historical or archeological resources are expected to be found within the proposed dredging areas. Both the MA Historical Commission (MHC) and MA Board of Underwater Archaeological Resources (MA BUAR) will be notified of the project as part of the Army Corps of Engineers permit review process. Air Quality: No direct or indirect increases or other changes in local or regional air quality are likely to occur with construction of the proposed project. 7. Summary The Town of Barnstable is proposing to perform maintenance dredging within the existing limits of the Barnstable Blish Point Boat Ramp and Access Channel. Dredging is required to address shoaling, restore navigation and safe public access and use of the waterway. The proposed maintenance project will consist of dredging a total combined area of ±2721 square feet (SF) and an estimated ±175 CY of sediment, including a 5H:1V ramp slope and 3H:1V side slopes for the Boat Ramp Access Channel. The Blish Point Boat Ramp Access Channel will be restored to their previously authorized footprints to -6.0 feet Mean Lower Low Water (MLLW) with a one (1) foot allowable over depth to -7.0 feet MLLW. The Town is seeking to obtain all regulatory approvals in time for maintenance dredging of the Boat Ramp and Access Channel to be performed as needed. The proposed project has been designed so that all impacts have been minimized to the greatest extent feasible. In accordance with the provisions of Section 401 of the Federal Clean Water Act (33 U.S.C. § 1251 et seq.), M.G.L. c. 21, §§ 26-53, and 314 CMR 9.00, MassDEP has determined there is reasonable assurance the project or activity, as conditioned herein, will be conducted in a manner which will not violate applicable water quality standards (314 CMR 4.00) and other appropriate requirements of state law. The waters of this portion of the Project Drainage Area are designated in the Massachusetts Surface Water Quality Standards as Class SA. Such waters are intended “as excellent habitat for fish, other aquatic life and wildlife, and for primary and secondary contact recreation.” Antidegradation provisions of these Standards require that “existing uses and the level of water quality necessary to protect the existing uses shall be maintained and protected.” 401 WQC – Application # 25-WW08-0010-APP Barnstable Harbor Mid-Entrance Channel and Blish Point Boat Ramp 2 The above referenced project involves a dredge of the mid-entrance channel of Barnstable Harbor and Blish Point Boat ramp. This area of the Harbor is due for maintenance dredging due to shoaling within the channel creating a buildup of sediment making navigation of the channel difficult in low to mid-tide. In the Mid-Channel an area of over 955 by 60 linear feet, ± 1,837CY of sediment will be dredged. The dredge depth will be 6 feet beginning at Mean Lower Low Water (MLLW) with an extra foot of over dredge. The Blish Point Boat Ramp Access Channel is 24 x 85 LF and ± 506 CY will be dredged at Mean Lower Low water at 6 feet with an extra foot of over dredge. In both areas, dredging is set to be performed using mechanical methods with a barge mounted crane or excavator able to move within the channel widths. It may be performed with an environmental style bucket with mud flaps. Temporary turbidity curtains will be used to contain sediments within the harbor. Utilizing a filtration and water pump system, the sediment is to be offloaded at the contractor's facility of choice and then loaded onto sealed trucks to transport to the proposed upland use site, 131 Great Western Rd, Dennis, MA (See Condition # 19). Sediment Chemistry Results: Four sediment samples were collected and the analytical results were compared to MassDEP’s Interim Policy for Sampling, Analysis, Handling and Tracking Requirements for Dredged Sediment Reuse and Disposal (COMM-94- 007). All of the results were below the Reportable Concentration (“RC”) S-1 criteria of the Massachusetts Contingency Plan (“MCP”). Public Notice: The Permit Application public notice was published in the Cape Cod Times on 8/18/2025. No comments were received by MassDEP during the 21-day public comment period pursuant to 314 CMR 9.05(3)(e), which ended on 9/9/2025. Pursuant to 314 CMR 4.00, 314 CMR 9.05(1), 314 CMR 9.06(1), 314 CMR 9.06(2), 314 CMR 9.07(1), 314 CMR 9.07(2), 314 CMR 9.07(3), 314 CMR 9.07(7), 314 CMR 9.09(1), and 314 CMR 9.09(2), the following Special Conditions are necessary to ensure that sediment dredging and disposal practices are implemented in such a manner as to prevent water quality degradation and to maintain the chemical, physical, and biological integrity of the Waters of the United States within the Commonwealth. These conditions ensure that practicable steps are taken to avoid and minimize water quality impacts from turbidity and sedimentation associated with sediment dredging, disposal, and/or transportation. Therefore, based on information currently in the record, MassDEP grants a 401 WQC for this project subject to the following conditions to maintain or attain water quality, to minimize any damage to the environment that may result from the project, and to ensure compliance with appropriate provisions of state law. MassDEP certifies that there is reasonable assurance the project or activity, as conditioned herein, will be conducted in a manner which will not violate 401 WQC – Application # 25-WW08-0010-APP Barnstable Harbor Mid-Entrance Channel and Blish Point Boat Ramp 3 applicable water quality standards (314 CMR 4.00) and other appropriate requirements of state law. 1. The contractor shall take all steps necessary to ensure that the proposed activities will be conducted in a manner that will avoid violations of the anti-degradation provi- sions of the Massachusetts Surface Water Quality Standards, 314 CMR 4.00, that protect all waters, including wetlands. 2. Prior to the start of work, or for any portion of the work thereafter, MassDEP shall be notified of any change(s) in the proposed project or plans that may affect waters or wetlands. MassDEP will determine whether the change(s) requires a revision to this Certification. 3. Dredging in accordance with this 401 WQC may begin following the 21-day appeal period and once all other permits have been received. 4. All work shall be performed in accordance with the following documents and plans: • Application for # 25-WW08-0010-APP, dated 7/24/2025 with attachments. • Plan entitled “Exhibit E-NOI Permit Plans 20250529 Digital Stamp JAH,” consisting of 1 sheet, dated 5/29/2025, as revised through 7/10/2025, signed and stamped by James Hill (JH). • Email from Jimmy Hill, Foth Infrastructure & Environment, LLC, to Carissia Leal, MassDEP, dated September 12, 2025 5. MassDEP shall be notified, attention Carissa Leal carissa.m.leal@mass.gov and David Wong david.w.wong@mass.gov, one week prior to the start of in-water work so that MassDEP staff may inspect the work for compliance with the terms and conditions of this 401 WQC. 6. The term of the 401 WQC of the Permit remains in effect for the same duration as the federal permit that requires it. 7. During the project period, there shall be no discharge or spillage of fuel, oil, or other pollutants, including sediments, onto any part of the site. The applicant shall take all reasonable precautions to prevent the release of pollutants by ignorance, accident, or vandalism. 8. No later than four weeks after issuance of this 401 WQC, the applicant shall submit a notification procedure outlining the reporting process to MassDEP for incidents relating to dredging activities that impact surrounding resource areas and habitats including, but not limited to, observed dead or distressed fish or other aquatic organisms, observed oily sheen on the surface of the water, a sediment spill, a 401 WQC – Application # 25-WW08-0010-APP Barnstable Harbor Mid-Entrance Channel and Blish Point Boat Ramp 4 turbidity plume beyond the deployed Best Management Practices (“BMPs”), and a barge or equipment accident/spill. If at any time during implementation of the project such an incident occurs, the applicant shall immediately notify MassDEP and all site related activities impacting the water shall cease until the source of the problem is identified and adequate mitigating measures are deployed to the satisfaction of MassDEP. 9. Future maintenance dredging is not authorized under this 401 WQC. 10. No in-water or silt producing work, including, but not limited to dredging, shall occur from February 1st to June 30th of any year to protect winter flounder and horseshoe crabs.1 11. The top of the dredge slope will maintain a buffer of at least 25 feet from any bordering salt marsh to reduce the risk of slumping and erosion impacts to this resource.1 12. The top of the slope shall be no closer than 25 feet from the MLW line. Dredging the toe of the slope near the MLW line may result in the slumping of the intertidal habitat.1 13. The applicant, or its contractor, shall make every feasible effort to complete the project within the 401 WQC timeframe. Should the applicant, or their contractor, fail to complete the project and wish to request an amendment to the 401 WQC for incursion into the no-dredge period, the written request shall be received by MassDEP by January 1st. The following information shall be included in the request: a. project location and 401 WQC Application number, b. the date on which dredging started, c. the number of days and hours per day the dredge operated, d. expected daily average production rate and the actual daily average production rate, e. an explanation of why the project failed to remain on schedule, f. an account of efforts made to get the project back on schedule, g. a plan depicting the areas that remain to be dredged, h. the number of cubic yards that remain to be dredged, i. an accurate estimate of the number of days required to complete the project, j. an evaluation of the impact of continued dredging on the species of concern, k. a description of any efforts that will be made to minimize the impacts of the project on l. the species of concern, and a realistic assessment of any societal/financial effects of a denial of permission to continue dredging. 1 Conditions 10, 11 and 12 are recommended by the MA Department of Marine Fisheries in a letter dated July 21, 2025. 401 WQC – Application # 25-WW08-0010-APP Barnstable Harbor Mid-Entrance Channel and Blish Point Boat Ramp 5 MassDEP will share the information with other resource agencies and a decision to grant or deny the amendment shall be made by January 15th. Requests for amendment received after January 1st will be considered at MassDEP’s discretion. All equipment/machinery shall be stored above the Mean High Tide Line (MHTL) and outside any wetland resource areas when not in use. 14. BMPs such as a silt curtain shall be deployed surrounding the dredge area to minimize turbidity. At a minimum, the silt curtain shall be bottom weighted to minimize the degree of lifting/flailing and shall be of suitable material/grade based on the velocity of the current at the site. Intermediate vertical floats shall be placed on the silt curtain to lift the bottom of the silt curtain at low tide so that the bottom edges of the curtain remain close to the mudline at low tide but do not rake the sediment in areas subject to tidal influence. 15. Barge/scow overflow is prohibited both at the dredge site and within waters of the Commonwealth. 16. The dredge vessel and/or barge shall not be allowed to ground. 17. Disposal of any volume of dredged material at any location in tidal waters is subject to approval by MassDEP and the Massachusetts Office of Coastal Zone Management (“CZM”). Disposal of any volume of dredged material at any location in tidal waters, except as authorized herein, is not authorized by this 401 Water Quality Certification and would require a request for amendment that would be subject to approval by MassDEP and the Massachusetts Coastal Zone Management office. This condition is necessary to prevent any pollution of tidal water resources by discharge of dredged material. 18. No later than 21 days prior to commencement of dredging activity, a dredged material dewatering plan shall be submitted to MassDEP for review and written approval. The Division also received the MESA Review Checklist and supporting documentation for review pursuant to the MA Endangered Species Act Regulations (321 CMR 10.18). The Division has determined that the Project, as currently proposed, is located within the actual habitat for the state-listed species presented in the following table. These species and their habitats are protected pursuant to the WPA and the MESA. Fact sheets for state-listed species can be found at www.mass.gov/nhesp. Scientific Name Common Name Taxonomic Group State Status Charadrius melodus Piping Plover Bird Threatened* Sternula antillarum Least Tern Bird Special Concern Sterna hirundo Common Tern Bird Special Concern Sterna dougallii Roseate Tern Bird Endangered* *The Piping Plover and Roseate Tern are federally protected as “Threatened” and “Endangered”, respectively, pursuant to the U.S. Endangered Species Act (ESA, 50 CFR 17.11). NHESP No. 06-20720, Page 2 Generally in Massachusetts, these coastal birds can be found from April – September. Piping Plovers and Least Terns are ground-nesting shorebirds that will establish nests on sparsely vegetated, sandy areas of coastal beaches and dunes. Their nests are comprised of shallow depressions in the sand that may be lined with shell fragments or pebbles. Piping Plovers, terns and their nests are particularly vulnerable to predators, unleashed pets, and inadvertent human disturbance. After hatching, Piping Plover and Least Tern chicks are not capable of flight - 25-30 days for plovers and 21-25 days for terns - during this period these unfledged chicks will often range widely to either forage or seek shelter. The purpose of the Division’s review of the proposed project under the WPA regulations is to determine whether the project will have any adverse effects on the Resource Areas Habitats of state-listed species. The purpose of the Division’s review under the MESA regulations is to determine whether a Take of state-listed species will result from the proposed project. WETLANDS PROTECTION ACT (WPA) & MASSACHUSETTS ENDANGERED SPECIES ACT (MESA) Based on the information provided and the information contained in our database, it is the opinion of the Division that this project, as currently proposed, must be conditioned in order to avoid adverse effects to the Resource Area Habitats of state-listed wildlife species (310 CMR 10.37) and must be conditioned in order to avoid a prohibited Take of state-listed species (321 CMR 10.18(2)(a)). The following conditions must be met to protect state-listed species and their habitats: For all Beneficial Reuse at Sandy Neck Cottages & Sandy Neck Beach Nourishment Sites the following conditions must be implemented: 1. Time of Year Restriction: Beach nourishment or beneficial reuse of dredge sediments shall not be deposited upon the coastal beach or dune during the period of April 1 - September 15, to protect state-listed coastal birds. 2. Plantings: Vegetation shall not be planted and sand fencing shall not be erected in areas of beach nourishment, unless otherwise approved in writing by the Division. 3. State-listed Species Protection and Monitoring: The applicant has the responsibility of protecting breeding Piping Plovers and state-listed species of terns that may be attracted to beach nourishment areas, as well as their eggs and unfledged chicks. The applicant must implement a Division-approved monitoring and protection plan for nourishment sites for a minimum of three consecutive years following any nourishment activity. i. Each year, beginning April 1, a qualified shorebird monitor, approved by the Division, shall determine whether territorial, courting, or nesting Piping Plovers or state-listed species of terns are present at beach nourishment areas and if so, shall erect and maintain warning signs and symbolic fencing to protect nesting habitat, breeding adults, nests, and chicks from disturbance or human-caused mortality. These fenced areas shall be managed in accordance with the Massachusetts Division of Fisheries and Wildlife document of April 1993 titled Guidelines For Managing Recreational Use Of Beaches To Protect Piping Plovers, Terns, And Their Habitats In Massachusetts. ii. Monitoring shall occur at least 2 times per week until at least July 1. However, if Piping Plovers or terns are found to be using the site, then monitoring frequency shall be increased to at least 3 times per week, and NHESP No. 06-20720, Page 3 shall continue until all nesting and brood-rearing activity has been completed. A report shall be submitted to the Division each year that summarizes the results of the state-listed species monitoring and site protection activities. 4. Amendments/Notice: Upon filing for renewal, extension, or amendment of the Orders of Conditions, the applicant shall contact the Division for written response regarding impacts to Resource Area habitat of state-listed wildlife. 5. Authorization Duration: This determination is valid for five (5) years. Subject to Division review and approval, the applicant has an option to renew this determination for an additional five (5) years. Provided these conditions are included in any approving Orders of Conditions issued by the Conservation Commission, and the applicant complies with all the above noted conditions, the project will not result in an adverse impact to the resource area habitats of state-listed wildlife species pursuant to the WPA and will not result in a prohibited Take pursuant to the MESA. A copy of the final Order of Conditions shall be sent to the Division simultaneously with the applicant as stated in the Procedures section of the WPA (310 CMR 10.05(6)(e)). We note that all work is subject to the anti-segmentation provisions (321 CMR 10.16) of the MESA. In accordance with the provisions of Section 401 of the Fed eral Clean Water Act as amended (33 U.S.C. §1251 et seq.), MGL c.21, §§ 26-53, and 314 CMR 9.00, the Department has determined there is reasonable assurance the project or activity will be conducted in a manner which will not violate applicable water quali ty standards (314 CMR 4.00) and other applicable requirements of state law. The waters of Barnstable Harbor are designated in the Massachusetts Surface Water Quality Standards as Class SA. Such waters are designated "as excellent habitat for fish, other aquatic life and wildlife and for primary and secondary contact recreation.” Anti-degradation provisions of these Standards require that "existing uses and the level of water quality necessary to protect the existing uses shall be maintained and protect- ed.” In addition, this area has been designated for Shellfishing pursuant to 314 CMR 4.00. 401 Water Quality Certification Transmittal №: X286011, Blish Point Boat Ramp at Barnstable Harbor, Barnstable Page 2 of 20 Project Background: The project site is located within Barnstable Harbor at Blish Point in Barnstable, MA (Figure 1). Barnstable Harbor is a natural harbor that is sheltered by Sandy Neck to the north and the Town of Barnstable to the south. The harbor is located 10 miles eastward of the Cape Cod Canal entrance and provides the approach to the north side of the Town of Barnstable. Navigation into/out of Barnstable Harbor is provided by the established entrance c hannel that provides access to/from the Inner Harbor and the Blish Point Public Access Facility which supports recreational, commercial and transient boating activities as well as private commercial marine operations and services. Present conditions show that the entire channel has filled-in, and there is very limited water depth existing during periods of low tide. This channel requires periodic maintenance dredging on a 1 to 3 year basis and is presently overdue. Figure 1 Project site at Blish Point Boat Ramp Access Channel, Barstable.1 Proposed Project Description: The proposed project scope entails maintenance dredging 658 cubic yards of sediment from the Blish Point Boat Ramp Access Channel at Barnstable Harbor (Figure 1).2 The proposed maintenance dredging of the Boat Ramp Access Channel will be performed using either mechanical or hydraulic methods. Dredged Material Dewatering: The dewatering of sediments will be performed within the parking lot at the MAOFBA Blish Point Public Access Facility. The use of the Blish Point parking lot for the dewatering/handing of dredge sediments has been previously 1 Revised BRP WW 26 Combined Permit Application for Waterways & Water Quality Certification: Maintenance Dredging Blish Point Boat Ramp Access Channel Barnstable, Massachusetts. Prepared by FOTH for the Town of Barnstable, Department of Public Work. Dated June 29, 2020. 2 IBID, See Footnote #1. 401 Water Quality Certification Transmittal №: X286011, Blish Point Boat Ramp at Barnstable Harbor, Barnstable Page 3 of 20 authorized and will be temporary. A dredged material dewatering plan will need to be developed and submitted to the Department for review (see Condition 11). Dredged Material Disposal or Reuse: Dredge sediments are proposed to be disposed at the Cape Cod Bay Disposal (CCBDS) and/or upland at an approved facility. Sediment Sampling Data: According to the interagency agreement, MassDEP accepts the sampling and evaluation protocol of the Army Corps of Engineers (ACoE) and EPA for unconfined open ocean disposal. In accordance with 314 CMR 9.07(2) and 314 CMR 9.07(7), to support upland disposal of dredged material, chemical analysis of two sediment samples were performed and no contaminants exceeding the Reportable Concentration (RC) S-1 criteria of the Massachusetts Contingency Plan (MCP) were found. 3 Time of Year Restriction (TOY) for In -Water Work: The Barnstable Harbor has been identified as winter flounder (Pseudopleuronectes americanus) spawning habitat. Therefore, Massachusetts Division of Marine Fisheries recommends no in-water silt producing work be conducted from February 1 to June 30 to protect winter flou nder and horseshoe crab spawning and juvenile development.4 Rare Species and Rare Wildlife Habitat: The site is not located within the Priority Habitats of Rare Species, Estimated Habitats of Rare Wildlife, and Certified Vernal Pools in accordance with the Massachusetts Natural Heritage Atlas, 14th Edition. Public Notice: The public notice of the 401 WQC application was published in the Cape Cod Times on August 26, 2020. The Department did not receive any comments during the 21-day public comment period, which ended on September 16, 2020. Section 61 Findings: Although the original improvement dredging projects, Pursuant to M.G.L. Chapter 30, Sections 61 to 62H inclusive [the Massachusetts Environmental Policy Act (“MEPA”)], were required to file an Env ironmental Notification Form (“ENF”) (301 CMR 11.01 (2)(b)3), the MEPA review thresholds for the current proposed maintenance dredging project in the same footprint, as referenced in Combined Permit Application, DEP Transmittal # X286011, do not apply (301 CMR11.03).5 Therefore, based on information currently in the record, the Department grants a 401 Water Quality Certification for this project subject to the following conditions to maintain water quality, to minimize impact on waters and wetlands, and to ensure compliance with appropriate state law. The Department further certifies in accordance with 314 CMR 9.00 that there is reasonable assurance the project or 3 According to additional information from Christine Player, FOTH, to David Wong, MassDEP, dated September 8, 2020. 4 According to a letter from Wright, Massachusetts Division of Marine Fisheries, to Barnstable Conservation Commission, dated May 4, 2020. 5 According to an email from Richard Bourre, Massachusetts Environmental Policy Act (MEPA) Office to Christine Player, FOTH, dated June 29, 2012. 401 Water Quality Certification Transmittal №: X286011, Blish Point Boat Ramp at Barnstable Harbor, Barnstable Page 4 of 20 activity will be conducted in a manner which will not violate applicable water quality standards (314 CMR 4.00) and other applicable requirements of state law. Finally, the Department has determined that upon satisfying the conditions and mitigation requirements of this approval, the project provides a level of water quality necessary to protect e xisting uses and accordingly finds that the project to be implemented satisfies the Surface Water Quality Standards at 314 CMR 4.00. Conditions 1. Project Description: The applicant is proposing to conduct maintenance dredging of approximately 2,345 cubic yards (cy) of material from shoaled areas totaling 0.82 acres of the Barnstable Harbor Mid-Entrance Channel and the adjoining Blish Point Boat Ramp Access Channel located in the town of Barnstable, MA (Figure 1). The areas will be dredged to the proposed depth of -6 feet at mean lower low water (MLLW) plus one foot of allowable overdepth. The applicant requested that disposal of the proposed dredge material be evaluated for the Cape Cod Bay Disposal Site (CCBDS) or upland disposal as potential alternatives for this project. However, this plan does not include evaluation requirements for placement alternatives located above the high tide line (HTL) as they do not fall under the New England District U.S. Army Corps of Engineers’ (NAE) regulatory authority. This sampling and analysis plan (SAP) has been developed by NAE to gather information to support a suitability determination for the proposed action. The sampling and analysis effort shall include a single phase of testing for physical properties and bulk sediment chemistry. The results of analysis will be evaluated against the most recent NAE datasets for the CCBDS reference areas and the National Oceanic and Atmospheric Administration (NOAA) effects range low (ERL) and effects range median (ERM) screening criteria. If additional evaluations are required, NAE will provide the applicant with a supplemental SAP for elutriate and biological testing. All sampling and analysis activities described in this plan shall follow the requirements set forth in the “Regional Implementation Manual for the Evaluation of Dredged Material Proposed for Disposal in New England Waters” (RIM) dated May 6, 2004. A copy of the RIM may be downloaded from the NAE website: http://www.nae.usace.army.mil/Missions/Regulatory/ DredgedMaterialProgram/RegionalImplementationManual.aspx. If three years have passed since this SAP was issued and the project has not been sampled, NAE will need to review the SAP prior to sampling activities. 2. Conceptual Site Model: NAE reviewed historic testing data, water quality data, spill records, and adjacent land use information to develop a conceptual site model (CSM) for the proposed project. The CSM was used to characterize the system and identify potential sources of contamination, site-specific contaminants of concern, exposure pathways, and biological receptors to inform this sampling and analysis plan. Project Setting: The project is associated with the Town of Barnstable, MA’s existing Barnstable Harbor Mid-Entrance Channel and adjoining Blish Point Boat Ramp Access Channel. The project area is located along the southern FINAL Sampling and Analysis Plan for Barnstable Harbor & Blish Point, Barnstable, MA, File Number NAE-2012-0990 2 waterfront of Barnstable Harbor and Maraspin Creek. Barnstable Harbor, located approximately 10 miles east of the Cape Cod Canal entrance, is a natural harbor on the northern shore of Cape Cod. The harbor is home to a small recreational and commercial fishing fleet and is a popular destination for transient boaters. Land use in the surrounding area includes several waterfront facilities, commercial marine service centers, and the Barnstable Town Marina with 88 slips, fuel docks, parking, and a public boat ramp. Other land use in the surrounding area is primarily open space with moderate density residential development to the east. Water Quality: Water quality in the vicinity of Barnstable Harbor is dictated by tidal exchange with Cape Cod Bay to the north and freshwater input from Maraspin Creek and several small streams located to the south and west. There are two outfalls located along the waterfront in the inner portion of Barnstable Harbor. The Commonwealth of Massachusetts designates the waters of Barnstable Harbor as Class SA (314 CMR 4.06). Class SA waters are considered excellent habitat for fish, other aquatic life, and wildlife, and are suitable for shellfish harvesting and for primary and secondary contact recreation (MassDEP 2022). However, shellfish harvesting is prohibited in the project area (MassDMF, 2013). Dredge History and Existing Testing Data: The project areas were last dredged in 2021 when approximately 5,500 cy of material were placed offshore at CCBDS. Sampling and testing of material from the Mid-Entrance Channel documented sediment as a mix of sand and fine grains. A review of the associated chemistry data found contaminants of concern were either not detected or were less than a level that may have the potential to cause toxicity. Sampling and testing of material from the Blish Point Boat Ramp Access Channel in 2020 documented sediments as predominately sand with little fines. A review of the associated chemistry data found arsenic, nickel, some individual polycyclic aromatic hydrocarbons (PAHs), and total DDX (the sum of 4,4’-DDD, 4,4’-DDE, and 4,4’- DDT) were detected at concentrations with the potential to cause toxicity based on current sediment screening guidelines. A suitability determination from 2016 for the Mid-Entrance Channel and a suitability determination from 2020 for the Blish Point Boat Ramp Access Channel each found sediments suitable for unconfined open water disposal at CCBDS. Sampling and testing from the adjacent Barnstable Harbor Outer Entrance Channel in 2020 documented sediments as predominately sandy. A suitability determination from 2020 found sediment suitable for 10-year beach nourishment. Spill Data: Based on information provided by the applicant and a review of the Massachusetts Department of Environmental Protection (MassDEP) Document Online Search Portal FINAL Sampling and Analysis Plan for Barnstable Harbor & Blish Point, Barnstable, MA, File Number NAE-2012-0990 3 (https://eeaonline.eea.state.ma.us/portal#!/search/wastesite), NAE determined that there have been no reported spills in the vicinity of the project area since the area was last dredged in 2021. Risk Ranking: Following the tier one review of the site characteristics, location, and the available historical data, the proposed project was given a low-moderate risk ranking according to the following matrix (Table 1): Table 1: Project Risk Ranking Rank Guidelines Low Few or no sources of contamination. Data available to verify no significant potential for adverse biological effects. Low-Moderate Few or no sources of contamination but existing data is insufficient to confirm ranking. Moderate Contamination sources exist within the vicinity of the project with the potential to produce chemical concentrations that may cause adverse biological effects. High Known sources of contamination within the project area and project area or project(s) in the vicinity were previously unsuitable for unconfined open water placement. 3. Sample Collection: The applicant shall collect sediment cores from four locations within the proposed dredge areas as specified in Table 2 (also see Figure 3). These locations were selected based on information from the CSM described above, the low-moderate risk ranking for the project, and shoaled areas identified in the project conditions survey submitted by the applicant. All core samples shall be collected to the proposed dredge depth using inert core liners. Estimated core lengths based on the bathymetry provided by the applicant are provided in Table 2, but the actual required core lengths shall be determined at the time of the sampling effort using measured water depths at each location corrected to MLLW. In order to ensure that the core samples adequately represent the dredge interval at each location, all cores to be used for this project shall have a recovered length that is within 75% of the core penetration depth. In addition, any cores that display significant disturbance such as compaction or wash out shall be disregarded. If the cores from any location do not meet the acceptability criteria after six attempts, then the applicant should retain the best core from that location and contact NAE for further guidance. The penetration and recovery for the core used for the chemistry and grain size samples should be recorded on the sample log. Upon collection, all cores shall be measured and maintained in an upright position for a minimum of 15 minutes to allow any fine-grained material to settle. After a core has settled, it shall be re-measured, taking care to not include overlying water with sediment flocculant in the measurement before any overlying water is drained. All cores shall be split lengthwise, photographed with a stadia rod for scale with zero indicating the sediment/water interface, and FINAL Sampling and Analysis Plan for Barnstable Harbor & Blish Point, Barnstable, MA, File Number NAE-2012-0990 4 described in accordance with ASTM D 2488 (Standard Practice for Description and Identification of Soils). Samples shall be collected from the dredge interval (dredge depth + overdepth) within each core for grain size and bulk chemical analysis as described in the sections below. If the dredge interval within a core is homogenous then the entire length may be composited as a single sample with the chemistry/grain size sample interval depths noted on the sampling log. If any core shows significant stratification or obvious signs of contamination, then subsamples shall be collected from each layer and noted on the sampling log and the applicant shall consult NAE for guidance prior to the start of analysis. The term “significant stratification” includes any distinct change in sediment composition that could represent a change in depositional history or waterway usage such as a change in color or lithology. Compositing of dissimilar sediment layers without prior approval from NAE will result in the rejection of any resulting data products. In addition, a field duplicate sample should be collected for bulk chemistry and grain size analysis and an equipment blank should be collected for chemical analysis off any non-dedicated equipment used in the sampling process. All sediments held for testing shall be stored in accordance with the requirements in Table 3 (from Table 8-2 in Evaluation of Dredged Material Proposed for Ocean Disposal, Testing Manual, 1991). Sample chain of custody forms shall be maintained by the Applicant and submitted to NAE with the data package described in section 5 of this SAP. Vessel positioning shall be achieved using a Global Positioning System (GPS) that has been calibrated on site using a known reference point. The required horizontal accuracy at each sample location shall be 10 feet or less. Water depths at each location are to be determined with an accuracy of ±0.1 feet (relative to MLLW). All sample data including date, time, latitude, longitude, GPS accuracy at each sample station, measured water depth, tidal correction, core penetration and recovery, and chemistry sample interval(s) shall be recorded in a sampling log (Figure 4 or equivalent) and provided to NAE with the Applicant’s core descriptions and photographs. All coordinate data shall be reported in geographic NAD 83 decimal degree format to six decimal places. All depth data shall be reported in tenths of feet. 4. Sample Analysis: All core logs from the dredge area shall be submitted to NAE prior to performing physical and chemical analysis of each sample. Each core or core layer from the dredge area shall be individually analyzed for grain size and bulk chemical analysis. Testing parameters, analytical methods, and reporting limits to be used are outlined in Table 4 (extracted from Tables 1, 2, and 3 of the RIM). The listed analytical methods are recommended but can be replaced by other methods that will give the required reporting limits. Additional guidance on the physical and chemical analysis of sediments can be found in chapter 5 of the RIM. FINAL Sampling and Analysis Plan for Barnstable Harbor & Blish Point, Barnstable, MA, File Number NAE-2012-0990 5 All laboratories used for this project must have an approved Laboratory Quality Assurance Plan (LQAP) on file with NAE. Any data produced from a lab without an approved LQAP will not be accepted. The RIM, a list of laboratories with approved LQAPs, and the reporting format and requirements for electronic submission of data are available for download through the NAE website: http://www.nae.usace.army.mil/Missions/Regulatory/Dredged-Material- Program/. 5. Reporting requirements: All sediment testing data is required to be submitted electronically in the electronic data deliverable (EDD) format available on the NAE website (http://www.nae.usace.army.mil/Missions/Disposal-Area- Monitoring-System-DAMOS/Electronic-Data-Deliverables.aspx). Hard copy data submission is also required but may be substituted with a printer friendly, easy- to-read format (e.g., PDF, MS Word). Any analytes not detected shall be reported as half the method detection limit (MDL) and qualified with a “U”. RIM quality control summary tables are required to be submitted with each project dataset. These tables are found in Appendix II of the RIM. 6.
