ISLANDS ENGINEERING, INC. submits this Notice of Intent (NOI) application, on behalf of the applicant and owner, Kristen L. Anderson, for the proposed construction of residential additions, a deck, and associated site improvements at 279 Ocean Street in Barnstable (Hyannis), Massachusetts. The proposed activities will occur within Land Subject to Coastal Storm Flowage (LSCSF). Work will occur within Land Subject to Coastal Storm Flowage (LSCSF) only. 1.2 Applicable Regulations This application has been filed jointly with the Department of Environmental Protection, pursuant to the Commonwealth of Massachusetts Wetlands Protection Act (MWPA, M.G.L. Chapter 131, Section 40) in accordance with its implementing regulations (310 CMR 10.00); and the Town of Barnstable, pursuant to Town of Barnstable Wetlands Protection Bylaw (Chapter 237 of the Town Code) and implementing regulations. 2.0 BACKGROUND 2.1 Existing Conditions The project is located at 279 Ocean Street, a private residential property in the RB zoning district. The property is developed with a single-family dwelling with a deck, retaining walls, a second-floor balcony, stone steps, a brick patio, concrete pavers, an outdoor rinse station, an air-conditioning unit and perimeter fencing. The dwelling is served by municipal sewer, gas and electric utilities. Access to Ocean Street is provided by a gravel driveway over an access easement on the abutting property (Deed Book 4748, Page 246 and Plan Book 405, Page 72). The lot is relatively flat, with existing grades ranging from approximately elevation 10 to 12 feet (NAVD 88). Open space consists of maintained lawn with little native vegetation. Residential parcels border the property to the north, east, and south with forest and wetland open space associated with 287 Ocean Street to the west. 2.2 Property History The property is shown on the Town of Barnstable Assessors as Map 325 Parcel 173. The lot is recorded in the Barnstable Registry Land Court under Certificate of Title 200562. The property was originally developed in 1921 and effectively built in 1984 per the Town Assessors records. No known environmental permits have been issued for the property. 2.3 Site Characteristics Jurisdictional wetland resources identified on or within 100 feet of the property include LSCSF and Bordering Vegetated Wetlands, located off property to the south and west. The 100-foot setback from the wetland is shown on the project plan and lies entirely outside the property boundary. Site features were located by an on-the-ground instrument survey and are shown on the project plan. According to the Federal Emergency Management Agency (FEMA) Flood Insurance Rate Map (FIRM) Community Panel No. 25001C0569J, Effective July 16, 2014, the western portion of the property is located within the 100-year floodplain Flood Zone AE (EL. 11) (NAVD 1988), and the eastern portion is NOTICE OF INTENT APPLICATION 279 OCEAN ST, BARNSTABLE, MA Project Narrative Page 2 within the 0.2% Annual Chance Flood Hazard Zone X. The limits of the 100-year floodplain define LSCSF. The Massachusetts Natural Heritage and Endangered Species Program (NHESP) Atlas (15th edition, August 1, 2021) and MassGIS online were consulted, and the project site does not fall within Estimated Habitats of Rare Wildlife or Priority Habitats of Rare Species. There are no vernal pools within 100 feet of the site. The property does not fall within mapped Areas of Critical Environmental Concern, Outstanding Resource Waters, or Interim or Zone II Wellhead Protection Areas. The project involves work on a single-family dwelling and is exempt for Massachusetts Stormwater Standards. 3.0 PROPOSED PROJECT 3.1 Scope of Work The proposed project includes the construction of two residential additions, a deck and associated walkways, as well as the removal of several existing structures and hardscape features. A 16.0-foot by 20.7-foot addition (approximately 331 sf) is proposed on the west side of the dwelling, and a 2.0-foot by 18.0-foot addition (approximately 36 sf) is proposed along the south side of the dwelling, both set at the same finished flood elevation of 13.5. An L-shaped deck, approximately 19.0 feet by 16.7 feet, is proposed off the west addition, with stairs down to the existing brick patio. A new short walkway will connect the deck stairs to the existing concrete pavers, and new landscape steps are proposed off the south addition. To accommodate the new construction, the existing deck, retaining wall and steps on the south side, the second-floor balcony, and the stone steps on the east side will be removed. All proposed structures maintain the 10-foot building setback from the property lines. 3.2 Construction Methodology Prior to the start of work, the Order of Conditions and DEP File Number will be posted at the site, and the Conservation Commission will be notified in advance that work will be starting on site. The limit of work will be established and sedimentation controls consisting of a sediment stop or silt fencing will be installed as necessary. Erosion controls will be maintained throughout the construction phase and until ground surfaces are stabilized. Construction access will be from Ocean Street by way of the existing gravel driveway, and materials will be staged within existing concrete pavers and gravel driveway and away from resource areas. No debris, equipment or materials will be stored outside the designated limit of work. The contractor will first remove the existing deck, retaining wall and steps, the balcony and the stone steps. Once demolition is complete, the concrete foundation for the west addition will be poured, followed by the construction of both additions, the deck and stairs, the walkway and the landscape steps. Work will be confined to the smallest practicable area immediately around the dwelling, and existing grades will be maintained, with no fill proposed to raise grades within LSCSF. Equipment used will include a small excavator and other small site work equipment. All refuse and debris will be transported off-site to an approved disposal site, and excavated material will be reused on site or removed from the site. Temporarily disturbed areas will be stabilized immediately after construction and returned to pre-existing conditions as maintained lawn. Once the project is found satisfactory under the approved permits, a request for a Certificate of Compliance will be filed with the Barnstable Conservation Commission to close out the permit. NOTICE OF INTENT APPLICATION 279 OCEAN ST, BARNSTABLE, MA Project Narrative Page 3 3.3 Anticipated Impacts The proposed project falls within LSCSF and will result in a 251 sf net increase in lot coverage from structures and hardscape, after removal of features. The property and all proposed work are located outside the 100-foot Buffer Zone to the off-site wetland. All work will take place within previously disturbed and legally altered areas of maintained lawn and existing hardscape adjacent to the dwelling. No work is proposed within any resource area other than LSCSF, and no change to existing topography is proposed. 3.4 Mitigating Measures The lot and proposed work is located outside of the 100-foot Buffer Zone to jurisdictional resource areas as defined under Chapter 704 and no mitigation is proposed. 4.0 APPLICABLE PERFORMANCE STANDARDS The following is a discussion of how the proposed project meets state and local performance standards for each resource area affected. 4.1 Land Subject to Coastal Storm Flowage (LSCSF) LSCSF is subject to protection under 310 CMR 10.02(1)(d) and Chapter 237. Performance standards for LSCSF are not specified in 310 CMR 10.00 or in Barnstable Regulations. The western portion of the lot, including the west addition and deck, is located within Flood Zone AE (EL. 11); a portion of the south addition falls outside of LSCSF. Approximately 3522 sf of the limit of work lies within Flood Zone AE (EL. 11). The proposed work consists of additions to an existing dwelling on a developed lot. No fill is proposed, and no change in topography, landforms or drainage patterns is proposed. The proposed deck will be supported on posts/piers, allowing floodwater to pass beneath, reducing obstructions within LSCSF. The additions are designed in compliance with the flood-resistant construction requirements of the Massachusetts State Building Code. The project will not increase flood elevations, redirect floodwaters, or increase storm damage to adjacent properties. No other resource areas are located near the lot that would affect the structures’ ability to protect against storm surges and flood events. 5.0 SUMMARY 5.1 Performance Standard Metrics The existing wetland resources, anticipated project impacts and the proposed impact reduction measures associated with this project have been fully documented within this Notice of Intent application. Based on the information provided in this application it is asserted that the following project features would result in no a benefit to the associated resource area will have no adverse effect on the subject resource area(s) values and functional characteristics. The project should be approved for the following reasons: • All work will take place within previously disturbed and legally altered areas. Proposed additions and expansions are located outside of the 100-foot Buffer Zone. • The existing deck, retaining wall and steps, balcony and stone steps will be removed, partially offsetting the new structures within LSCSF. • No fill or change in topography is proposed within LSCSF, and the additions will be constructed to flood-resistant construction standards. NOTICE OF INTENT APPLICATION 279 OCEAN ST, BARNSTABLE, MA Project Narrative Page 4 The project conforms to the Massachusetts Wetlands Protection Act, (MWPA, M.G.L. Chapter 131, Section 40) and its implementing regulations (310 CMR 10.00) and the Barnstable Wetlands Protection Bylaw, (Chapter 237 of the Town Code) and implementing Regulations (Part VI of the Town Code). 5.2 Request for Order of Conditions The Applicant has demonstrated and documented evidence that this project meets or exceeds all the relevant performance standards set forth in the governing regulations and respectfully request this project be approved and that an Order of Conditions be issued to the Applicant through its representative. 5.3 Contact Information In an effort to reduce the amount of paper required for filings, the entire application can be emailed upon request to regulatory staff and commission members.
