I drove by as recently as this morning and noticed considerable activity on the property. The Fire District informs me that operations are continuing. I would like to request that the Town begin appropriate legal proceedings in order to stop Mr. Van Wormer from continuing his automobile repair business in a location that is one hundred to two hundred feet from a Barnstable Fire District well. Mr. Van Wormer appears to be in violation not only by operating a business in a residential district but also by operating this type of business in disregard of the Groundwater Protection Bylaw which was recently approved at town meeting and which, I understand, was recently approved by the Attorney General. I am concerned with this zoning violation because the potential for contamination of a public water supply well is great. The Town has spent considerable amounts of money purchasing open space and land for aquifer protection; it has exhibited its concern by funding studies and backing stringent groundwater protection regualtions and bylaws. To allow one person to jeopardize an entire well is unconscionable and in contradiction to the town ' s expressed concerns with its water supply. I believe such a writing would satisfy c. 40A' s requirement of refusal to act on the part of the Town and would allow the Fire District to bring its own action for injunctive relief . January 15, 1988 Mr. Joseph Daluz Building Commissioner Barnstable Town Hall 367 Main Street Hyannis , MA 02601 Dear Mr. Daluz : We are in receipt of another complaint from Mr. George Weir of the Barnstable Water Company regarding a Mr. David Van Wormer of 1795 Phinneys Lane, Barnstable. This matter was previously brought to our attention via a letter from attorney, Barbara Harris , dated December 8 , 1987 . Mr. Weir states that Mr. Van Vormer is conducting an automobile repair business and has observed Safety-Kleen trucks in front of the property. Donna Miorandi has inspected the property on October 23rd and December 9th of 1987 as well as January 14, 1988 and has not observed any Toxic or Hazardous Waste violations . However, he may be in violation of conducting a business F in a residential zone . It appears that this alleged vic,lation would fall under your ,jurisdiction.
