Pursuant to Title 5 of the State Environmental,Code,310 CMR:15.412,the Southeast Regional Office of the Department of Environmental Protection has completed its review of the above-referenced application. The applicant requested Department approval of variances granted by the Barnstable Board of Health for the on-site sewage treatment and disposal system at 37 Broken Dike Lane. The proposed system will serve a proposed 4-bedroom residence. The application contains a copy of the Board of Health's grant of variances from the following provisions of Title 5, 310 CMR 15.000: 310 CMR 15.211: Minimum setback distances: the proposed soil absorption system will be installed 38' from the top of a coastal bank. The proposed reserve area will be 29' from the top of a coastal bank. The applicant has established that enforcement of 310 CMR 15.000 would be manifestly unjust, considering all of the relevant facts and circumstances of this case. Due to lot limitations the system cannot be located elsewhere on the property. Based on this information,the applicant has demonstrated that to deny the variance would be manifestly unjust. 2. The applicant has established that a level of environmental protection that is at least equivalent to that provided under 310 CMR 15.000 can be achieved without strict application of 310 CMR 15.211. The applicant has established equivalent environmental protection because the system has been designed to maximize the separation to a non- eroding coastal bank. The Department,therefore,approves the requested variances subject to the following conditions: 1. Prior to installation of the system,the owner shall obtain a Disposal System Construction Permit from the Barnstable Board of Health. 2. Prior to the issuance of the Disposal System Construction Permit,the owner shall obtain an Order of Conditions as required under the Wetlands Protection Act. Please note that the conditions, outlined above, do not supersede any conditions imposed by the Barnstable Board of Health. The above conditions supplement any other conditions imposed by the Barnstable Board of Health. Any person aggrieved by this action, may request an Adjudicatory Hearing. A request for a hearing must be made in writing and postmarked within thirty (30) days of the Variance Approval date. ' 4 r^ Page 2 r..t BSC is of the opinion that enforcement of the required setbacks specified at 310 CMR r 15.211 (1) would be manifestly unjust due to the following: • The Barnstable Conservation Commission issued a Notice of Resource Area Delineation (NORAD) by under DEP file number SE3-3811 on May 16, 2001. y.a Resource areas delineated and described on the eight (8) ± acre subject property were bordering vegetated wetlands (BVW), floodplain, riverfront area, and coastal banks. In summary, the subject property consists of 7 ± acres of wetlands and 1 ± acre of ,X uplands. Attachment 4 provides a copy of the Order of Resource Area Delineation �. �3 SE3-3811. j ' • BSC designed the proposed sewage disposal system for a four (4)-bedroom dwelling that meets all required Title V standards except the distance to coast bank. r • BSC evaluated a smaller proposed sewage disposal system by sizing a system fora two (2) bedroom dwelling and determined that it was the width (not the length) of the ; SAS that most significantly affected the setback to coastal banks. As such, the top of ' coastal bank is configured so that the fifty-foot setback to coastal bank could not be met. • In summary, the inability to meet the required setback would be manifestly unjust and would not allow the applicant to use the subject property for residential uses without construction of any subsurface sewage system. ; BSC is of the opinion that the proposed sewage system disposal design is considered to j provide an equivalent degree of environmental protection to that provided under 310 CMR 15.000 can be achieved thorough the following, Distance to Coastal Bank • The coastal bank present on the subject property is not considered as a `wet' wetland. ' ' Further, BSC is of the opinion that inclusion of coastal banks as resouice areas in Title 5 was to deter the placement of subsurface sewage disposal systems in areas where bank erosion could' expose the disposal system. As the coastal bank present t° on the subject property is not eroding, it is not anticipated to create such a condition where the subsurface disposal system would be exposed. The coastal bank present on s AF the subject property is heavily wooded, not eroding, nor does it face seaward. , Inspection of the coastal bank indicates that it appears to be partially man-made by apparent historical excavation activities. This variance is granted because physical constraints at the site severely restrict ' the location of a soil absorption system due to the fact that wetlands adjoin the lot on three sides. And, the use of a Mashpee well for reference for a 30-inch buffer is inappropriate for this project since the proposed project parcel is subject to tidal action. A site-specific reference should be used. b. the applicant does not consider that the only access to the proposed parcel is via a wooden bridge that crosses the Centerville River. The bridge may not be of sufficient strength to accommodate construction equipment and in the event of an accident, the Centerville River could easily be contaminated. c. I recommend the Board make a site visit in order to completely understand the scope and scale of the proposed project and its potential impact on the public health and the environment. d. I further recommend that the Board require the applicant to demonstrate in specific terms that all Town and State regulations and requirements regarding public health and the environment are being satisfied and that the proposed project is in the best interests of the public health and the environment prior to any Board decision on the variance request. Two factors are considered equivalent 1) Distance to a coastal,bank. The setback from top of a coastal bank' which is not a"wet” wetland ; and is included in Title-.5, as a deterrent to placing septic systems in areas where erosion could expose the system. Therefore as long as the coastal bank is not eroding; it is not`likely to create such a condition. The,bank in question-is wooded and not eroding and in part was.man made"by apparent excavation some tirrie.in'the distant past. The Conservation Commission debated if this was a coastal bank due to . it's inland location andthe fact that-it is not seaward facing. : 2) Distance to,a,watercourse The unique factor,to this site is the fact that the site is on a peninsula formation surrounded by a tidal creek. This condition would-be' expected to create,a;ground water_gradient that fluctuates slightly in < direction with the tidal:cycle meaning the groundwater could reverse- directions with eachtide cycle. The-time of subsurface flow from-the septic system location to the exposure point at the wetlands would therefore be expected to be delayed due to the reversal in hydraulic . ' gradient.The estimated impact of such a fluctuation would be to reduce'the'subsurface flow time to perhaps 1/2 of that which would occur cif the ground water gradient was unidirectional and more constant in that area. In accordance with 310 CMR: 15.411 (Process of Seeking a Variance From Local Approving.Authorities), the abutter notification "shall reference the specific provisions of 310 CMR 15.000 from which a variance is sought, a statement of standards set forth in 310 CMR 15.410... Enclosed is a copy of the notification we received which makes no reference to either of these requirements. I recommend the Board reschedule the public hearing for this variance request to a later date and require the applicant to again notify abutters adhering to Town and State regulations. 2. I understand the variance request: a. seeks to nearly completely wave the 310 CMR 15.211 (Minimum Setback Distances) requirement of a 50-foot setback and Part VIII Section 1.00 requirement of 100-foot setback with a variance of 49 feet from State requirements and 99 feet from Town regulations. b. is located entirely in Flood Zone A and is in extremely close proximity to Flood Zone B with both Zones encompassing the entire proposed site which is adjacent to the Centerville River(a tidal zone and salt marsh wetland). C. may not demonstrate that there is enough elevation so that the requirements of separation from maximum groundwater elevation in accordance with Part VIII Section 9.00 can be met since the maximum . The purpose of this letter is to advise the Board of Health on BSC's understanding of Barnstable Conservation Commission's position on the interpretation of the Riverfront Area located at the site. This interpretation is based on the ANORAD approved by the Barnstable Conservation.Commission under DEP File #SE3—3811. The proposed project at the site will be in accordance with 310 CMR Section 10.58 (Riverfront.Area). The following Riverfront Area Regulations apply to this site: 1. The lot was recorded prior to August 1996 so the scope is limited to the lot and.the Conservation Commission shall allow a single family home but minimize the impacts to the Riverfront Area to the maximum extent feasible through the filing of a Notice of Intent. 2. Construction of a Single Family Home. The construction of the single family home will be regulated by special conditions promulgated under the Notice of Intent procedure by the Conservation Commission. The applicant is aware that any disturbances and/or structures outside the footprint of the single family home would be tightly regulated by the Commission and kepi to a minimal size. 3. This project is classified as a Limited Project under 310 CMR 10.53. In the early 1990's, the previous owners filed,received authorization, and built a wooded bridge with enclosed utilities. At that time the owners were advised to file a Notice Engineers of Intent with the Barnstable Conservation Commission for any further construction on the lot.
