Dear Mr. and Mrs. Scott and Mr. and Mrs. Tirinnanzi,
Thank you for your letter dated August 25, 2003 and for your participation during our
informal discussion last Tuesday evening regarding the vacant lot at 176 Captain Crosby
Road Centerville.
We wish to make it clear that the Board did not make any indication to the applicant that
an alternative—type percolation test method would be approved. We also wish to make it
clear that the Board did not make any indication as to whether or not any variances would
be granted for new construction at this site.
One Board member did inform the engineer during the previous meeting that a drill rig
could be used and split-spoon coring samples could be obtained to examine the different
soil types. During the discussion, the Board member stated that this methodology doesn't
fit into the standard and the Board will have to consult with the Massachusetts
Department of Environmental Protection(DEP).
At least two percolation tests must be conducted in compliance with the State
Environmental Code, Title 5. The procedure for performing a percolation test is clearly
specified within Section 310 CMR 15.105 of the Code.

Dear Sir and Madam:
Please be advised that we, the abutters and neighbors, of the lot situated between 160
Captain Crosby Rd and 184 Captain Crosby Rd are angered by your hearing testimony
from Mr. Pesce relating to his letter written to the Board. You, without notifying us, advised
him he could proceed to take multiple soil samples at a depth of 30-35 feet below the
surface of the lot. For what purpose would he like to do that if he didn't expect that you
would grant him a variance for an alternative septic system?
You have given the appearance of collusion withMr. Miller, owner, and Mr. Pesce, soil
expert. The purpose for which is not immediately clear.
Under State Law, Title V, no alternative soil samples or perc tests are permitted. Since it is
the law and there is no precedence in Barnstable, we would hope you would abide by it.
In short, we hope you would advise Mr. Pesce that no further soil samples nor perc tests
will be required since no variance should be given.
In the future, we hope that if a property is discussed by the Board you would see fit to
notify the concerned parties so we might have some input.
Finally, we would like to add that Mr. Miller is an irresponsible owner who has allowed his a
agents to destroy the trees and ground cover which held the grade together. We are
deeply concerned about the erosion and mud and standing water at the rear of the lot. We
fear for our properties and the wet lands which hang in a delicate balance. Further drilling
could potentially cause serious reprocussions.

Dear Tom,
Per our conversation today I'm writing to request that I be added to the next
available BOH agenda to discuss the possibility of performing an alternative percolation
test for 176 Capt. Crosby Road.
Background
• My client has a record of previous drilling activities performed by Desmond
Well Drilling, indicating clay soils to a depth of 50 feet, after which sands were
encountered.
• The previous perc testing performed on December 18, 2002 showed sandy
loam and glacial till soils to a depth of 14 feet, with perched water observed at
34-52" depth. Static groundwater was not observed.
Proposed Approach
• To use a drill rig to explore the site at depth to determine the actual depth of
the sandy permeable layer.
• After locating this layer, determine the feasibility of actual deep excavation of
the overburden soils to conduct a perc test.
• This approach I believe will require a variance of the Part Vill, Section 9.00
bylaw regarding 4 feet of naturally occurring pervious soil below the leaching
area above the maximum groundwater elevation.

Again, I understand that this procedure may yield results that would require
variances to Barnstable Health Regulations, in order to design and approve a Title 5 septic
system for this lot (for a single family home). It is my understanding that the Board may
have approved such variances for systems for other lots with similar conditions.

possible on August 19, 2003) to discuss with the Board an alternative percolation test
for 176 Capt. Crosby Road. I will review the status of the percolation testing completed
to date, and discuss a proposal to conduct deep soil exploration to determine if suitable
permeable soils do exist on the lot.
My client wishes that I discuss this informally with the Board to determine the
feasibility of any further progress towards developing this vacant lot for a single family
home.
